I am sure Sharman Stein from ACS is a fine person doing her public relations job and being paid to defend ACS, but let’s look at the facts. She begins by comparing ACS reasons to police reasons to intervene. I want to point out that in the same way as there is police brutality, there is ACS brutality and ACS brutality is much much worse.

She calls the kidnapping of Black and Latino children “removals”, I call them more accurately kidnappings. She can be safe that ACS would never “remove” a child from her: she does not qualify.

She says that “we take steps to help a parent fix the problem”. Ask parents and they will tell you that this is not accurate, but rather a Public Relations spin or a cruel joke. After the tragic death of Nizxmary Brown the “removals” almost doubled. How can ACS explain that all of a sudden parents started abusing their children at a double rate? Or it was rather that ACS had gone into protective mode by protecting themselves rather than the children.

The fact of ripping children from the people they love and trust the most, is such a perverse act that leave them psychologically scarred for life. No wonder that 75% of them end in the prison system. Most of the rest as homeless or mentally ill. The State Legislature uses the number of children in foster care as the best predictor to build more beds for the ever growing prison system. ACS is the enforcement arm of the Child Slave Trade. They feed the profit-driven foster care industry that preys on those who oppose the least resistance: People of color who are not rich. You mention the Guinea Pig Kids being used at the Incarnation Children’s Center in Washington Heights. That is just the tip of the iceberg. What happened there, would not had been possible without the climate of abuse and impunity in which ACS operates. If what they did with those innocent children had been done to animals, the ASPCA would had close down the place and had everyone arrested, but since the children where mostly Black and Latino, they are expendable.

ACS happens to be the biggest child abuser in NYC. For any child they may help, they destroy 1,000. Either moron’s logic or clever evil social engineering.

The scam counts with the unconditional support of the family court judges who are appointed by the Mayor and who work for him (as the ACS Commissioner does) and who rubber stamp anything that ACS does and wants. There is no Jury Trial or Due Process in Family Court and a generous estimate is that parents win about 2 cases out of every 1,000 in a 1028 Hearing in Family Court.

ACS is not getting better but rather worse. The only thing they are getting better is the public relations strategies. Ms. Stein claims that “we do a lot to support teens who are aging out, like helping them to go to community college.” Of course, after having damaged the mind of that child, they want to show off by sending him/her to college. If they really cared about children, they should leave them with their natural protectors and in those few cases where there are problems, should help those families with voluntary services. ACS and all those who make a living from this scam want to defy the laws of nature and on top of that the laws of economics. Who is going to believe that oxymoron? They are really preparing teenagers not to college but to the prison system.

Well Well Well. ACS honchos have been inventing adopted kids and cashing checks for them. Wow. And it's been going on for years. And this is probably the tip of the iceberg.

An atmosphere that says: "We're ACS, we can do what we want" has finally come back to bite the mayor on the part of his rump where he can feel, that is in the realm of money. Not that he wants to blame the guy who came to ACS as a watchdog for this slipshod and primitive accounting system, oh no, not the commissioner's fault.

Though I thought I could be "different" and "honest" and do things both legally and sensibly they were not having it. I started a blog that exposes much of how their "child protective" division operates.

They've been working at "reforming" this mess for more than thirteen years and what do we have? A commissioner named John Mattingly (not Don Mattingly) who was once actually a "watchdog" now with his head in a ridiculous place where he cannot see the theft all around him, kids dying while in the governments "care" and a mayor who defends the falling cranes, the dead kids, the fifty shot cops.

Ah yes, the geniuses at ACS found three year old Kyle Smith to be one happy little kid just before his guardians murdered him. His grandmother's complaints were written off as motivated by a custody battle. No kidding. The boy's grandmother wanted to care for the kid, and not allow people whose own kids were taken away from them permanently to abuse him. In the idiot world of ACS this becomes an ulterior motive, and that trumps any facts. Besides, with this ulterior motive one can close a case and that's what ACS does, close cases the easy way, or the overtime way, as CPS and supervisor's priorities dictate. The guardian's own kids had been taken from her by Texas CPS authorities and the Family Court and ACS knew about this.

I'm a former CPS worker and I've come to the conclusion that this system is so decrepit and useless that it must be ended. As I've said before, if there is knowledge of a crime against a child (or anyone else) the police should investigate the matter and arrest wrongdoers. If a child then has no one to care for him the child should be given over to a relative, family friend or godparent. Only if there is no such person (and Kyle had a grandmother and a father) a very much smaller temporary foster care system would be needed. ACS must be taken off of investigations of crime, they are proven incompetents time after time after time. In Kyle's case he had a biological father. Why was he not considered? Might he have needed some help finding housing? Kyle's mother is said to be a drug addict. If drug addicts were allowed to get prescriptions for their drugs and function within the law there would be a whole lot fewer dead children and destroyed families.

