He gets confrontational and targets the neighbors.”&lt;br /&gt;&lt;br /&gt;Civic leader Roe Daraio, president of Communities of Maspeth and Elmhurst Together, has been working with 66th Street residents in hopes of forcing the city to take action. “It’s not really progress, but the guy is in jail right now,” she said. Adjacent residents were affected when a pipe in the house burst last year and are concerned that the house will be left to deteriorate, added Daraio.&lt;br /&gt;&lt;br /&gt;Neighbors have informed Daraio that Nasser, 25, is enrolled in an out-patient drug treatment program at Elmhurst Hospital Center and blew up a garage behind the home while getting high several years ago. “He gets confrontational with neighbors, invites teens over there, and meanwhile the house has gone into serious decay,” said Daraio, echoing the laundry list of complaints she has heard from neighbors. “He’s in jail now, but that’s not solving the problem. For six months, they’ll be fine, but it’s a Band-Aid effect.”&lt;br /&gt;&lt;br /&gt;Daraio has reached out to local elected officials for assistance, but thinks the city needs to go after Nasser for failing to maintain the home. “Maybe if the family starts getting violations, they’ll start paying more attention,” she said, adding that Nasser lives there alone and is supported by his relatives. “To give him free reign of a private house, I don’t think is the smartest thing. It’s become the neighbor’s problem, and it shouldn’t be that way. It’s a quiet block, and everyone is friendly with one another.”&lt;br /&gt;&lt;br /&gt;Residents agree that the city needs to step up and secure the house so that it doesn’t pose a danger to local children or cause damage to adjacent properties. “The city has to condemn that house – that’s the bottom line,” the longtime resident said, adding that he fears a physical confrontation will eventually occur. “Somebody is going to get hurt. It’s been ratcheting up since the summer.”&lt;br /&gt;&lt;br /&gt;A visit to the empty house this week showed how the situation could become inviting to squatters and drug users. The front windows were wide open, and the unfurnished living room was strewn with trash. Neighbors worry that teenagers who used to hang out with Nasser will continue to use the house to get high while he is incarcerated.&lt;br /&gt;&lt;br /&gt;An officer from the 104th Precinct’s Community Affairs Unit confirmed that Nasser was recently locked up, but said he was unaware of ongoing issues with neighbors. Addabbo was elected to the Senate last year to replace longtime Republican Serf Maltese, leaving some of the groups and people who worked to elect the Democrat feeling let down when he didn’t support the law.&lt;br /&gt;&lt;br /&gt;At the same time, much of Addabbo’s district, which stretches from Woodside south to Howard Beach, is made up of socially conservative voters in neighborhoods such as Glendale and Middle Village who oppose gay marriage. As a result, Addabbo was left in a tough spot as he is now being viewed as a major reason the bill was defeated 32 to 24.&lt;br /&gt;&lt;br /&gt;Throughout the weeks of debate leading up to the vote, Addabbo refused to reveal how he personally stands on the issue. Instead, he says that more than 400 constituents contacted his office in the weeks leading up to the vote, on top of the many more he spoke to each day. Addabbo says about three quarters of the constituents he heard from on the issue were against allowing gay marriage. “This decision of mine was totally constituent driven,” continued Addabbo.&lt;br /&gt;&lt;br /&gt;“When I took the oath of office, it was to represent the opinions of the people, and it was very clear that… the residents who I represent in Albany are against marriage equality.” He says not divulging his personal stance allowed him to receive an accurate and clear picture of his constituents’ views, instead of just having residents on one side of the debate contact him.&lt;br /&gt;&lt;br /&gt;During the interview, Addabbo repeatedly stressed that the role of an elected official is to get the community’s consensus on an issue. “I keep saying that my personal feeling is my personal feeling, and it’s only one opinion, so I take my opinion out of it and go with the views of many,” he said. “When you have issues along the lines of civil rights, religion or other personal beliefs people have, certainly their voices should be heard… When it came time for a vote, my people had been clear.”&lt;br /&gt;&lt;br /&gt;While Addabbo called this “one of the hardest” votes he has been part of during his career in politics, he noted that, unlike budget and tax decisions, it only impacts a small portion of the community. “I knew at some point we would have to take up this issue, and there still will be hard issues in the future and I’ll try to get the consensus of my people again in the future,” he said.&lt;br /&gt;&lt;br /&gt;Now that a vote has finally been cast on this emotional subject, Addabbo stressed the importance of moving ahead with other state business. “I think the idea here is, we did this issue - which was ery important to many - but we have very serious issues that lie ahead that affect everyone” including budget, education, transportation and public services, he said. “We definitely need to move forward with issues that affect the daily lives of constituents.”&lt;br /&gt;&lt;br /&gt;Looking ahead at his own political future, and the possibility that he alienated portions of the Democratic and liberal base that helped get him elected, Addabbo maintained that he never made promises to groups regarding gay marriage.&lt;br /&gt;&lt;br /&gt;“One thing I’ve been consistent with was that I kept an open mind and never committed myself to a yes or no,” he said. “I am grateful to all those who supported me, including members of the gay community, but they did that as everyone did, not knowing if I was a committed yes.”&lt;br /&gt;&lt;br /&gt;Addabbo said he couldn’t base his decision on the possibility of facing a Democratic primary next year, even though his vote has made that much more likely. “My philosophy is to do my work to the best of my ability, and I put that body of work, both legislation and constituent service-wise, on the lien every other year, and it’s up to the people to judge me I hope not on one issue, but on a whole bunch of issues I put work into.”&lt;br /&gt;&lt;br /&gt;He said he “can’t be hung up” on the prospect of facing a party primary challenge on the basis of one vote. “If there is a primary, I’ll put my record up against my opponent, and if there is a general, I’ll put my record up against that opponent.”&lt;br /&gt;&lt;br /&gt;Addabbo did seek to debunk one theory that has been presented since the vote: that his vote, which came early in the roll call due to his last name, set off a chain reaction that led other Democrats to also reject the bill. “We knew going into the chamber that there were not enough votes, so the myth that I caused a chain reaction didn’t happen,” he said. “If you do the math, eight other Democrats were solid with their no votes. This issue really wasn’t as cultivated as much as it should have been, and we didn’t have enough votes going in.”&lt;br /&gt;&lt;br /&gt;The other Queens Democrats voting against the bill were George Onorato (Astoria), Hiram Monseratte (East Elmhurst) and Shirley Huntley ( Jamaica), while borough Democrats Toby Ann Stavisky (Flushing) and Malcolm Smith (St. Albans) supported the measure. However, work at the 6.6-acre property, which is also bounded by the Horace Harding Expressway,   62nd Drive and 97th Street, is entering the final stages in advance of an opening this spring.&lt;br /&gt;&lt;br /&gt;The 600,000-square-foot shopping center, developed and managed by Vornado and owned by Alexander’s Inc., is adjacent to the Rego Park Mall, which features an Old Navy, Sears and Bed Bath &amp; Beyond. The new four-level center is slated include a 138,000-square-foot Costco, a 134,000-square-foot Century 21 and a 132,000-square-foot Kohl’s. The Costco was included after Home Depot withdrew from the project, and T.J Maxx is also in the process of signing a lease with Vornado for space at the center.&lt;br /&gt;&lt;br /&gt;Frank Gulluscio, district manager of Community Board 6, said he plans to meet with city Department of Transportation officials to ensure the shopping center doesn’t cripple the neighborhood. “I am going to meet with DOT to make sure that the plans that were initiated come to fruition,” said Gulluscio. “The impact of that mall is going to be huge, which everyone knew… We’re going to be inundated with traffic, everybody knows that, but this has all been worked out, so we want to make sure everything is in place.”&lt;br /&gt;&lt;br /&gt;One big change from the initial proposal is the elimination of two residential towers that were planned when ground was broken at the site in 2006. Vornado has constructed the building so one of the towers can eventually be built when the market rebounds, according to Gulluscio. “It’s definitely on hold, but the footprint is there so they can build them,” he said. “They built what’s there now with the full intentions of having the towers, so all that stuff is ready to go if they decide they can do that.”&lt;br /&gt;&lt;br /&gt;The original plans also included space for a Wal-Mart, but that plan was met with opposition from the City Council after word of that agreement began circulating in 2004.&lt;br /&gt;&lt;br /&gt;Gulluscio welcomed the switch from Home Depot to Costco, which he says will be useful to a wide range of residents. “There is such a need for a Costco type store in that part of Queens, so this board feels that is a positive thing,” he said. “If you think about that side of Queens Boulevard, there are some small supermarkets, but nothing that can compare to a Costco.”