Alguien que le conoce bien me ha pedido que le dé un resumen escrito de lo que sé sobre el escándalo conocido por el nombre “Project Gunwalker” que resultó en la muerte del Agente de la Patrulla Fronteriza de E.E.U.U, Brian Terry, el 14 de diciembre pasado y especialmente sobre la violación deliberada, calculada, y premeditada de la soberanía mexicana que ese incidente implicó.

Entiendo que usted ya está informado de las circunstancias cuestionables que rodean la muerte del agente Terry— como la ATF (la agencia de Alcohol, Tabaco, y Armas de Fuego de los Estados Unidos) permitió que más de 2,000 rifles semiautomáticos fueran comprados por informadores y “straw purchasers” (que quiere decir “personas que compran armas para criminales que tienen prohibido comprarlas directamente”) y los pasaron de contrabando al sur de la frontera internacional en un intento mal concebido por la ATF de fortalecer su argumento por más fondos en el programa muy criticado que se llama “Project Gunrunner”. En esa operación, tiendas de armas Americanas eran animadas a dejar proceder ventas cuestionables, incluso en los casos cuando vendieran armas a individuos sospechosos, despues de llamas a ATF a preguntarles si debian negar esas ventas. (Vease el caso de la tienda de arma de fuego “Carter’s Country”, en el area metropolitana de Houston, Tx.)

Esto es lo que declaró el abogado Dick Deguerin, sólo un día antes del asesinato del agente Terry de la APF:

“Déjenme decirles algo acerca de la tienda Carter's Country. Sus dueños han estado cooperando con la agemcia ATF desde el principio,” declaró el abogado Deguerin, quien representa al dueño de la tienda, Bill Carter.

Deguerin dice que la ATF de los E.E.U.U. le pidió a Carter's Country que completara transacciones, incluso cuando los empleados sospechaban fuertemente que las armas serian enviadas a los carteles mexicanos de la droga.

“Les pidieron que procedieran con las ventas que consideraban ser altamente cuestionables. Les pidieron que hicieran ventas de tres o más fusiles de asalto al mismo tiempo, o de cinco o más armas de 9mm al mismo tiempo, y que vendieran a jóvenes latinoamericanos que pagaban en efectivo. Era todo un perfil étnico, pero lo llevaron a cabo,” dijo Deguerin.

Era inevitable que una o más de las armas que transitaron al sur sin notificar a las autoridades pertinentes de su gobierno terminarían en las manos de criminales. Brian Terry murió víctima de una bala disparada de una de esas armas. La probabilidad estadística y la lógica sencilla indican que muchos más de sus propios ciudadanos mexicanos han sido muertos por ellas desde que empezó esa operación

Debo informarle que el agente Darren Gil, agregado de la ATF en México, D.F., trató de hacer lo justo. Aunque el Agente Especial Encargado de la oficina de Phoenix, Arizona, William D. “Bill” Newell, lo mantuvo con los ojos vendados sobre los detalles, yo entiendo que a través de otros agentes de la ATF que ahora han sido contactados por la oficina del Senador Grassley, el Sr. Gil se enteró por vías de comunicación informales que eso estaba ocurriendo y tuvo una confrontación con AEE Newell sobre si el gobierno mexicano debería ser notificado. Newell insistió que no habría ninguna notificación a las autoridades mexicanas apropiadas. Me dicen que el Sr. Gil no se fió de la palabra de un solo AEE cuando una actuación así podría suponer violaciones de tratados y de entendimientos formales entre nuestros dos gobiernos, e hizo contacto con sus superiores en Washington D.C. En una reunión que me dicen incluía a Lanny Breuer, el Asistente del Procurador General para la División Criminal del Ministerio de Justicia, el Subdirector Melson de la ATF y varios subordinados, fue resuelto dejar al gobierno de México mal informado. En agradecimiento a su intención honrada de prevenir un derramamiento de sangre al igual que un incidente internacional, el Sr. Gil fue forzado a jubilarse, y lo hizo el 31 de Diciembre del año pasado. Estas fueron las palabras que un agente experto de la ATF, me dijo el 17 de Diciembre de 2010:

“Darren Gil, el anterior agregado a México, es un hombre honrado y sincero. Fue despedido en noviembre de su puesto en México sin advertencia, a la fuerza, en gran parte porque no hubiera guardado silencio sobre este asunto. El dirá la verdad si es interrogado por una autoridad competente. El se jubiló el 31 de diciembre a causa de todo esto.”

Entiendo que se le dijo informalmente al gobierno mexicano que ese fue un incidente aislado. Pero si eso fuera verdad, por que eligió nuestro Procurador General, Eric Holder, al AEE Newell para reemplazar a Darren la semana pasada? Newell irá a México D.F. para asumir el puesto de agregado antes del 8 de mayo, según las órdenes de la ATF.

