Even its handling of the media has improved dramatically. For example, as the California wildfires raged Tuesday, Vice Adm. Harvey E. Johnson, the deputy administrator, had a 1 p.m. news briefing.<br /><br />Reporters were given only 15 minutes' notice of the briefing, making it unlikely many could show up at FEMA's Southwest D.C. offices.<br /> <br /><br />They were given an 800 number to call in, though it was a "listen only" line, the notice said -- no questions. Parts of the briefing were carried live on Fox News (see the Fox News video of the news conference carried on the Think Progress Web site), MSNBC and other outlets.<br /><br />Johnson stood behind a lectern and began with an overview before saying he would take a few questions. The first questions were about the "commodities" being shipped to Southern California and how officials are dealing with people who refuse to evacuate. He responded eloquently.<br /><br />He was apparently quite familiar with the reporters -- in one case, he appears to say "Mike" and points to a reporter -- and was asked an oddly in-house question about "what it means to have an emergency declaration as opposed to a major disaster declaration" signed by the president. He once again explained smoothly.<br /><br />FEMA press secretary Aaron Walker interrupted at one point to caution he'd allow just "two more questions." Later, he called for a "last question."<br /><br />"Are you happy with FEMA's response so far?" a reporter asked. Another asked about "lessons learned from Katrina."<br /><br />"I'm very happy with FEMA's response so far," Johnson said, hailing "a very smoothly, very efficiently performing team."<br /><br /><br />"And so I think what you're really seeing here is the benefit of experience, the benefit of good leadership and the benefit of good partnership," Johnson said, "none of which were present in Katrina." (Wasn't Michael Chertoff DHS chief then?) Very smooth, very professional. But something didn't seem right. The reporters were lobbing too many softballs. No one asked about trailers with formaldehyde for those made homeless by the fires. And the media seemed to be giving Johnson all day to wax on and on about FEMA's greatness.<br /><br />Of course, that could be because the questions were asked by FEMA staffers playing reporters. We're told the questions were asked by Cindy Taylor, FEMA's deputy director of external affairs, and by "Mike" Widomski, the deputy director of public affairs. Director of External Affairs John "Pat" Philbin asked a question, and another came, we understand, from someone who sounds like press aide Ali Kirin.<br /><br />Asked about this, Widomski said: "We had been getting mobbed with phone calls from reporters, and this was thrown together at the last minute."<br /><br />But the staff did not make up the questions, he said, and Johnson did not know what was going to be asked. "We pulled questions from those we had been getting from reporters earlier in the day." Despite the very short notice, "we were expecting the press to come," he said, but they didn't. This bill is one of the most blatant attacks against the Constitution yet and actually defines thought crimes as homegrown terrorism. If passed into law, it will also establish a commission and a Center of Excellence to study and defeat so called thought criminals. Unlike previous anti-terror legislation, this bill specifically targets the civilian population of the United States and uses vague language to define homegrown terrorism. Amazingly, 404 of our elected representatives from both the Democrat and Republican parties voted in favor of this bill. There is little doubt that this bill is specifically targeting the growing patriot community that is demanding the restoration of the Constitution. First let’s take a look at the definitions of violent radicalization and homegrown terrorism as defined in Section 899A of the bill.<br /><br />The definition of violent radicalization uses vague language to define this term of promoting any belief system that the government considers to be an extremist agenda. Since the bill doesn’t specifically define what an extremist belief system is, it is entirely up to the interpretation of the government. Considering how much the government has done to destroy the Constitution they could even define Ron Paul supporters as promoting an extremist belief system. Literally, the government according to this definition can define whatever they want as an extremist belief system. Essentially they have defined violent radicalization as thought crime. The definition as defined in the bill is shown below.<br /><br />(2) VIOLENT RADICALIZATION- The term violent radicalization’ means the process of adopting or promoting an extremist belief system for the purpose of facilitating ideologically based violence to advance political, religious, or social change.