&lt;br /&gt;&lt;br /&gt;He noted that residents at recent CB 6 meetings are eagerly anticipating the additional shopping options close to home, which Gulluscio noted should be an “economic boom” for Queens, as many residents currently head to Long Island. “People want it open now, they’ve dealt with the construction, so there is a sense of ‘Ok, let’s get it open now,’” he said. “The fact that we could stop people from going to Nassau County and keep the tax base here, is the beauty of this whole thing.”&lt;br /&gt;&lt;br /&gt;While the property is in the City Council district to be represented by Daniel Dromm beginning in January, much of the impact will likely occur in the Rego Park and Forest Hills area that Karen Koslowitz is preparing to represent. Her spokesman, Greg Lavine, said that Koslowitz "plans on working closely" with the community board and Dromm "to ensure that the transportation situation makes sense for the residents of the area."&lt;br /&gt;&lt;br /&gt;A traffic study was previously completed, but Koslowitz still wants to follow up with the DOT and community board "to make sure that all issues are looked at, and that any changes that are needed to be made are accomplished in time for the mall opening," said Lavine.&lt;br /&gt;&lt;br /&gt;"The opening of this mall really presents a great option for Queens and all of New York City, and we hope this will keep residents shopping in Queens and provides a service that hasn't been here," the spokesman added.&lt;br /&gt;&lt;br /&gt;The large anchor stores will occupy space in the mall’s cellar and upper levels, leaving space on street-level for smaller stores and restaurants. Subway sandwich restaurant has signed a lease for one of the storefronts. Since it only recently signed on, Costco isn’t expected to open until the summer.&lt;br /&gt;&lt;br /&gt;The center also contains a parking garage with approximately 1,400 spaces and a 2,500-square-foot community center. In all, the project is expected to cost more than $400million. Kids need stability and structure. If we’re closing schools, bringing in new principals and new teachers, we continue to take stability away from these students.” Ulrich says this is a classic example of band-aid measures that won’t hold up in the long term. “Kids need to come to school each day and know there is a system—there is order.”&lt;br /&gt;&lt;br /&gt;The Department of Education announced its decision to phase Beach Channel High School out of operation beginning in the 2010-2011 school year. Beach Channel will begin phasing out one grade per year, with Grade 9 eliminated in 2010-2011; grade 10 eliminated in 2011-2012; and grade 11 will be eliminated in 2012-2013. Beach Channel will close in June 2013. Nearby, Jamaica High School, which also serves grades 9-12 will be phased out of operation during the 2010-2011 school year.&lt;br /&gt;&lt;br /&gt;The eventual closure of Beach Channel will provide space at its current location of 100-00 Beach Channel Drive to house 27Q324, a new school. The DOE is proposing a new high school as Beach Channel phases-out. 27Q324 will open in 2010-2011 with grade 9 and will serve grades 9-12 at scale. DOE says the phase-out and eventual closure of Beach Channel and phase-in of 27Q324 will address the need to provide higher quality high school options throughout the City. According to a press release, the DOE says it will continue to assess the available space and needs for additional options at Beach Channel in 2011 and 2012.&lt;br /&gt;&lt;br /&gt;The decision to eventually close the school is the result of a DOE evaluation and determination that the school does not have the ability to improve student performance. The department’s framework mandates that schools scoring either a D or an F in progress reports are subjected to the institution of school improvement measures. If no significant progress is made over a three-year time period, the DOE will implement a leadership change, restructure or possible closure.&lt;br /&gt;&lt;br /&gt;The same is true for schools receiving a C for three years in a row and for schools that the Chancellor has determined lack the necessary capacity to improve student performance.&lt;br /&gt;&lt;br /&gt;In accordance with feelings expressed by Councilmember Ulrich was a spokesperson for the United Federation of Teachers (UFT), District Representative for Queens High Schools, James Vasquez. “The UFT really feels that the DOE and the chancellor are responsible for every single school and every single child—the same way a teacher is responsible for every student in their classroom and the principal is responsible for every teacher in the building.”&lt;br /&gt;&lt;br /&gt;Vasquez says the DOE has “abandoned” the schools. “The schools they’ve deemed to be failing and not achieving have been the same way for at least the past 7 years. Where has the DOE been?”&lt;br /&gt;&lt;br /&gt;Instead, critics of the DOE’s intended plan say it will not serve students, their families or school faculty and staff. “They [DOE] have other choices,” said Vasquez. “They don’t have to upend students, parents and families.”&lt;br /&gt;&lt;br /&gt;The public will have the opportunity to attend hearings scheduled at each school in early January. That plan has been delayed for years, leaving the structure to deteriorate at the intersection where Maspeth, Middle Village and Ridgewood meet.&lt;br /&gt;&lt;br /&gt;“I am excited that the LIRR has approved our plan to clean up and green up the property,” said Crowley in a statement. “For the past decade this abandoned old newsstand has invited graffiti, vandalism and traffic. As one of the busiest intersections in Queens, beautifying this corner will help east traffic tension, reduce crime and attract consumers to surrounding businesses.”&lt;br /&gt;&lt;br /&gt;The next step, according to Crowley, is securing funding for the project. Her office is estimating that about $100,000 will be needed to demolish the structure and replace it with greenery and benches. She plans on working with city and state officials, including Assemblymembers Mike Miller (D-Glendale) and Cathy Nolan (D-Ridgewood) in hopes of finding money to complete the intersection’s transformation.&lt;br /&gt;&lt;br /&gt;“This is an important community initiative,” said LIRR President Helena Williams. “We are working with Councilmember Crowley to help the community identify a source of funding for removal of the old newsstand building and to develop a green area.”&lt;br /&gt;&lt;br /&gt;The intersection is one of the busiest in the borough, with six different bus lines passing through the area each day, along with thousands of vehicles and pedestrians. At a recent hearing on the MTA’s 2014 capital plan, Crowley testified about the property and provided board members with photos of the abandoned LIRR-owned properties. A study which tracked the number of meals served in Queens this year as compared to 2006, shows a 106% increase for 2009 - an additional 14.3 million meals served. Overall 87,552 Queens households were either unable to obtain enough food for their families or were uncertain about having enough food. Throughout the county the total number of meals served between July 2008 and July 2009 is 27.7 million.&lt;br /&gt;&lt;br /&gt;The term food insecurity has been coined to define households that are uncertain of having or acquiring enough food for all members and the number of those families rose in 2007 from just over 10 percent of U.S. households to nearly 15 percent by the end of 2008. Across New York, approximately 800,000 households are now food insecure, with the number of meals served by emergency food outlets across New York rising by early 60 million – an increase of 55 percent. In New York City, approximately 340,000 households are food insecure, with nearly 50 million more meals served by emergency food outlets since 2006 – an average increase of over 75 percent.&lt;br /&gt;&lt;br /&gt;In response to the crisis, U.S. Senator Kirsten Gillibrand has introduced legislation in an attempt to spearhead an increase in charitable donations this holiday season. The legislation will provide double federal funding for the Emergency Food Assistance Program (TEFAP), make the Good Samaritan Hunger Relief Tax Incentive permanent to encourage more businesses to fill food banks with unused food items, and extend tax credits that incentivize seniors to donate portions of their retirement savings to New York charities.&lt;br /&gt;&lt;br /&gt;“The holiday season is a time for giving, but because of the bad economy, New York families that typically donate food, warm clothes and other basics to those in need just can’t afford to this year,” Senator Gillibrand said. “As a result, food bank shelves have gone bare, and hunger and food insecurity have reached disturbing, historic highs. We need to make sure we’re helping New York children and families who were hit the hardest by this economy. So this holiday season, I have a plan to double federal funding for emergency food outlets like food pantries and soup kitchens, make tax credits permanent for businesses that donate to food banks, and extend tax credits for seniors who donate to New York charities.”&lt;br /&gt;&lt;br /&gt;Charitable giving fell 2 percent to $308 billion last year -- the first decline since 1987, according to the annual report published at Indiana University, Giving USA. Last week, he was sentenced to 75 years in prison by Queens Supreme Court Justice Gregory L. Lasak.