If you ride the subway in New York you may have seen the ads, and they're online too. New York City's Administration For Children's Services is once again on the lookout for cannon fodder, frontline troops in their war against parental rights and authority, the poor and "minority" communities.

If you are considering becoming a Child Protective Specialist why not first ask people in the community if they respect ACS, if they respect the people who work for ACS and if they believe that ACS serves the interests of New York City's children? Don't ask on East End Avenue or West End Avenue, because ACS just about never impinges on the well to do. Ask people who are shopping on Fulton Street in Brooklyn, or Fordham Road in The Bronx, or living in the housing projects which are the last refuges of the poor in Manhattan.

Google "John Mattingly is not Don Mattingly".
Read the Essence Magazine article on ACS and what it did to helpess children .
Read about their lawlessness. Ask your City Council representative what happened to the investigation of this scandal. Ask yourself if you want to be associated with the organization that snatched hundreds of kids, ran experiments on them and cannot even give a credible number of how many kids they did this to.

Ask school teachers and guidance counselors if they respect ACS. Ask Emergency Room staff if they respect ACS. Ask people who work at ACs and are feverishly sending out resumes. Ask John Mattingly why ACS cannot retain its frontline staff.

If you are thinking about working at ACS, especially about becoming a "Child Protective Specialist" you should ask questions, and think again.

PS- I'll bet that in two years more than half of the staff they used for their commercials will be gone.

I have not posted in quite a while and I have not been involved in the newsgroup ACS Must Be Stopped either. For one thing, as I have written about, my wife and children have been threatened by ACs staff in the form of an anonymous letter that included mis spelling of a name that is identical to a mis spelling in ACS records and a visit by NYPD claiming that the children were "missing", a visit no doubt generated by a phone call from ACS staff to 911. My family has in the past undergone an ACS investigation that was very stressful and included a court case that tried to compel, in a court, one of the children to have an unneccesary medical operation. People who have lived that expect anything at all from ACS and I cannot argue that they are wrong. I have held back in participating in the newsgroup I initiated and will continue to be absent for some time to come.

I hope the newsgroup continues on and organizes effective actions to curb and eliminate ACS.

I maintain a blog called "CPM Ramon Vargas is Not an Idiot" for fun and I know it is read by and bothers certain unscrupulous staffers at my alma mater, Emergency Children's Services. In it I compare whores and Child Protective Services staff as members of society, (whores come out on top in that match up) and to keep people like Ramon Vargas, for whom the office is more like a happy hunting ground anyway, amused, I have some semi nude posters on that site. An ex CPS worker named Matt who blogs and is now an investment banker dropped by and left me two comments and a dare that I post on one of them. Being this is a day off from work for me I took a few minutes to reply to Matt and to hopefully make a point or two about Child Protective Services and how it functions in New York as an enemy of the poor.

I am surprised you lasted as long as you did there. I made it through only a few months, and I have to agree that ACS was far more problematic to deal with than any of my clients. I was lucky to have awesome supervision, but it wasn't for me and I went quickly back to the private sector. The problems there are quite serious and far-reaching, bad casework is only a small part of it. There are some great people, but there are not enough of them. In the interest of equal time, I found it a waste of my life to deal with the stupid problems of uneducated people who made the very poor choice to reproduce without having the mental or financial means to support that bad decision. Clients: Please stop doing drugs. Please stop beating your wife and children. Please go back to school and finish your education. School & Work is whats going on, there is no option 3. Also, this site would be a little more credible without the odd mixture of soft-porn and pseudospirituality.

As for what you call pseudo spirituality I do believe there is a God of justice and mercy and I do believe there is right and wrong. Most ACS staff would profess a belief in and a fear of God. I try to address them on this level.

As for your attitude toward the poor and their right to reproduce I'm totally against it. I oppose all anti human ideologies such as Malthusianism which is old time nazism. There are not "too many people" on earth, there are too many two legged pigs.

Anytime there is a child fatality, it is of the utmost necessity that the home still be assessed immediately and thoroughly for the presence and/or safety of any remaining children. Every square inch thoroughly examined. Any failure to act on the part of ACS/ECS in this instance could've resulted in additional child injury and/or fatality, regardless of police involvement and what the ORT said. The police do police work, not Child Protective work. You don't know anything for sure about the presence or condition of any other children in the home until you go in and verify. I would think that is obvious. You are VERY lucky you didn't wind up on the front page of the Post on this one.

Where did you get this "regulation"? Did you pull it out of your ass?

Matt you are wrong. Do you really think that if a child in Soho or Tribeca or Central Park West or President Street dies ACS comes barging into the home without a warrant at two in the morning after the detectives have already torn the place apart??