<br /><br />The definition of homegrown terrorism uses equally vague language to further define thought crime. The bill includes the planned use of force or violence as homegrown terrorism which could be interpreted as thinking about using force or violence. Not only that but the definition is so vaguely defined, that petty crimes could even fall into the category of homegrown terrorism. The definition as defined in the bill is shown below.<br /><br />(3) HOMEGROWN TERRORISM- The term homegrown terrorism’ means the use, planned use, or threatened use, of force or violence by a group or individual born, raised, or based and operating primarily within the United States or any possession of the United States to intimidate or coerce the United States government, the civilian population of the United States, or any segment thereof, in furtherance of political or social objectives.<br /><br />Section 899B of the bill goes over the findings of Congress as it pertains to homegrown terrorism. Particularly alarming is that the bill mentions the Internet as a main source for terrorist propaganda. The bill even mentions streams in obvious reference to many of the patriot and pro-constitution Internet radio networks that have been formed. It also mentions that homegrown terrorists span all ages and races indicating that the Congress is stating that everyone is a potential terrorist. Even worse is that Congress states in their findings that they should look at draconian police states like Canada, Australia and the United Kingdom as models to defeat homegrown terrorists. Literally, these findings of Congress fall right in line with the growing patriot community.<br /><br />The biggest joke of all is that this section also says that any measure to prevent violent radicalization and homegrown terrorism should not violate the constitutional rights of citizens. However, the definition of violent radicalization and homegrown terrorism as they are defined in section 899A are themselves unconstitutional. The Constitution does not allow the government to arrest people for thought crimes, so any promises not to violate the constitutional rights of citizens are already broken by their own definitions.<br /><br />SEC. 899B. FINDINGS.<br /><br />The Congress finds the following:<br /><br />(1) The development and implementation of methods and processes that can be utilized to prevent violent radicalization, homegrown terrorism, and ideologically based violence in the United States is critical to combating domestic terrorism.<br /><br />(2) The promotion of violent radicalization, homegrown terrorism, and ideologically based violence exists in the United States and poses a threat to homeland security.<br /><br />(3) The Internet has aided in facilitating violent radicalization, ideologically based violence, and the homegrown terrorism process in the United States by providing access to broad and constant streams of terrorist-related propaganda to United States citizens.<br /><br />(4) While the United States must continue its vigilant efforts to combat international terrorism, it must also strengthen efforts to combat the threat posed by homegrown terrorists based and operating within the United States.<br /><br />(5) Understanding the motivational factors that lead to violent radicalization, homegrown terrorism, and ideologically based violence is a vital step toward eradicating these threats in the United States.<br /><br />(6) The potential rise of self radicalized, unaffiliated terrorists domestically cannot be easily prevented through traditional Federal intelligence or law enforcement efforts, and requires the incorporation of State and local solutions.<br /><br />(7) Individuals prone to violent radicalization, homegrown terrorism, and ideologically based violence span all races, ethnicities, and religious beliefs, and individuals should not be targeted based solely on race, ethnicity, or religion.<br /><br />(8) Any measure taken to prevent violent radicalization, homegrown terrorism, and ideologically based violence and homegrown terrorism in the United States should not violate the constitutional rights, civil rights and civil liberties of United States citizens and lawful permanent residents.<br /><br />(9) Certain governments, including the United Kingdom, Canada, and Australia have significant experience with homegrown terrorism and the United States can benefit from lessons learned by those nations.<br /><br />Section 899C calls for a commission on the prevention of violent radicalization and ideologically based violence. The commission will consist of ten members appointed by various individuals that hold different positions in government. Essentially, this is a commission that will examine and report on how they are going to deal with violent radicalization and homegrown terrorism. So basically, the commission is being formed specifically on how to deal with thought criminals in the United States. The bill requires that the commission submit their final report 18 months following the commission’s first meeting as well as submit interim reports every 6 months leading up to the final report. Below is the bill’s defined purpose of the commission. Amazingly they even define one of the purposes of the commission to determine the causes of lone wolf violent radicalization.