&lt;br /&gt;&lt;br /&gt;“The defendants disturbingly cowardly attacks on elderly and defenseless women – two of whom needed the aid of a walker to get around – has rightfully cost him his future,” said Queens District Attorney Richard Brown. “He will now spend the rest of his life behind bars, never again having freedom to breathe fresh air or the opportunity to prey on society’s most frail and vulnerable citizens.”&lt;br /&gt;&lt;br /&gt;According to trial testimony, Rhodes accosted 51-year-old Angela Khan as she entered her 182nd Street residence in Jamaica through the basement garage on the evening of Dec. 30, 2006. Rhodes punched and kicked Khan while robbing her of cash and other personal property, causing her to suffer a fractured nose, black eyes and lacerations to her face which required six stitches. The attack was caught on surveillance tape.&lt;br /&gt;&lt;br /&gt;Shortly before noon on March 2, 2007, the superintendent of a Devonshire Road building in Jamaica confronted Rhodes, who was trespassing in the basement, and ordered him to leave. The super watched as Rhodes left the property with a red, pink and black bike.&lt;br /&gt;&lt;br /&gt;Less than an hour later, Rose Morat – who was 101 years old at the time and uses a walker – was caught on surveillance video exiting the elevator on the main floor of her Highland Avenue building. Rhodes approached her in the vestibule and offered to open the front door for her. Rhodes then repeatedly punched Morat on the left side of her face while demanding money from her. The defendant then grabbed her pocketbook, which contained $33 and her house keys, before knocking her to the ground and fleeing on a bike. Morat sustained a fractured cheekbone, bruises and facial swelling in that attack.&lt;br /&gt;&lt;br /&gt;About a half-hour later, 85-year-old Solange Elizee, who also uses a walker, was getting on the elevator of her 170th Street building at the lobby level when she saw Rhodes already on the elevator. Elizee exited the elevator alone one floor below her apartment and waited for the next elevator. As she exited on her floor and entered her apartment, Rhodes blocked the door from closing and forced his way inside.&lt;br /&gt;&lt;br /&gt;Once inside the apartment, Rhodes repeatedly punched Elizee in the face, knocking her to the floor. The defendant then removed two yellow metal rings from her hand and took her pocket book, which contained $32. Mickey will be greatly missed by all of Howard Beach.&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The Eulogy of Mickey Hornung&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;&lt;em&gt;Delivered on Saturday, November 28 Our Lady of Grace Church by Mickey’s sister, Maureen Hornung&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;My brother Mickey was the sweetest gentlest little boy I ever met. He was kind, quiet and unassuming as a child—yet he was no coward. He never gave my parents or teachers an ounce of trouble. He was a wonderful brother, but had the unfortunate distinction of having my older brother Johnny as his big brother when Johnny was refining the art of teasing.&lt;br /&gt;&lt;br /&gt;Although much of Johnny’s good natured teasing was directed toward Mickey, who was naïve and gullible as a child, Mickey adored Johnny and was always following him around, which made him an easy target. When things occasionally got too much, Mickey came to me to tell on Johnny. In those days, kids didn’t run to their parents unless there was a calamity but attempted to work out disagreements on their own. Like the Little Rascals and Charlie Brown, parents were always busy doing grownup things. He and my brother Johnny grew up to be close friends, confidents and inseparable for good and sometimes the not so good. Their escapades were legendary in Howard Beach.&lt;br /&gt;&lt;br /&gt;My fondest memory of Mickey occurred one Sunday morning when he was about 7 years old. His beloved salamanders, Sally and Mander (they actually turned out to be Sal and Mander), appeared to be lifeless. He ran to tell my parents who were preparing for mass. They told him that they would have a funeral when they returned from church. &lt;br /&gt;&lt;br /&gt;Ever organized, Mickey took it upon himself to hold the funeral and bury his salamanders in the back yard. When my parents returned he ran up to tell them that he had taken care of the situation. My mother replied, “What if they weren’t dead?” He said it was OK because he buried them with their heads sticking out of the ground in case they were still alive.&lt;br /&gt;&lt;br /&gt;At age 24, Mickey took on the adult responsibility of organizing the funeral of our father and later in his life, the arrangements for our brother Johnny, both of whom died at an early age.&lt;br /&gt;&lt;br /&gt;When I spoke to my sister Annemarie who was in Florida, she was so happy that she came up for Camille’s 50th costume party last month so she could remember him as he was that night. I said “Yes” but reminded her that he was dressed as a “Whoopee Cushion” at the time.&lt;br /&gt;&lt;br /&gt;Over the past three days, I have heard comments about him ranging from loyal, sweet, gentle, good friend, trustworthy to goonbaka, and if he said ‘ZSA, ZSA one more time, I was going to beat him!” Let’s face it, Camille was a saint and he adored her. She was good to him and took care of him and my family is forever grateful.&lt;br /&gt;&lt;br /&gt;Mickey was a loving husband to Camille and unconditionally supportive and loving father to Bettina and Michael. He was a good family man, like his father before him, a generous, loving brother to his siblings and a respectful son.&lt;br /&gt;&lt;br /&gt;Some of you may remember Mickey for his good deeds to this community, some as a childhood friend, others as a devoted family member. I will remember him as my little brother who thought I could fix everything and everybody.&lt;br /&gt;&lt;br /&gt;As you know Mickey’s life was an open book and sometimes… you were literally a character in it. Yet he was never mean or vindictive. Mickey dealt with his personal tragedies with dignity and forgave his trespassers with grace.&lt;br /&gt;&lt;br /&gt;“Blessed are the pure in spirit for theirs is the kingdom of heaven. If there is a heaven and he wanted to go there, I am certain that there is a spot for him.&lt;br /&gt;&lt;br /&gt;When he gets to the pearly gates, I know he will be ushered in without hesitation…Unless of course, my brother Johnny is there convincing him to take one last adventure with him.&lt;br /&gt;&lt;br /&gt;Thank you for celebrating my brother’s life with us. I know that his passing has affected most of you in some way, and I couldn’t let it pass by without a farewell column in his honor.&lt;br /&gt;&lt;br /&gt;Those of us that know Mickey know he took the writing of each article very seriously. Although each article had some flaws, a misspelling or a run-on sentence, they were all from the heart. (I am not a professional writer so you may find the same things in this article also.) What made them special was that they took us back to a time of childhood innocence. A time before fears of losing jobs, raising families, and paying bills were even thought about. A time of worrying about the health and well-being of our parents, children, families, friends, and ourselves were even a concern. To lose yourself for those few minutes in each column was a relief.&lt;br /&gt;&lt;br /&gt;What was our biggest concern back then? For the boys, it was getting the newest pack of baseball cards, making sure your baseball mitt was oiled and formed perfectly. To being at the schoolyard on time for whatever was going on. For the girls, the right Barbie dolls, what were we going to wear so the ‘cute’ guy will notice, or what the new type of shoe to get was. Our biggest worry was to make sure we were home for dinner by the last chime of the church bells, and home at night by the time the street lights went on. We were gone for hours without contact with our parents. No cell phones or any connection to those who would worry about us. Lost innocence.&lt;br /&gt;&lt;br /&gt;How great that Mickey could bring us back to better days. I was fortunate that I was present for some of the things he wrote about. (The squeaky step at the top of flight of the stairs was scary to this young girl) One of the articles that I remember the most and still brings a smile to my face was the nickname article. Who had names back then? How many people approached me in my youth to ask if my parents actually named my brother John Mugger? Who would do that to a child? That did not stop us, however. My uncle Harry, Mickey’s dad, gave each and everyone a nickname, whether you wanted one or not.&lt;br /&gt;&lt;br /&gt;A couple of months ago I sat and asked Mickey a question that was on my mind since childhood. He was a great singer and I had always heard stories of him trying out for a roll in the original Broadway version of Jesus Christ Superstar and coming in third for the roll of Judas Iscariot. When approached he assured me the story was true but he didn’t go through with it because he was about seventeen or eighteen at the time and he would have to wear tights for part of his costume and he didn’t want his friends and his girlfriend at the time making fun of him. In response I told him he could have been an actor today and could have had money and everything. As I rambled on he response to me was a simple “Yeah but would I have been happy?”&lt;br /&gt;&lt;br /&gt;The bible states that Jesus says “Bring unto me the little children”. That is how I will always remember my cousin. He had the ability in every article to bring unto ourselves the little child. The impact caused the bus to spin around before flipping onto its left side, striking parked vehicles in the process.