Its Unpatriotic To Criticize The NHS

Do you remember the furore over Dan Hannan saying that we needed a complete rethink on the NHS whilst in America, and telling the Americans not to emulate the NHS ?

The situation is so bad at Basildon and Thurrock that a 'special measures; team has been flown in to sort out the high mortality rate, the blood spattered wards and the high cross infection rate.

In a case of 'who is watching the watchers', this was the hospital quango that was give a 'good' by the inspecting Quango and 13/14 for cleanliness.

In Nu Labour's Britain reality should never get in the way of the tractor stats.

I have just listened to some Scottish Quangocrat on R4, trying to defend the indefensible, whilst rubbishing private research that was factually correct.

You get to become a highly paid Quangocrat, by appeasing your political masters, irrespective of the facts on the ground, irrespective of reality, irrespective of the damage and deaths caused, irrespective of the cost to the taxpayer.

It is exactly how Brown is running the war in Afghanistan and exactly why the State is bloated and incompetent.

Just because what you are saying is unpopular with the Government, it does not make you wrong. Where are all the pundits defending the slovenly NHS this morning.

Computer programmers and software engineers tend to score highly on the autistic spectrum. They are not actually all mad as hatters, but those that are do well in that introspective and highly focussed career.

Little surprise then to find that one of their number is ever so slightly odd. Gary McKinnon odd. Interested in peculiar things, like model rockets.

'J' ran true to course, had his own software business and a model rocket making hobby. Declared himself to be a Libertarian. Moved to the Netherlands because he thought the UK was becoming a police state. Obviously certifiable.

He had at one point attempted to go to Canada without the required visa. Further evidence of his increasing mental instability was that he then took a train back to England to keep an appointment with HM Customs in respect of this offence - an offence for which no charges have been laid..

The authorities needed little more. The new French/English customs/anti-terrorism/passport control at the Eurostar terminal in Paris detected by cunning use of an x-ray machine that he had a model rocket about his person. No fuel, no explosives, nothing else, just a model rocket still in its packaging. Fool that he was.

They promptly radioed ahead to operation headquarters in England, and by the time our friend landed at St Pancreas, a full complement of our friendly local anti-terror Gestapo were waiting for him.

They broke into his hotel room and impounded his computer. Being a software developer he had a considerable amount of open source software code on his machine, as you do, and he had taken the precaution of encrypting his work. The police demanded the encryption key, they gave him one hour to hand it over under the UK Regulation of Investigatory Powers act (RIPA). Our friendly computer programmer, already believing the UK to be a police state, and having left the country to escape this sort of treatment, remained silent for the entire hour.

The police charged him with 'remaining silent', when he tried to get another passport to escape this hell hole, they also charged him with trying to obtain a new passport whilst they were still holding his old one. At no point have they charged him with anything to do with his model rocket, nor with anything found on his computer, nor with his earlier transgression regarding his attempted entry into Canada.

His crime was refusing to speak during that hour.

"There could be child pornography, there could be bomb-making recipes," said one detective.
"Unless you tell us we're never gonna know... What is anybody gonna think?"

He was sentenced to 13 months in Winchester Jail.

In his judgment, Judge Hetherington accepted 'J' was no threat to national security and noted his outsider lifestyle. "You... wished to involve yourself in a world which was largely based upon the access to the internet and using computers and not really interacting with other people in the ordinary outside world to any great extent," he said. "It is said on your behalf that you lead an existence rather akin to that of a monk, and that there is nothing sinister in any of this but it is essentially private matters and you do not see why you should have to disclose anything to the authorities."

Despite referencing his solitary existence, Judge Hetherington appeared not to know about 'J's mental health problems and criticised him for not speaking to authorities.
Abandoning normal court procedures, he said: "It was because I was satisfied you would not tell the Probation Service anything significant further that I saw no purpose in obtaining a pre-sentence report which is normally a prerequisite for someone of no previous convictions who has not previously received a prison sentence," he said.

Originally sentenced to 13 months for ten separate charges relating to ten separate requests of provide encryption keys, he was subsequently interviewed by a police psychiatrist.

"Do you think they are out to get you?"

Indeed he did. Little wonder! He says he felt harassed by authority and helpless against police he believed were determined to pin a crime on him.

The psychiatrist diagnosed him as a paranoid schizophrenic, and he is now held at a secure hospital, where his release date is subject to approval by his Doctors that he no longer thinks 'they are out to get him'.