<br /><br />(b) Purpose- The purposes of the Commission are the following:<br /><br />(1) Examine and report upon the facts and causes of violent radicalization, homegrown terrorism, and ideologically based violence in the United States, including United States connections to non-United States persons and networks, violent radicalization, homegrown terrorism, and ideologically based violence in prison, individual or lone wolf’ violent radicalization, homegrown terrorism, and ideologically based violence, and other faces of the phenomena of violent radicalization, homegrown terrorism, and ideologically based violence that the Commission considers important.<br /><br />(2) Build upon and bring together the work of other entities and avoid unnecessary duplication, by reviewing the findings, conclusions, and recommendations of–<br /><br />(A) the Center of Excellence established or designated under section 899D, and other academic work, as appropriate;<br /><br />(B) Federal, State, local, or tribal studies of, reviews of, and experiences with violent radicalization, homegrown terrorism, and ideologically based violence; and<br /><br />(C) foreign government studies of, reviews of, and experiences with violent radicalization, homegrown terrorism, and ideologically based violence.<br /><br />Section 899D of the bill establishes a Center of Excellence for the Study of Violent Radicalization and Homegrown Terrorism in the United States. Essentially, this will be a Department of Homeland Security affiliated institution that will study and determine how to defeat thought criminals.<br /><br />Section 899E of the bill discusses how the government is going to defeat violent radicalization and homegrown terrorism through international cooperation. As stated in the findings section earlier in the legislation, they will unquestionably seek the advice of countries with draconian police states like the United Kingdom to determine how to deal with this growing threat of thought crime.<br /><br />Possibly the most ridiculous section of the bill is Section 899F which states how they plan on protecting civil rights and civil liberties while preventing ideologically based violence and homegrown terrorism. Here is what the section says.<br /><br />SEC. 899F. PROTECTING CIVIL RIGHTS AND CIVIL LIBERTIES WHILE PREVENTING IDEOLOGICALLY-BASED VIOLENCE AND HOMEGROWN TERRORISM.<br /><br />(a) In General- The Department of Homeland Security’s efforts to prevent ideologically-based violence and homegrown terrorism as described herein shall not violate the constitutional rights, civil rights, and civil liberties of United States citizens and lawful permanent residents.<br /><br />(b) Commitment to Racial Neutrality- The Secretary shall ensure that the activities and operations of the entities created by this subtitle are in compliance with the Department of Homeland Security’s commitment to racial neutrality.<br /><br />(c) Auditing Mechanism- The Civil Rights and Civil Liberties Officer of the Department of Homeland Security will develop and implement an auditing mechanism to ensure that compliance with this subtitle does not result in a disproportionate impact, without a rational basis, on any particular race, ethnicity, or religion and include the results of its audit in its annual report to Congress required under section 705.’.<br /><br />(b) Clerical Amendment- The table of contents in section 1(b) of such Act is amended by inserting at the end of the items relating to title VIII the following:<br /><br />It states in the first subsection that in general the efforts to defeat thought crime shall not violate the constitutional rights, civil rights and civil liberties of the United States citizens and lawful permanent residents. How does this protect constitutional rights if they use vague language such as in general that prefaces the statement? This means that the Department of Homeland Security does not have to abide by the Constitution in their attempts to prevent so called homegrown terrorism.<br /><br />This bill is completely insane. It literally allows the government to define any and all crimes including thought crime as violent radicalization and homegrown terrorism. Obviously, this legislation is unconstitutional on a number of levels and it is clear that all 404 representatives who voted in favor of this bill are traitors and should be removed from office immediately. The treason spans both political parties and it shows us all that there is no difference between them. The bill will go on to the Senate and will likely be passed and signed into the law by George W. Bush. Considering that draconian legislation like the Patriot Act and the Military Commissions Act have already been passed, there seems little question that this one will get passed as well. One <span class="blsp-spelling-error" id="SPELLING_ERROR_2">Undersheriff</span> even described the procedure as "like a telemarketer that you couldn't hang up on,".