Doctors Raise Questions-Concerns About FDA Suicide Warning

Epilepsy experts urge patients and caregivers to continue drug therapy

SEATTLE, December 8, 2008-Medical specialists at the nation's largest professional meeting on epilepsy discussed multiple questions and concerns they have about data presented by the FDA in support of its recent suicide alert on anticonvulsant drugs (AEDs) and the potential effect of the federal agency's analyses on clinical practice and the way AED drug trials are to be conducted in the future.

It is well known that non-adherence to antiepileptic drug therapy can lead to a dramatic increase in accidents and deaths. For these reasons, epileptic experts believe it is imperative that patients continue their antiepileptic therapy to prevent the occurrence of serious accidents and death.

During the American Epilepsy Society's annual meeting, epidemiologists, epileptologists and psychiatrists offered a critical review of the FDA's methodology and analyses, describe the suicide alert's potential impact on patient compliance and seizure management, and its likely effect on the selection of patients for AED regulatory studies. Among the doctors' concerns is that news reports of the FDA's analyses have confused patients and, perhaps, some physicians on the risks associated with epilepsy drugs. They cite data showing that the risk of suicide possibly associated with AEDs is extremely small compared to the potential danger of leaving patients untreated. Also of concern is that epilepsy patients prone to suicidal ideation or behavior will be excluded from clinical trials of new AEDs.

The panel is seriously concerned about methodological flaws in the FDA's data collection and analysis, including biased measurement of suicidality and exclusion of a large proportion of the data. The FDA performed similarly flawed analysis of the SSRIs. After the black box warning appeared, there was a decrease in use of the SSRIs with a corresponding increase in suicide, contrary to what the FDA's conclusions would predict.

The discussion by leading experts was headed by Andres M. Kanner, M.D., professor of neurological sciences at Rush Medical Center and associate director of the Rush Epilepsy Center. The other panelist for the session, titled Suicidality and Epilepsy: A Complex Problem, are Dr. Hesdorffer (Columbia University), Anne T. Berg, Ph.D. (Northern Illinois University), John J. Barry, M.D. (Stanford University), Rochelle Caplan, M.D. (UCLA), and Jacqueline A. French, M.D. (New York University).

Public Citizen Petitions FDA to Ban Avandia, Cites Life-Threatening Toxicity as Top Diabetes Associations Advise Against Use

Risks Outweigh Benefits of the Diabetes Drug; Safer Alternatives Are Available

WASHINGTON, D.C.- Public Citizen - Oct. 30, 2008 - The Food and Drug Administration (FDA) should immediately ban the dangerous diabetes drug Avandia because it can cause death from liver failure and has many other life-threatening risks that far outweigh its benefits, Public Citizen said in a petition filed today with the agency.

New research released by Public Citizen about the drug, used to treat Type 2 diabetes, comes as a working group with representatives from the American Diabetes Association (ADA) and the European Association for the Study of Diabetes, unanimously advised against using Avandia, whose generic name is rosiglitazone, because of their concerns about the drug's risks. This statement appears in the newly published issue of Diabetes Care, the ADA's peer-reviewed medical journal. Despite a significant decrease in its use since publication of a study linking it to increased risk of heart attacks, approximately 10,000 prescriptions a day are still filled for this unacceptably dangerous drug, which is sold by Glaxo-SmithKline.

Public Citizen has identified 14 cases of Avandia-induced liver failure, including 12 deaths. These cases were derived from the FDA Adverse Event Reporting System after careful review of the agency's MedWatch forms, which are submitted to the agency when adverse drug reactions are suspected.

Liver toxicity is only the most recently noted danger of Avandia; Public Citizen has encouraged diabetes sufferers to avoid taking the drug because it increases the risk of heart attack approximately 40 percent, doubles the risk of heart failure and bone fractures, and increases the risk of anemia and vision loss from macular edema, a swelling of the retina caused by fluids accumulating in the eye. There were 39 times more reports of macular edema per million prescriptions filled for Avandia than for an older diabetes drug, glipizide.

Avandia prescriptions fell sharply following a May 2007 study published in The New England Journal of Medicine connecting the drug with increased heart attack risk. In 2006, the number of people taking the drug peaked at 13.2 million. Since then, that number has dropped to 4.6 million for the last full year. This means that about 10,000 prescriptions a day are still being filled for this dangerous drug.