BBC Newsflash- Banks Win the OFT Case

In what can only be described as the fit up of the year, the 'Supreme Court' has awarded the Banks victory over the OFT.

Only a few months ago the banks were largely seen as having given up by Legal Circles in this long running case. So there we have it the Courts have given British Banks 'Carte Blanche' to charge what they like in penalties. Because of the monopoly situation, you have nowhere else to go, as they all charge the same. If they screw up, Uncle Mervyn will give them £61Bn of your money on the quiet.

The Banks case seems to rest squarely on the fact they cannot afford to pay.

No Appeal allowed.

People power nil Banks & the State win every time.

OH UPDATE: This is it. This is the straw that will break the camels back. Expect RIOTS. Close to a million people have just been told to shut the fuck up and pay up thousands each to bankers already wallowing in taxpayers cash.

Zombie Banks

Mervyn King has just revaled that we the Taxpayer lent HBOS and RBS over £60bn in October and November of 2008, this was repaid by January 2009.

In an additional statement, the Bank said it had carefully considered the public interest case for disclosure but decided that the assistance should only be revealed "once the Bank considers that the need for secrecy has ceased".

Mervyn King said the Bank was acting in its capacity as the lender of last resort.

RBS has since signed up for the government's Asset Protection Scheme while Lloyds Banking Group - which took over HBOS - has announced plans to raise capital from its shareholders.

In his parliamentary testimony Mr King was also asked whether the UK was at risk of a credit downgrade.

"I don't think there's any immediate risk, but the longer there isn't a credible plan that sets out what action will be taken [on reducing the deficit], the more that is a risk," he replied.

So basically Merv is saying that Brown has no credible plan to deal the the deficit, he is dithering this country to death. For Gods Sake South Africa has come out of recession. Were we not supposed to be the 'best placed' to ride out the recession.

Not that I think that Cameron has got much of a clue, as his previous economic policy was to shadow Labour's spending. But the time has come for Brown to go, we cannot take another six months of this.

Here at OH we rant and rave about the inequities of MP's and Parliament. What is Parliament for ? it is for the enactment of Laws by people that we vote for to represent our point of view in the framing of these Laws.

Parliament is Ours, The Law is Ours, we as a people fought long and hard for these rights. This Rotten Parliament infected with more than its fair share of Lawyers has passed thousands upon thousands of new Laws,spewing out Statutory Instuments by the day, drafting more regulations by the day.

The Law is being used as a weapon to chain us on a daily basis. A Law that cannot be enforced is a bad Law, a Law that only applies to a section of Society and not its ruling elite is Bad Law, A Law that an ordinary man or woman cannot afford to defend themselves against is Bad Law. A Law that is not simple to understand is bad Law.

The Law has become a vested interest, it has its own rules, its own way of doing things, its 'traditions'. Not only has Parliament become disconnected from the People , the Law has become something to be avoided at all costs.

We have seen, Blair offering inducements to donors in the Peerages for cash scandal in contravention of the Law- No Charges

We have seen MP's let off fraudulent expense claims, by a 'Court' of MP's sitting in judgement, the only punishment is an apology to parliament and keep the cash. It is now apparent that the 'Judges' in this form of Parliamentary Sharia are just as guilty of fraud as those that they are trying.

The LAW is ours, if everybody stopped paying the £60 'fine' for speeding and demanded their day in Court the system would collapse. The Banks are due to face the Courts in the OFT v Banks test case Wednesday in the new 'Supreme' Court on unfair charging. The Banks will not refund anything to their customers and will defy the Law.

Only the Rich and Powerful can afford to challenge the 'Law'.

This Rotten Parliament has enshrined the Law as a weapon against the people, you can take the Freeman option, but unless 90% of the population adopt this course of action you will lose your posessions and Liberty.

It is our Law, we need to send legislators back to Parliament who will repeal the Laws of the Rotten Parliament, this not going to happen because the Constitution is in disarray, therefore we have to fight cases before the Courts, for this we have to as a people form a legal union that we pay our dues into monthly as an insurance, to retain able Lawyers who value the Law as a vehicle of Liberty and Justice, not a sinecure for personal wealth.

Where the State refuses to try Blair for Corruption in cash for peerages, a private prosecution is started by public subscription. Damien McBride was on the receiving end of two writs for slander that he has had to settle out of Court, in the course of working for Brown as his attack dog.

