Sometimes, "right" is used rather loosely, to mean (as best as I can tell) "something Franz Fanon would agree with". But other times, it seems to be forwarded as a positive description of contemporary international law. For example, the group ANSWER (Act Now to Stop War and End Racism), &lt;a href="http://www.informationclearinghouse.info/article8968.htm"&gt;answering whether Iraqis had the right to resist American occupation&lt;/a&gt;, wrote the following: &lt;blockquote&gt;"We support the right of self-determination in the struggle against imperialist domination, and believe the Iraqi people have the right to resist occupation by any means chosen. The right to resist occupation is a concept enshrined in international law. . . . This is not a matter of political or ideological affinity. Nor is it an issue of the tactics of war --al &lt;i&gt;[sic]&lt;/i&gt; of which are ugly. It boils down to this simple equation: On the one side are all the forces fighting a war against colonialism and occupation, and on the other side are the colonialists, neo-colonialists and their Iraqi agents. In that struggle we take an unambiguous position opposing the colonizers. To do otherwise would be to put entirely secondary issues --ideology, war tactics, etc. --at the forefront, while ignoring the core issue of colonialism in Iraq and elsewhere. Moreover, since we are a U.S. antiwar movement, and it is our country that has invaded Iraq, we are obligated to be crystal clear on this issue." &lt;/blockquote&gt;&lt;br /&gt;See also &lt;a href="http://dissidentvoice.org/2009/02/amnestys-scandalous-obliquity/"&gt;here&lt;/a&gt; ("The Palestinians, long tormented by this cruel occupation, have every legal and moral right to resist, using whatever means available to them."). Article II of the 1998 Arab Convention for the Suppression of Terrorism is ambiguous, it reads: &lt;blockquote&gt;All cases of struggle by whatever means, including armed struggle, against foreign occupation and aggression for liberation and self-determination, in accordance with the principles of international law, shall not be regarded as an offence. This provision shall not apply to any act prejudicing the territorial integrity of any Arab State.&lt;/blockquote&gt;&lt;br /&gt;Love that last line, by the way. Finally, Laila El-Haddad reportedly &lt;a href="http://www.campus-watch.org/article/id/6976"&gt;stated at a Duke "teach-in"&lt;/a&gt; that Palestinians "are a stateless people and international law gives them the right or obligation to resist with whatever means possible."&lt;br /&gt;&lt;br /&gt;I'm curious as to what legal doctrine, if any, these speakers are tracing to in support of this "by any means" claim. The 1977 &lt;a href="http://www.icrc.org/ihl.nsf/FULL/470?OpenDocument"&gt;Protocol I amendments to the Geneva Conventions&lt;/a&gt;, specifically Article I, Para. 4, do affirm the legitimacy of what might be called a "right to resistance", in that it categorizes such conflicts as equivalent to state/state international conflicts: &lt;blockquote&gt;The situations referred to in the preceding paragraph [delineating which conflicts are covered under the Protocol, namely, international armed conflicts] include armed conflicts in which peoples are fighting against colonial domination and alien occupation and against racist regimes in the exercise of their right of self-determination, as enshrined in the Charter of the United Nations and the Declaration on Principles of International Law concerning Friendly Relations and Co-operation among States in accordance with the Charter of the United Nations.&lt;/blockquote&gt;&lt;br /&gt;This was important, in that it established that entities fighting "colonial domination and alien occupation and racist regimes in the exercise of their right of self-determination" are not in of themselves enemy combatants. Of course, ambiguities remain -- both in terms of what qualifies as a "colonial domination" or "alien occupation" or "racist regimes" (which are primarily political questions), as well as how much bite to place upon "in the exercise of their right of self-determination."&lt;br /&gt;&lt;br /&gt;But even read to its fullest, this clause seems to establish the exact opposite of the "by any means chosen" claim. It does not provide a &lt;i&gt;carte blanche&lt;/i&gt; right of resistance, it places such resisters firmly inside the same legal regime that attaches to all other international armed conflicts, with all the duties therein.&lt;br /&gt;&lt;br /&gt;Of course, the corpus of international law is large, and I might be missing something. Moreover, the claim that such an indeterminate right of resistance does or does not exist in international law is separate from the claim that it &lt;i&gt;should&lt;/i&gt; exist -- I am familiar with the case for the latter, and do not wish to rehash it. But not for &lt;a href="http://dsadevil.blogspot.com/2009/07/about-that.html"&gt;the reason you think!