Read what I wrote, this time for comprehension. We went to the home even though there was no legitimate CPS report. The state 800 operator in the case spiced up the report the second time around, but I was alreaduy enroute to the apartment. The father denied us entry. He asked us to come back at a reasonable hour. He refused to allow us to awaken and terrorize his neighbors who had helped him at that unGodly hour. He refused to allow us to terrorize his surviving child.

Matt you might have barged in without a warrant and possibly would have gotten away with it too.

Interestingly Hani Malek, the Supe I who accompanied me on the case was soon promoted once I submitted my resignation from ACS. Adegbola and the crew who rang everyone's doorbell in that Harlem apartment building of course had no consequences for their lawless acts. People like them are lucky that the poor tend to be overwhelmed with surviving because that allows impunity. I do believe that there is justice somewhere. God hates ugly.

Well then just what does Matt represent as a CPS worker? He represents a mode of thought that justifies the State interfering in the raising of poor and minority children from a point of view that these children should never have been born to begin with. He justifies terrorizing poor and minority parents and government lawlessness. He represents state undermining of parental authority. He represents the government imposition of a certain religious point of view- that the Bible was wrong in its advice for parents : Proverbs 13:24 “Whoever spares the rod hates his son, but he who loves him is diligent to discipline him.” While I personally do not agree with this Bible passage, it is in the bible, millions of people believe it is correct, millions have been raised this way and have gone on to be productive human beings and the government has no right to impose it's viewpoint, or mine, or Matt's on parents in their homes. In fact I'd like to ask Matt if he would do a survey among his fellow real estate investors: Find out how many of them received physical discipline from their parents. Then find out if any former foster children are among them. I'll go it even further than that: Find out how many had parents who had drug or alcohol problems, and in whose homes the father hit the mother. I think he'll find many, many, many who were physically disciplined and who also had troubled homes, but damned few if any real estate investors who survived New York City's foster care system.

Just as he cannot understand how I lasted ten and a half years in Child Protective Services I don't understand why he wanted to leave it. Oh, money.

Mother makes desperate plea to child welfare agency for return of daughter

The mother of a 6-year-old girl in city custody on allegations that her parents are mentally ill Wednesday made an emotional plea directly to the head of the city child welfare agency.
More than three months after Amber James was taken from her South Ozone Park home, her frustrated mom confronted city Administration for Children's Services Commissioner John Mattingly at a public conference on the agency's ongoing reforms.
"ACS has kidnapped my daughter wrongfully!" Vanessa James, 41, said at the gathering at the New School in Manhattan.
A pediatrician reported Vanessa James to authorities over concerns that she may suffer from Munchausen syndrome by proxy, a rare disease where a parent believes the child is sick - or makes them sick - to get attention.
Vanessa James and her husband, Marvin James, 48, have been to numerous court hearings since Amber was placed into the foster care system on Aug. 23. But they have not been charged with any crime, and neither has been found to be mentally ill.
"They found us innocent," Vanessa James said to Mattingly during the question-and-answer portion of the panel discussion.
"My daughter's being held prisoner," the desperate mother said. "What do we do now?"
After she made charges that her daughter has been abused while in foster care, Vanessa James was interrupted by the panel's moderator, who asked Mattingly to respond.
"I can feel the hurt in your voice," Mattingly said. "I know about this situation. I know it's in court and hearings have been held and will be held. ... It is up to the court to make the future decisions."
Amber's case has become a public tug-of-war between her parents and the ACS since the Daily News first reported the family's plight in September.
Ironically, yesterday's forum was largely devoted to announcing an ACS pilot program to increase family services and reduce foster-care placements.
After Vanessa James' plea, several welfare workers attending the forum referred to Amber's case as an example of the ongoing problems at ACS.
"Children are being abused" in foster care, said Sharonne Salaam of People United for Children, an advocacy group. Yet ACS has failed to crack down on foster care abuse, she charged.
Susan Loeb, of Voices of Women, said the ACS hotline is often abused.
"Malicious reports are an epidemic in many communities," Loeb said. "Anyone with an ax to grind can call, without any real consequences."

Amber James and Administration for Children's Services

This Tuesday Amber James' parents, having been accused by the incompetent Administration for Children's Services of taking too good care of the six year old have to come again to the kangaroo court in the Queens County Family Court building, part one, second floor.

Amber, who was "too well taken care of" is a prisoner of war held by Mayor Bloomberg's and Governor Spitzer's idiot social worker flunky "PhD" John Mattingly. I intend to write here as to why "social work" is not a legitimate profession in New York City in the near future.

Not long ago the New York Times published an item reporting that the population of black people in New York City is shrinking at a rate of three percent a year. Among the many reasons this is happening is Administration for Children's Services. Black people bring their children to emergency rooms at great risk of having ACS unleashed onto their lives, which can lead to disaster as exemplified by the suffering of Amber James, a little girl who has been sexually molested, beaten, denied food, abandoned in a mental ward waiting room at midnight, told her mother is dead, treated by docrtors without her parents consent or knowledge, all under Mattingly's watch. Black parents speak up to school officials, who are failing in their mission, at the same horrible risk.

