A woman is set to testify at R. Kelly’s upcoming child pornography trial that she had a three-way sexual encounter with Kelly and the allegedly underage girl shown in the video at the heart of the case.

The 41-year-old R&B superstar is accused of videotaping himself having sex with a girl estimated to be 13 or 14. He has pleaded not guilty. Jury selection is set to begin Friday.

As part of the case, prosecutors claim to have identified the girl in the videotape. This alleged victim is now in her 20s. Kelly’s lawyers plan to argue — and the alleged victim will reportedly testify — that she is not the girl in the tape.

But the prosecution’s new witness could undermine that defense, since she will identify the girl, sources with knowledge of the matter told the Chicago Sun-Times. In addition, the witness is expected to say the girl was underage at the time of their encounter.

“She was involved in a threesome with [the girl] and R. Kelly,” one source said.

Prosecutors and defense lawyers declined to comment, citing a gag order in the case.

The witness’ testimony was among the evidence discussed in secret hearings last month before Judge Vincent Gaughan. The judge, citing concerns about pretrial publicity, closed the hearings to the public and put multiple court filings under seal.

The Sun-Times, Chicago Tribune and the Associated Press filed a legal challenge to unseal the proceedings and documents, as did WBEZ-FM (91.5). Those challenges are still pending.

At one of the closed hearings, Gaughan ruled in the prosecution’s favor and said testimony about the threesome would be admissible at trial, sources said.

In the past, Kelly has faced civil lawsuits from underage girls accusing the singer of inducing them to have sex with him and a second woman. The title track of his 2007 album “Double Up” refers to a man arranging a ménage a trois.

The Kelly case has been pending since June 2002, when the R&B star was indicted on multiple counts of child pornography. It has been delayed repeatedly, but lawyers and courthouse personnel expect it will finally begin May 9.

The indictment followed a more than three-year Chicago Police investigation. The Sun-Times reported on the investigation in a December 2000 story about Kelly’s pattern of pursuing underage girls for sex.

The big break in the case came in February 2002, when a videotape was sent anonymously to the Sun-Times. It shows a man alleged to be Kelly engaging in various sex acts — including urinating on the underage girl. The tape was turned over to the Chicago Police.

Cook County State’s Attorney Richard Devine impaneled a grand jury that heard dozens of witnesses identify Kelly and the teen on the tape and confirm that they had a sexual relationship.

The tape was authenticated by the FBI, which determined it could not have been a forgery.

Kelly, of Olympia Fields, faces up to 15 years in prison if convicted.

Florida police are investigating the apparent suicide of the so-called D.C. Madam, who was found dead in the Florida mobile home of the madam's mother Thursday.

The madam, Deborah Jeane Palfrey, was recently convicted on federal charges stemming from operating a prostitution service in the Washington, D.C. area with a number of high-profile clients. She was scheduled to be sentenced July 24.

Palfrey told ABC News last year she would never return to prison, after serving time in the 1990s for other prostitution-related charges. "I sure as heck am not going to be going to federal prison for one day, let alone, you know, four to eight years."

Palfrey's 76-year-old mother, Blanche, found her daughter's body in a shed to the side of her home, according to police. Palfrey had hung herself with nylon rope from a beam in the shed's ceiling, the police said.

Blanche had looked in the shed after awaking from a nap to discover outside her house a tricycle she normally stored there, according to police. She called 911.

Hand-written notes were found near Palfrey's body which "describes the victim's intention to take her life," the police statement read.

Local police responding to a call late Thursday morning discovered the woman's body in a storage shed to the side of the home, according to a statement released by the Tarpon Springs, Fla. Police. Foul play does not appear to have been involved, according to the police. They did not immediately release the contents of the notes.

A jury in Washington, D.C. found Palfrey guilty of money laundering, racketeering and using the mail for illegal purposes in connection with a prostitution ring she ran from 1993 to 2006.

