Although similar protections<br>have been in place in the City of Pittsburgh for over 20 years, this<br>week's ordinance marks the first time these protections will be<br>extended to County borders. This is a historic step forward and true<br>cause for celebration.<p>The bill, which passed by an 8-6 vote, established a county-wide Human<br>Relations Commission that will be responsible for investigating claims<br>of discrimination. The ordinance is set to become law once it is<br>signed by County Executive Dan Onorato on Thursday, June 9, 2009.<p>The Coalition for the Allegheny County Human Relations Ordinance,<br>along with many other individuals, worked with County Executive Dan<br>Onorato and County Council this week to modify the bill after a<br>previous amendment was found to include an unreasonably broad loophole<br>per religious exemptions. The final amended language, while explicitly<br>stating an exemption by religious organizations, sidesteps the issue<br>of organizations that receive tax-payer funds. This language allows<br>for further dialogue on this particular issue.<p>LGBT rights organizations from across the state also praised the<br>Ordinance for its inclusive protection of transgender individuals.<br>The Coalition for the Allegheny County Human Relations Ordinance<br>called the new legislation "the highest standard of trans-inclusive<br>language in the Commonwealth." The county is now the fifteenth<br>municipality in the state to grant protection to LGBT individuals.<p>For the past year, our community has worked with determination and<br>persistence to bring this day about. Throughout this process, we have<br>formed important relationships, and the unique collaboration between<br>LGBT organizations, allies, grassroots activists, and public officials<br>will continue to serve as a model of effective partnership. We thank<br>all those involved, particularly Council Members Burn, DeFazio,<br>Cleary, Fitzgerald, Macey, Martoni, Robinson and, of course, the prime<br>sponsor Amanda Green. We also thank County Executive Dan Onorato and<br>his staff for lobbying in support of the Ordinance in recent weeks.<p>While the individuals and groups involved in this effort are numerous,<br>several groups and grassroots outlets offered frequent input into the<br>process in recent days: Speakers at the Council meeting, the<br>Pennsylvania Human Relations Commission, the Pittsburgh Human<br>Relations Commission, ACLU-PA, Delta Foundation of Pittsburgh,<br>Equality Advocates PA, GLCC Pittsburgh, GLEC Group, New Voices<br>Pittsburgh-Women of Color for Reproductive Justice, One Church<br>Pittsburgh, Pennsylvania NOW, PERSAD Center, Steel-City Stonewall<br>Democrats, Trans Working Group, Women's Law Project, Women & Girl's<br>Foundation of PA. Council and the County<br>Executive are expected to give it their final approval.<p>The ordinance will establish a Human Relations Commission and prohibit<br>most discrimination in employment, housing and public accommodation<br>based on many characteristics including sexual orientation, gender<br>identity and expression. Similar protections have been in place in the<br>City of Pittsburgh for over 20 years. Now most of those protections<br>will be extended to the County borders.<p>As many of you are aware, three County Councilman introduced an<br>amendment at the Council's Government Reform Committee. This<br>amendment is not supported by the coalition. On Monday, Coalition<br>representatives met with County Executive Onorato's staff to<br>strategize and find an appropriate solution.<p>The Coalition members were able to suggest wording similar to what has<br>been in effect in Philadelphia for many decades. This amended<br>amendment would exempt Sectarian, Religious, Charitable and Fraternal<br>organization from complying with the Human Relations Ordinance. This<br>amended amendment would also not require religious organizations to<br>register with this Human Relations Commission and in doing so receive<br>the right to discriminate. We would like to reiterate that this<br>solution is exactly the same as what is currently in place in<br>Philadelphia. While the coalition does feel this is a much better<br>solution, this would still allow County dollars to be spent on<br>organizations that are exempt. This however does not prevent the<br>County from mandating in contracts that these types of organizations<br>must comply with the Human Relations Act. These types of mandates in<br>contracts are current practice in Philadelphia.<p>This ordinance meets the highest standard in trans-inclusive language<br>in the Commonwealth. That being said we believe that we should<br>SUPPORT amending the amendment as proposed by the coalition and<br>PASSING County Council bill 4201-08. Throughout<br>the year, community leaders have worked with Councilperson Green to<br>shape the bill and many community members have voiced support for it.<p>The ordinance will establish a Human Relations Commission and prohibit<br>most discrimination in employment, housing and public accommodation<br>based on many characteristics including sexual orientation, gender<br>identity and expression. Similar protections have been in place in the<br>City of Pittsburgh for over 20 years. Now most of those protections<br>will be extended to the County borders.<p>The bill is not perfect. We have major concerns about an amendment<br>(Section 215.31. "Definitions." Sub-section H. Sub-paragraph 1) made<br>to the bill in the Council's Government Reform Committee (over the<br>objections of Councilperson Green) on June 18. -This amendment allows<br>religious organizations to discriminate, even if they receive County<br>government funding. This is not allowed in the Pittsburgh ordinance<br>and will make the protections of the Allegheny County Human Relations<br>Ordinance weaker than the Pittsburgh ordinance.<p>-It allows for discrimination by religious organizations not only on<br>the basis of sexual orientation and gender identity, but also on the<br>basis of race, color, national origin, sex, disability, age, etc.<p>-The amendment sets up an inane and unconstitutional requirement that<br>religious organizations document their homophobia and transphobia in<br>order to be exempt from the ordinance. So, religious organizations<br>that are BGLT friendly would have to comply with the ordinance while<br>the homophobic organizations can discriminate against anybody for any<br>reason.<p>-This amendment is potentially a harmful model for statewide non-<br>discrimination legislation.<p>Some of us who are familiar with the legislation feel the amendment<br>makes the entire bill not worth having for the reasons listed above.<br>On the other hand, some of us feel that the protections the bill<br>offers are substantial and that the bill is at least a step in the<br>right direction. And there is also the strong possibility of striking<br>some of the problematic portions of the legislation in court.<br>Representatives from our working group are meeting with County<br>Executive Onorato's staff to try to get rid of as much of this bad<br>language as possible prior to approval of the ordinance. SchedulePride Week 2009!<p>This year, we pause to remember the Stonewall Riots, which took place<br>on June 28, 1969 and has been long recognized as the start of the<br>modern Gay Rights Movement in the US. A group of individuals had the<br>courage to stop the harassment, begin to speak up and fight back. We<br>have come a long way in 40 years, but we all know that the fight for<br>true equality and basic protection under the law still has a long way<br>to go!<p>The theme of this year's Pride Week is "Your Rights, Our Rights, Human<br>Rights".