"The scientific consensus against Avandia is overwhelming," said Dr. Sidney Wolfe, director of Public Citizen's Health Research Group. "The timing of these findings should give the FDA the momentum it needs to act swiftly to prevent further needless deaths and health damage by banning this drug."

Safer, more effective drugs for Type 2 diabetes include metformin (brand name Glucophage) and glipizide (brand name Glucotrol). Pioglitazone (sold as Actos), a drug in the same family as Avandia, is not recommended, as it shares most of Avandia's toxicities - except for the risk of heart attack - and the ADA does not number it among the preferred therapies for most diabetics.

Research Will Focus on Relationship of Concussion, Pituitary Hormonal Failure and Quality of Life in Retired National Football League Players

SANTA MONICA, Calif.-- July 02, 2008--The John Wayne Cancer Institute at Saint John's Health Center announced today that it has received a grant from the National Operating Committee on Standards for Athletic Equipment to study pituitary hormonal failure (hypopituitarism) in retired football players.

The research, which will be conducted in collaboration with the University of North Carolina's (UNC) Department of Exercise and Sport Science, and the Los Angeles Biomedical Research Institute at Harbor-UCLA Medical Center, will be directed by Daniel F. Kelly, MD, director of the Neuro-Endocrine Tumor Center at the John Wayne Cancer Institute, and Kevin M. Guskiewicz, PhD, chairman of the Department of Exercise and Sport Science at UNC.

In a cohort of retired National Football League (NFL) players, the study will examine the relationship between the number of concussions sustained in players' NFL careers, and their subsequent pituitary hormonal function and post-retirement quality of life. The investigators hypothesize that players sustaining multiple concussions are at increased risk of developing pituitary hormonal dysfunction which may in turn contribute to problems of obesity, fatigue, impaired metabolism, depression, sexual dysfunction and a general poor quality of life.

According to Dr. Kelly, the new study will focus on a relatively unexplored area of traumatic brain injury (TBI)-the potential correlation between recurrent concussions and pituitary hormonal dysfunction. More than 1.2 million Americans sustain a TBI annually, the majority of which are cerebral concussions. Repeat concussions have been shown to be a risk factor for neurodegenerative dementing disorders, including mild cognitive impairment and Alzheimer's Disease. However, little is known about the impact of single or multiple concussions on hormonal function and quality of life. Only in the sport of boxing, have a few small studies shown that boxers are at increased risk of developing pituitary failure. In contrast, it is well known that a single severe head injury can lead to pituitary damage and hormonal abnormalities in up to one third of individuals.

The pituitary is a small bean-shaped gland located immediately below the brain and behind the nasal cavity in the skull base; it is connected to the brain by the thin delicate vascular pituitary stalk. Weighing less than one gram, the pituitary is often called the "master gland" since it controls the secretion of the body's hormones. These essential substances when released by the pituitary into the blood stream have a broad range of effects on growth and development, sexuality and reproductive function, metabolism, the response to stress and overall quality of life.

"This research is long overdue," Dr. Kelly said. "Millions of young people and professional athletes participate in sports that put them at risk of concussion; not just football, but also hockey, rugby, soccer, baseball and basketball. We need to know more about how these so-called "minor head injuries" impact their lives in subsequent years, and in particular, whether multiple concussions can lead to pituitary hormonal failure and poor quality of life."

Using the database of the Center for the Study of Retired Athletes at University of North Carolina and in cooperation with the National Football League Players' Association, 90 study participants will be categorized based on the number of concussions they sustained during their NFL career. The retired players will then be assessed utilizing pituitary hormonal blood tests, body composition testing and neurobehavioral, quality of life and sexual function surveys. Retirees found to be deficient in any hormones such as thyroid, testosterone or growth hormone will be treated with physiological replacement doses of the appropriate hormone and will then have repeat quality of life testing. Hormonal testing assays will be conducted by the General Clinical Research Center at Harbor-UCLA Medical Center under the direction of Professor Christina Wang, an endocrinologist and a study co-investigator.

"The problem of sports-related concussions is increasingly recognized as a major contributor to long-term disability in many retired athletes," said Bob Klein, vice president at Saint John's Health Center and a ten-year NFL veteran with the Los Angeles Rams and San Diego Chargers. "However, the potential impact of concussions on quality of life is not well understood. This research will fill that gap in our knowledge. I have spoken with many of my former colleagues in the NFL, and they share my belief in the critical importance of this study."

