Meeting About New Laws??

Was there a meeting to discuss possible new laws about adopting from Haiti??

Yup. November 7th, IBESR and Haitian Social Affairs met.

The Proposal:

Couples (Married, Co-habitants):

One spouse must be more than 30 but less than 50 years old.
One spouse can be younger than 30 or older than 50 years old.
The couple must have been married at least 5 years.
(POSSIBLY: Couples married 3 years with documented infertility can adopt)
Couple that have lived together at least 10 years and can get documentation for this can adopt.

Singles:

Single women at least 35-50 years old can adopt.
Single men, who are divorced or widowed, without biological children and are at least 35 years old but younger than 50 can adopt.

Family:

A family with more than 2 biological children can only adopt a handicapped child, a child with special health issue, or a child over 5 years old.
(POSSIBLY: A family with 2 children can adopt a normal infant.)

General:

Orphanages can only work with an Agency in the foreign country. No private/independent adoptions. (This is being fought.)
All dossiers must go to IBESR and will be distributed to the orphanages.
(The assumption is that there can be an indication within the dossier as to which orphanage you would prefer the dossier to be sent to. )

Elections are SCHEDULED for December, however, that doesn't mean a lot.

An updated list of those in MOI as of 30 Oct 07 is on its way to the Minister of Interior of Haiti.

Please continue to use and update the MOI list as updates occur.

If you know for ABSOLUTE SURE that someone has exited MOI and has not had the opportunity to update the list because they have been so busy with traveling and having their child(ren) home, please update their information as well.

MANY of the entries do not have last names. If you are one of them, PLEASE reconsider adding your last name and/or your child’s last name.

I am no longer maintaining it. You are on the honor system to modify it yourselves...

Generic Information:
Here are a few names for you.... I would LOVE telephone numbers if anyone has them....

Parquet, Port-au-Prince Office:
Mr Gassant: The Head guy that is trying to get the laws changed.
Mr. Mazar: Holds parent interviews.

As of October 2007:
No one is allowed to stop by or even visit the Parquet office in Port-au-Prince. Appointments are made BY INVITATION ONLY and the appointments are usually only for attorneys.

Files Out of MOI

Sources from the MOI office can verify 30 files have been released this week and others within the passport office are saying somewhere around 107 files have been released (finally). We have no way of knowing for sure which number of released files is correct (Unless the 107 being reported is over a period of time).

The good news is that the files are from April, May, June and July. Although that means that there is currently no pattern as to what files get released when, it is a good sign that the older files are not being completely forgotten.

Please continue to pester your orphange director and/or adoption lawyer to continously check on your files within the MOI office.

1974 Adoption Law

For those that are curious and can read legal mumbo-jumbo, the 1974 Adoption Law has been found....

The summary of it:

Adoption is only allowed for people older than 35.
If married, at least one parent should be 35 years old.
If married, to qualify for adoption from Haiti, you must have been married for at least 10 years, and not have any biological children from this (current) marriage. Children from previous marriages or adoptions are ok. (HUH?!?!)
You must be at least 19 years older than the child you are adopting.