Black parents and indeed all parents have seen their authority over their chiildren destroyed. Children are encouraged in schools to report their parents who attempt to maintain discipline. Rumors of "freedom" in the group homes lure children to turn on their parents. Parents who use physical discipline, as do 95 percent of parents on this earth risk not only having theiir children taken into the dysfunctional abusive foster care system, they risk being put into handcuffs and taken away in front of their children and neighbors. There is a totalitarian campaign to encourage spying and reporting to the government of people who are trying to take care of theiir children in a world gone mad. Well to do white people can hardly imagine the situation that prevails in the public schools, the municipal hospitals, social service offices.

We've got to stand with Amber James and her family.

There is erroneous information here that must be corrected. Geralsine Fowler did not abandon Amber at the Kings County Psychiatic Hospital waiting room. She is the worker whose efforts did get A,er put into foster care and abusd, but the credit fo abandoning the child at the gates of mayhem goes to Adrian Prichette of St. Vincent foster care agency.

ACS in its typical outlaw mode has not complied with the order of the Family Court to place Amber in a kinship home by Thanksgiving.

This is not Geraldine Fowler, the ACS child protective specialist from Queens who of course is not the one who set up six year old Amber James to be kidnapped, sexually molested, beaten, deprived of food and told her mother was dead under the loving care of John Mattingly. It is not the same Geraldine Fowler who abandoned the six year old in a mental ward waiting room at midnight because "I had to go home."

No this is not Geraldine. Geraldine does not seem to like water that much.

Amber James Must Be Freed Update

I just got off the telephone with Vanessa James. She said that she and Marvin saw Amber for the first time in weeks today. Amber had been rushed to the hospital, having stopped breathing. The doctors would not explain just what had happened to Amber but she was returned to her foster home today. Amber has been sexually molested, beaten, deprived of food, abandoned in a mental ward waiting room at midnight by her "Child Protective Specialist" Geraldine Fowler of the Queens Administration for Children's Services. They say not to judge a book by its cover but in Geraldine Fowler's case what you see is what you get. (Ugly outside as inside).

The case went well as far as testimony is concerned and it looked like the Law Guardian, the one who is almost always supporting the babysnatchers in court, might be moving away from the government position towards actually trying to help her client who is the little girl AmberJames. Tomorrow there will be another hearing at Queens Family Court part one at eleven in the morning. If anyone can go, please do so.

A man whose last name is similar to mine and who might even be related to me named Richard Wexler heads up this "reform" group but he puts out some very sharp criticisms of foster care. The Annie Casey group of non profit "Child Welfare Expert" organizations is interesting to ACS victims because it is so closely connected with ACS. William Bell lost a bunch of money and got eased over to a Casey office way out in Seattle, about as far away from New York as one could go...

