Accompanying the activists was Mumbai North MP Sanjay Nirupam, who the activists feel is convinced that Right to Information (RTI) Act 2005 was not being properly implemented in Maharashtra.<br /><br />Says Mohammed Afzal, "There should be a CCTV or digital video recorders to record all meetings, so that a copy of it can be made available to the applicant or any citizen on payment of a small fee, say Rs 50." In fact, Afzal also happens to be one of the 11 activists that Mumbai Police arrested on the evening of May 19 and jailed for two days for allegedly trespassing and rioting at the office of the Chief State Information Commissioner (SIC) Suresh Joshi. Adds Afzal, "Had there been a recording of that meeting, such gross injustice would not have been meted out to 11 activists, who have been crusading to strengthen the RTI Act. If there was a CCTV used, applicants, activists and even the bureaucrats would feel safer, as every action can be put on record, when required. No Information Commissioner should have an objection with this suggestion until and unless he has something to hide."<br /><br />States Krishnaraj Rao, "We are happy that the Chief Minister, State Govt. and even the Central Government are showing keenness to ensure proper implementation of the RTI Act, which is a powerful tool in the common man's hand. The CM has assured us that he will look into the matter, which is encouraging. The crusade we have initiated shall not stop till we ensure proper implementation of RTI Act, and stop the bureaucratic abuse of this important Act."<br /><br />Asserts MP Sanjay Niruapm, "It's a priority for our Government to correct the faulty implementation of RTI Act. We have taken up the issue with the CM, along with these activists, and will keep following it up at the highest level if required."<br /><br />SOME IMPORTANT POINTS IN THE CHARTER<br /><br />Maharashtra Government must direct every Information Commissioner (IC) to serve show-cause notice to Public Information Officer (PIO) along with notice of hearing. The purpose of hearing is to determine whether the PIO and the public authority acted diligently under the RTI Act and if not, what penalty and disciplinary action is to be imposed. The purpose of hearing is not to enter into discussions, negotiations and grievance redressal.<br /><br />· Whatever transpired during the hearing between the Information Commissioner, Public Information Officer, Appellant authority and the applicant -- it has been seen many a times that the final order does not reflect the hearing proceedings. After a lot of resistance the revenue department parted with the records. It was an eyeopener for the deputy collector of Viramgam.<br /><br />A local talati of Dethraj taluka, in Vasna Saniyar village helped miscreants sharing the same 'Champaklal' surname, get their names included as inheritors in revenue records of Shah. These miscreants were then provided farmer's certificate. The deputy collector noticed that the talati had used the same modus operandi in records of other people, alerted the district development officer (DDO) of the scam in 2007 and requested an enquiry.</div><div class="Normal" style="font-size: 12px; color: rgb(0, 0, 0); margin-bottom: 12pt; ">The matter is hushed up and the DDO is yet to react to the letter. "People owning land or any sort of property should file RTI to ensure that their records are straight--almost every year. This would ensure that there is no meddling in the revenue records. Such cases happen in the case of large land owners. These miscreants just need a farmer's certificate to start with, then buy agriculture land in surrounding areas.</div><div class="Normal" style="font-size: 12px; color: rgb(0, 0, 0); margin-bottom: 12pt; ">After buying huge tracts they will forge a "power of attorney" document and enter their names as inheritors and even sell of your land," says Champaklal. The revenue department is yet to institute an inquiry into the incident after Shah's RTI application. The intimation of this was given to the Appellant. This was confirmed in the appeal and it has been specifically mentioned that if the Appellant does not receive the information from the Society a complaint to that effect should be made to the Deputy Registrar. During argument the Appellant insisted that he should get the information either from the Deputy Registrar’s office or from the Federation.