AMS issues fatwa prohibiting long-term pact

BAGHDAD / Aswat al-Iraq: The Association of Muslim Scholars (AMS – Sunni organization) on Monday issued a fatwa prohibiting signing the long-term Iraqi-U.S. security agreement, accusing governmental officials and lawmakers who would approve it of betrayal, according to a release issued by the association.
“The long-term security pact between Iraq and the U.S. administration occupying the country, if it is signed, is considered religiously prohibited and obsolete, and creates no commitments that Iraqis should abide by,” said the release that was received by Aswat al-Iraq.
“The Iraqi politicians who are in the executive (government) or legislative (parliament) authorities who would pass this treaty are considered careless regarding the interest of the Uma (Muslim’s nation), the prophet (Mohammed) and Muslim Iraqis and others,” it said.
“This agreement includes concessions made by Iraqis, government and people, in all directions to their enemies, the American occupiers and their allies,” it added.
“It also embraces a military alliance with an occupying non-Muslim country; therefore it is religiously prohibited and obsolete,” it noted.
“In Islam, Muslims are not allowed to form military alliances with non-Muslims to battle Muslims,” it asserted.

What is democracy and what are its origins?
Statement on Democracy as Kufr: A warning for those planning to vote in this year's election
Democracy is the principle of the mastership of the people; and that mastership is an absolute and a supreme authority. This authority consists in the people's right to choose their leaders and legislate whatever laws they want.
The people usually practice this authority through delegation, by electing MPs who will represent them in the parliament and practices authority on their behalf. This mastership is the supreme authority above which there is no authority. Joseph Frankel - a western politician said: `the mastership means the supreme authority, which does not acknowledge any authority to be above it.
(The word `parliament' derives from the French word `parler', to speak or talk, and from the middle ages kings summoned representative advisers to their palace at Westminster to discuss the affairs of state).
The democratic system was founded in England and France, then from them it was transmitted to the other countries.
The pillars of democracy were established by the French Revolution in 1789. However, the parliamentary systems was founded in England one century before that. Ideologically, the principle of the mastership of the nation - which is the basis of democratic school of thought - had developed before the French Revolution for decades. This appeared in the writings of John Locke, Montesquieu and Jean Jacque Rousseau, who founded the theory of the social contract, which is the basis of the theory of the mastership of the nation. This was as a reaction and a war against the theory of divine delegation which had been widespread in Europe for about ten centuries. Such theory decided that the kings ruled by a choice and delegation from God. As a consequence, the Kings used to possess an absolute authority, supported in this by the priests (Roman Catholic Church).
Indeed the European peoples suffered severely from the absolute rule. Accordingly, the mastership of the nations was the best substitute for them, so as to find their way out of the supreme reign of the kings and the priests who ruled by the delegation of God - as they claimed. Therefore, democracy was originally founded to rebel against the authority of God, and grant the entire authority to Man to make his own way of life and laws without any restrictions.
The transition from the theory of delegation of God to that of the mastership of the nation was not a peaceful one. Rather, it happened by means of one of the bloodiest revolutions in the world, and that was the French Revolution in 1789, which had as its motto: `hang the last King by the intestines of the last priest'.
The French Revolution ended up with some highly important outcomes. Indeed there was born, for the first time in the history of Christian Europe, a non-religious republican state. Its philosophy was based on ruling in the name of the people instead of Allah (swt), on the freedom of belief instead of Catholicism, on individualism instead of being restricted by the religious conduct, and on man-made rule instead of the decisions of the church'.
The theory of the mastership of the nation and its right to lay down its laws appeared, indeed, in the principles of the French Revolution and its ruling system. Thus the sixth act of the declaration of the rights in 1789 stated: `the law is the expression of the will of the nation'. This means that the law is not an expression of the will of the Church or the will of God. In a declaration of the rights of man, which was issued along with the French ruling system in 1793, the 25th Act stated: `the mastership is centered in the people'. This why Abdul Hamid Mitwalli said: `the principles of the Revolution of 1789 are considered to be the basis of the western, democratic principles.'
The Islamic Verdict On Democracy, Mps And Those Who Vote For Them
With democracy, the supreme authority does not recognize any other authority to be higher than it, because its authority emanates from itself. Therefore, it does that which it wills and legislates that which it wills, without being accounted by anyone. But this is the ATTRIBUTE of Allah (swt):
And Allah (swt) judges there is none to put back His Judgment and He is swift at reckoning. (Qur'an 13:41). Allah (swt) commands that which He Wills. (Qur'an 5:2) Verily Allah (swt) does what He Wills. (Qur'an 22:14 )
We conclude from this that democracy ascribes the attributes of Uluhia (Godhead) to man, by granting him the absolute right to legislate. Owing to this, it has made him an Ilah (God) beside Allah (swt) and a partner to him concerning the right of legislating for the creation. This is no doubt a Kufr Akbar (i.e. Kufr that takes a person outside the fold of Islam). To put it more precisely, the new God in democracy is the desire of man, who legislates what he fancies and desires, without being restricted by anything. In the Qur'an Allah states:
Have you (O Mohammed) seen him who has taken as his Ilah (God) his own desire ? Would you then be a wakil (protecting guide) over him ? Or do you think that most of them hear and understand? They are only like cattle - nay; they are even farther astray from the path (i.e. even worse than cattle) .(Qur'an 25:43-44)
This makes democracy a self established religion in which the mastership is for the people. In contrast, in the religion of Islam the mastership belongs to Allah (swt) as the messenger of Allah (swt) said: the master is Allah (swt) [Narrated by Abu Dawud in his sunan, the book of Al-Adab (manners) and classified as Sahih].