A Brief Analysis of the Casey Family Programs
Northwest Foster Care Alumni Study

Imagine for a moment that you went to a doctor and he told you the following:
· 80 percent of my patients don't get any better.
· A lot of the time, they get worse.
· One-third of the time, I commit malpractice.
But, the doctor continues, if you'll just pay me even more money than I already get and build me a fancy new hospital, I'm sure I can reduce my failure rate to only about 60 percent. Do we have a deal?
Odds are you'd look for another doctor.
But what if all the other doctors told you the same thing? And what if none of them let on that there were, in fact, better treatments with fewer side effects?
Odds are you'd be furious.
Now, consider a study released on April 7, 2005 by a large, Washington State-based foster-care provider, Casey Family Programs, and Harvard Medical School. The study used case records and interviews to assess the status of young adult "alumni" of foster care.
When compared to adults of the same age and ethnic background who did not endure foster care:
· Only 20 percent of the alumni could be said to be "doing well." Thus, foster care failed for 80 percent.
· They have double the rate of mental illness.
· Their rate of Post Traumatic Stress Disorder was double the rate for Iraq War veterans.
· The former foster children were three times more likely to be living in poverty – and fifteen times less likely to have finished college.
· And nearly one-third of the alumni reported that they had been abused by a foster parent or another adult in a foster home.
The authors went on to design a complex mathematical formula to attempt to figure out how much they could improve these outcomes if every single problem besetting the foster care system were magically fixed. Their answer: 22.2 percent.
Even if one argues that foster care didn't cause all of these problems, clearly foster care didn't cure them. Yet the authors of the study recommend only more of the same: Pour even more money into foster care to "fix" it to the point that maybe the rotten outcomes could be reduced by 22.2 percent.
At a two-and-a-half-hour briefing for advocates, there was barely a word about keeping children out of foster care in the first place.
Why, then, do we continue to pour billions of dollars into a system which fails 80 percent of the time and actually abuses at least one-third of those forced into it?
We do it because, over 150 years, we've built up a huge, powerful network of foster-care "providers" – "a foster-care industrial complex" with an enormous vested interest in perpetuating the status quo. They feed us horror stories about foster children whose birth parents really were brutally abusive or hopelessly addicted. But such cases represent a tiny fraction of the foster-care population.
As is documented in NCCPR's Issue Papers, elsewhere on this site, far more common are cases in which a family's poverty is confused with child "neglect." Several studies have found, for example, that one-third of foster children could be back home right now if their parents simply had adequate housing. (See NCCPR Issue Paper 5.)
Other cases fall on a broad continuum between the extremes, the parents neither all victim nor all villain. What these cases have in common is the fact that the children would be far better off if states and localities used safe, proven alternatives to foster care – alternatives that don't come with an 80 percent failure rate, and a 33 percent risk of child abuse. (See Nine Ways to do Child Welfare Right).
Nearly as disturbing as the study's findings is how the study authors attempted to spin them.
The finding about the rate of abuse in foster care is not mentioned in the press release accompanying the study. It's not in the Executive Summary. It's not in any of the glossy material that accompanies the report. One must dig it out of the report itself, on page 30. During the entire briefing for advocates, I waited in vain for the study authors to even mention the issue of abuse in foster care. When I finally asked about it, at the very end of the briefing, one of the researchers tried to blame birth parents, speculating, without a shred of evidence, that maybe the foster children had been abused during visits.
But that is contradicted by the study itself, which states:
"One third (32.8%) of the sample, however, reported some form of maltreatment by a foster parent or other adult in the foster home during their foster care experience, as recorded in their case files" [emphasis added].
If anything, this underestimates the true rate of abuse, since a major problem in foster care is foster children abusing each other (see NCCPR Issue Paper 1) and those cases apparently were not counted in the study.
Of course, some will rush to conclude that because family foster care has failed so badly, we should go back to orphanages. There's just one problem with that. Over a century of research is nearly unanimous: The outcomes for children warehoused in orphanages are even worse. (See NCCPR Issue Paper 15.)
Though the authors try desperately to ignore the obvious, their study is one more indication that the only way to fix foster care is to have less of it. Until we realize that, foster care systems will continue to churn out walking wounded – four out of five times.

Today a small but spirited and dedicated group of people from this newsgroup came to Manhattan Family Court and carrying signs that denounce Family Court and ACS handed out leaflets to people coming out of the Kangaroo Courthouse called New York Family Court and made contacts with several people.

In addition last week a number of us along with others went to Queens Family Court to show support for the James family, a family that is under the most terrible attack from the Family Court System and ACS that one could possibly imagine.

We need to turn ourselves into a political, moral and spiritual snowball that is rolling down a mountainside headed straight at the CPS system and its New York headquarters at 150 William Street and these actions are a beginning.

My thanks go to those who showed up today in the rain, especially Louise and her husband (sorry that I forgot your name) who printed leaflets and made artistic and educational signs. Today would have been a zero without them.

In the next few days we will have our December target picked. To those who did not or could not make it today, please try to clear Saturday December 15 and or Monday December 17 on your schedules. We should have something planned for both days. There will be more details in the near future.

Regarding the website called "Child Protective Manager Ramon Vargas Is Not An Idiot"

Q- Aren't you just a disgruntled ex employee?
A- I worked for Administration for Children's Services for more than ten years, eight of those years as a child protective investigator in their Emergency Children's Services. Because my work was thorough and I was a dedicated employee I was among the minority granted a merit pay raise. I was a worker who could be called upon to go into the field in order to correct the blunders of others, and I did that several times.

I had myself convinced that I could do some good from "inside the system" and in a sense sometimes I did help individuals in my casework, more often though, the system was going to do what it does best- mess things up - with me or without me. The system is designed to do what it does.

I was assigned as a one worker "Instant Response Team" unit and worked as such for around two years, going to the most difficult cases, working along with detectives of the Special victims and Sex Abuse squads of the NYPD. Ultimately I decided that I should be in a "regular unit" and so I went to work under Mr. Adegbola. He is not a good supervisor, though he is a nice guy. I reached a point where I simply was not going to harm other people just because Adegbola couldn't understand what was going on in some cases. Also I was at loggerheads with Mr. Vargas especially after he idiotically ordered me to transport sex abuse and domestic violence victims in one case back to the man who had them terrorized from a shelter where I had brought them. I refused an offer to be put aside once again and be given autonomy in my work. I felt that I was not the problem, and I wasn't! ultimately the management had the Department of investigations take the hard drive from my workstation and lo and behold, they say they found unauthorized emails and Internet contacts. (As virtually the entire municipal workforce that has access to computers would have.) Out of disgust after ACS Commissioner John Mattingly (not to be confused with Don Mattingly who posted from a blog of mine some very damaging information about ACS) emailed me to my home and told me that he did not want me to take advantage of his "open door" policyI resigned and took my pension, since I had signed up for an early retirement package upon my entry into ACS. I left them on my 60th birthday and presently I am happily a yellow taxicab driver on the night shift in NYC (see my blog TAXI NIGHTS).