</span><br /><br /><span style="font-family: trebuchet ms;">The Denver post reported on the incident earlier this week:</span><br /><br /><span style="font-family: trebuchet ms;"> Sgt. Bob <span class="blsp-spelling-error" id="SPELLING_ERROR_3">Enney</span> said deputies assisted the Pacific Institute for Research and Evaluation in stopping motorists at five sites along Colorado 119 for surveys on any drug and alcohol use. Surveyors then asked the motorists to voluntarily submit to tests of their breath, blood and saliva. At least 200 drivers were tested, <span class="blsp-spelling-error" id="SPELLING_ERROR_4">Enney</span> said. About five motorists later complained, he said.</span><br /><br /><span style="font-family: trebuchet ms;">The research is reportedly part of a nationwide study partly financed by the National Highway Traffic Safety Administration.</span><br /><br /><span style="font-family: trebuchet ms;">Some motorists told the Post that they repeatedly asked if the questioners were law enforcement officials and after stating that they were not interested in participating in the study, were still not given clearance to leave.</span><br /><br /><span style="font-family: trebuchet ms;">Describing the surveyors as being dressed in blue jumpsuits, others stated that they were "too persistent" and even offered $100 incentives to motorists in an attempt to get them to change their minds after they had declined to take part in the survey. Some even said that the surveyors then ridiculed the motorists for not taking the money.</span><br /><span style="font-family: trebuchet ms;">In recent years police have moved towards taking blood samples as they cannot be challenged where as breath tests can. Now, authorities in most states are taking blood, by force if necessary.</span><br /><span style="font-family: trebuchet ms;">Laws in at least seven states allow police to take blood without the driver's consent, without explicitly authorizing force. In most other states, court rulings have authorized reasonable force to obtain blood. Many such rulings cite a little-known fact about driving laws in the U.S.: All motorists are considered to have consented to a search of their blood, breath or urine. Such "implied consent" laws were introduced in New York in 1953, and today all 50 states and the District of Columbia have them."</span><br /><br /><span style="font-family: trebuchet ms;">Regular DUI checkpoints have increasingly come under scrutiny across the country with some judges ruling them unconstitutional and illegal. Those who think this crew will quietly walk away from power are simply not paying attention.<br /><br />The real question is not how or when they might do it. It's how, realistically, we can stop them.<br /><br />In Florida 2000, Team Bush had a game plan involving a handful of tactics. With Jeb Bush in the governor's mansion, the GOP used a combination of disenfranchisement, intimidation, faulty ballots, electronic voting fraud, a rigged vote count and an aborted recount, courtesy of the US Supreme Court.<br /><br />A compliant Democrat (Al Gore) allowed the coup to be completed.<br /><br />In Ohio 2004, the arsenal of dirty tricks exploded. Based in Columbus, we have documented more than a hundred different tactics used to steal the 20 electoral votes that gave Bush a second term. More are still surfacing. As a result of the King-Lincoln-Bronzeville federal lawsuit (in which we are plaintiff and attorney) we have now been informed that 56 of the 88 counties in Ohio violated federal law by destroying election records, thus preventing a definitive historical recount.<br /><br />As in 2000, a compliant Democrat (John Kerry) allowed the coup to proceed.<br /><br />For 2008 we expect the list of vote theft maneuvers to escalate yet again. We are already witnessing a coordinated nationwide drive to destroy voter registration organizations and to disenfranchise millions of minority, poor and young voters.<br /><br />This carefully choreographed campaign is complemented by the widespread use of electronic voting machines. As reported by the Government Accountability Office, Princeton University, the Brennan Center, the Carter-Baker Commission, US Rep. John Conyers (D-MI) and others, these machines can be easily used to flip an election. They were integral to stealing both the 2000 and 2004 elections. Efforts to make their source codes transparent, or to require a usable paper trail on a federal level, have thus far failed. A discriminatory Voter ID requirement may also serve as the gateway to a national identification card.<br /><br />Overall, the GOP will have at its command even more weapons of election theft in 2008 than it did in Ohio 2004, which jumped exponentially from Florida 2000. The Rovian GOP is nothing if not tightly organized to do this with ruthless efficiency. Expect everything that was used these past two presidential elections to surface again in 2008 in far more states, with far more efficiency, and many new dirty tricks added in.