<o:p></o:p></span></p> <p style="margin:0in;margin-bottom:.0001pt;background:white"><span style="font-size:10.0pt;font-family:Arial;color:red">Under RTI Act, 2005 if the information is held by another public authority the public authority to which such application is made should transfer the said application to the concerned public authority. In his case the application has been sent by the PIO of Deputy Registrar’s office to the concerned Cooperative Society with the direction to give the information to the Appellant i.e. as per the provisions of the Act. The Act gives the right to the Appellant to get the information but he cannot insist that I must get the information from a particular office. In the instant case if he has not received the information from his Coop. Enquiry into this complaint was conducted on 31.8.2007 and 1.9.2007 when Mr. Kewal Semlani on behalf of Mr. Julio F. Rebeiro and Mr. Tidke, Dy. Collector and Shri R.R.Tripathi, Assistant PIO, SRA were present. The Assistant PIO explaining the delay has stated that the information sought through this application was voluminous more than 300 number of documents and several number of approved plans and they had taken considerable time to take out xerox and prepare the set. Moreover, it has been pointed by the Asst. PIO that criminal investigations are in progress by the Economic Offence Wing of CID in respect of this case, hence the information cannot be furnished u/s 8(1)(h) of RTI Act, 2005 and, therefore, though the documents required by the Appellant were kept ready, were not issued. However, he ought to have informed the applicant about the possible delay in furnishing the desired information. In this case, the PIO ought to have sought the guidance from the CEO, SRA as regards whether such information should be given or not. In this case, however, he simply did not take any initiative and put-forth this argument only at the time of hearing before this Commission. Since the information has been kept ready, it should be immediately given to the Complainant without charging any fee since there has been delay on the part of the PIO in giving the information. Readers will remember that the very first report of the Second Administrative Reforms Commission (ARC) focused on strengthening the RTI Act describing it as the 'master key to good governance'. GOI has made public its decisions on all the recommendations made by ARC through the website of the Department of Administrative Reforms and Public Grievances</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: small;">[http://darpg.nic.in/arpg-website/Right%20to%20Information%20-%20Master%20Key%20to%20Good%20Governance.pdf]. </span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><span class="Apple-style-span" style="color:#009900;"><b>Given below is a list of important and practical recommendations of the ARC rejected by GOI:</b></span></span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><b><span class="Apple-style-span" style="color:#FF0000;">Official Secrets Act to stay</span>: </b>The ARC had recommended and rightly so, the repeal of the Official Secrets Act (OSA) and incorporation of some of its anti-espionage provisions in the National Security Act. GOI has rejected this recommendation on the ground that the offences under the OSA are substantive offences and cannot be placed in what is essentially a preventive detention law. This argument cannot be flawed but the anti-espionage provisions may be placed in the Indian Penal Code without much difficulty. There is no reason for treating OSA as a treasured heirloom that must be preserved for posterity. </span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><b><span class="Apple-style-span" style="color:#FF0000;">Oath of Secrecy to stay: </span></b>The ARC had recommended that the oath of secrecy administered to Ministers be replaced with an oath of transparency. GOI has rejected this recommendation on the ground that Ministers will still be expected to maintain secrets in the RTI era. So even if Parliament signaled its will to change the underlying paradigm of governance from secrecy to openness by passing the RTI Act GOI wants its Ministers to be sworn to secrecy- the numerous calculated leaks of government information notwithstanding- praan jaaye par vachan na jaaye.</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><b><span class="Apple-style-span" style="color:#FF0000;">Composition of the selection committee for Information Commissions remains unchanged:</span></b> The ARC had taken note of the monopoly enjoyed by the government on the committee mandated with the selection of members of Information Commissions. It had recommended that the Cabinet Minister on the committee be replaced by the Chief Justice of the Supreme Court at the Central level and the Chief Justice of the respective High Courts at the level of the States. GOI has rejected this decision stating that the existing arrangements have no infirmity. </span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><b><span class="Apple-style-span" style="color:#FF0000;">Refusal to end the bureaucratic domination of Information Commissions:</span></b> A vast majority of Information Commissioners appointed at the Centre and in the States are officers who retired from senior positions in government. Individuals who swore by the OSA were made champions of transparency overnight. Recognising this anomaly, the ARC recommended change in the RTI Rules to ensure that at least 50% of the Commissioners are drawn from fields of expertise outside the bureaucracy. GOI has rejected this recommendation merely stating that the Act provides for the appointment of eminent persons from different fields of expertise. Apparently the necessity of giving detailed reasons for a decision of rejection applies only to the domain of PIOs and appellate authorities, and not to GOI as a whole.