&lt;br /&gt;&lt;br /&gt;The children had exited the bus by the time emergency workers arrived at the scene. They were treated for minor injuries and taken to Jamaica Hospital for observation. A woman who answered the phone at the school on Wednesday said none of the children suffered serious injuries and all were discharged from the hospital later that day. They were on the way home from school when the accident occurred, said the woman, who asked not to be identified.&lt;br /&gt;&lt;br /&gt;The bus was operated by a private company and is assigned to the school through the city Office of Pupil Transportation, according to the school. Several approached Councilwoman Elizabeth Crowley (D-Middle Village) with their concerns over the past year, which prompted her to write at least four letters to Department of Transportation Borough Commissioner Maura McCarthy requesting that safety measures be implemented.&lt;br /&gt;&lt;br /&gt;In June, McCarthy responded with a letter informing Crowley that an analysis that considered factors such as vehicle and pedestrian volume, accident history, vehicle speeds, visibility and sign spacing was completed by her office. Based upon that study, McCarthy determined that all-way stop signs were not needed at 69th Road and 76th Street, but agreed to install a “stop ahead” sign along that stretch.&lt;br /&gt;&lt;br /&gt;Following Tuesday’s accident, Crowley wrote yet another letter pushing for a stop sign at 69th Road and 75th Street. Raymond Sheehan in February of 2008.&lt;br /&gt;&lt;br /&gt;Now Sheehan is facing a murder trial and because of one judge’s ruling, will have to do so without the benefit of expert testimony to demonstrate the extent of the physical and mental abuse she suffered from for almost twenty years. &lt;br /&gt;&lt;br /&gt;This week, Barbara Sheehan recalls her life as an abused woman and explains what happened on the day she shot her husband.&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;I SHOT MY HUSBAND&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;“I shot him because he was going to kill me. Finally he was going to end it all and shoot me. So I shot him.” Barbara Sheehan says that on the morning she killed Ray Sheehan he had been in the bathroom shaving, one of his handguns resting on the sink next to him. They had been arguing since the night before.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;THE NIGHT BEFORE&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;“We went up to see my son at school. I brought him chicken cutlets and returned some laundry.”  But as soon as they got in the car to leave Sacred Heart College, Ray Sheehan turned, without notice, and delivered a blow to her face that immediately sent blood gushing from her nose and pain shooting through her head. “I thought right away that it [my nose] was broken. There was so much blood and it hurt so much.” And Barbara says, “It didn’t stop there. He tried to throw me out of the car on the Merritt Parkway.”&lt;br /&gt;&lt;br /&gt;Barbara Sheehan continued. “I was afraid to get out of the car. It was a wooded area and I was bleeding so much. No one was around.” All she wanted was to get home and go to the hospital. After arguing on the side of the road Ray Sheehan gunned the car back on to the parkway and headed toward home.&lt;br /&gt;&lt;br /&gt;But the rest of the ride was filled with more verbal abuse, slaps, punches, pinches and anything else Ray Sheehan could manage from behind the wheel of the moving car. This episode had been brought on because Barbara had told her husband that she would not accompany him on a trip to Florida scheduled for the next morning.&lt;br /&gt;&lt;br /&gt;“I was afraid to go away with him - to be alone with him in another state. My sister-in-law warned me not to go — she said he was going to kill me.” The sister-in-law she spoke of was married to Sheehan’s twin brother. The couple knew of Ray’s abuse and had gotten Barbara information on a domestic violence hotline and some support groups where she could go for help.&lt;br /&gt;&lt;br /&gt;When they arrived home, Barbara was covered in blood--the cartilage from her nose displaced and moved completely over to one side. “I looked in the mirror and saw my whole nose on the side of my face. I just wanted to go to the hospital.”&lt;br /&gt;&lt;br /&gt;But Ray Sheehan refused to take her. “I got my coat and left the house. I was going to walk to the hospital.” And on her way down the street Barbara used her cell phone to call her sister-in-law. “She told me to get out of here as quickly as possible, that Ray would probably be enraged because I had left.” As she hurried away, she heard the sound of a speeding car coming toward her — she turned and saw Ray Sheehan in their car. “I have to go,” she screamed into the phone, “he’s coming for me.”&lt;br /&gt;&lt;br /&gt;Screeching to a halt, he pulled up and demanded she get into the car. They drove to St. John’s Hospital on Queens Boulevard. “He told me to get out and that he was going to wait right there. He wasn’t going in with me and warned me to keep my mouth shut.”&lt;br /&gt;&lt;br /&gt;Inside the hospital Barbara Sheehan waited for treatment, but within a few minutes of her arrival, the cell phone began to ring. “He was calling to say that if he saw any police pull up he would know that I had called them. If that happened he said, hewould leave and go kill my family. ‘You know I have the guns with me—if you open your mouth, I’ll go out in a blaze of glory and your family will be dead.’”&lt;br /&gt;&lt;br /&gt;Over and over her phone rang or beeped with text messages. Numerous calls and texts with more threats about keeping silent or paying the consequences. Finally when she grew too afraid to continue waiting for treatment, Barbara Sheehan left the hospital and returned to the car.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;THE SHOOTING&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;The next morning the arguing continued, her husband infuriated over her refusal to go to Florida. “He was in the bathroom with one of his guns on the sink next to him. He was so angry because of Florida. And I knew. I just knew he was going to kill me.” It was then she says that he picked up the gun to threaten her. Barbara Sheehan ran into the bedroom where she grabbed another of Ray’s handguns.&lt;br /&gt;&lt;br /&gt;“I came out of the bedroom with the gun. I wanted to get downstairs and get out of the house.” But Raymond Sheehan saw his wife heading for the stairs. Gun in hand, he turned and aimed it at her. “I knew he was going to shoot me and I just started firing.”&lt;br /&gt;&lt;br /&gt;&lt;a onblur="try {parent.deselectBloggerImageGracefully();} catch(e) {}" href="http://2.bp.blogspot.com/_5jNcZftGVF8/SxnQe5gnKlI/AAAAAAAABfg/xS5Dre8uFy0/s1600-h/bullets.jpg"&gt;&lt;img style="float:left; margin:0 10px 10px 0;cursor:pointer; cursor:hand;width: 315px; height: 320px;" src="http://2.bp.blogspot.com/_5jNcZftGVF8/SxnQe5gnKlI/AAAAAAAABfg/xS5Dre8uFy0/s320/bullets.jpg" border="0" alt=""id="BLOGGER_PHOTO_ID_5411585656514619986" /&gt;&lt;/a&gt;Media reports have consistently made inaccurate claims that she emptied 11 shots into the back of her husband, however, the autopsy report clearly proves that Raymond Sheehan was not shot in the back--the entry wounds were from the side of his body, consistent with Barbara’s story that he turned toward her aiming his gun.&lt;br /&gt;&lt;br /&gt;After a documented history of almost twenty years of being beaten, Barbara Sheehan shot her husband. Ray Sheehan dropped to the floor; he was dead. Barbara Sheehan was downstairs on the phone. She called her sister, Robin, who arrived at the house minutes later. She found Barbara on the floor huddled in a fetal position. Robin called 911.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;LOOKING TOWARD TRIAL&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;According to Barbara Sheehan’s attorneys, psychiatrists, psychologists and national experts on domestic violence all agree that those with little to no personal exposure to domestic violence are likely not capable of comprehending the harm which these abusers repeatedly levy on their victims.&lt;br /&gt;&lt;br /&gt;Those unfamiliar with domestic abuse are most often unaware that this abuse devastates its victims with induced trauma on the emotional, psychological and physical levels. Typically, it is through the testimony and shared experience of expert witnesses that jurors can gain insight to the typical lives of abusers and their abused.&lt;br /&gt;&lt;br /&gt;&lt;a onblur="try {parent.deselectBloggerImageGracefully();} catch(e) {}" href="http://4.bp.blogspot.com/_5jNcZftGVF8/SxnQ0L4YWgI/AAAAAAAABfo/ysbQH2LU1zw/s1600-h/sheehan+outfit.jpg"&gt;&lt;img style="float:left; margin:0 10px 10px 0;cursor:pointer; cursor:hand;width: 258px; height: 320px;" src="http://4.bp.blogspot.com/_5jNcZftGVF8/SxnQ0L4YWgI/AAAAAAAABfo/ysbQH2LU1zw/s320/sheehan+outfit.jpg" border="0" alt=""id="BLOGGER_PHOTO_ID_5411586022223403522" /&gt;&lt;/a&gt;When Barbara Sheehan stands trial for her husband’s murder, she will have to do so without the benefit of such witnesses due to a ruling handed down in early November by Justice Arthur Cooperman. The ruling prohibits the inclusion of expert psychological and psychiatric testimony.&lt;br /&gt;&lt;br /&gt;Now attorney Michael Dowd will search for a mechanism to overturn Cooperman’s decision — or find a way to bring a defense as strong as that which has been disallowed by the judge. “We’re in trouble here... what I don’t want is this terrific lady to go to prison,” said Dowd, “and be forced to stay there while we fight for an appeal. There is no reason for that. All we want is the right to present the evidence. We’re only asking for a fair trial by jury.”