The worst thing wrong with this from my perspective is that any such material sold to the cartels will not be available to insurgents when the revolution comes.

The Sec. only has sporting purposes latitude. He does not have self defense or resistance to tyranny difference or authority to find a damned thing.
This is right back to the Miller Case. Find cases of shot type loads in arms used by the militia.
Absent a showing that a sawed off shot gun is a militia type weapon...