&lt;/a&gt; Rather, it's because I think the jibe isn't quite on target. The point of Matt's critique is to make fun of pro-Israel writers who have been busy savaging HRW as an anti-Israel organization due to its various critiques of Israeli policy. But I don't think that this has converged with any desire to discredit HRW reports on other countries. Much the opposite -- a major facet of the critique has been a supposed lack of equitable attention given to these countries.&lt;br /&gt;&lt;br /&gt;Meanwhile, the point of Matt's HRW defense is that they suspect that HRW is being attacked not because of any substantive errors in their analysis, but based off the simple syllogism of critiquing Israel = prejudicially anti-Israel. Which means the analogous "joke" with regards to Venezuela or wherever would be to say something like "I guess this is yet another manifestation of HRW's anti-Venezuela bias", or something to that effect. During the blockade of the cinema insults such as “Jewish swine” were to be heard. A Hamburg association of the Left Party published a justification of the action, saying a “Zionist propaganda film” was prevented from being shown.&lt;br /&gt;&lt;br /&gt;The film to be shown was the 1972 movie “Why Israel,” by the French filmmaker Claude Lanzmann, who is best known for his nine-hour documentary “Shoah.” According to the cinema in the district of St. Pauli, and the organizer of the planned demonstration which had about 15 people from an anti-imperialist group, the Center internationalist B5, access to the cinema was blocked and the incoming visitors were filmed and photographed.&lt;br /&gt;&lt;br /&gt;The blockaders were wearing gloves and wielding a bike lock and a belt prepared for a violent action. In fact, there had been a scuffle, and some visitors were injured by blows to the face. The demonstration was called because of the boycott campaign.&lt;br /&gt;&lt;br /&gt;The chairman of the Jewish community Pinneberg, Wolfgang Seibert, condemned the action and called it “the actions of the petit bourgeois running wild” who understood themselves however as on the left, but “in their approach can certainly be described as followers and stooges of neo-Nazis.” With insults like “Jewish pig” and “sissy,” the blockaders have discredited themselves: “Those who use such anti-Semitic and homophobic words, have lost every right to call themselves ‘internationalists’.” That it is determined by force “what is allowed to be seen and what not,” is completely unacceptable, said Seibert: “We are fed up with this kind of censorship.”&lt;/blockquote&gt;&lt;br /&gt;German police &lt;a href="http://jta.org/news/article/2009/11/22/1009334/german-police-investigating-lanzmann-film-protest"&gt;are now investigating&lt;/a&gt;, though persons who had tried to attend the screening complained that the police stayed on the sidelines as they were violently assaulted by the left/fascist thugs. Stephanie Bell (Univ. of Chicago '08) competed in LD, so I only knew of her back when I was competing (though I met her post-graduation -- she was very nice). But Eva Lam (Harvard '10) and I were quite close as she came up through the ranks -- indeed, I remember her from her very first Harvard tournament! I think the intuitive definition of being sexually complementary is sharing a mutual attraction and compatible desires vis-a-vis giving and receiving sexual pleasure. But here, it looks like that is being replaced with juvenile "tab A in slot B" or "entrance, not exit!" argumentation. It is testament to the increased potency of the pro-equality argument that opponents now have to work so hard to obfuscate what they're actually doing.&lt;br /&gt;&lt;br /&gt;It's really simple. Right now, marriage is open only to heterosexual couples. Homosexual couples are excluded, for no real reason other than irrational prejudice and/or animus. That's incompatible with American norms of equality. I am, of course, pleased to see the President aligning with Cuba's burgeoning civil society which is pressing domestically for democracy and human rights. In response, he's busy flip-flopping his way over to oppose bipartisan climate-change efforts.&lt;br /&gt;&lt;br /&gt;I have to say, I'd be thrilled if John McCain loses a primary. From my perspective, it's win-win. Among McCain voters, the breakdown is 31%-49%-20%. By comparison, independents weigh in at 72%-18%-10%, and Democrats are 86%-9%-4%.&lt;/blockquote&gt;&lt;br /&gt;As TPM and &lt;a href="http://yglesias.thinkprogress.org/archives/2009/11/republicans-dont-believe-obama-won-the-election.php"&gt;Matt Yglesias&lt;/a&gt; point out, the comparison to Democratic discontent over Florida in 2000 doesn't really hold -- not just because the difference in the magnitude (less than 600 votes in Florida, versus a 9.5 million vote edge for Obama nationwide), but also because the Florida controversy stemmed from a well-observed and legitimately disputed controversy over how to count imperfect ballots (butterflies, hanging chads, the whole she-bang).