One famous person wrote:
"The western civilization is founded on three pillars: secularism, nationalism and democracy. As for the third principle: (that is) democracy or ascribing Godhead to man, by joining the previous pillars, the picture which encompasses within its frame suffering and the weariness of the world becomes complete. With democracy the inhabitants of a place are free concerning that which fulfils their social welfare, and that the law of such a place stems from their desires.
Secularism has liberated the people from worshipping Allah (swt), obeying Him, fearing Him and from the established restrictions of conduct. It has also caused them to wander wherever they wish, and has made them slaves of themselves without being responsible to anyone.
Nationalism has come to give them big mouthfuls of the wine of egoism, pride, arrogation and disrespect for others.
Finally, democracy has come to make this man - after granting him freedom and making a prisoner of the desires of the self, and obsessed by the pleasure of egoism - sit on the throne of Godhead. Thus it has bestowed on him the full authority of legislating and making laws, and has made the ruling system, with all its capacities, at his services in order to fulfill everything that he requests.
Nationalism, secularism and democracy contradicts the religion of Aqeedah that Muslims embrace. So if you surrender to it, this would as if you have left the book of Allah (swt) behind your backs; and if you take part in establishing or keeping it, you have indeed betrayed your Messenger whom Allah (swt) sent to you. Wherever this system is present, Islam does not exist, and wherever Islam is present there is no place for this system."
The above was said by Professor Abu Ul-Aala Al-Mawdudi, founder and former leader of a group called Jamaat Islami. Unfortunately in Pakistan, Jamaat Islami has taken democracy as a methodology and has participated in the parliamentary elections in Pakistan - which is a secularist state - during Al-Mawdudi's lifetime, after his death and until today.
Allah (swt) said:
Why do you say that which you do not do ? Most hateful in the sight of Allah (swt) that you say that which you do not. (Qur'an 6:23)
Allah (swt) also said:
`Enjoin you Al-Birr (piety and righteousness and each and every act of obedience to Allah (swt) on the people and you forget (to practice it) yourselves, while you recite the Scripture ! Have you no sense? (Qur'an 2:44)
As the people are the ones to whom the mastership belongs - in democracy - and who practice it by means of their delegates in the parliament, therefore both parties are falling into Kufr. The members of the parliament and those amongst the people who vote them for these positions.
As for the MPs, the cause of their Kufr is that they are the ones to whom the applicable mastership belongs, and are the ones who legislate for the people beside Allah (swt), be it by making laws, legislating them or consenting on them.
Besides all the modern, secularist ruling systems state that: `the authority of legislation belongs to the Parliament', whether this parliament is called the House of Commons, The National Assembly, The Congress, The Legislative Assembly or something else. This sets up the MPs as partners to Allah (swt) in His Rububia (i.e. His right of being the sole Legislator for mankind, and this is one of His Actions).
Or have they partners (false gods) with Allah (swt), who have instituted for them religion which Allah (swt) has not allowed'. (Qur'an 42:21)
The religion - in one of its meanings - is the people's life system, be it true or false because of His saying: to you be your religion and to me my religion. (Qur'an 109:6)
So Allah (swt), Praise and Glory be to Him, called the Kufr that the Kufr were upon, a religion. Therefore whoever legislates for the people, has indeed appointed himself as a God to them and has made himself a partner with Allah (swt). This is one evidence.
Another proof concerning the Kufr of these MPs is that by legislating for the people, they have set themselves as gods besides Allah (swt), and that is the very same Kufr mentioned in his saying:
`Say (O Mohammed [saw]: O People of the Scriptures Come to a word that is just between us and you, that we worship none but Allah (swt) and that we associated no partner with Him, and that none of us shall take other as Lords besides Allah (swt). And if they turn away: then say: Bear Witness that we are they who have surrendered unto Him'. (Qur'an 3:64)
Indeed this Rububia (Godhead), which is mentioned in this verse in regard to legislating beside Allah (swt), is the same as the one mentioned in His saying:
`They (Jews and Christians) took their rabbis and their monks to be their lord, beside Allah (swt); (Qur'an 9:31)
Adey bin Hatim, may Allah (swt) be pleased with him - who was a Christian and then embraced Islam said: I came to the Messenger (saw) of Allah (swt) while he was reciting Surah At-Taubah till he reached this verse: ` they (Jews and Christians) took their Rabbis and their Monks to be their Lords beside Allah (swt)'. So I said: `O Messenger (saw) of Allah (swt), we never took them as lords. He (Prophet (saw) ) said: `Yes (you did). Did not they legalise for you that which Allah (swt) forbade you, and you forbade it ?' I said: `yes indeed'. He said: `that is worshipping them.' [Narrated by Ahmed and Tirmidhi who classified it as Sahih].
Concerning the tafsir of this verse Al-Alussi said: 'Most of the tafsir scholars said: `the meaning of lords is not because they believed that they were the gods of the universe, rather, the meaning is that they obeyed them in what they commanded and forbade'. All of this illustrates that whoever legislates for the people besides Allah (swt), such as the Rabbis of the Jews, the Monks of the Christians and the MPs, he has indeed set himself up as a lord to them, and that is enough as a clear kufr. So should anyone of these MPs be pleased with this parliamentary job of Shirk or participate in it, his Kufr is clear without any doubt. As for the MP who claims that he is not pleased with it, and that he has only entered the parliament for Daawa and reform, he is a Kafir as well. His saying so is but a trick to deceive the laymen and the ignorant people, and a shield by which he defends himself. The reason behind his kufr is that his entering the parliament is a recognition of the legality of their activities i.e. going to the desire of the people for judgment, and is an abiding by its principles and the principle of the system through which they (parliaments) were established. So all of this is a voluntary going to the Taghut (false gods) for judgment, which makes the person who does it a Kafir, because Allah (swt) says:
'And in whatsoever you differ the decision thereof is with Allah (swt) (He is the Ruling Judge) (Qur'an 42:10)
In contrast, democracy states: `And in whatsoever you differ, the decision thereof is with the delegates of the people in the parliaments or with the majority of the people in the referendum.` All the MPs of the House of Commons are abiding by this Kufr principle, and if they show the least opposition to it, they will be dismissed from it according to its regulations. So whoever manifests Kufr to us we shall manifest to him Takfeer (i.e. judging a person as a kafir)... These parliaments are based on disbelief in the verses of Allah (swt), because their prime task is to legislate beside Him, Praise and Glory be to Him. Therefore, whoever sits with them in Kufr.... There is another Kufr task for the MPs which some people are not aware of. Their job is not only to take charge of the authority of legislating beside Allah (swt).
Rather, all the modern, secularist ruling systems state that the parliament is the one which gives assertion to the general politics of the country and observes the activities of the government which carries out (laws), and that is the government; and that the government is responsible in the presence of the parliament. This means that all the kufr which the government practices - such as ruling by man-made laws and following the secularist method - the non-religious one - in both external and internal politics, in education, media, economy, or else - is decided upon by the MPs, who grant license to the governments to implement them. In fact they have the right to account the government if it deviates from this kufr or permits its implementation.
The fourth thing that nullifies Islam: everyone who believes that it is permissible to rule by other than the Shariah of Allah (swt) in dealings, hudud (Islamic Penal code) or something else. In fact, even if he does not believe that this is better than the rule of the Shari, because by permitting this, he would legalese that which Allah (swt) has forbidden by the Ijma (unanimous consensus); and everyone who legalizes that which Allah (swt) has forbidden and which is known from the religion by necessity, such as fornication, wine, riba (usury) and ruling by other than the Shari of Allah (swt), he is a kafir by the Ijma of the Muslims. Additionally, in his essay, `The Criticism of the Arabs Nationalism`, Sheik Bin Baz described the ruling by man-made laws as `This is the great mischief, the clear kufr and the manifest Ridda (Apostasy). As for those amongst the people who vote for them (MPs), they are committing kufr as well, because according to the parliamentary democracy, the voters are in reality delegating them so as to practice the mastership of shirk-legislating beside Allah (swt) - on their behalf. Thus the voters give the MPs the right to implement shirk, and set them up - through their voting - as legislating lords beside Allah (swt). Allah (swt) says:
`Nor would he order you to take angels and Prophets for lords (gods). Would he order you to disbelieve after you have submitted to Allah's will.' (Qur'an 3:80)
So if a person who takes angels and Prophets as lords has become a kafir, how then about the person who takes the MPs for that?
"Say (O Muhammad [saw]): O People of the scriptures (Jews and Christians), come to a word that is just between us and you, that we worship none but Allah (swt), and that we associate no partners with Him, and one of us shall take others as lords besides Allah (swt)" (Qur'an 3:64)
Consequently, taking people as lords besides Allah (swt) is a shirk and a disbelief in Allah (swt), and that is what those who vote for the MPs are doing.
Professor Sayyed Qutb, may Allah's mercy be upon him, said concerning the previous verse: `Verily, people, in all the systems of the earth, are taking one another as lords beside Allah (swt). This is happening in the most progressed democracies as well as in the most declined dictatorships...Verily the prime quality of Rububia is the right of making people worship Allah (swt), the right of establishing systems, schools of thought, Sharai' (plural of Shariah ?), laws, values and standards.
These group of people, who are subjugating the others to their laws, standards, values and conceptions, are the lords of the earth whom some people are taking as lords beside Allah (swt), and are allowing them to claim Uluhia and Rububia. Owing to this, they are worshipping them beside Allah (swt), even if they do not make sujud (prostration) and ruku (bowing) to them, because worship is ascribed to none but Allah (swt).`
Sayyed Qutub said: `And Islam...is the religion for Allah (swt), and which every Messenger came with from Allah (swt). Indeed Allah (swt) sent the Messengers with this religion to liberate mankind from the worship of the slaves to the worship of Allah (swt), and from the oppression of the slaves to the Justice of Allah (swt). Therefore, whoever turns away from it, is not a Muslim by the testimony of Allah (swt), no matter how the misconceived people misinterpret and the misguided lead. Verily the religion for Allah (swt) is Islam.' These secularist parliaments, wherein legislating kufr laws, permitting them and, in fact, reinforcing their implementation are fulfilled, are today similar to the Mushrikuns' temples, in which they set up their lords and practice their pagan and shirk rituals. Therefore, whoever helps to establish these parliaments - either by taking part in them, as the MPs do, or electing the MPs, as the voters do, or beautifying them to the people - is a Kafir.
Democracy and parliament, is the religion of the kufaar and their desires. Therefore, being pleased with entering into their religion and following it means going out of the fold of Islam.
`Verily, if you follow their desire after that which you received knowledge (from Allah (swt)); then indeed you are of the Zalimun (polytheists, wrongdoers, etc)'. (Qur'an 2:154)
`And it is the disbelievers who are the Zalimun' (Qur'an 2:254)
Accordingly, do not turn your back on your heals as kafirs and apostates, and do not let the Shaytan mislead you and give you hope regarding establishing the laws of the Shari by means of these houses of Kufr. Allah (swt) says:
`He (Shaytaan) makes promise to them, and arouses in them false desires; and Shaytaan's promises are nothing but deceptions.' (Qur'an 4:120)
Likewise, democracy is the religion of America (and western countries in general), which regards itself as the protector of democracy in the world. The American Congress (parliament) has laid down a law, which has as its condition the implementation of democracy in the countries that are offered American aid. This is because the democratic system is one of the easiest systems that give America the opportunity to interfere in the affairs of the countries in a lawful manner. This happens by taking over the members of the legislature, and by making specific MPs succeed in elections by seducing the masses with money. (Italy, Iran, Russia, etc)