<br /><br />But in Ohio 2006, the GOP learned a hard lesson. Its candidate for governor was J. Kenneth Blackwell. The secretary of state was the essential on-the-ground operative in the theft of Ohio 2004.<br /><br />When he announced for governor, many Ohioans joked that "Ken Blackwell will never lose an election where he counts the votes."<br /><br />But lose he did . . . along with the GOP candidates for secretary of state, attorney general and US Senate.<br /><br />By our calculations, despite massive grassroots scrutiny, the Republicans stole in excess of 6 percent of the Ohio vote in 2006. But they still lost.<br /><br />Why? Because they were so massively unpopular that even a 6 percent bump couldn't save them. Outgoing Governor Bob Taft, who pleaded guilty to four misdemeanors while in office, left town with a 7 percent approval rating (that's not a typo). Blackwell entered the last week of the campaign down 30 percent in some polls.<br /><br />So while the GOP still had control of the electoral machinery here in 2006, the public tide against them was simply too great to hold back, even through the advanced art and science of modern Rovian election theft.<br /><br />In traditional electoral terms, that may also be the case in 2008. Should things proceed as they are now, it's hard to imagine any Republican candidate going into the election within striking distance. The potential variations are many, but the graffiti on the wall is clear.<br /><br />What's also clear is that this administration has a deep, profound and uncompromising contempt for democracy, for the rule of law, and for the US Constitution. When George W. Bush went on the record (twice) as saying he has nothing against dictatorship, as long as he can be dictator, it was a clear and present policy statement.<br /><br />Who really believes this crew will walk quietly away from power? They have the motivation, the money and the method for doing away with the electoral process altogether. So why wouldn't they?<br /><br />The groundwork for dismissal of both the legislative and judicial branch has been carefully laid. The litany is well-known, but worth a very partial listing:<br /><br />The continuation of the drug war, and the US PATRIOT Act, Homeland Security Act and other dictatorial laws prompted by the 9/11/2001 terror attacks, have decimated the Bill of Rights, and shredded the traditional American right to due process of law, freedom from official surveillance, arbitrary violence, and far more.<br /><br />The current attorney general, Alberto Gonzales, has not backed away from his announcement to Congress that the Constitution does not guarantee habeas corpus. The administration continues to act on the assumption that it can arrest anyone at any time and hold them without notification or trial for as long as it wants.<br /><br />The establishment of the Department of Homeland Security has given it additional hardware to decimate the basic human rights of our citizenry. Under the guise of dealing with the "immigration problem," large concentration camps are under construction around the US.<br /><br />The administration has endorsed and is exercising its "right" to employ torture, contrary to the Eighth Amendment and to a wide range of international treaties, which Gonzales has labeled "quaint."<br /><br />With more than 200 "signing statements," the administration acts on its belief that the "unitary executive" trumps the power of the legislative branch in any instance it chooses. This belief has been further enforced with the administration's use of a wide range of precedent-setting arguments to keep its functionaries from testifying before Congress.<br /><br />There is much more. In all instances, the 109th Congress and the public have rolled over without significant resistance.<br /><br /><span style="color: rgb(204, 0, 0);">Most crucial now are Presidential Directive #51, Executive Orders #13303, #13315, #13350, #13364, #13422, #13438, and more, by which Bush has granted himself an immense arsenal of powers for which the term "dictatorial" is a modest understatement.</span><br /><br />The framers established our government with checks and balances. But executive orders have accumulated important precedent. The Emancipation Proclamation, by which Lincoln declared an end to slavery in the South, was issued under the "military necessity" of adding blacks to the Union Army, a step without which the North might not have won the Civil War. Franklin Roosevelt's Executive Order #8802 established the Fair Employment Practices Commission. Harry Truman's Executive Order #9981 desegregated the military.<br /><br />More to the point, FDR's Executive Order #9066 ordered the forcible internment of 100,000 people of Japanese descent into the now infamous concentration camps of World War II.<br /><br />There is also precedent for a president overriding the Supreme Court. In the 1830s, Chief Justice John Marshall enshrined the right of the Cherokee Nation to sovereignty over its ancestral land in the Appalachian Mountains. But President Andrew Jackson scorned the decision. Some 14,000 native Americans were moved at gunpoint to Oklahoma. More than 3,000 died along the way.