What About Everyone Else?</title><content type='html'>From: NAR Government Affairs&lt;br /&gt;Date: 29 May 2009&lt;br /&gt;RE:   Tax Credit Guidance for FHA Loans Announced by HUD&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;In his speech at the National Association of REALTORS  Housing Summit on &lt;br /&gt;May 12, 2009, US Department of Housing and Urban Development (HUD) &lt;br /&gt;Secretary Shaun Donovan announced a program that allows borrowers to use &lt;br /&gt;the first-time homebuyer tax credit for a down payment or closing costs on &lt;br /&gt;a FHA-insured mortgage.  The Secretary said  We think the policy is a real &lt;br /&gt;win for everyone, ensuring that borrowers can tap into the numerous &lt;br /&gt;organizations that are already part of the FHA network to receive this &lt;br /&gt;additional benefit.&lt;br /&gt;&lt;br /&gt;The details of the program were announced today in Mortgagee Letter &lt;br /&gt;2009-15.  Government entities and instrumentalities of government may &lt;br /&gt;provide a second mortgage.  Currently, 10 state housing finance agencies &lt;br /&gt;offer a product buyers can use that will effectively monetize the tax &lt;br /&gt;credit for down payment purposes.  These states are Colorado, Delaware, &lt;br /&gt;Idaho, Kentucky, Missouri, New Jersey, New Mexico, Ohio, Pennsylvania, and &lt;br /&gt;Tennessee Get information on these programs at &lt;br /&gt;http://www.ncsha.org/section.cfm/3/34/2920..  State Associations are &lt;br /&gt;encouraged to work with their respective housing finance agency to &lt;br /&gt;implement similar programs.  The 3.5 percent down payment may also be a &lt;br /&gt;gift from a family member, employer or nonprofit, charitable organization.&lt;br /&gt;&lt;br /&gt;The original guidance permitted lenders and HUD-approved nonprofits and &lt;br /&gt;lenders to offer bridge loans via second lien financing or short term &lt;br /&gt;loans.  Guidance released today allows lenders to offer the monetized tax &lt;br /&gt;credit for down payments in excess of 3.5 percent, closing costs and &lt;br /&gt;interest rate buy downs. Did You Take Action For Something Better?</title><content type='html'>In case you haven’t heard, mortgage rates went up drastically Wednesday.  To be specific, 0.50% to RATE in 1 day!&lt;br /&gt;&lt;br /&gt;The main reason for Wednesday’s tsunami...OVERSUPPLY. The Treasury has literally been printing money by way of Treasury auctions to pay for the massive spending initiatives. Not to mention that these hundreds of BILLIONS of dollars of new Bond supply have to be absorbed by the market, so the additional supply literally weighs on the entire Bond market and drags prices lower. Also, when you think of supply, consider they myriad of refinances and all those loans have been bundled, packaged and sold on Wall Street.  This additional supplyhas now started to hit the secondary market, as those closed loans are now getting turned around and sold. This supply also must be absorbed, and while the Fed has been a buyer, they simply can’t buy enough to balance all the selling. It’s Economics 101, anytime supply vastly exceeds demand, prices will move lower. As prices move lower, yields rise and that rise in yield will attract new buyers as they get a higher return on their investment. This process is how the market finds balance.&lt;br /&gt;&lt;br /&gt;The question on everyone’s mind, will rates come back? The answer is that we will probably see some improvement, of which we saw a 0.25% decrease in RATE this morning.  However, it will be difficult to see rates fight back to the levels they were at just last week. There are both fundamental and technical reasons why a retracement back to last week’s levels would not be easy. NAR has been lobbying congress about the importance of stabilizing home prices, which will then stabilize the assets of banks, insurance companies, investment firms, and individual homeowners.  He is hopeful that the $8,000 credit to first time buyers will act as a strong stimulant to get these first time buyers "off the fence".&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Dr. Yun showed statistics that demonstrate how much healthier Colorado's real estate markets are, especially when compared to the four problem states: California, Nevada, Arizona, and Florida.  There is good evidence that Colorado has already bottomed out and should have a solid summer sales season.  California, which has suffered a severe downturn, is now showing renewed activity.  Lower priced California homes are selling well, with multiple bids becoming common.  It may be at the "tipping point" where everyone jumps back into the market.