Indeed America interfered in many legislative elections; for instance its interference in the Italian elections in 1947, the year in which the American president Truman, declared his famous principle which legalized form America's secret services to spend over $70 million to make the Christian Democratic Party succeed and the Communist Party fail. Moreover, America has made this public and is proud of it. Once again America interfered in the Italian elections in 1976, in which the American secretary of state, Henry Kissenger, proclaimed his famous principle in order to meddle in the Italian elections.
This is the religion of America, the religion of the Jews and the Christians, and that is what the Prophet (saw) warned us from falling into by his saying: `You will certainly follow the ways of those who came before you, span by span, and arm by arm, even if they enter the hole of the lizard, you will certainly follow them.' They (Sahabah) asked: `Do you mean the Jews and the Christians O Messenger of Allah (swt)?' He said :'who else then?'
This (democracy) is nothing but an evil deception to divert the Muslims from Jihad which is obligatory upon them, the Jihad against the apostate rulers and the other kafirun. Thus the human satans have come to say: `And why Jihad and hardship while the election boxes are the solution ?; what is obligatory upon you, as far as the Shari is concerned, is to go and throw a card in the box, and indeed Sheik bin Baz issued a fatwa about the permissibility of this. `But if you do not win in this round, you may well win in the next one.'
Thus, people would spend their lives awaiting what the election boxes would result in. Undoubtedly, the happiest amongst the people about this satanic way are At-Tawagheet (Apostate Rulers), in their various types, who allowed some of those who belong to Islam to enter into the parliament for nothing but to divert the Muslims from their Jihad. Indeed Sheik-ul-Islam, Ibn-Taymia, may Allah's mercy be upon him, mentioned that: `the Imamate is established by giving the allegiance to the people with power.` Similarly, no Islamic state will be established in our age except by power. Therefore, one should not be lured by the millions of people who vote for those who claim to be Islamist in parliamentary elections.
Verily, if these people were asked to raise their arms and wage Jihad in order to implement the Islamic rule, they would certainly run away. So what power or so strong military do these people have against kuffar rulers? The state belongs to those who possess the power and power consists of men and arms, then reinforcements. The result of the parliamentary elections are nothing but falsities and delusions, which are not based on power, let alone being founded on a legal evidence (from the Shariah).
Additionally, democracy, with its parliaments and elections, is nothing but a deception which drugs the Islamic capacities, and a station which consumes these capacities far away from the thrones of the Tawagheet (Apostate Rulers). The Kuffar, various as they are, are calling for democracy as long as it fulfills their desires. But once it opposes their benefits, they would be the first ones to destroy it. Theirs is a similitude of that Kafir who mad his Idol out of dates, but when became hungry he ate his lord which used to worship. The examples concerning this are numerous both in the East and the West.
The conclusion, is that the MPs are the ones who have the right to legislate for the people, and are, in reality,, lords that are worshipped beside Allah (swt); and those who vote for them are appointing them as lords besides Allah (swt). So both parties become Kafirs because of this.
`Say (O Muhammad [saw] O People of the Scripture (Jews and Christians) come to a word that is just between us and you, that we worship none but Allah (swt), and we associate no partners with Him, and that none of us shall take others as lords beside Allah (swt). Then if they turn away: bear witness that we Muslims.' (Qur'an 3:64)
Therefore, it is not permissible to enter into Parliament or participate in electing their members. Indeed, it has become clear for you that participating in these parliaments, either by being candidate or voting is from the Kufr Akbar.
Indeed some kuffar claimed that their intention and aim from committing kufr was to bring themselves near to Allah (swt). But Allah (swt) rejected their saying and judged them as kafirs and liars. This is because if they intended to draw near to Allah (swt) they would have done so by means of that which He (swt) enjoined and not by that which He forbade.
`And those who take Awliya (protectors and helpers) beside Him (Say):'We worship them only that they may bring us near to Allah (swt). Verily Allah (swt) will judge between them concerning that wherein they differ. Truly, Allah (swt) guides not Him who is a Liar and a disbeliever.' (Qur'an 39:4)
Bin Baz himself said: 'And indeed some Mushrikun claimed that their intention from worshipping the Prophets and the pious people, and from taking idols as lords beside Allah (swt), was to bring them near to Allah (swt) and gain the intercession through them to Allah (swt), Praise and Glory be to Him. But Allah (swt) rejected that and refuted it by saying:
"And they worship besides Allah (swt) things that hurt them not, nor profit them, and they say `these are our intercessors with Allah (swt)'. Say `Do you inform Allah (swt) of that which he knows not in the Heavens and on the Earth?' Glorified and Exalted be He above all that which they associate as partners with Him!"
The case is, therefore, the same with the one who enters into the parliament and says that his intention is to call to Allah (swt): he is a liar and a Kafir, even if he calls his shirk in regard to Allah (swt) a Daawa to Allah (swt).
`Say (O Muhammad) the things that my Lord has indeed forbidden are al-Fawahish (great evil sins, every kind of unlawful sexual intercourse, etc...) whether committed openly or secretly, sins (of all kinds), unrighteous oppression, joining partners (in worship) with Allah (swt) for which He has not given authority, and saying things about Allah (swt) of which you have no knowledge. (Qur'an 7:33)
It is wrong to make, support and participate in systems which rule by what Allah (swt) has not revealed, and (then) claim to be Muslims and have respect for Aqeedah at the same time. Consequently, they have destroyed the feeling of the people, guaranteed for themselves their friendship and drugged their conscience.