</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><span class="Apple-style-span" style="color:#FF0000;"><b>Refusal to print suo motu disclosure documents:</b></span> Recognising the fact that less than 5% people in India are internet literate, the ARC had recommended printing of proactive disclosure documents of public authorities periodically in order to make them easily accessible to people. GOI has rejected this recommendation on the ground that this would be an expensive affair to be undertaken periodically. Instead public authorities would upload their proactive disclosure documents on the RTI portal set up by GOI. No mention is made of the fact that the existing disclosures are not regularly updated on this portal and in any case they are inaccessible to non-english-speaking and internet-illiterate citizens.</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: small;"> <span class="Apple-style-span" style="color:#FF0000;"><b>Shortchanging records management:</b></span> Recognising the poor state of management of public records all over India, the ARC had recommended the setting up of a well networked series of public records offices at the Central and state level. It had also recommended setting aside 1% of the budget of flagship programmes of each ministry for this purpose. GOI has rejected the 'public records office' idea stating that the Public Records Act and the National Archives would be adequately strengthened for this purpose. The fact that the Public Records Act does not cover the States has been conveniently forgotten. GOI has rejected the funding idea also on the ground that no separate allocation needs to me made for improving records maintenance, the same could be met under the existing budgetary provisions. Behind this rejection there is little realisation of the fact that records management is an area of least concern in several public authorities. The question that begs consideration is how many public aurhorities take records management seriously to make budgetary provisions for this item of expenditure every year as it is a continuous exercise. The provision about records management found in the RTI Act has only enthused many public authorities to hasten the destruction of records that are past their stipulated lifespan.</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: small;"> <b><span class="Apple-style-span" style="color:#FF0000;">Refusal to set up single window system:</span></b> Based on the strong backing from civil society the ARC had recommended that a single window system manned by Assistant PIOs be set up at the district level for receiving applications from citizens. The obvious purpose was to create convenience for citizens who would otherwise have to go through considerable difficulty identifying the correct PIO. GOI has rejected this recommendation stating that complaints would pertain to different areas and time would be lost in distributing them to the relevant offices. The possibility of linking up with the State Governments for setting up such facilities has been ignored. The example of Nawanshahr district in Punjab where such a system was functional has been ignored.</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><b><span class="Apple-style-span" style="color:#FF0000;">Refusal to effectively monitor the implementation of the RTI Act: </span></b>Recognising that a large number of public authorities function at the regional, state, district and sub-district level the ARC had recommended that a nodal officer be appointed by the relevant Information Commission as a monitoring authority to ensure proper implementation of the RTI Act. GOI has rejected this recommendation on the pretext that it may lead to inter-departmental conflict. Surely, making the District Collector/Deputy Commissioner's office as a monitoring authority at the district level may not lead to any conflict as they perform a supervisory role on many accounts including the maintenance of law and order. Another good suggestion has been rejected on incredible grounds.