Several well-known men were reportedly clients of her service, including former U.S. Agency for International Development chief Randall Tobias and Sen. David Vitter, R-La. Neither man was among the clients called to testify at Palfrey's trial. Neither immediately responded to requests for comment.

In an interview last year, Palfrey vowed to fight the federal prosecutors who brought the charges against her. "They just destroy you on every level, financially, emotionally, psychologically," she said, but still she refused to accept any deal they offered.

In the interview, she contrasted herself with Brandy Britton, a woman who once worked as a prostitute -- apparently for a time with Palfrey's service, Palfrey's phone records reflected -- who committed suicide after charges were brought against her.

"She committed suicide because of the police and the prosecutor," Palfrey said then, arguing that prostitution should be legal because the prosecutions are more harmful than the business itself. "They, they had to push it, in the name of justice. I'd like to know what justice they're talking about."

"Eleven Tips on Getting More Efficiency Out of Women Employees: There's no longer any question whether transit companies should hire women for jobs formerly held by men. The draft and manpower shortage has settled that point. The important things now are to select the most efficient women available and how to use them to the best advantage.

Here are eleven helpful tips on the subject from Western Properties:

1. Pick young married women. They usually have more of a sense of responsibility than their unmarried sisters, they're less likely to be flirtatious, they need the work or they wouldn't be doing it, they still have the pep and interest to work hard and to deal with the public efficiently.

2. When you have to use older women, try to get ones who have worked outside the home at some time in their lives. Older women who have never contacted the public have a hard time adapting themselves and are inclined to be cantankerous and fussy. It's always well to impress upon older women the importance of friendliness and courtesy.

3. General experience indicates that "husky" girls - those who are just a little on the heavy side - are more even tempered and efficient than their underweight sisters.

4. Retain a physician to give each woman you hire a special physical examination - one covering female conditions. This step not only protects the property against the possibilities of lawsuit, but reveals whether the employee-to-be has any female weaknesses which would make her mentally or physically unfit for the job.

6. Give the female employee a definite day-long schedule of duties so that they'll keep busy without bothering the management for instructions every few minutes. Numerous properties say that women make excellent workers when they have their jobs cut out for them, but that they lack initiative in finding work themselves.

7. Whenever possible, let the inside employee change from one job to another at some time during the day. Women are inclined to be less nervous and happier with change.

8. Give every girl an adequate number of rest periods during the day. You have to make some allowances for feminine psychology. A girl has more confidence and is more efficient if she can keep her hair tidied, apply fresh lipstick and wash her hands several times a day.

9. Be tactful when issuing instructions or in making criticisms. Women are often sensitive; they can't shrug off harsh words the way men do. Never ridicule a woman - it breaks her spirit and cuts off her efficiency.

10. Be reasonably considerate about using strong language around women. Even though a girl's husband or father may swear vociferously, she'll grow to dislike a place of business where she hears too much of this.
11. Get enough size variety in operator's uniforms so that each girl can have a proper fit. This point can't be stressed too much in keeping women happy."

Paras got a lot of breaks. First she didn’t show up for court last July of 2007, so a $50,000 bench warrant was issued, the the warrant was recalled after she showed up finally in February 2008. Even luckier is the fact her record will be expunged once she completes the Asian American Drug Abuse Program she enrolled in.

News of Paras conviction didn’t even surface until today. If she successfully stays off drugs she’ll be even luckier.

PROVIDENCE, R.I. - Gay couples had to struggle mightily to win the right to marry or form civil unions. Now, some are finding that breaking up is hard to do, too.

In Rhode Island, for example, the state's top court ruled in December that gays married in neighboring Massachusetts can't get divorced here because lawmakers have never defined marriage as anything but a union between a man and woman. In Missouri, a judge is deciding whether a lesbian married in Massachusetts can get an annulment.

"We all know people who have gone through divorces. At the end of that long and unhappy period, they have been able to breathe a sigh of relief," said Cassandra Ormiston of Rhode Island, who is splitting from her wife, Margaret Chambers. But "I do not see that on my horizon, that sigh of relief that it's over."