Members Of Plaid Cymru attempted to force through a writ against Blair for impeachment for lying to Parliament, it was struck down by MP's of all parties.

The Law should be simple, it should be easily understood and it should apply to everybody from the greatest in the Land to the most humble.

'There never did, nor can exist a Parliament, or any description of man, or any generation of men in any country, possessed of the right or the power of binding or controlling posterity to 'the end of time'.... every age and generation must be free to act for itself.... as the ages and generations which preceded it. The vanity and presumption of governing beond the grave, is the most ridiculous and insolent of all tyrannies.... I am not contending for, the right of the living, and against their being willed away, and controlled and contracted for, by the manuscripted-assumed authority of the dead.

A constitution is not a thing in name only, but in fact. It has not an ideal, but a real existence; and whereever it cannot be produced in a visible form there is none. A Constitution is a thing antecendent to a government, and the government is only the creature of a constitution.... I is the body of elements, to which you can refer, and quote article by article..... A Constitution therefore, is to a government, what the laws... are to a court...

The court... does not make the Laws, neither can it alter them; it acts in conformity to the laws made, and the government is in like manner governed by a constitution.

It is a fallacy to be bound by Laws, that are not previously assented to by the People of this Country. Without a Constitution that guarantees our Liberties, there is no valid Law. Because we the living have not assented to be governed like this.

The Rotten Parliament is without authority because it it is not by the assent of the living people of this country, it derives its 'authority' from arcane traditions not the living will of the people.

With a Constitution we can deride bad Law as unconstitutional, with free speech we can 'outlaw' political correctness as unconstitutional, speeding fines, taxes and impositions as unconstitutional without reference to a Court of Law, not some Quangocrat.

The Law is ours, do not vote for anybody who will not tell you they will repeal the Laws of the Rotten Parliament and will vote for a written Constitution.

I asked earlier in the week what we could do to stop what in my opinion has become a fast tack to total control. Since then, Peter Mandelson, an unelected Politician has seized total control of the Internet in the UK, an unelected man has become "President" of half a billion people in Europe and a scheme to actually steal unimaginable amounts of money from next three generations of the worlds people has been made public.

That's just last week.

Captian Ranty has responded to my challenge and I re post in full.

This then, is my response. There are some fine suggestions in the 90 comments so far. Regular readers will not be surprised to learn that I favour Lawful Rebellion. It is simple. It is peaceful. It clogs up the government machine. It is effective. No blood is shed. No need to mass march on anywhere or anyone in particular. This is an Armchair Warrior's dream come true.

From the comfort of your favourite chair you can unleash chaos. Using ancient law you can, and will, reclaim the high ground. Any soldier knows that once you have the high ground you have won. No-one is asking you to dash through the streets, Molotov Cocktail clutched in a sweaty hand. No-one is asking you to risk life and limb in an unfair battle against uniformed thugs who are trained to believe that the people they are meant to protect are, in fact, their enemy. Old school coppers know that the vast majority of us are good people, law-abiding people, but the new recruits are trained using neurolinguistic programming. They are a new beast entirely. They have some serious kit that can hurt, maim, or even kill us.

Before I set out on Freedom Road I carried out a risk assessment. I investigated the pro's and the con's and it became a no-brainer for me. Is there a risk in what I do? Certainly. But I find the risks acceptable. The worst they can do is kill me, and what I am doing, or intend to do, is definitely worth an "accident" when I am out walking my dogs. But here's the kicker: far too many people are doing the same thing. More and more join us every day of the week. I hear that over 200 affidavits a day are being delivered to government, and/or Queen Lizzie the 2nd. Lawful Rebellion is the new black.

I ask you this: what have you got to lose? If you are angry, if you are beyond that and regularly see a big purple vein standing out near your temples, it really is time to get a grip. I too was outraged, and when I started reading OH's blog, or DK's blog, or Leg-Irons blog, and a huge number of others, I found that my rage did not go away. It merely accelerated to new, life-threatening levels. I knew it wasn't healthy, I knew I just had to find another road to travel. And so, as you are all now aware, I became a Freeman.

Now, (as you also know), it is not all beer and skittles. It is a serious responsibility. Taking my destiny back from a bunch of scumbags in government was an easy choice. Retaking control, and I do not pretend that I am there yet, feels....amazing. Awesome. Fantastic. Pick any superlative you want. That's how I feel. What has it cost me? A few quid in stamps and registered letters. Just a few quid to remove a rabid, mindless monkey from my back. It was money well spent.