*&lt;br /&gt;&lt;br /&gt;Meanwhile, &lt;a href="http://www.dailykos.com/storyonly/2009/11/19/806058/-FL-Sen:-Bombshell-results"&gt;Research 2000 put a poll in the field&lt;/a&gt; showing right-wing star Marco Rubio surging against wildly popular (statewide, anyway) but moderate Governor Charlie Crist in a GOP primary for the Senate seat -- showing a whopping net 43 point improvement from the last R2K poll. And this is with Rubio at only 50% name ID and with no money spent on advertising yet.&lt;br /&gt;&lt;br /&gt;The poll also asked GOP voters whether they believed Obama was born in the US. Only 35% said yes (29% no, 36% not sure). Break that down for Crist and Rubio voters, and a distinct pattern emerges. 73% of Republicans who believe Obama was born in the US go for the more moderate Crist, with only 16% for Rubio. Among birthers, it flips to 31% for Crist and 54% for Rubio. There is, in other words, a pretty clear linkage between the resurgent conservative base currently driving the party and adherence to some pretty ridiculous conspiracy theories about the President. Sayeth &lt;a href="http://www.motherjones.com/kevin-drum/2009/11/acorn-madness"&gt;Kevin Drum&lt;/a&gt;: &lt;blockquote&gt;This is craziness.  I could understand 10 or 15% believing this.  That's sort of the base level of people who will believe any nutty idea.  But 52%?  Someone in the GOP needs to take a deep breath and a long look in the mirror, and then try to rescue their party.  Condoning insanity is not a long-term electoral strategy.&lt;/blockquote&gt;&lt;br /&gt;This is 9/11 trutherism turned into a legitimate political force. It's a scary thing to behold.&lt;br /&gt;&lt;br /&gt;* My own feeling about Florida is that I believe more people in the state filled out a ballot believing they had cast a vote for Al Gore. Whether there was any fair or manageable standard for counting ballots that could have reflected that decision is unknowable, however. Alas, it seems like many of these organizations are more interested in provoking and prolonging the conflict with Israel than they are with bettering the lives of Palestinians. Casey&lt;/a&gt;, 505 U.S. 833 (1992), the case famous for upholding &lt;i&gt;Roe v. Wade&lt;/i&gt;. One argument they discuss in the case is the issue about a woman's right &lt;i&gt;not&lt;/i&gt; to have an abortion -- that is, the freedom to carry a pregnancy to term. Anti-abortion organizations often accuse pro-choicers of being "pro-abortion" to the point of being indifferent to policies such as China's forcible abortions. (859)&lt;/blockquote&gt;&lt;br /&gt;Legally speaking, pro-life actors rarely rely on fetal personhood as their mode of attack, presumably because this would undoubtedly cause a complete inversion in the constitutional status of abortion, from constitutionally protected to constitutionally prohibited -- a goal that, if made public, would engender significant opposition (it also, as the &lt;i&gt;Roe&lt;/i&gt; opinion makes clear, is entirely inconsistent with the original understanding of the 14th Amendment). So instead, they argue simply that this is an area where the constitution is silent, and hence is a province of the legislature.&lt;br /&gt;&lt;br /&gt;But if that's the case, and this arena really does lie outside judicial purview, then the &lt;i&gt;Casey&lt;/i&gt; plurality is correct that there is no reason why a legislature could not just as soon force women into terminating pregnancies as they could force them into carrying them to term. And the citation to &lt;i&gt;Arnold&lt;/i&gt; and &lt;i&gt;Avery&lt;/i&gt; shows that this is hardly a hypothetical concern.&lt;br /&gt;&lt;br /&gt;&lt;i&gt;Roe&lt;/i&gt; stands a fundamental bulwark defending a woman's right to control her own body. Alienating that principle to prohibit a woman for &lt;i&gt;choosing&lt;/i&gt; to end a pregnancy means gutting its ability to protect a woman from being &lt;i&gt;forced&lt;/i&gt; to end one. Plus, being a religious minority, I was acutely aware of how non- or polytheists could feel excluded by hinging loyalty to America on belief in God. I felt it was wrong, and so I refused to participate.&lt;br /&gt;&lt;br /&gt;Today, in Arkansas, a ten-year old boy, Will Phillips, is &lt;a href="http://www.arktimes.com/articles/articleviewer.aspx?ArticleID=2f5d7a3b-c72a-446b-8d20-3823aa79c021"&gt;making the news for also not saying the pledge&lt;/a&gt;. His reasons are slightly different from mine -- the "liberty and justice for all" part doesn't cohere with continued state-sponsored discrimination of gays and lesbians -- but needless to say, I find it heartwarming. Phillips is apparently very civic-minded for his age -- he, like me, wants to be able to pledge allegiance to America that really does provide liberty and justice for all, and won't settle for the substitution of "some".