Over the past four years, Massachusetts has been the only state where gay marriage is legal, while nine other states allow gay couples to enter into civil unions or domestic partnerships that offer many of the rights and privileges of marriage. The vast majority of these unions require court action to dissolve.

Gay couples who still live in the state where they got hitched can split up with little difficulty; the laws in those states include divorce or dissolution procedures for same-sex couples. But gay couples who have moved to another state are running into trouble.

Massachusetts, at least early on, let out-of-state gay couples get married there practically for the asking. But the rules governing divorce are stricter. Out-of-state couples could go back to Massachusetts to get divorced, but they would have to live there for a year to establish residency first.

"I find that an unbelievably unfair burden. I own a home here, my friends are here, my life is here," said Ormiston, who is resigned to moving to Massachusetts for a year.

It's not clear how many gay couples have sought a divorce.

In Massachusetts, where more than 10,000 same-sex couples have married since 2004, the courts don't keep a breakdown of gay and heterosexual divorces. But Joyce Kauffman, a member of the Massachusetts Lesbian and Gay Bar Association, said probably more than 100 gay divorces have been granted in Massachusetts, and possibly many more.

She said she suspects the divorce rate among gays is lower than that among heterosexual couples, because many of the same-sex couples who got married in Massachusetts had probably been together for years.

Vermont has dissolved 2 percent of the 8,666 civil unions performed there since they became legal in 2000. Those numbers do not include couples who split up in another state.

Chambers and Ormiston wed in Massachusetts in 2004 and filed for divorce in 2006. But the Rhode Island Supreme Court last winter refused to recognize their marriage. That means at least 90 other gay couples from the state who got married in Massachusetts would not be able to divorce in Rhode Island if they wanted to.

Getting a divorce could prove toughest in some of the 40 states that have explicitly banned or limited same-sex unions, lawyers say.

In Missouri, which banned gay marriage in 2001, a conservative lawmaker has urged a judge not to grant an annulment to a lesbian married in Massachusetts.

Oregon started allowing gay couples to form domestic partnerships this year. But to prevent problems similar to those in Massachusetts, lawmakers added a provision that allows couples to dissolve their partnerships in Oregon even if they have moved out of state.

The measure is modeled on California's domestic partnership system and represents a major change in the usual rules governing jurisdiction.

"It's a novel concept in the family law area," said Oregon lawyer Beth Allen, who works with Basic Rights Oregon, a gay rights group.

Same-sex couples can form civil unions in Vermont, Connecticut, New Jersey and New Hampshire. They can enter into domestic partnerships or receive similar benefits in California, Oregon, Maine, Washington, Hawaii and the District of Columbia.

New York does not permit gay marriage, but a judge there has allowed a lesbian married in Canada to seek a divorce. In 2005, Iowa's Supreme Court upheld the breakup of a lesbian couple who entered into a civil union in Vermont.

Some Rhode Island lawmakers are pushing to legalize gay divorce. But Gov. Don Carcieri, a Republican who opposes gay marriage, is against the idea. So are church leaders in the heavily Roman Catholic state.

"Whatever name they want to give to it, it is a recognition of same-sex unions," said the Rev. Bernard Healey, a lobbyist for Catholic Diocese of Providence.

NEW YORK (AP)—A construction worker’s bid to curse the New York Yankees by planting a Boston Red Sox jersey in their new stadium was foiled Sunday when the home team removed the offending shirt from its burial spot.

After locating the shirt in a service corridor behind what will be a restaurant in the new Yankee Stadium, construction workers jackhammered through the concrete Sunday and pulled it out.

The team said it learned that a Sox-rooting construction worker had buried a shirt in the new Bronx stadium, which will open next year across the street from the current ballpark, from a report in the New York Post on Friday.

Yankees President Randy Levine said team officials at first considered leaving the shirt where it was.