&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;LOOKING BACK&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;“When I think of life before, I just stop and try to think of life now. It’s so much better. I am safe. I may go to prison. But my kids and my family they are safe.” Then Barbara Sheehan comments on the irony. “Ray always told me that I could never escape him. He used to say that the ADA’s and the judges and the police ‘they all stick together Barbara.’ Now I see he was right—it’s as though he were reaching out from the grave.”&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style:italic;"&gt;Photos: More than 400 rounds of ammunition recovered by police from Raymond Sheehan’s nightstand following his death. Starting from the age of 4, the 23-year-old nurse at Memorial Sloan Kettering says her earliest memories of the violence in her home were the sounds of screaming and things breaking downstairs beneath her bedroom.&lt;br /&gt;&lt;br /&gt;&lt;em&gt;“I didn’t get up from my bed… I remember going to sleep scared.”&lt;/em&gt; Jennifer continued recounting a series of harrowing childhood experiences during an interview with &lt;em&gt;The Forum&lt;/em&gt;. One by one she dredged up the memories of the household where a mother’s love was the only barrier between two children and their raging, abusive father.&lt;br /&gt;&lt;br /&gt;&lt;em&gt;“He would never say anything to us.” &lt;/em&gt;Jennifer recalled coming home from school; her father sitting on the sofa reading the newspaper. &lt;em&gt;“He never even looked up.”&lt;/em&gt; There were no happy times in the Sheehan house when Raymond Sheehan was there. &lt;em&gt;“You would never know what would set him off. If something wasn’t where he wanted it, that was more than enough for my mother to get beat.”&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;Even mealtime was a trauma, especially when Raymond Sheehan didn’t like the menu. &lt;em&gt;“My brother and I love my mother’s sauce. I remember one night when we were eating. She put the dish down in front of him—it was right off the stove. He picked up the dish and poured the whole thing over her head.”&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;And there were other times, many of them when Jennifer says she and her brother, Ray, saw their mother getting beaten. One of the worst she can remember was after her mother had accidentally scraped the side view mirror on the car when pulling into the driveway.&lt;br /&gt;&lt;br /&gt;She heard crying and screaming coming from the living room downstairs. “&lt;em&gt;I came out of my room to look. My father’s gun was lying next to him on the table. He was on the couch, on top of my mother. He just kept punching her. All over her body. Harder and harder. She just cried and cried, begging him to stop. Asking him over and over again, ‘Why are you doing this?”&lt;/em&gt; But Raymond Sheehan never answered. He would finish with his beating, get up and go out.&lt;br /&gt;&lt;br /&gt;Of the beatings and the bruises, Jennifer says there are far too many to recall. &lt;em&gt;“Her eyes were black and blue. There were marks on her arm. And then I would see my mom in her pajamas, where other people did not. And there were bruises all over her.”&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;And the reflections of other violence in the house; when on occasion her father would use his hands on her. &lt;em&gt;“I remember one time, I was about eight. He grabbed me and picked me up. He threw me across the room. My mom got in between to help me. Then he beat her.”&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;Now Jennifer says she doesn’t get as upset as she used to when talking about the life she and her mother and brother spent with Ray Sheehan. She says life is much better. &lt;em&gt;“The most anxiety comes from worrying about my mom’s trial. We are still not free to move on until we have that behind us. But at least we are all safe.”&lt;/em&gt; And she says that she hopes her mom will have the chance to work helping other victims of domestic violence.&lt;br /&gt;&lt;br /&gt;When asked about the personal relationship with her father the pain in her eyes is obvious. &lt;em&gt;“There was no relationship. Never. Not with me and not with my brother. We didn’t go to his funeral and the only reason I went to his wake was because I had to see for myself that he was really dead. I had to see that now we were really safe.”&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;Of her mother Jennifer Sheehan says very simply, &lt;em&gt;“No matter what was going on with my mom, she never let anything get in the way of her love for us. She protected us from him. The trees were among 300 recently planted as part of the mayor’s PlaNYC effort.&lt;br /&gt;&lt;br /&gt;During overnight hours in September, an unknown vandal entered the park and cut the trees down. Unlike previous acts of vandalism, in which limbs were ripped off the trees, the perpetrator of the recent destruction clearly used a power saw to cut the trees down. The JPCA and several elected officials offered a reward, but the suspect wasn’t caught. A total of 20 trees have been victimized during several separate incidents this year.&lt;br /&gt;&lt;br /&gt;In response, the volunteers planted nine Snow Goose Cherry trees, two Kwanzan Cherry trees and three Bosnian Pines. Ed Dart of Dart’s Tree Farm in Long Island donated 20 elm trees in response to the vandalism. However, many are shocked at the city’s decision to only open the school up to one grade at a time, meaning it won’t be filled to capacity for four more years.&lt;br /&gt;&lt;br /&gt;The city Department of Education unveiled its proposed zoning map for the new 1,000 seat high school set to open on Metropolitan Avenue near Woodhaven Boulevard in time for the start of the next school year. Aside from expected disappointment and complaints from parents whose block wasn’t included in the zoning, many in attendance at PS 113 on Monday were surprised that the school will initially only be occupied by freshmen.&lt;br /&gt;&lt;br /&gt;The complex, which as been in the works for nearly two decades, includes the 1,000-seat high school, for which priority is being given to District 24 and District 28 students who live within the proposed zoning boundaries. It also contains a 6-12 school which has been set aside for students in District 28 and wasn’t part of Monday’s zoning discussion.&lt;br /&gt;&lt;br /&gt;Gaby Fighetti, senior director of enrollment at the city DOE, said the main goal is to “set up this high school to be a success.” The goal was to create a zone that will eventually include about 250 students from each grade level, with half the seats set aside for District 24 students and half for District 28 students. &lt;br /&gt;&lt;br /&gt;For the first year only, students living in an area previously zoned for another local high school such as Forest Hills or Hillcrest, but now included in the Metropolitan Avenue zone, will be allowed to choose which facility they attend. In future years, they will only be zoned for the new school.&lt;br /&gt;&lt;br /&gt;Priority will first be given to students living in the zoned area, and then to the rest of Queens before admission is opened up to residents citywide. The proposed zone was created using mapping software that contains addresses of enrolled students, explained Fighetti. “It’s all about density. You go out as far as you can go until you have too many families zoned,” she said.&lt;br /&gt;&lt;br /&gt;During Monday’s meeting, some residents requested changes to the proposed zoning, such as extending it further north so students don’t have to cross Queens Boulevard. Another asked if Cord Meyer residents currently zoned for Hillcrest would be allowed to utilize seats at Forest Hills High School that will open up as students enroll in the new Metropolitan Avenue complex.&lt;br /&gt;&lt;br /&gt;Fighetti said that since FHHS is already overcrowded, the department will not be redrawing zoning lines for that facility. “No matter where you draw the zoning lines, there is a family across the street that isn’t included,” she said, adding that while the DOE is willing to listen to arguments regarding the zoning, the rationale behind a change can’t simply be that a particular block or household isn’t included.&lt;br /&gt;&lt;br /&gt;However, a major point of contention was the DOE’s decision to open the new school up to one grade level at a time, meaning it won’t be filled to capacity for four years – even though nearby high schools are filled beyond capacity. In explaining the decision, Fighetti repeated the mantra of “setting the school up to succeed.”&lt;br /&gt;&lt;br /&gt;A DOE spokesman later told &lt;em&gt;The Forum&lt;/em&gt; that the department is “phasing in the school one grade at a time rather than opening all grades at once because research, as well as our experience, shows that new schools do better when they phase in gradually. While we understand that high school overcrowding is a serious concern in Queens, our first responsibility is ensuring that we’re setting up our schools for success. The Metropolitan Avenue complex will help alleviate overcrowding in nearby high schools starting when it opens in 9th grade next year, and as it adds new grades in subsequent years.”&lt;br /&gt;&lt;br /&gt;Still, many didn’t buy that rationale at Monday’s meeting. “We can’t have schools operating on five sessions,” said Dmytro Fedkowskyj, the borough president’s appointee to the Panel for Educational Policy. “We’re building state of the art buildings and we’re not even utilizing them… I think this is a mistake. Go back to the drawing board and utilize more of this school now,” he said to loud applause.