Este es otro deliberado insulto al gobierno y a la soberanía de la república mexicana. El seleccionar al hombre que insistió en mentirle a su gobierno, ya sea por omisión o por falsedades directas, no puede ser interpretado de otra manera.

Le exhorto a que presione al Departamento de Estado de los E.E.U.U sobre esta cuestión en cuanto le sea posible. Como mínimo, el gobierno de los Estados Unidos le debe al gobierno mexicano una disculpa por haber permitido que ese vil escándalo “Gunwalker” amenazara las vidas de ciudadanos mexicanos y la seguridad de sus calles. Si acaso esa barbaridad exige además indemnización es, naturalmente, un asunto para ser considerado por parte de su gobierno. Yo diría, sin embargo, después de muchos años de estudiar la ATF de cerca y de lejos, que del dicho al hecho hay un gran trecho—hay promesas olvidados y disculpas fingidas. La indemnización, por otra parte, es dinero contante y sonante: algo que ellos bien entienden.

Your Excellency,

I have been asked by someone who knows you well to brief you in writing about what I know about the scandal known as "Project Gunwalker" which resulted in the death of U.S. Border Patrol Agent Brian Terry on 14 December and especially on the deliberate, calculated and premeditated violation of Mexican sovereignty that this incident entailed.

By now I understand that you have been made aware of the questionable circumstances surrounding the death of BPA Terry -- how the ATF allowed over 2,000 semi-automatic rifles to be purchased by informants and "straw purchasers" and smuggled south of the international border in an ill-conceived attempt by the ATF to boost the agency's case for more funding in the much criticized "Project Gunrunner." In this operation, American gun stores were encouraged to allow questionable sales to go through, even when they called ATF to ask if they wished the transactions to be declined at the point of sale. (See the case of Carter's County gun stores in the Houston area.)

Here is what attorney Dick Deguerin was quoted as saying about this case, just a day before the murder of BPA Terry:

"Let me tell you something about Carter's Country. They have been co-operating with ATF from the get go," says attorney Dick Deguerin who represents Carter's Country owner, Bill Carter.

Deguerin says the U.S. Bureau of Alcohol, Tobacco and Firearms asked Carter's Country to complete transactions, even when sales people strongly suspected the weapons were headed to Mexican drug gangs.

"They were told to go through with what they considered to be questionable sales. They were told to go through with sales of three or more assault rifles at the same time or five or more 9 millimeter guns at the same time or a young Hispanic male paying in cash. It's all profiling, but they went through with it," said Deguerin.

It was inevitable that one or more of the weapons allowed to go south without notifying the appropriate authorities of your government would end up in the hands of criminals. Brian Terry is dead from a bullet fired from one of these. Statistical probability and plain logic indicates that far more than one of your own citizens have already been killed by them since this operation began.

You should know that one ATF employee, Darren Gil, the ATF attache in Mexico City, tried to do the right thing. Though he was kept out of the "intelligence loop" by Special Agent in Charge of the Phoenix, Arizona office, William D. "Bill" Newell, my understanding from other ATF agents who have now been contacted by Senator Grassley's office, is that Mr. Gil, when he learned by informal communication channels that this was happening, clashed with SAC Newell over whether your government should be notified. Newell insisted that there would be no notification of the appropriate Mexican authorities. Mr. Gil, I am told, did not take the word of a mere SAC when such an action involved possible violations of treaty and formal understandings between our two governments, contacted his superiors in Washington, D.C. In a meeting that I am told included Lanny Breuer, the Assistant Attorney General for the Criminal Division of the U.S. Department of Justice, Deputy Director Melson of ATF and various subordinates, it was decided to keep the government of Mexico in the dark. Mr. Gil, in return for his honest attempt to prevent an effusion of blood as well as an international incident, was forced into retirement and did so on 31 December of last year. Here, in words of an experienced ATF street agent, is what I was told on 17 December 2010:

"Darren Gil, former attache to Mexico is an honest and honorable guy. He was forcefully removed from Mexico without warning in November in large part because he wouldn't sit silent on these matters. He will tell the truth if asked by competent authority. He retired Dec 31 because of all this."

I understand that representations have been made to your government informally that this was an isolated incident. Yet, if that were the case, then why did our Attorney General Eric Holder select SAC Newell to replace Darren Gil earlier this week? He is to go to Mexico City and take over the attache position by 8 May according to ATF orders.

This again is a studied and deliberate insult to the government and sovereignty of the Republic of Mexico. To select the man who insisted that your government be lied to, either by omission or commission, cannot be otherwise interpreted.

I urge you to press this question with the U.S. State Department at the earliest opportunity. At the least, the government of the United States owes the Mexican government an abject apology for allowing this scandal to threaten the lives of Mexican citizens and the safety of your streets. Whether such an outrage demands monetary damages is, of course, a matter of consideration for your government. I would say, however, after many years of studying the ATF from near and far, that talk is cheap, promises forgotten and apologies insincere. Money damages, on the other hand, is a coin of the realm they well understand.
