The National Arbitration Forum panelist found that the domain names Webkinzz.com, Webkniz.com, and Weblinz.com were registered by renowned <A href="http://www.domainercomplainer.info/">cybersquatter</A> Texas International Property Associates.<BR><BR>The Panel found that the three disputed domain names are confusingly similar to the WEBKINZ mark all with slight typographical variations. The Panel went on to find that erroneous variations of Complainant's WEBKINZ mark are typical of typosquatting -- using a website to profit from the mistyping of someone else's trademark -- and prove the Respondent's lack of rights and legitimate interests. Because the Respondent used the websites to generate revenue through pay-per-click advertisements it was found that the <A href="http://www.web-domain-name-registration.info/">domain names were registered</A> and used in bad faith. Ganz proved all three elements required of the ICANN Policy and was granted the rights to Webkinzz.com, Webkniz.com, and Weblinz.com on July 19, 2007.<BR><BR><STRONG>ChocolateKiss.com</STRONG><BR>The Hershey Company, one of the largest chocolate production facilities in the world, <A href="http://www.lawyermesothelioma.us/">filed a claim</A> electronically on April 20, 2007 against Respondent R. Reaves. Complainant, the Hershey Company, requested that the dispute over ChocolateKiss.com be handled by a panel of three National Arbitration Forum arbitrators.<BR><BR>The Panel found that ChocolateKiss.com was confusingly similar to Complainant's KISSES mark, as the term "chocolate" was simply descriptive of Complainant's business and the combination of the terms was calculated to suggest the involvement of Complainant. The Panel also found that Respondent lacked rights or legitimate interests because the content displayed on Respondent's website gave the erroneous impression that it was affiliated with Complainant. Finally, the Panel found that Respondent registered and was <A href="http://www.domainercomplainer.net/">using the domain name in bad faith</A> because Respondent was using this implied affiliation with Complainant to attract users to its website for commercial gain. These two groups could be referred to as bottom-liners (not to be confused with <A href="http://www.domainercomplainer.com/">bottom-feeders</A>), and content purists (read: <A href="http://www.unguarded.us/">hopeless idealists</A>).<BR><BR>The bottom-liner views the proliferation of <A href="http://www.intextication.com/">in-text advertising</A>, or in-textification, as a natural progression of the <A href="http://www.agencycatalog.com/">ad-supported</A> Internet universe. In this world, Web sites exist to <A href="http://www.makemoneyinternet.cn/">generate revenue</A>, or at least that's what their job description says. The added value of the related content provides the visitor with a compelling reason to click on the <A href="http://www.sknillinks.com/">highlighted link</A> and view the contents of the in-text window, including the ad.<BR><BR>The result is an <A href="http://www.concealment.us/">in-text solution</A> that could appease both the bottom-liners and the <A href="http://www.contentguarder.com/">content purists</A>. The ad unit generates revenue and the <A href="http://www.contentseek.com/">related content</A> adds value to the overall user experience, or at least that is the intended goal.<BR><BR>While this solution may not completely bridge the gap between salespeople and journalists, maybe the two sides could view it as a small plot of common ground in the <A href="http://www.trademarkissues.biz/">battle</A> for Web page real estate. ICANN granted Verisign a contract that has no ability to end and has price increases that are baked into the contract forever. The new hope is an underdog watch group known as the "Coalition for ICANN Transparency, Inc." (CFIT) that has filed a motion to declare the Verisign-ICANN contract a monopoly according to the Sherman Act. This is the third time they have brought the suit against ICANN and Verisign. The head lawyer on the case is Bret Fausett a sharp ICANN observer. There is not much hope that CFIT will win against such a titan, the other side has been able to get the case dismissed two times before, however I think the case is very strong and very accurate. The reason CFIT will face an up hill battle is because ICANN and Verisign have a lot of money to fight the lawsuit. Verisign has an extra $20 Million a year thanks to the contract and ICANN and VeriSign baked in a new ICANN fee that would be assessed on VeriSign and passed on to the registrars and ultimately passed on to consumers. This fee would result in excess of approximately $150 million dollars to ICANN over the contracted period of time and would be an end run around the existing ICANN budget approval process. The Court has already recognized that to eliminate competitive bidding violates the Sherman Act. The CEO of Tucows went on public record that they could provide DotCom registry services for $2 a name, which prompted the CEO of GoDaddy, the world's largest registrar, to say that GoDaddy could do it for a dollar a name. Meanwhile the Chinese Registry CNNIC has figured out how to do provide global registry services for 13 cents a name per year.