&lt;br /&gt;&lt;br /&gt;Another resident suggested that the school be opened up to freshmen, sophomores and juniors initially, since most students wouldn’t want to transfer to a new school for their senior year anyway. Fighetti later denied a resident’s theory that the decision is drive by budget constraints. “It is not an economic decision, it’s an instructional one,” she reiterated.&lt;br /&gt;&lt;br /&gt;While the proposed zoning map is close to a final product, the DOE will continue to accept community feedback over the next two weeks, according to a spokesman. Residents can e-mail suggestions and comments to portfolio@schools.nyc.gov before the proposal is submitted to Schools Chancellor Joel Klein for approval.&lt;br /&gt;&lt;br /&gt;Assemblyman Andrew Hevesi (D-Forest Hills) told the audience that the zoning map presented that night was different from a proposal officials reviewed several weeks ago, which didn’t include Forest Hills Gardens. A garage serving the multi-family unit next door was replaced with a three-family building, which the board claims doesn’t conform to either the R5 zoning in effect prior to the March 2006 area rezoning or the current R4-1 regulations.&lt;br /&gt;&lt;br /&gt;Sanchez reported at the November board meeting that District Manager Gary Giordano wrote a letter to the Buildings Department about the concerns, which include lack of parking, work without a permit and violations of front and side yard regulations. The board is “really concerned about the safety of the people inside” in light of recent fatal fires, said Sanchez, especially since it involved self-certified plans. “We want to put it on the record,” Sanchez said of the letter, which was copied to area elected officials.&lt;br /&gt;&lt;br /&gt;“After additional review, our [committee] remains concerned and quite sure that the three family home constructed at the property in question complies neither” with the current or previous zoning, wrote Giordano. “To our knowledge, self-certified plans were filed... for the conversion of an existing two-family house to a five-family dwelling. In actuality, what has been done is to demolish the garage serving 78-44 79Place and build a three-story dwelling where the garage was.”&lt;br /&gt;&lt;br /&gt;As a result, neither property now has off-street parking, which is required. Further, the garage was torn down without a permit, which the owner only obtained after receiving a violation, according to Giordano. A stop work order “related to this questionable construction” was issued in November 2008, and the property still doesn’t have a valid certificate of occupancy, wrote Giordano, adding that it is “very questionable” whether the property meets yard setback requirements.&lt;br /&gt;&lt;br /&gt;The advisory board voted 38 to 0 in October in favor of having the building dismantled. Last week, a DOB spokeswoman said a stop-work order had been issued at the fully-completed building and that the application was being reviewed. When asked what course of action, including demolition, was possible, she said an inspector would visit the property and determine an appropriate course of action.&lt;br /&gt;&lt;br /&gt;No updates regarding recent inspections have been posted on the DOB online records, and the department did not respond to a followup inquiry this week. On Monday, the DOI announced that Cheng has been charged with receiving reward for official misconduct, a felony, and official misconduct, a misdemeanor for allegedly accepting cash payments from Sung Ho Shin, a state registered architect.&lt;br /&gt;&lt;br /&gt;Shin, 49, of Syosset, has been charged with giving unlawful gratuities, a misdemeanor. Upon conviction, the felony charge is punishable by up to four years in prison and the misdemeanor charges by up to a year’s incarceration.&lt;br /&gt;&lt;br /&gt;“As charged, these defendants betrayed their professional responsibilities and brazenly disregarded the rules,” said Rose Gill Hearn, commissioner of the DOI. “everyone should know that offering and accepting money in exchange for a city employee giving preferential service is a crime that will end in arrest and prosecution.”&lt;br /&gt;&lt;br /&gt;Cheng, who is also a state certified architect, began working at DOB in June 1997 as a Plan Examiner. He resigned in February 2001 to take a similar job with the city School Construction Authority until March 2003, when he returned to DOB as Chief Plan Examiner in the department’s Kew Gardens borough office.&lt;br /&gt;&lt;br /&gt;In that post, Cheng was paid an annual salary of $99,149 until he resigned in November. His duties included meeting with the public, including architects and engineers, reviewing project records and building plans for compliance with city building code and assigning them to be reviewed by plan examiners.&lt;br /&gt;&lt;br /&gt;According to the criminal complaints, Cheng reviewed zoning analysis for building plans that had not yet been submitted to DOB in exchange for cash payments from Shin over a two-week period in 2008. The investigation revealed that Cheng knew and told Shin that he was not allowed to engage in that type of activity.&lt;br /&gt;&lt;br /&gt;The DOB released the following statement from Commissioner Robert LiMandri: "These allegations, if true, are clearly unacceptable and are not condoned in any way. Mr. Cheng resigned from the Department last month, and we are currently reviewing his jobs as a precaution. &lt;br /&gt;&lt;br /&gt;"The Department has taken significant steps to increase integrity and transparency, including an online property database detailing inspection results, mandated integrity training for all employees and the use of GPS technology to track on-duty inspectors. While no weapon was brandished, the perpetrator told the student he had a weapon during the robbery.&lt;br /&gt;&lt;br /&gt;“It is distressing to realize that not only do things like that happen, but they happen ‘so close to home,’” wrote Sister Rose. Teachers planned to discuss the incident with students, and the principal reminded parents to encourage children to travel home from school with friends and leave the school grounds immediately after dismissal “so that there are many people on the street at the same time, thus limiting the ‘alone time’ that students who walk home from school would have on the street.”&lt;br /&gt;&lt;br /&gt;“It took the occurrence of an unfortunate incident to reinforce safety precautions that all of our students should be reminded of,” wrote Sister Rose. “We are grateful that our student who was as approached on the street was not seriously hurt and I count on you, as a parent, as well as our teachers, to reinforce that there is safety in numbers and that it is not wise to stay behind the group after dismissal time.”&lt;br /&gt;&lt;br /&gt;After the e-mail was sent out, it was forwarded to other individuals in the community along with a message from a parent claiming that officers at the 104th Precinct refused to take a report from the victim on this incident.&lt;br /&gt;&lt;br /&gt;In response, an officer from the precinct’s Community Affairs Unit told &lt;em&gt;The Forum&lt;/em&gt; that the stationhouse was especially busy when the victim and his mother arrived to file a report. They were told they would have to wait and ended up leaving before an officer could assist them. Officers followed up with the victim this week so that a report could be filed, according to the Community Affairs Unit. Social networking sites such as Facebook and MySpace can now access that information to prevent sex offenders from maintaining accounts.&lt;br /&gt;&lt;br /&gt;Under the first database sweep since the law went into effect, Facebook was able to identify and disable accounts linked to 2,782 sex offenders across the state, while MySpace recently disabled 1,796such accounts. Since some sex offenders had accounts with both sites, the number of individuals purged during the sweep stands at 3,533.&lt;br /&gt;&lt;br /&gt;In all, there are more than 8,100 sex offenders who have registered e-mail addresses with the state. That means more than 43 percent of those sex offenders using e-mail have accounts registered with Facebook and MySpace, which are both popular with teenagers. Information about the accounts is now being shared with law enforcement authorities.&lt;br /&gt;&lt;br /&gt;While Facebook and MySpace are taking part in the initiative to prevent sex offenders from soliciting new targets through social networking sites, others “remain slow at adopting available new protections against sexual predators online,” the attorney general noted in a press release. In response, Cuomo’s office has sent letters to other sites urging them to take action now to prevent offenders from maintaining accounts.&lt;br /&gt;&lt;br /&gt;“We created e-STOP to help put an end to sexual predators using the Internet as a tool to prey on the innocent,” said Cuomo. “Facebook and MySpace are successfully using e-STOP to help make the Internet safer, and it’s time for all social networking to do their part to keep others from being senselessly victimized.”&lt;br /&gt;&lt;br /&gt;Under e-STOP, the nation’s more comprehensive law to enhance protections from sexual predators on the Internet, many offenders are banned outright from using social networking sites while on probation or parole. Also, convicted sex offenders must register all of their e-mail addresses, screen names and other Internet identifiers with the state, which shares the information with social networking sites so they can purge offenders from their online worlds.