The Neuro-Endocrine Tumor Center (www.neuro-endo.org) is housed at Saint John's Health Center and the John Wayne Cancer Institute in Santa Monica, California. The Center's focus of activities is the treatment of pituitary tumors, brain tumors, and other neuro-endocrine disorders including pituitary hormonal deficiencies.

The Center for the Study of Retired Athletes at the University of North Carolina works in close affiliation with the National Football League Players Association. Since 2001, the Center has been investigating a spectrum of physical and mental disabilities common to retired athletes. "AB 2899 will revolutionize the way we do HIV testing in California, and we strongly urge the Governor to sign this bill," said Michael Weinstein, President of AIDS Healthcare Foundation. "Today, in government-funded programs, extensive education and counseling is required for every person regardless of how many times they might have been tested. Treating the young person, who is testing for the first time the same as a person in their forties or fifties who has been tested dozens of times doesn't make sense. This important reform will allow AHF, the largest HIV tester in California, to do three times as many tests per hour as we do now. The unanimous approval of the legislature for this common sense approach to HIV testing is very encouraging."

The bill, known as the Sexually Transmitted Diseases and HIV/AIDS Counseling Reform Bill, unanimously cleared both chambers of the Legislature this week-clearing the California Assembly (64-0) earlier today after clearing the Senate in a 36 to 0 vote yesterday.

"This bill brings the requirements for HIV counseling in line with where we are today in our knowledge and understanding of HIV/AIDS and other STDs, and it will allow us to focus our counseling efforts where they are most needed-to those at high risk and those who may test positive," said Joey Terrill, Acting Director of Public Affairs for AIDS Healthcare Foundation, co-sponsor of the bill. "The California Legislature has recognized the importance of this prudent public health legislation with its unanimous passage in both chambers. When this bill is chaptered into law, it will allow the Department of Public Health and the State Office of AIDS far more flexibility in its counseling regulations to best serve and reflect the needs of communities throughout California."

AB 2899 codifies the changes that testing organizations need to conform their practices to current needs and to facilitate the swift introduction of newer counseling models by the Office of AIDS.

The study is being conducted at The Matthew J. Ryan Veterinary Hospital, a small animal teaching hospital affiliated with the University of Pennsylvania in Philadelphia.

Prior gifts to The Matthew J. Ryan Veterinary Hospital from the Foundation have been a respirator for their ICU department and a mast cell tumor research study.

Dr. Sorenmo treated Breezy, who had mast cell tumors. "Thanks to Dr. Sorenmo, Breezy lived another 2 years, of quality life, after other vets gave her only 6 weeks to live," said Wanda Shefts. "We are glad that this project will help owners of dogs in remission from lymphoma and help advance Dr. Sorenmo's work on the cancer vaccine.

Dr. Sorenmo stated that she was encouraged by the results and she is hoping that this is just the beginning of more trials that can benefit dogs and ultimately help people. Thanks to this study, a number of the participating dogs are now cancer free. The researchers now estimate that they are within two years of testing the vaccine on humans. Without the dogs, they would be more than a decade away.

"We have a tremendous amount of respect for the work they do at the Hospital and we are glad to be able to fund another project for them", said Mark Shefts.

OLDWICK, N.J.-- July 03, 2008 --A.M. Best Co. has commented that the ratings of UnitedHealth Group Inc. (UnitedHealth) (Minnetonka, MN) (NYSE: UNH) and its subsidiaries remain unchanged following the company's release of a revision to earnings guidance and reduced second quarter and full year 2008 earnings. UnitedHealth also announced a settlement in the federal securities class action and Employee Retirement Income Security Act (ERISA) lawsuits.

On July 2, 2008, UnitedHealth announced a revision to its earnings outlook for 2008 following an assessment of preliminary second quarter 2008 results and recent business trends. The company's risk-based commercial business produced a lower level of gross margin than expected due to increased pressure on premium yields, which are resulting from a competitive commercial business environment. Furthermore, UnitedHealth is experiencing a decrease in the gross margin for Medicare Part D and Medicare Chronic Special Needs Plans.

Additionally, UnitedHealth announced that it had reached an agreement to settle both the federal securities class action and ERISA lawsuits. Both lawsuits arose from UnitedHealth's historical stock option practices. As a result of the settlements, UnitedHealth will pay $895 million pre-tax into a settlement fund for the benefit of class members of the federal securities class action lawsuit and $17 million into a settlement fund for the benefit of ERISA class members. UnitedHealth's insurance carriers will cover the majority of the ERISA settlement.