</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; ">Bureaucrats have not accepted most of the important recommendations that civil society has been advocating for since the inception of the RTI Act. People have the right to know why. We advocators and activists should demand that the entire file on the ARC recommendations along with notings must be proactively disclosed by GOI. This is indeed the mandate of clauses (c) and (d) of section 4(1) of the RTI Act: </span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><b><span class="Apple-style-span" style="color:#FF0000;">"Every public authority shall.</span></b></span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; ">(c) publish all relevant facts while formulating important policies or announcing the decisions which affect public;</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; ">(d) provide reasons for its administrative or quasi-judicial decisions to affected persons."</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; ">People have the right to know the details of why such progressive and practical recommendations have been rejected. </span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; ">What can you do to demand transparency and resist amendments?</span></p><p class="MsoNormal"><span class="Apple-style-span" style="font-size: 13px; "><b>Please send emails demanding your right to know and insisting on the public authorities to proactively disclose detailed reasons for rejection. If the United Progressive Alliance (UPA) Government goes ahead with the changes, as announced by President Pratibha Patil in her address to Parliament on June 4, nothing good is to come out of it, they insist.</div><div> </div><div>After the Magsaysay award winner Aruna Roy last week expressing serious doubts about the intention behind the move to amend the existing Act, it was the turn of Shailesh Gandhi, Commissioner with the Central Information Commission, to give out similar sentiments here on Saturday. “We have to fight this move as it is not an attempt to improve upon the existing law,” said Mr. Gandhi, speaking as the chief guest at the launch of an orientation workshop on the second phase of the RTI project being implemented by the Jaipur-based NGO, CUTS Centre for Action, Research and Training(CUTS CART).</div><div> </div><div>“My fear is that with the amendment the present provision in the law to provide copies of file noting would go. In the next 100 days this can happen and the people have to remain vigilant against any such move,” said Mr. Gandhi, a businessman turned RTI activist.</div><div> </div><div>“People are only familiarizing themselves with the existing law and changes in them would only complicate the situation and obstruct the implementation of the law,” he warned. “The Governments in general are no great advocates of right to information,” he pointed out.</div><div> </div><div>As such education of the masses was taking considerable time in making the law more effective, Mr. Gandhi, who created a record of sorts in clearing the pending applications with the Central Information Commission, said. “What I have come across while dealing with the applications is that many of the applicants do not know how to seek information. However it should be pointed out that initially only 15 per cent in Rajasthan knew how to file an application under the law to get information. If the ministry is to be believed, all decisions taken by CIC and state commissions in the past three years are illegal. Unfazed by the DoPT's big brother attitude, the CIC has asked DoPT to keep off its turf. </div><div><br /></div><div>In a recent circular, DoPT said appeals and complaints could not be heard by a single member or a double member bench but must be heard by the full commission. </div><div><br /></div><div>Citing advice from the department of legal affairs, the DoPT communique said, "The matter has been examined in consultation with the department of legal affairs which has pointed out that the CIC or state commissions could function through benches only if there was a specific provision in the Act regarding constitution of benches." It went on to add that since there was nothing in the RTI Act about constitution of benches, the full commission should hear all cases. </div><div><br /></div><div>The commission, however, is firm on its stand. "We, in a decision two years ago, made it clear that a single or double bench will hear cases. In fact, the department of legal affairs was taken into confidence on the decision and it has not been challenged in the court either," chief information commissioner Wajahat Habibullah said. He added that the CIC would respond to DoPT. </div><div><br /></div><div>Pointing out that the decision would not only serve to increase pendency and delay hearings further, Habibullah said, "Our rate of disposal has gone up drastically but the number of appeals has also increased so there is still a long wait before hearings for complaints can be held." </div><div><br /></div><div>The rate of disposal has increased from 689 cases in October 2008 to nearly double at 1,495 in April 2009. Manhas’s plea was a modest one, asking ‘‘year-wise financial grant given by HRD ministry and its purpose.’’ </div><div> JNMF shot off a letter to CIC wanting to know if ‘‘charitable trusts set up in memory of national leaders come within RTI Act’’. But there were also concrete promises. A key example of the latter was the assurance that transparency in the flagship rural employment (NREGA) programme would be enhanced by enforcing social audit and setting up an independent grievance redressal mechanism at the district level in the form of an ombudsman. There were also specific commitments on the creation of an Independent Evaluation Office at an arms length from the government, which would work with social science research organisations to evaluate flagship schemes and place the findings in the public domain. Also, the government promised it would come out with annual reports on five key areas education, health, employment, environment and infrastructure. </div><div><br /></div><div> Similarly, a Delivery Monitoring Unit in the PMO would monitor all flagship programmes and iconic projects and report on their status publicly, while ministers from the relevant ministries would publicly report on progress under Bharat Nirman every quarter. While the Chief Secretary presided over the meeting, the State Commissioner Jagadananda attended the meeting. Chavan, who took over formal charge on Friday, said that various systems will be taken in to consideration and the proposition of setting up a directorate of prosecution will be put up before Cabinet soon. </div><div><br /></div><div>"We are studying the practices in other countries and will bring the proposal to Cabinet soon,'' Chavan said. Prosecution is currently under the CBI that is overburdened with more than 8,000 cases under investigation. </div><div><br /></div><div>The minister added that efforts would be made to make Right to Information Act more accessible. Replies to RTI queries on the Internet and filing of RTI on phone were facilities that were being looked at. "We have already kickstarted work on setting up a call centre so that people can ask for information on the phone. The system is already operational in Bihar and we will introduce some refinements before introducing it in some states. The facility is likely to start in Delhi soon,'' he said. Chavan however refused to specify any deadline on these plans. </div><div><br /></div><div>Denying that CBI was under any political interference, Chavan admitted that there was a public perception that the agency worked on the direction of its political masters. "This perception exists and we must change it. Why were you charged with trespass, rioting, assault etc? Did you go on a rampage in Dr Suresh Joshi’s office or courtroom? How can singing Jana Gana Mana get somebody into so much trouble?”<br /></div><div><br /></div><div>People also ask, “How did it feel to be in jail? How are you feeling now? Aren’t you ashamed of being branded as criminals?”</div><div><br /></div><div>On behalf of our small group of jailbirds, who proudly call themselves the Jana Gana Mana group, let me put the facts on record. I shall write this in three parts:</div><div><br /></div><div>Part I: What exactly happened at Maharashtra State Information Commission on Tuesday, 19th May? Why did we get arrested? Why did CSIC Dr Joshi lodge an FIR with the Police?</div><div><br /></div><div>Part II: What were the events in the earlier months that built up to this incident? Were we very aggressive or did we misbehave in earlier meetings? What put Dr Joshi into his negative / angry / vindictive frame of mind?</div><div><br /></div><div>Part III: How did it feel to be in police lockup, taken around in police vans, marched barefoot to the Magistrate court, and sleep among 130 assorted inmates at Arthur Road jail? How was the food, and how were our conversations with undertrials and hardened criminals?</div><div><br /></div><div>Today, I shall write only Part I.</div><div><br /></div><div>What happened on the afternoon of 19th May</div><div><br /></div><div>Dr Srikant Prabhu, a 67-year-old veterinarian, had a second appeal hearing before Dr Suresh Joshi at 4.30 pm. He was accompanied by G R Vora and Mohd Afzal. They completed that hearing before the other activists arrived one by one at the State Information Commission.</div><div><br /></div><div>In fact, we were not one homogenous group. Two groups and some individual activists pursuing their own cause were together at this meeting to press for clean implementation of the RTI Act.