&lt;br /&gt;&lt;br /&gt;Sex offenders recently purged from Facebook and MySpace come from all regions throughout the state. Raymond Sheehan. &lt;br /&gt;&lt;br /&gt;Sheehan and her attorney, Michael Dowd, speak candidly about his murder, and how a judge’s recent decision could destroy their defense strategy. &lt;br /&gt;&lt;br /&gt;The mother of two has been free on $1 million bail since the February 2008 shooting at the family’s Howard Beach home and is  expected to stand trial in early 2010.&lt;br /&gt;&lt;br /&gt;For the first time the defense speaks about questionable behavior by attorneys for the prosecution and discusses how the judge’s disapproval of Dowd’s tactics may affect the case. &lt;br /&gt;&lt;br /&gt;The murder sent shockwaves through the quiet community but has since faded from the headlines. However, a recent decision by the judge in the case has thrust the story back into the news.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;“We’re in trouble.” That is how defense attorney Michael Dowd describes what he terms the devastating consequences of the decision handed down by Justice Arthur Cooperman which will prohibit the testimony of expert witnesses in establishing the post traumatic stress disorder and battered woman’s syndrome defense in the murder trial of his client, Barbara Sheehan.&lt;br /&gt;&lt;br /&gt;In the decision handed down on November 10, Cooperman cited “defense counsel’s disregard of this Court’s orders,” and “transparent excuses for delay and for disrupting a July 28 interview.” But Dowd says those claims are absolutely not true. “We went a long way to try to get the information about this case and the history to the psychologist. I personally spoke to Barbara’s family and friends urging them to cooperate by speaking with the prosecution psychologist, Dr. Kathy Yates,” he said.&lt;br /&gt;&lt;br /&gt;Dowd explained further that there was some hesitancy at first because prosecution attorney Debra Pomodore had stated to a neighbor that Barbara was a murderer and that her children were liars. “Despite word of the prosecution’s comments, all of the family, including Barbara’s parents and both of her kids still agreed to speak with Dr. Yates,” said Dowd. &lt;br /&gt;&lt;br /&gt;That interview, scheduled for July 28, is now a hotbed of controversy because of a series of events that occurred during the course of the day, subsequently causing the collapse of the process and leading to the “emotional breakdown” of Sheehan. The judge attributed the disturbances to Michael Dowd’s actions on that day, but the attorney says he wasn’t even there until after twelve noon.&lt;br /&gt;&lt;br /&gt;“That morning my associate, Niall Giollabhui was there with Barbara. I was to get there later. He was checking out the rooms where the interviews were going to take place. He saw Debra Pomodore sit down on the couch and start talking to Barbara. That violates the disciplinary rules — no attorney is supposed to engage another’s client in conversation, especially an adversary,” said Dowd. &lt;br /&gt;&lt;br /&gt;When the attorney crossed the room to find out what was going on, Pomodore told him she was just asking Barbara what she wanted for lunch. Barbara Sheehan didn’t wait long to tell her attorney what had happened.&lt;br /&gt;&lt;br /&gt;“I told Niall she [Pomodore] was lying. What she said to me on that couch was “I want you to do your best in there. I know you are a very religious woman and you’re going to tell the truth because you’re so religious. I know you’ll tell the truth and it will all come out,” Sheehan said. &lt;br /&gt;&lt;br /&gt;Sheehan continued, “I knew what she was doing. She had never even said hello to me in the courtroom. She never even acknowledged me and now she was talking to me this way... She was using some interrogation techniques... To me she was saying that I had been lying all along and now was the time when I could tell the truth.”&lt;br /&gt;&lt;br /&gt;Barbara Sheehan described the encounter with Pomodore and her assistant Donna Aldea as what upset her so deeply on that day. “They’re saying it’s Mr. Dowd’s fault. But he had nothing to do with it. If anything he calmed me down. What caused problems that day was the behavior of Debbie Pomodore and Aldea.”&lt;br /&gt;&lt;br /&gt;Sheehan qualified her remarks, “She started to talk loudly walking up and down the hallway — listen, she was saying, this has to get done here today. The room wasn’t ready and the camera was not set up.”&lt;br /&gt;&lt;br /&gt;According to Barbara Sheehan, prosecutor Debbie Pomodore was acting wildly. Sheehan went on to say that Pomodore’s rant set her on edge.&lt;br /&gt;&lt;br /&gt;“By the time I finally got in with Dr. Yates, I was physically sickened. I broke down with the first question she asked me. I asked permission to go to the bathroom. Aldea, Debbie Pomodore’s assistant was there and followed me to the bathroom. I wanted to be alone in the bathroom; to wash my face and compose myself. But she came right up behind me. I sat there in the stall to be by myself but when I came out she was just standing there waiting for me.”&lt;br /&gt;&lt;br /&gt;Prior to the interview there was an abundance of psychological testing conducted by experts hired by Sheehan’s defense team. A judge’s order forced them to share all notes from such interviews with the prosecution prior to trial. “I fought that order because that was in the best interest of my client, but in the end the judge ruled and we had to turn over all the notes. Of course we complied,” explained Dowd. &lt;br /&gt;&lt;br /&gt;Now Dowd says he is faced with the monumental task of coming up with a defense that will offer his client what he says is everyone’s entitlement. A fair trial.&lt;br /&gt;&lt;br /&gt;At the heart of the objections from the defense team is the fact that the prosecution has all the benefit of the expert testimony from the notes that were provided them however, the same experts will not have the opportunity to explain the complex and dark details of Battered Woman’s Syndrome to a jury of Sheehan’s peers.&lt;br /&gt;&lt;br /&gt;“We are not going to get any abuse victims on the jury," Dowd predicted. "The average person could not possibly know the level of sickness that is associated with the abusers and those they batter. Because of this and because the criminal process does not allow for an appeal before a guilty verdict is rendered by a jury, Barbara could very well end up in jail while waiting for an appeal. The proposal will move on to the borough president for review before the city ultimately rules on it.&lt;br /&gt;&lt;br /&gt;At its meeting last Wednesday in Christ the King High School, Land Use Chairman Walter Sanchez reported to the full board that the committee felt that a “saturated condition” already exists on the roof at 53- 00 65th Place. Companies generally don’t need special approval for cellular antennas, but a variance is needed in this case because the roof already contains antennas for Sprint, Verizon and the 911 system.&lt;br /&gt;&lt;br /&gt;Sanchez noted that the new antenna would result in the building exceeding the amount of square footage allowed to be used for cell antennas and said the roof is already damaged from a 2008 fire. There are also concerns over light, noise and long term health impacts that the antennas would have on the residential neighborhood. Finally, the company made no effort to find space on a nearby commercially-zoned building, said Sanchez.&lt;br /&gt;&lt;br /&gt;After hearing the Land Use Committee’s recommendation, the full board voted 33-0 to reject the application. Since there are no businesses along that stretch, the parking spaces now sit empty the majority of the time during the week. The spots are now virtually useless to 75th Street residents, who used to park there when their dead-end block was full.&lt;br /&gt;&lt;br /&gt;Adding insult to the situation is the fact that the DOT installed the meters with no advance warning to the residents, Councilwoman Elizabeth Crowley or Community Board 5. Even worse, several residents who parked there before the meters were installed returned to their cars to find tickets on their windshields, according to residents.&lt;br /&gt;&lt;br /&gt;The issue was raised at last week’s CB 5 meeting by Dmytro Fedkowskyj of the 75th Street Block Association, who said it is “appalling that members of the community are subjected to impacting and neighborhood change without notification from the city.” He adds that he can “only assume that the genius behind this project never surveyed the area before installing these useless meters,” which go unused from Sunday night to Saturday night “while the rest of Eliot Avenue looks like a parking lot.”&lt;br /&gt;&lt;br /&gt;After residents contacted her office, Crowley wrote to the DOT asking who had requested that the meters be installed. She was told she had to submit a letter under the Freedom of Information Law to find out who made the request and is still awaiting a response. In her letter, she noted that the meters “are not needed in this residential area as they provide nothing positive for the community” since there are no stores nearby “where parking meters would be beneficial.”&lt;br /&gt;&lt;br /&gt;The DOT press office was unable to provide information to &lt;span style="font-style:italic;"&gt;The Forum&lt;/span&gt; by press time on Tuesday, including regarding who requested the meters. While the problem has impacted 75th Street residents who used to park there, it has also led to frustration along 74th Street as drivers have begun to head there in search of free parking.