“The first thought was, you know, it’s never a good thing to be buried in cement when you’re in New York,” Levine said. “But then we decided, why reward somebody who had really bad motives and was trying to do a really bad thing?”

On Saturday, construction workers who remembered the employee, Gino Castignoli, phoned in tips about the shirt’s location.

“We had anonymous people come tell us where it was, and we were able to find it,” said Frank Gramarossa, a project executive with Turner Construction, the general contractor on the site.

It took about five hours of drilling Saturday to locate the shirt under 2 feet of concrete, he said.

On Sunday, Levine and Yankees CEO Lonn Trost watched as Gramarossa and foreman Rich Corrado finished the job and pulled the shirt from the rubble.

In shreds from the jackhammers, the shirt still bore the letters “Red Sox” on the front. It was a David Ortiz jersey, No. 34.

Trost said the Yankees had discussed possible criminal charges against Castignoli with the district attorney’s office.

“We will take appropriate action since fortunately we do know the name of the individual,” he said.

A woman who answered the phone at Castignoli’s home in the Bronx on Sunday said he was not there.

A spokesman for Bronx District Attorney Robert Johnson said Sunday he did not know whether any criminal charges might apply.

Levine said the shirt would be cleaned up and sent to the Jimmy Fund, a charity affiliated with Boston’s Dana-Farber Cancer Institute.

“Hopefully the Jimmy Fund will auction it off and we’ll take the act that was a very, very bad act and turn it into something beautiful,” he said.

RALEIGH, N.C. - A Marine wanted in the brutal slaying of a pregnant colleague who had accused him of rape was arrested in Mexico, the FBI said late Thursday. The FBI's office in Charlotte said special agents and Mexican authorities arrested Marine Cpl. Cesar Laurean, who is charged with murder in the death of Marine Lance Cpl. Maria Lauterbach. The FBI did not say when or where in Mexico Laurean was arrested, but said he is awaiting extradition to the U.S.

"Laurean's swift arrest in Mexico was due to the diligence and dedication of the Mexican government and our law enforcement partners," Nathan Gray, the special agent in charge of the FBI's Charlotte office, said in a statement.

"This was truly an international effort, and we will do all we can to ensure Laurean is brought back to Onslow County (N.C.) as quickly as possible to answer the charges against him."

Onslow County District Attorney Dewey Hudson said after Laurean's arrest was announced that "it could be a year or two" before authorities can bring the personnel clerk back to North Carolina if he decides to fight the extradition process.

"The extradition process is one where you have a right to appeal," Hudson told The Associated Press. "I have no idea whether he would waive extradition."

In the end, Remy Ma couldn't beat the rap.

The Grammy-nominated rapper (real name: Remy Smith) was convicted Thursday of shooting a woman outside a Manhattan nightclub in July 2007.

She faces up to 25 years in prison when she is sentenced April 23.

Ma wiped tears from her eyes as the verdict was read and wept openly as she was led from the courtroom in handcuffs. The judge denied a request from her attorney, Ivan Fisher, to have her released on bail until her sentencing.

Her defense team had conceded that Ma, 26, fired a shot at a friend whom she suspected of stealing $3,000 from her but claimed that it was an accident.

In their version of events, Ma and her victim, Makeda Barnes Joseph, were struggling over Joseph's purse after Ma demanded to look inside for the missing money and Joseph refused. Amid the tussle, Ma's gun supposedly went off accidentally, launching a bullet into Joseph's gut.

However, Assistant District Attorney Michael McIntosh said that Ma "took every step you had to take to shoot somebody," including loading her illegal .45-caliber automatic with hollow point bullets and using both hands to cock the weapon.

Joseph survived the shooting, but required three operations on her abdomen and was hospitalized for several weeks, according to her testimony.

Ma was found guilty of assault, weapon possession and attempted coercion. She was acquitted of additional charges of witness tampering and gang assault, stemming from the beating of the boyfriend of a witness who ultimately testified against her.

Her attorney said he plans to appeal the ruling.