Q- It's very extreme of you Mr. Weixel to tell people not to call reports against parents to ACS, isn't it?
A- It isn't extreme at all. After all our city and nation survived for many years without anything that looked like Administration for Children's Services. The fact is the only thing ACS ultimately does to "protect" "maltreated" children is to destroy their families, traumatize them and prepare them for a life of institutionalization.
God Is Love. We need to love each other and take care of each other, and not turn to moronic government programs that are proven to to work. (For the record- fire departments work, they put out fires and save lives, homes and workplaces from destruction, public housing works, it provides decent housing to millions of people, food stamps work, they provide food to millions of people including rookie NYPD officers by the way.) - I'm talking about idiotic interventions into the lives of free and autonomous human beings, typified by what is called Child Welfare or Child Protective Services, and includes foster care and subzidized adoption.

ACS functions on a level of incompetency, disregard for human and civil rights and impunity that are hard to match. This blog focuses on one manager in their Emergency Children's Services department, but the truth is, he might not even be the worse that they have, he's just the worse that I had occasion to work with. Did you know that after the Nixzmary fiasco (read my blog ACS MUST BE STOPPED to be filled in about Nixzmary) they fired or demoted to civil service rank ten managers? (The managers at ACS are not civil service employees and they are not unionized. They have their jobs at the pleasure of Mayor Bloomberg.)

Now if these managers were worse than Vargas that would be something! It would be quite an indictment of the system in which they had become managers and functioned as managers to begin with. I suspect however that they were not particularly worse than Vargas, but that once word came down from John Mattingly that some managers needed to be purged they got rid of ten who aren't sociable, or are the wrong ethnicity, for their particular office, or who are too serious, or who authorized "too much overtime." Whether they were worse than Vargas or not it's a sign of just how terribly run the agency is. When you make a child maltreatment report you are handing a family over to these kinds of people. Can your conscience allow that?

Q- But what about the abused children. Child Abuse is real, Weixel.
A- Yes, it is real. It is found everywhere, isn't it, including and especially in foster homes and group homes. Most ACS cases are not "abuse" cases. Most ACS cases (the majority of which have no supporting evidence according to ACS) are called "maltreatment" cases. These can be matters of "dirty homes" or old fashioned discipline, the kind that has existed for thousands of years in Judeo/Christian/Islamic cultures and that I suspect a vast majority of readers of this blog themselves know of first hand. Personally I don't agree with "physical discipline" but I do not see a legitimate government function to be destroying families and locking up parents who believe in what the majority believes in.

Q- Did you say Locking up parents?

A- Yes, good parents, you bet I did. Non white inner city parents get locked up for hitting their children with belts, for the kinds of things that do not result in incarceration in New York City's predominantly white neighboring counties.

Q- But what about abuse cases? Real abuse.
A- First of all even these cases are often blown out of proportion and the majority of them are found to have no supporting evidence. I remember vividly a case of a girl who had definitely been violated according to an emergency room doctor. Police went into action and brought all her siblings into a hospital to be examined. The child was taken out of her home. The next day the hospital's child abuse expert ruled that there had been no abuse. This sort of thing happens, and happens often. But yes, there is abuse. When someone actually abuses another person that criminal should be prosecuted, no? If the criminal is removed from the home the children involved do not have to be removed.

Communities are important. A corrupt and idiotic government agency cannot replace a community. Frankly during a time when I was coming to realize that God is real I was moved to see a church pastor, and congregants come down to a police station house to volunteer themselves and their homes to keep some children out of the horrendous foster care system. It occurred to me that most if not all of the single mothers caught up in the system and their children being violated by The State, need to be in a church, a mosque or a synagogue or community organization (formal or informal) that can function this way. - In this case a police Sergeant decided (not me or my boss) that the child in question had to go to a juvenile detention facility "pending investigation" (imagine that in a country where we claim to uphold rule of law and presumption of innocence!) This child- a boy, a black child, was a barely articulate, most likely mentally delayed and not "tough" non "streetwise" and he was going to Spofford because a police sergeant wouldn't allow his community to handle or even participate in handling a family problem, which this case really was! In this case a retarded boy might have been molesting another child in his home. Instead of bringing help, the system brought charges that their poor overwhelmed overburdened guardian was negletcful! All the children were traumatized rather than helped. Congregants offered to take each child or any child into their homes and they were refused and rebuffed by the order of a police sergeant!