&lt;br /&gt;&lt;br /&gt;Of course, in taking this stand the young man, who is straight but identifies as an ally, is taking the usual barrage of homophobic taunts from classmates and others (along with, it must be said, at least some support from his friends). But so far he is staying strong, and he is being supported by messages of support from around the country (of which I am glad to contribute). In the meantime, he has a good idea of what he is standing for by sitting out: &lt;blockquote&gt;At the end of our interview, I ask young Will a question that might be a civics test nightmare for your average 10-year-old. McLendon, an intensely focused man in a neatly pressed suit, kept a Bible on his desk at the office. Sullivan explained to McLendon and the other attendees that the rise in benefits claims the VA was noticing was caused partly by Iraq and Afghanistan veterans who were suffering from PTSD. “That’s too many,” McLendon said, then hit his hand on the table. “They are too young” to be filing claims, and they are doing it “too soon.” He hit the table again. The claims, he said, are “costing us too much money,” and if the veterans “believed in God and country . . . they would not come home with PTSD.” At that point, he slammed his palm against the table a final time, making a loud smack. I did appreciate that the author both resisted the temptation to personally demonize Goldstone, while at the same time not let him off the hook for some severely problematic assumptions and extensions that, ultimately, lie on his head. (I hope I &lt;a href="http://dsadevil.blogspot.com/2009/11/halbertal-reflects-on-goldstone.html"&gt;reached a similar balance&lt;/a&gt;).&lt;br /&gt;&lt;br /&gt;Mr. Norwitz, like Professor Halbertal, &lt;a href="http://dsadevil.blogspot.com/2009/10/investigation-team-go.html"&gt;like myself&lt;/a&gt;, have adopted a pretty robust consensus position that says Israel should investigate all credible allegations of war crimes and other improper activity, regardless of the problems in the Goldstone Commission. I'd snark about Japanese internment, or the trail of tears, but I don't want to tempt him.&lt;br /&gt;&lt;br /&gt;In all seriousness though -- while there is a lot of blathering about Maoists and Castroites and America haters -- the fact of the matter is that America is a country of laws, and that fact seems to infuriate certain folks on the right. One gets the feeling that their rage at Iran stems from jealousy more than anything else -- why are they so lucky to be able to have process-free show trials and we're not? (Answer: because we're a constitutional democracy, and they're an authoritarian theocracy, and that's a distinction I prefer to maintain).&lt;br /&gt;&lt;br /&gt;The international jihadist movement, more than anything else, &lt;i&gt;wants&lt;/i&gt; to be seen as in a war with the United States. Why? Because wars carry with them honor, and glory, and most importantly, &lt;i&gt;legitimacy&lt;/i&gt;. Al-Qaeda likes the frame of a holy war because it fundamentally legitimizes violence -- violence is not &lt;i&gt;per se&lt;/i&gt; wrong in war -- and they like it because the glorious struggle of warfare is a fabulous recruiting tool for disaffected young men looking for a chance to prove their masculinity and honor. Which, in all likelihood, is why Mr. Horowitz wants to forward the war framing as well -- it fuels his John Wayne hero fantasies of being part of an epic struggle for global supremacy. Apparently, police officers are just too mundane. But America ought not craft legal policy based on what best enables David Horowitz's fantasy life. The struggle against Islamist terrorism is serious business, and it can't be left to fundamentally unserious persons like David Horowitz.&lt;br /&gt;&lt;br /&gt;The terrorists of al-Qaeda aren't noble holy warriors. They're run of the mill thugs who happen to play with bigger weapons. That doesn't mean they're "isolated individuals who have decided to break the law" -- the law understands the concept of a conspiracy. It means that, morally speaking, they do not deserve the social elevation to the level of "warrior". They're not. They're simply violent criminals backed by a murderous ideology. Nothing more, and they deserve nothing more.&lt;br /&gt;&lt;br /&gt;It is a symbol of American greatness that we are strong enough to follow the rules, even when our enemies do not. It is a symbol of American greatness that we always hold ourselves to the highest ethical standards, even when our enemies openly flout them. It is a symbol of American greatness that even in times of great stress, we maintain our commitment to due process and rule of law, even as our enemies have disdain for both.&lt;br /&gt;&lt;br /&gt;That's what makes America, America.