A.M. Best expects UnitedHealth to continue to experience pressure in the commercial market, which may result in lower margins. The result of these announcements and the subsequent payment for the settlements are expected to increase UnitedHealth's debt-to-capital ratio above 40%, should the company use debt for the payment. While A.M. Best is not comfortable with an increase in the debt-to-capital ratio above 40%, A.M. Best expects the ratio to remain less than 45% and for this ratio to return to 40%by second quarter 2009. A.M. Best also expects UnitedHealth's earnings before interest and taxes (EBIT) interest coverage to remain at 10 times or greater. Additionally, A.M. Best would like UnitedHealth to scale back its share repurchase program until the debt-to-capital ratio decreases to 40%.

On January 29, 2008, A.M. Best issued a press release announcing a downgrade to the ratings of UnitedHealth Group and select subsidiaries. At that time, A.M. Best considered the change in the company's capital structure and increase in debt-to-capital ratio in the rating action.

If UnitedHealth's debt-to-capital ratio increases above 45% or if the company announces another negative revision to earnings (including any additional settlements or fines), a negative rating action may occur. Additionally, A.M. Best would take into consideration the magnitude of the amount of any settlement or fine in any rating action. A.M. Best will continue to monitor the financial results and risk-based capitalization of UnitedHealth and its insurance subsidiaries, as well as continue its ongoing dialogue with company management.

About Suboxone:

Suboxone is the first drug approved by the FDA for opiate dependence treatment in office based settings. This means that patients addicted to opiates may now choose to receive opiate-based treatment as an outpatient instead of in a hospital setting. Patients are evaluated and treated during office visits and receive a prescription for suboxone which they may fill at any pharmacy. Suboxone is comprised of two separate medications: buprenorphine and naloxone. Buprenorphine is a partial opiate agonist, meaning its opiate effects are significantly reduced compared to that of full opiate agonists, such as vicodin or heroin. The naloxone in suboxone is not appreciably absorbed from the digestive track when suboxone is taken orally and is in place to prevent the misuse of suboxone by injection drug users. About Suboxone Treatment:

Suboxone treatment differs significantly from standard opiate dependence treatment programs. Traditionally, opiate addicts undergoing medical detoxification have been administered either methadone or a combination of drugs, each targeting a symptom of withdrawal. The latter approach usually must take place in an inpatient setting in order to be done safely, while methadone treatment requires a patient to visit a clinic on a daily basis to receive a prescribed dose. Suboxone treatment differs from these treatments in several important ways. Firstly, a prescription for suboxone can be obtained at a specially licensed physician's office and filled at any pharmacy. This means the patient does not need to be admitted to a hospital or make daily visits to a methadone clinic in order to receive their medication. Secondly, because suboxone is a mixture of naloxone and buprenorphine, a partial opiate agonist with a long duration of action, the potential for abuse and overdose are much less than with methadone. Thirdly, because buprenorphine is a partial opiate agonist, suboxone may be easier to taper off of than full opiate agonists like methadone.

GLENWOOD, Minn.-- June 18, 2008 --The Certification Commission for Healthcare Information Technology (CCHIT®) today announced that Dairyland Healthcare Solutions' Physician Practice Documentation (PPD), Version 9.0.0 is CCHIT Certified®, and meets the Commission's ambulatory electronic health record (EHR) criteria for 2007. Ambulatory EHRs are designed for physician offices and clinics where most Americans get their healthcare. CCHIT - an independent, nonprofit organization - is the Recognized Certification Body in the United States for certifying health information technology products.

In the second year of the program's operation, the criteria and testing have been significantly enhanced. The Commission added 96 criteria to the 151 original requirements from last year. As a CCHIT Certified product has been tested and passed inspection of 100 percent of a set of updated criteria for functionality, interoperability and security.