Then they have hastened to destroy the Shariah of Allah (swt), while being secure from their uprising. Residents of grim camp tell of clashes between coalition forces and the Taliban

In the evening the temperature falls at last and light slants across the camp, throwing long shadows across the stagnant puddles and shining through the kites, made from plastic bags, that the children fly.
It shines, too, through the thin walls of the makeshift tents that cover a patch of wasteland in the west of Kabul. The 3,500 refugees who live in them are a long way from their homes in the badlands of the south where the British are fighting. Most of the refugees are from districts such as Sangin, Nawazad, Kajaki or Gereshk in the southern province of Helmand, sites of fierce battles between British troops and the Taliban.
Their stories reveal a different side of the conflict. Few understand who is fighting, even fewer distinguish between British troops and those of other nationalities, all tell stories of civilians killed by coalition air strikes. There is little sign of progress in the campaign to win hearts and minds.
Rozi Khan, a day labourer from Kajaki, said he had no idea which soldiers were fighting around his village when he left two months ago. In fact, securing Kajaki with its strategically important reservoir and dam has been a British objective since the initial days of the deployment in 2006. Last week British soldiers successfully transported a huge turbine to the dam, which could eventually supply nearly 2 million people with electricity. Coalition spokesmen claimed to have killed more than 250 Taliban during the operation.
But there is little evidence of material improvement on the ground, according to the refugees. "They say they have come to help us but they have come for fighting," Khan, 25, said. "But instead of killing one person who has attacked them they kill 50 people in the village. Is this a help?"
Bismatullah, who like many Afghans uses only one name, said "the Americans" and the Taliban were fighting around his home in Sangin, again in the British zone of operations. He too spoke of how large numbers of civilians had been killed and buildings destroyed. Independent confirmation of the claim was unavailable.
Bismatullah, 32, was nostalgic for the days when the Taliban were in power. "There was peace and security and no real fighting. The Taliban were following the path of the Qur'an," he said.
Such sentiments appear widespread. Many refugees interviewed said that the insurgents had not bothered them; others said that, as they had nothing, the Taliban had accepted their refusal to provide food. "They came asking but I showed them my children who are hungry and have no clothes and they left me alone. They get food from the richer people," said one farmer from Sangin.
Elsewhere, however, the refugees said the Taliban demanded food, lodging or even volunteers. "If you have nothing else to give them you have to go with them and they give you a gun and you have to fight. They haven't committed any atrocities but people are afraid of them," said another Sangin resident.
Often, villagers made a distinction between local Taliban they knew personally, such as those apparently operating in Kajaki district, and those who came from elsewhere, sometimes Pakistan, with whom they had more trouble. The real problem, most said, was not the Taliban or the "Amriki", as western troops are universally known, but the combination of the two.
"We had to leave because the Taliban were coming to our village and firing once or twice and there would be a big bombardment and some civilians would die," Ahmed Shah, from Nawazad district, said. The word bombardment has been integrated into local languages.
Nato spokesmen frequently allege that the Taliban deliberately invite attacks that will kill civilians in order to turn local populations against the international forces and the Afghan government they support. Taliban spokesmen deny the charge. The situation is muddied further as local officials and tribal elders often inflate the number of civilian casualties for political gain or more compensation.
But that the villagers are caught in the crossfire is without doubt. Nor is their extreme poverty. Most are landless labourers forced to travel to seek work. For them the war brings particular problems.
"If I went out of my village I risked being shot by the government as a Taliban spy or shot by the Taliban as a government spy," said one refugee from the central Oruzgan province, where Dutch and US soldiers are deployed. "The government holds the district centres, the Taliban run everything outside."
Most of the refugees are destitute, often having borrowed money or sold their last possessions to travel by truck to Kabul. The unauthorised camp has been established on unused government land. There is no sanitation and summer temperatures reach 40C (104F). They live on scraps of stale bread scavenged from rubbish piles across the city.
As a widow with four young children, Gul Pari is in a worse situation than many. She said her husband, a labourer, was killed a year ago in Helmand in a "bombardment" but is unsure which side was to blame. "When there was fighting, we did not know what was going on. But I think it was the fault of the Taliban because they were shooting and then there was an attack afterwards. Now we have nothing except the 50 Afghani [65p] each day that my son gets from selling ice creams."
The refugees have received blankets and plastic sheets from the United Nations Refugee Agency (UNHCR), and an initial ration of food from the government, and are helped by local businessmen.
"They are in a poor situation but are better off than many other such communities around the country who are less visible," said Mohammed Nader Farhad of the UNHCR. "Especially in the south and east there are problems with displacement due to military operations. Most people want to go home but can't due to the fighting."
Government estimates place the number of internally displaced by the conflict at 10,000, though aid agencies believe the true total is seven times greater.
Said Ali, who last month fled the Helmand town of Gereshk, where British troops have struggled for two years to stabilise a secure zone, said: "There was fighting with the Taliban and local people shooting at the soldiers and then the planes were coming. My house was destroyed, my animals were killed, my brother injured. We have nothing there and we have nothing here."
Ali was unsure of the future. "When there is peace we will go home but now there is war," he said.
For a few autumn months at least the temperatures will be relatively pleasant and the dust storms will end. But then the vicious Kabul winter will come.