</div><div><br /></div><div>· Krishnaraj Rao, G R Vora, Mohd Afzal and Sunil Ahya comprise one group. They had been following up Dr Suresh Joshi for proper implementation of RTI Act since November 2008.</div><div><br /></div><div>· Another group consists of Mukund Parikh, Dr Srikant Prabhu, Sanjay Ghatalia and K N Singh.</div><div><br /></div><div>· Vijay Chavan is a social activist who had been pursuing a number of second appeals, and successfully got several PIOs penalized.</div><div><br /></div><div>· Ravi Kiran Haldipur was an appellant who had recently become interested in our cause and our methods.</div><div><br /></div><div>Our group – the first one -- submitted a letter (Pl scroll down to view the letter) to the inward department. The letter warned that if Information Commissioners implemented penal provisions of RTI Act in an arbitrary or mala fide way, then Sec. 217 & 218 of the Indian Penal Code would be applicable. They could be hauled to court and jailed for such action. Attached to this letter were relevant judgments of High Courts and Supreme Court.</div><div><br /></div><div>Having submitted the letter, we spoke to Dr Joshi’s Executive Assistant Kalpana Gavas, and asked for a time to see Dr Joshi. She said that he was too busy to see us, as he had a doctor’s appointment at 5.30.</div><div><br /></div><div>So we said we would go inside and observe his court hearings. (This is something that we have been doing a couple of times every month, in groups of varying sizes.) Again, she consulted Dr Joshi and said that only five of us could go inside at one time. We decided to disregard this.</div><div><br /></div><div>We entered, stood or sat at the back, and observed one hearing. After the hearing was completed, we requested Dr Joshi (who had a band-aid on his forehead) for a brief meeting to submit our letter personally. He granted us five minutes and asked us to come to the front. Dr Joshi said that he would henceforth meet us and other activists only on the first Monday of every month. We told him that this was unacceptable, as the list of things that he had promised and had not implemented was growing longer, requiring more frequent meetings.</div><div><br /></div><div>Suddenly, a well-known social activist who had come with us for the first time, stood up and announced that he always began this kind of meetings by singing the National Anthem in order to invoke a patriotic spirit. (He had earlier sung the National Anthem at the office of Dr Patangrao Kadam, Maharashtra Housing Minister.) He then unilaterally started singing Jana Gana Mana. The rest of us joined him in chorus. Dr Joshi remained seated for the initial three lines, and then shook his head in dismay, got up and left the room by the back door which leads to his chamber.</div><div><br /></div><div>After we finished singing, we waited a few minutes for him to return, and then someone went outside to find that Dr Joshi was leaving. Standing in the lobby, he said loudly that this was not the way, and he was calling police. We said that if that was indeed the case, they we would wait for the police to arrive.</div><div><br /></div><div>When we asked Ms Gavas again whether we were required to wait any longer, she asked us to wait. Approximately an hour after Dr Joshi’s departure, around 15 policemen arrived, took the statements of Ms Gavas and other office staff, took the group to Marine Drive Police Station in a police van and told us to sign us the arrest/surrender form. We were put in police custody at Azad Maidan Police Station overnight. Next day we were produced in Court and granted bail on a surety of Rs 20,000 per head. As we could not produce this at short notice, we were sent to Judicial Custody at Arthur Road Jail.<br /></div><div><br /></div><div>We were charged with the following offences:</div><div><br /></div><div><span class="Apple-style-span" style="color: rgb(255, 0, 0);"><span class="Apple-style-span" style="font-weight: bold;">Section 143</span></span>- Whoever is a member of an unlawful assembly shall be punished with imprisonment of either description for a term which may extend to six month, or with fine, or with both.</div><div><br /></div><div><span class="Apple-style-span" style="font-weight: bold;"><span class="Apple-style-span" style="color: rgb(255, 0, 0);">Section 145</span></span>- Joining or continuing in unlawful assembly, knowing it has been commanded to disperse- Whoever joins or continues in an unlawful assembly, knowing that such unlawful assembly has been commanded in the manner prescribed by law to disperse, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.</div><div><br /></div><div><span class="Apple-style-span" style="font-weight: bold;"><span class="Apple-style-span" style="color: rgb(255, 0, 0);">Section 146</span></span>- Rioting- Whenever force or violence is used by an unlawful assembly, or by any member thereof, in prosecution of the common object of such assembly, every member of such assembly is guilty of the offence of rioting.