<br /><br />All this will be relevant should Team Bush envision a defeat in the 2008 election and decide to call it off. It's well established that Richard Nixon -- mentor to Karl Rove and Dick Cheney -- commissioned the Huston Plan, which detailed how to cancel the 1972 election.<br /><br />Today we must ask: who would stop this administration from taking dictatorial power in the instance of a "national emergency" such as a terror attack at a nuclear power plant or something similar?<br /><br />Nothing in the behavior of this Congress indicates that it is capable of significant resistance. Impeachment seems beyond it. Nor does it seem Congress would actually remove Bush if it did put him on trial.<br /><br />Short of that, Bush clearly does not view anything Congress might do as a meaningful impediment. After all, how many divisions does the Congress command?<br /><br />The Supreme Court, as currently constituted, would almost certainly rubber stamp a Bush coup. If not, like Jackson, he could ignore it as easily as he would ignore Congress.<br /><br />What does that leave? There is much idle speculation now about what the armed forces would do. We also hear loose talk about "90 million gun owners."<br /><br />From the public side, the only conceivable counter force might be a national strike or an effective long-term campaign of general non-cooperation.<br /><br />But we can certainly assume the mainstream media will give lockstep support to whatever the regime says and does. It's also a given that those likely to lead the resistance will immediately land in those new prisons being built by Halliburton et. al.<br /><br />So how do we cope with the harsh realities of such a Bush/Cheney/Rove dictatorial coup?<br /><br />We may have about a year to prepare. Before we see the latest news lets just run down the dictator checklist to see how “The Decider” measures up:</span><br /><br /><span style="font-family: trebuchet ms;">1. Myth of the rustic manly background? Check! All dictators must fabricate a background that screams manliness and hardship that serves as a cover for cowardice and privilege. For Bush it is the myth of the cowboy. When not wearing boots, jeans and a cowboy hat he is seen tottering around bowlegged with a case of <span class="blsp-spelling-error" id="SPELLING_ERROR_3">ILS</span> (Inflated Lat Syndrome: characterized by puffing the chest out and bowing the arms out to appear muscular but instead looking ridiculous). Although his Waco “ranch” boasts no horses, due to his fear of large animals, it is still supports the cowboy myth and helps to deflect questions about dodging the draft and being an elitist from Maine.</span><br /><br /><span style="font-family: trebuchet ms;">2. Military Uniform? Got it! Who can forget the “Mission Accomplished Moment” aboard the Aircraft carrier! I remember it like it was yesterday, the brave chicken hawk strutting around the deck of a massive warship as if he himself had single <span class="blsp-spelling-error" id="SPELLING_ERROR_4">handedly</span> whooped the Taliban! However, to give him some credit it was the closest he ever got to a war… a few miles off the US east coast is closer than Texas!</span><br /><br /><span style="font-family: trebuchet ms;">3. Supporters with cool names? Got those too! However, I think he could have been a little more creative here: Bush calls his supporters “Pioneers” while Mao called his “Young Pioneers”, but since the Mao group was exclusively for children and Bush’s group is for adults with the minds of children we’ll let it slide.</span><br /><br /><span style="font-family: trebuchet ms;">4. Mood swings and mania? <span class="blsp-spelling-error" id="SPELLING_ERROR_5">Cha</span>-<span class="blsp-spelling-error" id="SPELLING_ERROR_6">ching</span>! Oh yeah! Freaking out in front of friends while wildly thumping your chest and screaming “I’m the President, I’m the President” is about as </span><a style="font-family: trebuchet ms;" href="http://thinkprogress.org/2007/05/31/bush-wild-eyed/">wild-eyed crazy</a><span style="font-family: trebuchet ms;"> as an aspiring dictator can be!</span><br /><br /><span style="font-family: trebuchet ms;">5. Creating false threats and concocting new enemies to scare the masses? You bet your <span class="blsp-spelling-error" id="SPELLING_ERROR_7">WMD</span>’s Junior has this one nailed! And, in true dictatorial fashion, he has even managed to swap and switch enemies so fast that if they were women he’d be the envy of Hugh Hefner!</span><br /><br /><span style="font-family: trebuchet ms;">6. Systematically destroying all rights in the name of security? Duh! Do we even have to get into this one?