THE CONTEMPORARY SYSTEM IS FINISHED – COME TO ISLAM

FOR IMMEDIATE RELEASE - As the world teeters on recent financial news, we gather here today with a very stern and prolific call to all of humanity. Indeed in this day and age a call such as this will seem ludicrous and many may claim it as even terroristic. but as the international monetary system comes crashing before our eyes and the workers on the ground that have helped to create this mess wonder if they too will ever be able to play the same casino cards again that they have been playing over the most recent economic era; we meet here to tell all that the international economic system has entered a terminal phase and that the longer radical changes are prevented from formulating a viable alternative, the more people across the globe will be affected by the inevitable recessions, hyperinflation and international economic blowout. Unfortunately, in times like these the poor and oppressed suffer the most and so we stand here today to call you to the only way out: the solution is to formulate a global system modeled on the tenants of Islam.

The basis of Islamic finance is the religion of Islam, submission to one God. Such submission, for the believer, requires adherence to the divine rules and rules derived from the interpretation of divine sources, in every aspect of his or her life including in the financial sphere. Sharia-compliant assets worldwide are worth an estimated $500 billion and have grown at more than 10 per cent per year over the past decade, placing Islamic finance in a global asset class all of its own. In the Gulf and Asia, Standard & Poor's estimates that 20 per cent of banking customers would now spontaneously choose an Islamic financial product over a conventional one with a similar risk-return profile. This growing market is a safe bet for investors for numerous reasons. Islamic finance has in recent times been developed as a response to specific prohibitions provided for in Islamic law. These prohibitions are agreed upon by the scholars and derived from specific verses in the Quran or specific authentic hadith:

Interest, riba, usury and the like – the Shari’ah abhors the concept of money on its own making money. Therefore, interest, riba, usury and the like are prohibited. Allah the most high says, “Those who devour usury will not stand except as stand one whom the Evil one by his touch hath driven to madness. That is because they say: ‘Trade is like usury,’ but Allah hath permitted trade and forbidden usury. Those who after receiving direction from their Lord, desist, shall be pardoned for the past; their case is for Allah (to judge); but those who repeat (the offence) are companions of the Fire: They will abide therein (for ever).” (the Quran 2:275).

Gharar or uncertainty – it is authentically reported from the Sunnah that the Messenger of Allah (may peace and blessings be upon him) forbade uncertainty; for example, the Prophet said, “Whoever buys foodstuffs, let he not sell them until he has possession of them” (reported in the hadith collection of Bukahri).

· Gambling or speculation (maysir) – the Shari’ah prohibits speculation. The prohibited speculation under the Shari’ah is not general commercial speculation, which is normally evident in most commercial transactions. Rather, it is one involving an effortless gain similar to a gambling scheme or activity. Allah the most high says, “O ye who believe! Intoxicants and gambling, (dedication of) stones, and (divination by) arrows, are an abomination, of Satan's handwork: eschew such (abomination), that ye may prosper.” (the Quran 5:90).

These prohibitions surely would have prevented the deregulated, sub-prime mortgage based, derivative and speculation driven catastrophe unfolding before our eyes today. We ask you to research the Islamic system and do something with your life that will establish an alternative to the ivory tower, Tower of Babel model whose idolatrous characteristics have defined the political economies of Babylon, Egypt, Greece, Rome, Britain, other empires and are exemplified contemporaneously the United States corporatist, neo-fascist models.

There is a need to return to a non-speculation driven system that utilizes finance, economic technology, and innovation to fund the development of a society rather than to create elite classes who upon their failure are bailed out with the people’s tax dollars. The era of the Post-Bretton Woods financial system witnessed a reliance on a floating exchange rate, speculation-driven, neo-colonialism that is far from coming to an end and is simply coming home to roost. However, the elite’s dominance can be righteously challenged by a populace that takes on the masters (international financiers and transnational corporations). We call on humanity to research and understand the principles of Islam, many of which are compatible with the principles of the American System of Political Economy such as
·protecting industry through selective high tariffs (especially 1861–1932) and some include through subsidies (especially 1932–70)
· government investments in infrastructure creating targeted internal improvements (especially in transportation)
· a national bank with policies that promote the growth of productive enterprises
These principles that built America must now be reinserted into the global economy to take away neo-feudalist trends (A.K.A globalization). Shariah Compliant Finance offers that solution and tangible alternatives can be developed to the present system, now in a flux, that will inevitably have to consume its own population this time in order to stay alive before turning to invest in authoritarian Middle Eastern regimes, oppressive China, and colonialist caste-based India. As Muslims, it is our duty to call on all to become aware of the present catastrophe and potential dark-age facing humanity. We call on all to contribute to the Islamic system that, upon further and more specific analysis by those economically inclined, offers the solution for mankind. We must develop truly revolutionary changes to the economic order. This includes massive populist revolts that will emancipate the human capital and natural resources of the Muslim world from Western imposed dictators that continue to squander the wealth of the Muslim nation. Mankind must then utter the dinar and dirham, backed initially in oil, gas, gold, and silver to take control over the world’s wealth, issue development bonds (sukook) and expand the infrastructure of the entire world through modern mechanisms very similar to the American Experiment over its first 150 years of emancipation from British monarchy, which it unfortunately has haphazardly stumbled back into conflict with today.

No longer can we live in a self-centered modality which breeds utter contempt for fellow man. We must learn to reward innovation but balance the narcisstic tendencies of wealth and power by inserting universal principles that can develop the quality of life for all against systems that oppress the majority and reward the rich. This recent crisis creates an opportunity to work for a viable alternative system and to come to the truth that is the message of Allah as delivered to His last and final Messenger Muhammad through the Quran as perceived by the righteous men and women that are so few in the universe today. We call you to Islam and to leave the lie that is Wall Street. Come to REAL ISLAM in its totality and make the world a better place.

U.S. troops in Afghanistan shot Dr. Aafia Siddiqui and took her into custody in July. She lies in solitary confinement in the Manhattan Detention Center, with an open scar from her sternum to her lower abdomen. She has not seen her lawyer, Elizabeth Fink, because if she leaves her cell she faces an excruciating strip search.