</div><div><br /></div><div><span class="Apple-style-span" style="color: rgb(255, 0, 0);"><span class="Apple-style-span" style="font-weight: bold;">Section 448</span></span>- Whoever commits house-trespass shall be punished with imprisonment of either description for a term which may extend to one year, or with fine or which may extend to one thousand rupees, or with both.</div><div><br /></div><div><span class="Apple-style-span" style="font-weight: bold;"><span class="Apple-style-span" style="color: rgb(255, 0, 0);">Section 452</span></span>- House-trespass after preparation for hurt, assault or wrongful restraint- Whoever commits house-trespass, having made preparation for causing hurt to any person or for assaulting any person, or for wrongfully restraining any person, or for putting any person in fear of hurt, or of assault, or of wrongful restraint, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.</div><div><br /></div><div><span class="Apple-style-span" style="font-weight: bold;"><span class="Apple-style-span" style="color: rgb(255, 0, 0);">Section 353</span></span>- Assault or criminal force to deter public servant from discharge of his duty- Whoever assaults or uses criminal force to any person being a public servant in the execution of his duty as such public servant, or with intent to prevent or deter that person from discharging his duty as such public servant, or in consequence of anything done or attempted to be done by such person in the lawful discharge of his duty as such public servant, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.</div><div><br /></div><div>Dear friends, many of us agree that the Jana Gana Mana singing was unnecessary and distracting. It happened in an unpremeditated way, and was not to our liking… but once someone in our large group started singing, we felt that the only gracious thing to do was stand at attention and join in. We could not stop him midway by poking his ribs or kicking his shin, could we?<br /></div><div><br /></div><div> Our conduct as a group may at worst be described as inappropriate or unruly. However, does this justify the serious charges levelled against us viz. assault, rioting, house-trespass etc? This in itself is against IAS service rules,” he added.</div><div><br /></div><div>Advocate H.C. Arora said even the present commissioners from bureaucracy were not performing their job satisfactorily.</div><div><br /></div><div>Most of them attended to work only 20-30 hours a month. “Except for General P.K. Grover (retd), none of the information commissioners appear to be serious in the discharge of their job,” he alleged.</div><div><br /></div><div>Earlier, several social activists and organisations have sent a joint representation to the Punjab Governor, the Chief Minister and the Leader of Opposition against the appointment of another bureaucrat in the commission.</div><div><br /></div><div>“We are even contemplating criminal action under Sections 166, 217 and 219 of the IPC against some of the information commissioners,” Goswami said. The representation to the Chief Minister read, “…none of the commissioners holds hearing for more than six hours a week…. Each commissioner costs the exchequer at least Rs 1.50 lakh a month. During the same period, there have been fascinating and dramatic developments in UK. Records obtained with the help of Freedom of Information law and other sources revealed massive misuse of public money by Members of Parliament. </div><div><br /></div><div>Daily Telegraph had deployed 10 journalist to probe into records, which revealed blatant misuse of public money by MPs. This is an ongoing political scandal following the disclosure of expenses of British Members of Parliament. It involves the disclosure of widespread alleged misuse of the permitted allowances and expenses claimed by Members of Parliament. There was an attempts by MPs to exempt themselves from Freedom of Information legislation. Ultimately information had to be revealed and was given extensive coverage in press and media. </div><div><br /></div><div>There is genuine concern among MPs that Parliament has never been held in lower regard by members of the public. Even MPs who have done nothing wrong are reported to be considering quitting as they are considered "crooks" by the public. </div><div><br /></div><div>There are several important lessons for India: </div><div><br /></div><div>(A) RTI /FOI law leads to effective public accountability.</div><div><br /></div><div>(B) Beneficiaries of corrupt practices try to avoid transparency. Transparency is essential to prevent misuse of public money.</div><div><br /></div><div>(C) Press and media can make good use of information revealed with the help of RTI/FOI laws.