</span><br /><br /><span style="font-family: trebuchet ms;">Well, what else would make this picture complete? Have you guessed it yet? I know I thought I had seen it all until just yesterday. As I sat down at my computer I opened an email from a friend who shares my love of politics and, from time to time, emails job postings from various government departments and agencies, this time it was the White House internship program. As I clicked the link and waited for the page to load I took a sip of my coffee and then choked and spit the hot coffee all over the desk as the words <span class="blsp-spelling-error" id="SPELLING_ERROR_8">leapt</span> off the screen and pounded my eyeballs… <span style="color: rgb(204, 0, 0);">“Thank you for your interest in SERVING PRESIDENT GEORGE W. Cryer stopped filing income taxes more than 10 years ago<br />July 13, 2007: By Loresha Wilson</span><br /><br /><span style=";font-family:trebuchet ms;font-size:180%;" >A Shreveport attorney who has challenged the government for years on the legality of filing federal income taxes has been acquitted on charges he failed to file returns.</span><br /><div style="text-align: justify;"><br /><span style=";font-family:trebuchet ms;font-size:180%;" >A federal jury unanimously found Tommy Cryer not guilty this week on two misdemeanor counts of failure to file.</span><br /><br /><span style=";font-family:trebuchet ms;font-size:180%;" >And according to Cryer, the prosecution dismissed two felony charges of tax evasion prior to trial.</span><br /><br /><span style=";font-family:trebuchet ms;font-size:180%;" >Attempts by The Times on Thursday to reach U.S. Attorney Donald Washington or Bill Flanagan, first assistant U.S. attorney, were not successful. Calls made to the two were not immediately returned.</span><br /><br /><span style="color: rgb(204, 0, 0);font-family:trebuchet ms;font-size:180%;" >"The court could not find a law that makes me liable or makes my revenues taxable," Cryer said. "The Supreme Court has ruled that the government cannot impose an income tax on anything but the profits and gains. When you work for someone you give your service and labor in exchange for money, so everything you make is not profit or gain. You put something into it."</span><br /><br /><span style=";font-family:trebuchet ms;font-size:180%;" >Cryer was indicted last year on two counts of tax evasion. The indictment alleged he evaded payment of $73,000 in income tax to the Internal Revenue Service during 2000 and 2001.</span><br /><br /><span style=";font-family:trebuchet ms;font-size:180%;" >Cryer created a trust listing himself as the trustee, and received payments of dividends, interest and stock income to that trust, according to the indictment. This approach is especially worrisome for several reasons.<br /><br />First, these signing statements tend to move authority from the legislative branch to the executive, thus upsetting our delicate system of checks and balances. Next, these statements grant the President power not given by the Constitution, allowing him to usurp powers of the judicial branch. Finally, the idea of agencies refusing to enforce the law as enacted sets precedent for the type of runaway administrative actions our constitution was expressly enacted in order to avoid.<br /><br />Although these signing statements are at record high numbers, the problem is not with a single administration. Contrary to the claims of those who raise this issue for purely political purposes, the most significant challenge to liberty presented by these statements is that they can serve to further erode our constitutional republic.<br /><br />I have long been skeptical of the line item veto on spending bills for the same reason I oppose these signing statements. The legislature should not yield its authority to the executive. Our constitutional republic demands that all branches of government understand and respect our system and jealously guard their own prerogatives.<br /><br />In modern Washington nothing is more misunderstood, and less appreciated, than the genius of republicanism. Presidents issue signing statements that effectively “approve in part and reject in part,” laws of the land – even though there is no constitutional provision for such a process. In addition, Congress cedes its powers at the crucial moment when a decision on whether or not a war is to be fought will be made, only to then criticize the effort it could have used its powers to stop.<br /><br />In his Notes on Virginia, Thomas Jefferson spoke clearly and directly about the idea of elected representatives delegating their responsibility to other branches of government, saying in no uncertain terms that since such representatives had received their authority by delegation from the people – expressly for the use as representative – the legislature had to choose to either use the authority granted or return it to the people. In other words, there is to be no delegation of authority from the representatives to the executive branch of government.<br /><br />Concerns with signing statements ought to include a concern for the health of our constitutional republic, it ought not to be based upon the political battle of the day. Regardless of whether the President is named Bush or Clinton, and without respect to any particular political interest, we in Congress need to fulfill our oath of office and protect and defend the constitution and our republic.