&lt;br /&gt;&lt;br /&gt;A group of residents gathered along Eliot Avenue on Saturday, at which point the entire stretch of parking was predictably empty. Since his election in September, the assemblyman had been operating out of the same building used by his predecessor, Anthony Seminerio.&lt;br /&gt;&lt;br /&gt;Miller took office after winning a special election to replace Seminerio, who resigned after pleading guilty to influence peddling in connection. Seminerio was accused of forming a consulting company in order to shake down area hospitals in return for political favors.&lt;br /&gt;&lt;br /&gt;Miller’s spokeswoman, Sierra Perez-Sparks, said that the assemblyman began using Seminerio’s old Myrtle Avenue office because it allowed him to immediately begin serving constituents of the 38th District, which includes Glendale, Woodhaven, Richmond Hill and Ozone Park. The proposal has been met with backlash from some residents who don’t want space in the park dedicated for a dog run, and a recent study by the city Parks Department estimated the project would cost $750,000.&lt;br /&gt;&lt;br /&gt;The mood of last week’s meeting took a contentious turn when association member Kate Burns said she believes “some members of this [CB 5 subcommittee] may be working against the best interests of dog owners.” She said she was invited to join the subcommittee, which was recently formed to explore the idea, but was told “in no uncertain terms that we will never, never get a dog run” in Juniper Valley Park. &lt;br /&gt;&lt;br /&gt;Burns added that the co-chair of the committee [Kathy Masi], told her that pushing the idea would result in a “ten year pissing match” with members of the Juniper Park Civic Association, which opposes the plan.&lt;br /&gt;&lt;br /&gt;Several other Dog Owners Association members spoke in favor of the proposal, including 18-year-old Tom Scotti, who spoke against board members who are “determined to make sure our dream of having a dog run in Juniper Valley Park will never happen.” He said he grew up near the park, plans to spend his adult life in Middle Village and vowed to continue the fight until the dog run is built.&lt;br /&gt;&lt;br /&gt;Joe Pisano, president of the dog association, expressed frustration that after attending CB 5 meetings for 12 consecutive months, little progress has been made. “Unfortunately, I don’t think we are any closer than we were a year ago,” he lamented, adding that he was also told to “forget the idea” because there will never be a dog run in Juniper Valley Park.&lt;br /&gt;&lt;br /&gt;“And you wonder why we get so frustrated over this,” continued Pisano. “I really feel this is ridiculous. We really feel like you care less and put us off until we go away. We’re not going away.” He added that board members should “check the personal feelings at the door” and act on the behalf of the community at large.&lt;br /&gt;&lt;br /&gt;Finally, John Rowan, who is a former district manager of Community Board 4 and a 22-year Middle Village resident, questioned the process by which the board has handled the group’s request. “I’m concerned about where we’re heading with the park,” he said, questioning why the subcommittee has yet to meet on the issue and why the board’s budget request simply mentioned a dog run within CB 5’s confines. “We don’t want it in CB 5 anywhere, we want Juniper Park,” he said.&lt;br /&gt;&lt;br /&gt;Later in the meeting, board District Manager Gary Giordano seemed to pour cold water on the association’s request. He called the group’s initial proposal “huge” and said it would have been as large as a football field. “I honestly was shocked at the magnitude of that,” he said, adding that in his view, there doesn’t seem to be “much interest” in the run outside of the association members.“Maybe something can be worked out, but I’ve got to tell you, I don’t think there is much of a constituency among members of this board for a permanent, all-day run” at that location.&lt;br /&gt;&lt;br /&gt;Masi was not at this month’s CB 5 meeting, but later told &lt;span style="font-style:italic;"&gt;The Forum&lt;/span&gt; that she has been actively working on this issue and denied telling association members in no uncertain terms that it will never happen. However, she suggested that their stance that the run must be located in Juniper Valley Park might lead to an impasse, and said she felt it was best to wait until after the November 3 election before formally moving forward on the issue.&lt;br /&gt;&lt;br /&gt;Next month, Masi is scheduled to visit two properties outside Juniper Valley Park that Councilwoman Elizabeth Crowley’s office has identified as potential sites for a dog run. She said that association members need to think “a little more globally about this” and keep an open mind about the location. &lt;br /&gt;&lt;br /&gt;“In a fiscal crisis, spending all that money is ludicrous and I don’t think anyone in their right mind would put up $750,000 for a dog run,” said Masi. “We want to get this done, but we don’t want to put a dog run in an area where the community won’t be happy about it. I don’t want to please fifty two and offend five thousand... I don’t see huge support from the community for a dog run anywhere.”&lt;br /&gt;&lt;br /&gt;Masi noted that while funding for a dog run was included in the board’s capital budget requests, it ranked dead last after members prioritized each item. “If that doesn’t send a message... To dig their heels in the ground and say they only want it in Juniper, if that’s the message, my response is we’re all wast- ing their time. After presenting their plan to Community Board 5, the women found that other nearby communities are suffering the same types of problems.&lt;br /&gt;&lt;br /&gt;To address these issues, which range from emissions coming from idling locomotives, along to noise and safety concerns, a group called Civics United for Railroad Solutions (CURES) was recently formed. It includes various civic groups such as Citizens for a Better Ridgewood, Glendale Property Owners Association, Communities of Maspeth and Elmhurst Together, the Juniper Park Civic Association, Maspeth West End Block Association and Citizens for a Better Ridgewood.&lt;br /&gt;&lt;br /&gt;After getting word of the effort out to the public, residents from Glendale and surrounding neighborhoods such as Middle Village began contacting the women to get involved, Parisen reported at last week’s Community Board 5 meeting. “They’re facing the same problems we’re facing in Glendale,” she said, noting that a petition effort is underway to pressure elected officials to taking action.&lt;br /&gt;&lt;br /&gt;Arnold said that while there are a host of problems related to rail operations, the main focus continues to be on lowering the harmful emissions that spew from the locomotives. “That’s what all of us are breathing when you have diesel engines idling outside your house,” she said, adding that federal grant money is currently available to pay for the conversion of diesel engines. “It’s hard times, but we’re all breathing this air and it’s a problem,” she said.&lt;br /&gt;&lt;br /&gt;Middle Village resident Laura Zimmer, who also lives along the rail corridor, said the problem has gotten much worse in recent years. Locomotives now idle in her residential area for as much as two hours at a time, preventing residents from enjoying backyards or hanging laundry outside. “It’s really disturbing... We’re all suf- fering from this,” she said.&lt;br /&gt;&lt;br /&gt;Board District Manager Gary Giordano later credited Parisen and Arnold for doing a “yeoman’s job to bring all this to the attention of the elected officials” and said support on the federal level “will be very important.” He is hopeful officials “can come up with an avenue for fund- ing very quickly” to help alleviate the problems.&lt;br /&gt;&lt;br /&gt;With state federal funding in mind, CURES recently sent a letter to officials regarding the MTA’s 2010-2014 capital budget and the state Department of Transportation’s 2010-2015 capital budget. The letter asks the agencies “to effect planning, infrastructure, and equipment upgrades in Queens that will better protect the public health and safety and quality of life in communities that presently are bearing serious environmental burdens.”&lt;br /&gt;&lt;br /&gt;The letter argues that the “contract between the LIRR’s gleaming double decker passenger rail cars that pass through our neighborhoods and the degraded condition of the LIRR rail corridor, the rail yards, and the freight transportation in our neighborhoods make it crystal clear that our neighborhoods have been neglected and dumped on for too long.” To remedy this, the group wants “state and federal oversight and money coming in here now to upgrade the freight transportation system and environment in Queens.”&lt;br /&gt;&lt;br /&gt;The issues CURES seeks to remedy include “unnecessarily high levels of diesel emissions due to old equipment, idling, lack of traffic capacity and lack of ‘last mile’ access,” exposure of residential areas to waste that is being stored in and transported in open cars instead of sealed intermodal containers, open access for vandals to the LIRR rail corridor in an area that includes hazardous chemicals and the Buckeye Pipeline, and storage and transportation of petroleum gas and other hazardous chemicals, which has led to two emergency evacuations of homes in the past three years.&lt;br /&gt;&lt;br /&gt;Regarding the problem described by Zimmer, Giordano said he has had a “much more difficult relationship” with New York and Atlantic Railroad than most of the other agencies he deals with. Trains had been parked outside Christ the King High School until the school sued in federal court.