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;When asked about inflation, Dr. Yun said that inflation is inevitable, given the money being pumped into the economy, so interest rates will be driven up from their current, phenomenally low rates under 5.0%.  Those that wait for home prices to drop or interest rates to drop further will probably miss the combination of low prices and low interest rates.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Colorado is a key growth market for real estate over the next 20 years.  It continues to enjoy a strong net immigration rate, which should translate into increased demand for mountain resort real estate.  He also talked about the influence of the baby boomers, many of whom are buying retirement homes.  Mountain Realtors® have also seen the effect of the wealth transfer from the depression generation to the baby boomers, resulting in boomers buying mountain homes.  While resort real estate sales have been slow the past couple months, there is pent up demand. This agreement, in response to an initial investigation into business practices conducted between Washington Mutual and appraisal management company E-AppraiserIT, once again fails to address the appraiser fraud problem. NAMB today issued the following statement from NAMB President Marc Savitt:&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“This agreement amounts to a de facto regulatory action which avoids the appropriate process. The law provides for a process to implement regulatory and policy changes such as those contemplated and specified in this agreement.  &lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;This agreement will increase costs to consumers and remove thousands of small business competitors from the marketplace. Through CHFA (Colorado Housing Financing Assistance,) 1st time home buyers can utilize a large portion of the tax credit “up front” for down payment and related costs.  How huge is this?&lt;br /&gt;&lt;br /&gt;A LARGE number of 1st time home buyers simply don’t have enough money saved up, even though they can afford these homes.  &lt;br /&gt;&lt;br /&gt;It seems like it would be a good time to GET OFF THE FENCE AND STOP RENTING!!!! &lt;br /&gt;&lt;br /&gt;With both this program and the 8K tax credit available, and the fact that housing is more affordable now in Parker(small Cottonwood houses are 135K now.)  Now you can get your down payment money loaned to you, then the loan is paid off with your tax credit next year.  Guess that makes it a no-money down deal! Audio Selectivism: The ability of a seller to hear only what they want."The buyer must be confused". "The appraiser was in a bad mood". "My neighbor said I wasn't asking enough". Grey once said in The Common Denominator Of Success that, "The secret of success of every man who has been successful lies in the fact that he formed the habit of doing things that failures don't like to do". The same quote applies to home sellers.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Unsuccessful sellers (called expired listings) have formed bad habits such as: not listening to their agent's advice, not pricing the property aggressively, not making cosmetic changes, and not periodically reducing the listing price.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Successful sellers don't enjoy doing the items above, but their motivation mandates that they focus on the goal of selling as compared to micromanaging the marketing. A smart seller would discount their price to affect a sale in Arizona so they could recapture the loss and buying bonanza in Missouri. A stubborn seller would 'step over dollars in order to pick up dimes'. A stubborn seller would wait for the market to change. What does that mean?&lt;br /&gt;&lt;br /&gt;The fact that the credit is refundable means that the home buyer credit can be claimed even if the taxpayer has little or no federal income tax liability to offset.  This is not a deduction or a reduction in income to reduce tax liability, it is a REFUND.  Typically this involves the government sending the taxpayer a check for a portion or even all of the amount of the refundable tax credit.  This means that if someone needs to borrow the down payment funds, it will be able to be repaid back after 2009 taxes are filed and the refund is received.&lt;br /&gt;&lt;br /&gt;For example, if a qualified home buyer expected, notwithstanding the tax credit, federal income tax liability of $5,000 and had tax withholding of $4,000 for the year, then without the tax credit the taxpayer would owe the IRS $1,000 on April 15th.  Suppose now that the taxpayer qualified for the $8,000 home buyer tax credit.  As a result, the taxpayer would receive a check for $7,000 ($8,000 minus the $1,000 owed).&lt;br /&gt; &lt;br /&gt;This is great news to get people into homes and to reduce some of the inventory out there.