Amber James Must Be Saved

The thought of animal and human sacrifices is repulsive to most people. The thought of human sacrifice where children are the sacrificial lamb, is simply blood curdling for most God fearing people. Yet ACS, the Administration for Children Services, or Active Child Sacrifice, actively practice children's blood sacrifice, with the full support and protection of the law. This agency, while publicly displaying itself as the safety net for children, is in fact, the embodiment of evil, in its routine destruction of children.

Now this analogy may seem somewhat extreme and inconceivable to the average person, but records will show time and again the blatant disregard for the safety and well being of children, the countless deaths of children in its custody, the power available to it and the ease with which countless cover-ups are made.

Consider the case of 6 year old AMBER JAMES, who was removed from her parents care and custody based on the proven false allegations of a doctor protecting herself after writing the wrong prescription for the child. Amber's loving and vigilant Mother, Vanessa, discovered the error, brought it to the doctor's attention. Amber's Father, Melvin voiced outrage at the negligence shown his then 5 year old daughter that included a 6 hour wait followed by the erroneous prescription. Nothing prepared neither he nor his wife for the nightmare that would follow. Rather than thanking the observant mother, Dr. Julia Garber, a pediatrician, sought to cover her mistake by placing a call to ACS, misrepresenting herself as a Psychiatrist and accusing the mother of Munchausen by Proxy Syndrome, and the couple of 'strange and unusual behavior'.

Hence, this family quickly became and continue to be another statistic of human sacrifice, and Amber, another victim of ACS's Active Child Sacrifice.

The hearing that followed determined without doubt that Dr. Julia Garber's report of Munchausen by Proxy was unfounded and her ACS report was false. During the next hearing where the charge was to be dismissed, with Amber present in court with her parents, the court decided on the spot that the child was in imminent danger and should be removed immediately. Needless to say, the scene in the courtroom was that of shear hysteria and pandemonium, comparable only to the evil family destroying practice of Slavery. Both parents gasping, shouting, pleading in disbelief, protectively clutching and shielding their 5 year old daughter, their daughter screaming with fright, grabbing and holding on to her parents for dear life, the armed court officers surrounding the huddling family, shouting, threateningly ordering them to loose the sacrifice, the judge shouting for order in her courtroom. The courtroom/torture chamber was a scene of total chaos and despair, with everyone shouting, for different reasons, for different results.

Amber James was torn from her parents' love, care and custody and placed in the callous diabolic vortex of the Foster care system on August 24th 2007.
Since then Amber has suffered physical abuse in the form of beatings that left visible wails and bruises all over her body, on her back especially. Prior to this, Amber had never been hit, not by her parents, nor her brother, her relatives, classmates....no one. The traumatic sequence of events so traumatized Amber that she stopped talking from fright, afraid to say what happened to her and who hurt her. Without the protection of her parents, she refused to talk. Her parents took pictures of her injuries, presented them in court and the court resolved the problem by moving Amber to 3 different foster homes, even though the court and ACS had repeatedly been presented with a long list of family members and friends willing to receive Amber under the Kinship Program. All the request for Kinship placement were disregarded. ACS did, however, offer to return custody of Amber to Mr. James provided he secured an Order of Protection against Mrs. James who would not be allowed in the marital home or around Amber. Mr. James absolutely refused ACS's offer stating the fact that his wife was an excellent mother and he refused to further traumatizing Amber by allowing her come home to an empty house, her mother's absence from their home would be devastating for Amber. The James were threatened by ACS not to take any more photos of Amber otherwise they would terminate their 2 hours per week visits with Amber.

Amber James was admitted to Kings County Hospital Psychiatric ward after suffering a psychological breakdown. Yet ACS via Family court refuses to return Amber to the safety and security of her parents. Instead ACS continues to elude responsibility for the kidnapping, physical and psychological destruction of this previously meticulously cared for child.
After visiting Amber 10/29/07, Ms. James left the hospital numb with hopeless despair, convinced that ACS is going to allow her child to die. During her half hour visit during which Mrs. James attempted to groom her daughter by combing her badly matted hair, she was horrified to discover a sizable patch of dried blood on Amber's head. She was told by the other children that Amber was beaten up badly by the older girls with whom she roomed. Mrs James' feelings of hopelessness and despair only increased when she recognized the same hopelessness in Amber. She recognized that Amber had given up, had stopped fighting. Mrs. James was/is convinced that ACS was going to sacrifice the life of her child, was going to allow her daughter to die and there was nothing she nor her husband nor anyone could do to save AMBER.