Aafia Siddiqui is a 36-year-old Pakistani national who is a graduate of MIT and holds a Ph.D. in neuroscience from Brandeis University. On a visit home to Karachi in 2003, she was disappeared along with her three children. Her family believes the U.S. government captured, tortured and incarcerated her.
The U.S. government claims Siddiqui is an Al Qaeda terrorist. Federal officials deny knowledge of her whereabouts for the last five years. But on July 17, U.S. troops arrested her outside the governor’s office in Afghanistan’s Ghazni province after police searched her handbag and allegedly found documents on making explosives as well as descriptions of New York City landmarks. This story is at odds with the one the Afghan police tell. According to the Afghan officials, Siddiqui was arrested with maps of Ghazni, a city in central Afghanistan, including one of the governor’s house.
When U.S. troops requested Siddiqui be handed over to them, Afghan police refused, so U.S. soldiers disarmed them. The U.S. troops, “thinking that she had explosives and would attack them as a suicide bomber, shot her and arrested her.” The U.S. troops claimed she somehow managed to grab an M-4 rifle in a police station and shot at them. (Reuters, Aug. 14)
Human rights groups said they believe Dr. Siddiqui had been secretly detained since 2003, much of the time in U.S. custody at the Bagram Air Base in Afghanistan. Dr. Siddiqui’s 12-year-old son is still in prison in Afghanistan. No one knows where her two youngest children are.
“We believe Aafia has been in custody ever since she disappeared,” said one of her lawyers, Elaine Whitfield Sharp. (New York Times, Aug. 5)
In Pakistan and the U.S., scores of protesters have condemned the detention and torture of Siddiqui and demanded her release. If there was to be a trial, Pakistanis claim that, “She should have faced a court of law here in her own country.” (Daily Times, Pakistan, Aug. 11)
Pakistan has been a client state of the U.S. for decades. Ex-dictator Musharraf allowed the U.S. and NATO to bomb civilians in its northern provinces, along with permitting the arrest, disappearance and detention of thousands of Pakistanis. Many Pakistanis are enraged over the U.S. claims of extraterritorial jurisdictions, which violate international laws.
After Dr. Siddiqui was shot, she was flown to the U.S. in the custody of FBI agents, in agony and confused. Her lawyer, Elizabeth Fink, explained at a trial on Sept. 4 in Manhattan that Dr. Siddiqui could not appear for trial because the strip search she must undergo each time she leaves her cell is physically unbearable. When Fink last saw her, on Aug. 11, Dr. Siddiqui was disoriented and begged Fink to send food she was given to her son in his prison in Afghanistan.
Hundreds came to the trial on Sept. 4 and gathered afterward to protest the unjust treatment of Dr. Siddiqui. Chanting, “Free, Free Aafia Siddiqui!” Pakistani, African-American and north American speakers called for an end to CIA torture prisons in Pakistan, Iraq, Afghanistan, Guantánamo in Cuba, and Somalia. They denounced the policies of the U.S. that have placed this young mother literally in the crosshairs of U.S. imperialism.

Afghanistan frees young son of al-Qaida suspect

ISLAMABAD, Pakistan (AP) — The 12-year-old son of a woman suspected of links to al-Qaida and facing charges in New York was freed Monday by Afghanistan and sent to his family in Pakistan, two months after he was detained with his mother.
Officials say the boy, Ali Hassan, and his mother, Aafia Siddiqui, were detained outside the governor's house in Afghanistan's Ghazni province in July. The American-educated Pakistani woman was then handed over to U.S. custody and flown to New York where she was accused of trying to kill U.S. personnel.
The U.S. indictment alleges that during Siddiqui's interrogation in Ghazni, the 36-year-old picked up a soldier's rifle, announced her "desire to kill Americans" and fired at U.S. soldiers and FBI agents. She was wounded by return fire.
American prosecutors say that when taken into custody in Afghanistan, she was carrying handwritten notes referring to a "mass casualty attack" and listing the Empire State Building and other New York landmarks. However, the indictment contains no charges of terrorism.
Ali was with his mother at the time of her arrest and had been in Afghan custody ever since, officials said.
A spokesman for Afghanistan's Foreign Ministry, Sultan Ahmed Baheen, said Ali had spent the previous 10 days in a "guest house" of Afghanistan's intelligence service. Before that, he was in the custody of a prosecutor who deals with minors, the ministry said.
Baheen said Ali is a dual American-Pakistani citizen because he was born in the United States.
Elaine Whitfield Sharp, who represents the family of Aafia Siddiqui, said the boy's release was "wonderful news."
"I'm just so happy for them. Finally, something good has happened for the family," Whitfield Sharp said by telephone from Massachusetts.
She added that she had spoken briefly with Aafia and described her client as "excited" to hear her son had been released.
Afghan authorities handed him over to Pakistani diplomats, who flew him to Islamabad on Monday evening. The Pakistani Foreign Ministry said he had been handed over to relatives of his mother.
Whitfield Sharp said the son was apparently now at the home of an uncle in Islamabad.
Pakistan's Express News television channel showed footage of Ali, a round-faced boy with dark hair, smiling shyly beneath a white prayer cap as an aunt kissed and embraced him at a house in the capital, Islamabad.
Fauzia Siddiqui told reporters her nephew was "very traumatized."
"He is like a dead body. They fed him and tried to make him look healthy, but he is disturbed," she said. "Thank God he is grown. He is a big boy now."
She said Ali told his relatives Monday that his name had been changed several times and that each change was followed by a change of location. But she did not elaborate.
Aafia Siddiqui came to the United States in 1990 and studied at the University of Houston and Massachusetts Institute of Technology, where she got a bachelor's degree in biology in 1995. She later studied neuroscience as a graduate student at Brandeis University.
She vanished in Pakistan in 2003.
In 2004, then-Attorney General John Ashcroft and FBI Director Robert Mueller III identified Siddiqui as one of seven people the FBI wanted to question about suspected ties to al-Qaida. Her family has vehemently denied any link.
Fauzia Siddiqui said she didn't want to blame anyone for Ali's ordeal and expressed hope that the embrace of his relatives would allow her nephew to forget.
She dodged a question about the circumstances of her sister and nephew's detentions in Afghanistan.
In Washington, State Department spokesman Sean McCormack told reporters the U.S. was following the latest developments closely.
Aafia Siddiqui's lawyers claim that before she was arrested and brought to New York, she was kidnapped by U.S. operatives and kept in secret captivity in Pakistan. The ordeal, they said, left her with severe physical and mental problems.
Last week, a warden at a federal prison in Brooklyn notified a judge that Siddiqui is suffering from major depression.
U.S. officials deny she was ever in their captivity before she surfaced in Afghanistan in July.
Baheen said Ali was adopted by Siddiqui after his parents were killed in an earthquake that struck Kashmir in 2005. However, Pakistan's Foreign Ministry spokesman Mohammed Sadiq said DNA tests done by U.S. authorities showed that the boy was Siddiqui's biological son.