OH wants ideas? You could do worse than to start with this. A few simple letters to those money-grabbing bastards saying, (nicely), "No. Not anymore. You keep taking my money, and you give nothing in return. It stops now. I offer conditional payment. All I ask is that you show me a contract with two wet signatures, yours and mine, and I will happily pay you the money you say I owe you". Mr Council Tax Collector and Mr Inland Revenue can do no such thing. No such contract exists. Question their demands. Every single time.

How much risk are you exposing yourself to there? Is it frightening to contest a bill or a demand for your hard-earned cash?

Of course not.

What terrifies you is stepping away from the norm. What scares the bejesus out of you is what your friends and family may think. You need to start behaving like Billy in Midnight Express. Start going around the column in the opposite direction. Just like the nutters in the film who didn't like what Billy was doing, so the nutters in Westmonster will start shitting bricks. Gordon Brown is facing demands to make Lord Mandelson foreign secretary in a row that risks tearing apart his government.

One of the NHS websites proudly claims that the NHS is the 'best health service in the world'. The much vaunted reduction to 18 weeks waiting time for treatment - 18 days in France would cause a near riot - is apparently all the fault of the patients.

For some patients to start treatment within 18 weeks would be inconvenient or clinically inappropriate.

Inconvenient for whom is not explained. Not for the man with a malignant tumour, I'll bet.

We have a health service which proudly proclaims its advances in condemning the dying to a minimum of work on the part of medical staff - the Liverpool Pathway.

We have secret courts that decide whether young and old are to live or die based on the 'futility' - or not - of their lives.

We have Hospitals that dole out food over a year past its sell by date based on 'best value' practices.

We have the National Institute for Health and Clinical Excellence saying that £30,000 a year is the limit that they put on the cost of saving a life.

But, we have the Department for International Development bunging the Sierra Leone Government a magnificent £34 Million pounds to ensure free health care 'for pregnant and lactating women' in Sierre Leone.

Are Sierra Leone lives less futile than British lives, do they represent better value? To whom?

BREAKING: Leaked UK government plan to create "Pirate Finder General" with power to appoint militias, create laws

A source close to the British Labour Government has just given me reliable information about the most radical copyright proposal I've ever seen.

Secretary of State Peter Mandelson is planning to introduce changes to the Digital Economy Bill now under debate in Parliament. These changes will give the Secretary of State (Mandelson -- or his successor in the next government) the power to make "secondary legislation" (legislation that is passed without debate) to amend the provisions of Copyright, Designs and Patents Act (1988).

What that means is that an unelected official would have the power to do anything without Parliamentary oversight or debate, provided it was done in the name of protecting copyright. Mandelson elaborates on this, giving three reasons for his proposal:

1. The Secretary of State would get the power to create new remedies for online infringements (for example, he could create jail terms for file-sharing, or create a "three-strikes" plan that costs entire families their internet access if any member stands accused of infringement)

2. The Secretary of State would get the power to create procedures to "confer rights" for the purposes of protecting rightsholders from online infringement. (for example, record labels and movie studios can be given investigative and enforcement powers that allow them to compel ISPs, libraries, companies and schools to turn over personal information about Internet users, and to order those companies to disconnect users, remove websites, block URLs, etc)

3. The Secretary of State would get the power to "impose such duties, powers or functions on any person as may be specified in connection with facilitating online infringement" (for example, ISPs could be forced to spy on their users, or to have copyright lawyers examine every piece of user-generated content before it goes live; also, copyright "militias" can be formed with the power to police copyright on the web)

Mandelson is also gunning for sites like YouSendIt and other services that allow you to easily transfer large files back and forth privately (I use YouSendIt to send podcasts back and forth to my sound-editor during production). Like Viacom, he's hoping to force them to turn off any feature that allows users to keep their uploads private, since privacy flags can be used to keep infringing files out of sight of copyright enforcers.

This is as bad as I've ever seen, folks. It's a declaration of war by the entertainment industry and their captured regulators against the principles of free speech, privacy, freedom of assembly, the presumption of innocence, and competition.

This proposal creates the office of Pirate-Finder General, with unlimited power to appoint militias who are above the law, who can pry into every corner of your life, who can disconnect you from your family, job, education and government, who can fine you or put you in jail.

More to follow, I'm sure, once Open Rights Group and other activist organizations get working on this. In the meantime, tell every Briton you know. If we can't stop this, it's beginning of the end for the net in Britain.