"For 2007, the Commission raised the bar from the previous year's criteria. Ambulatory EHRs now must include electronic prescribing, demonstrate an ability to receive lab results, and show enhanced patient safety, quality, and security features," said Mark Leavitt, M.D., Ph.D., chair, CCHIT. Two-Year Clinical Trial Findings Show Significant and Persistent Reduction in Blood Pressure with CVRx® Rheos® Hypertension Therapy

MINNEAPOLIS & BERLIN-- June 18, 2008 --The first available two-year data from the European clinical trial evaluating the Rheos® Hypertension (HT) System were presented today at Hypertension Berlin 2008. Developed by U.S.-based CVRx, Inc., the Rheos HT System is the only implantable medical device designed to control hypertension, or high blood pressure. Worldwide, hypertension is a leading and growing cause of heart and kidney disease, stroke and death. The Rheos HT System could provide a new treatment option for the millions of people who cannot control their hypertension with medications. The device activates the body's own system for regulating blood pressure.

"We are excited to see a sustained reduction in blood pressure after two years of Rheos HT Therapy - a major milestone in the evaluation of our novel treatment approach," said Nadim Yared, CVRx president and chief executive officer. "Hypertension is a complex condition, affecting multiple physiological functions. The clinical data from the Device-Based Therapy of Hypertension (DEBuT-HT) study (Abstract No. OS17/3) were presented at Hypertension Berlin 2008, a joint congress held in Berlin of the 18th Scientific Meeting of the European Society of Hypertension and the 22nd Scientific Meeting of the International Society of Hypertension. Of the 45 patients enrolled in this study, 16 patients from four European centers have completed two years of Rheos HT Therapy. Blood pressure measurements were taken in the clinic and after two years showed:

    * Systolic blood pressure was reduced by an average of 35 mmHg (191 mmHg vs.156 mmHg); and
    * Diastolic blood pressure was reduced by an average of 24 mmHg (116 mmHg vs. 92 mmHg).

Similar results were found at three months and one year of Rheos HT Therapy. Patients remained on background medical therapy during the trial. During the two-year study period, the average number of antihypertensive medications remained stable.

A drop in systolic blood pressure of at least 20 mmHg was achieved in 12 of the 16 patients (75 percent). The Rheos implants were well tolerated, and there were no unanticipated adverse events related to the system or procedure. Peter de Leeuw, professor of medicine and hypertension at the University of Maastricht in The Netherlands, is the leading enroller in the DEBuT-HT study. The 16 patients included in the two-year results were from the following clinical trial sites: the University Hospital Maastricht and Cardiovascular Research Institute Maastricht, Maastricht, The Netherlands; University Hospital, Inselspital Bern, Bern, Switzerland; Humboldt University Charité Campus Buch, Berlin; and Heart and Diabetes Center North Rhine Westphalia, Bad Oeynhausen, Germany.

Additional Rheos Data Presented at Hypertension 2008

Additional data from the DEBuT-HT study and U.S. Rheos feasibility study were presented in two poster sessions at Hypertension 2008. These studies showed early signs that the Rheos HT System can improve heart function and preserve kidney function.

    * Heart function was notably improved among the 16 patients who completed one year of Rheos HT Therapy (Abstract No. PS33/THU/24). Blood pressure was reduced significantly, and left ventricular hypertrophy (LVH) significantly regressed. LVH, a process in which the heart becomes enlarged and does not work efficiently, increases the risk of heart attacks, heart failure and sudden cardiac death and regression of LVH reduces these risks.
    * The University of Maastricht studied the effects of the Rheos HT Therapy on kidney function (Abstract No. PS32/WED/63) among their 12 patients who received therapy for one year. In this group, the Rheos HT Therapy was shown to help preserve kidney function over this time period. High blood pressure increases the risk and progression of kidney disease.

U.S. Rheos Pivotal Trial in Progress

CVRx received investigational device exemption (IDE) approval from the FDA to begin the Rheos Pivotal Trial to evaluate the safety and effectiveness of the Rheos HT System. The Rheos HT System: Working with the Body's Own Mechanisms

The Rheos HT System uses CVRx patented Baroreflex Activation TherapyT (BATT) technology that is designed to electrically activate the carotid baroceptors, the body's natural blood pressure sensors. When the baroreceptors are activated, signals are sent through neural pathways to the brain and interpreted as a rise in blood pressure. The brain works to counteract this perceived rise in blood pressure by sending signals to other parts of the body (heart, blood vessels and kidneys) to lower high blood pressure.

The Rheos HT System includes the following components:

    * A small pulse generator that is implanted under the collar bone;
    * Two thin lead wires that are implanted at the left and right carotid arteries and connect to the pulse generator; and
    * The Rheos Programmer System, an external device used by doctors to non-invasively regulate the activation energy from the generator to the lead wires.