Make Your Court-Appointed Attorney Work For YOU
Recently I introduced two site features: one, a place for people to post referrals to good CPS-fighting attorneys, and the other, a place for people to make a request for an attorney. Both posts have had good responses, yet I know without a doubt that most of the people asking for legal help will not find it by posting on this website. I’m sorry to say that, but it is true. There are few attorneys who are so hard-up for work to do that they’ll come here to pick and choose clients who are probably broke and looking for someone to work pro-bono (for free).
Get over the idea that you might find a good pro-bono attorney. It rarely happens. In the seven-plus years since I started this site I’ve seen it happen only once. An attorney represented a very high-profile case in Oregon AFTER the couple became so desperate they kidnapped their own children from state custody. That attorney lost the case and the couple has been imprisoned ever since.
The alternative to finding the dream-attorney is to take that court-appointed freebie do-nothing attorney the county provides, and make that person WORK for YOU.
The main problem with these court-appointed attorneys is that they are paid by the county; that same county that is your adversary in juvenile court. So how motivated can they be to go against the county and help you?
Turn the tables. Take charge of your case.
A way to control how your attorney handles your case is to decide, yourself, how you want it handled. Then sit down and write your attorney a comprehensive letter detailing exactly what you want to have done with your case.
A keyword to remember is proactive. YOU take the lead. Rather than REacting to what others are doing to you, start thinking ahead to what your next move should be. Keep your attorney informed with a series of letters.
Remind this person, your attorney, that you are the client and you need and demand request the attention your case deserves. If your attorney doesn’t do the things you request, that person is setting himself/herself up for a legal malpractice lawsuit. But if you don’t set forth your requests in writing, there’s no proof you asked for anything in particular to be done.
Let’s face it. These court-appointed attorneys are known for what they don’t do. They often meet a client at the door on the way into the courtroom. They look through the case file as if it were the first time they’ve seen it, trying to orient themselves to what’s going on. Of course there’s no time for them to do any type of adequate defense of the case. They don’t know you, your children, or your situation. They don’t know the truth and don’t know who’s lying. And it seems they just don’t care.
My apologies to all court-appointed attorneys who don’t fit this description, but I’m sure you know that these are the facts about many if not most court-appointed attorneys in juvenile law cases.
You have to do something to get a dead-beat court-appointed attorney’s attention. Writing letters is the way to go. It puts them on notice that (1) you have some legal knowledge, (2) you want your children back, (3) you want a better quality of representation than they are giving to most clients.
If I were to write a letter to an attorney in a new CPS case, it might go something like this:
You have been appointed to represent me as an attorney in the county juvenile court. Be on my side; I need your help. I am fighting for the release of my three children from state custody. I am innocent of any wrongdoing. The caseworker made assumptions about me that are false. My children need to be at home with me, for their well-being - mentally, emotionally, and physically.
While you are my attorney, please keep in mind that you are working for me, not for the county that pays you. As my attorney I expect you to give me the best legal representation available. I therefore request face-to-face meetings with you at least once monthly to make sure you are actively working on my case, and not letting it slide between the cracks.
I understand that many court-appointed attorneys tend to simply guide parents through the juvenile court system, advising them to plead guilty to charges to make things easier for everyone else in the courtroom. This is not the kind of representation I’m requesting. I’m asking you to be actively involved in proving my innocence.
I’m hereby asking that you take my case to trial and make the caseworker prove all charges. Since they are false charges, I think it would be in my best interest, and the best interest of my children, if I were to fight to prove my innocence with a full trial. Do not under any circumstances ask me to plead guilty to false charges against me.
As you know, parents involved in CPS cases have to complete a ’service plan’ yet many do so and still do not get their children returned. I would like to avoid doing any kind of ’services’ and request that you refuse all services, and/or force the caseworkers to prove the need for any services requested. I do not want to be in the position of many parents in these cases forced to have psychological evaluations when there is no evidence of mental illness, or forced to do drug testing when there’s no evidence of drug abuse. Please honor my request, protect my best interests, and see that my time is not wasted by unnecessary court-ordered ’services’. Of course they would also be a waste of taxpayer money. Do everything you can to resist these services in my case. As you are my attorney I’m trusting you to fight these issues individually and fiercely.
I expect you to be 100% aware of what is happening with my case at all times, and to inform me immediately of any changes.
I expect you to obtain and share with me a complete copy of the case file including all case narratives.
I expect you to help me compile substantial evidence to prove my innocence in this case by preponderance of the evidence.
I expect you to produce legal paperwork including a complete response to all caseworker reports, declarations supporting my side of the case, and other documents as needed, and to present those documents to the judge or juvenile court referee who hears our case.
I expect you to do everything you can to prevent my name from being included on the central index, blacklisting people from working with children. I am innocent and my name should not be included on that list.
Please respond to my requests in writing within ten days; I will need your written response for my records in this case.

Comments? I would like to get other ideas from the people reading this on what could be included in letters to attorneys. What do you want from your attorney? Let’s brainstorm this and come up with some great ideas that people who come here in the future will be able to benefit from. Are there any phrases all letters should contain? Anything you think we shouldn’t ask the attorney?