Stocks Plunge - Worst Day on Wall Street since 9/11/01

NEW YORK - A stunning makeover of the Wall Street landscape sent stocks falling precipitously Monday, with the Dow Jones industrials losing 500 points in their worst slide since the September 2001 terrorist attacks. Investors recoiled after a shakeup of the financial industry that took out two storied names: Lehman Brothers Holdings Inc. and Merrill Lynch & Co.
The pullback, which erased about $700 billion in shareholder wealth, occurred across much of the globe as investors absorbed Lehman's bankruptcy filing and what was essentially a forced sale of Merrill Lynch to Bank of America for $50 billion in stock. While those companies' situations had reached some resolution, the market remained anxious about American International Group Inc., which is seeking funding to shore up its balance sheet. A faltering of the world's largest insurance company likely would have implications far beyond that of Lehman, already the largest U.S. bankruptcy in terms of assets.

The swift developments that took place Sunday are the biggest yet in the 14-month-old credit crisis that stems from now toxic subprime mortgage debt.

For the first part of Monday's trading, the market was falling, but in a largely orderly fashion as investors seemed to draw some relief from the resolution of Lehman's problems. As the session wore on, and there was no word about AIG, the market suffered another bout of fear that the credit crisis will continue to devastate the financial sector. Selling accelerated in the final hour and then took on more momentum as stock indexes broke through lows set in July — an ominous sign for some traders.

Monday's trading followed the pattern of the past year; there were some signs of optimism, but they were dashed when investors weary of bad news perceived there was more ahead.
Investors are worried that trouble at AIG and the bankruptcy filing by Lehman, felled by $60 billion in bad debt and a dearth of investor confidence, will touch off another series of troubles for banks and financial institutions that may be forced to further write down the value of their own debt assets. Wall Street had been hopeful six months ago that the collapse of Bear Stearns Cos. would mark the darkest day of the credit crisis.

AIG's troubles are worrisome for some investors because of the company's enormous balance sheet and the risks that its troubles could spill over to the companies with which it does business. AIG, one of the 30 stocks that make up the Dow industrials, fell $7.38, or 61 percent, to $4.76 as investors worried that it would be the subject of downgrades from credit ratings agencies.
"We have a very, very nervous market and folks hate uncertainty," said Alfred E. Goldman, chief market strategist at Wachovia Securities in St. Louis. "They've been waiting for another shoe to drop and two of them dropped on Sunday."

The market was expected to remain fractious when trading resumes Tuesday. Besides its continuing concerns about AIG, Wall Street will be waiting anxiously for the Federal Reserve's regular policy-making meeting. The central bank is expected to keep rates steady, though some traders have speculated about a surprise rate cut. The market will be looking for signs from the Fed that it is willing to lower rates amid the nation's continuing economic problems and because the price of oil has retreated sharply from its highs in July. The drop in oil gives the inflation-wary Fed more room to maneuver.

The Dow fell 504.48, or 4.42 percent, to 10,917.51, moving below the 11,000 mark for the first time since mid-July. It was the worst point drop for the Dow since it lost 684.81 on Sept. 17, 2001, the first day of trading after the terror attacks.
In percentage terms, the drop was the steepest since July 19, 2002. It was also the sixth-largest point drop in the Dow, just behind the 508.00 it suffered in the October 1987 crash.
The Dow is now down about 23 percent from its record high of 14,198.09 last October.
Broader stock indicators also fell. The Standard & Poor's 500 index declined 59.00, or 4.71 percent, to 1,192.70 — also its biggest drop since 9/11 and the first time it closed below 1,200 in three years.

The Nasdaq composite index fell 81.36, or 3.60 percent, to 2,179.91; that was its worst point loss since Jan. 4.
The Dow Jones Wilshire 5000 Composite Index, an index that measures the value of 5,000 U.S.-based companies, fell 4.53 percent Monday, giving investors an overall paper loss of about $700 billion.
Declining issues overwhelmed advancers on the New York Stock Exchange, where 164 stocks rose compared with 3,064 that fell. Consolidated volume came to an extremely heavy 8.05 billion shares, compared with 6.11 billion traded Friday.
Oil closed below $100 for the first time in six months as investors worried that a slowing economy would hurt demand. Light, sweet crude fell $5.47 to settle at $95.71 on the New York Mercantile Exchange. Oil is down sharply from its mid-July highs when it hit a record over $147 a barrel.
Bond prices surged as investors fled to the security of government debt. The yield on the benchmark 10-year Treasury note, which moves opposite its price, plunged to 3.41 percent from 3.72 percent late Friday. The dollar was lower against other major currencies, while gold prices rose.
Investors likely shrank from snapping up any bargains Monday after Treasury Secretary Henry Paulson said from the White House he "never once" considered using taxpayer money to help prop up Lehman. That punctured some hopes that the federal government might come to the rescue of AIG.
But AIG pared some of its losses after New York Gov. David Paterson said the company will be allowed to access $20 billion of assets held by its subsidiaries to stay in business. Paterson asked the state's insurance regulators to in essence allow AIG to provide a bridge loan to itself. Investors are worried that the company could need up to $40 billion to aid its balance sheet.
Other financial stocks fell as investors worried about the strength of banks' balance sheets. Washington Mutual Inc. fell 73 cents, or 27 percent, to $2, while Wachovia Corp. fell $3.56, or 25 percent, to $10.71.
Merrill rose 1 cent to $17.06, while Bank of America fell $7.19, or 21 percent, to $26.55.
Goldman noted, however, that the market's sell-off wasn't the cathartic move the market needed to purge its worries over bad debt and the tight credit conditions that have hobbled the economy. At some point, he contends, stock valuations will prove too tempting for investors sitting on the sidelines with piles of cash.
"At some point the sellers have done their dastardly deed," he said.
Scott Fullman, director of derivatives investment strategy for WJB Capital Group in New York, said investors should remember that while the financial sector founders, others like consumer names aren't suffering as much.
"While they might get hit hard they won't get hit as hard," said Fullman.
Wal-Mart Stores Inc. fell 78 cents to $61.63, while Coca-Cola Co. rose 25 cents to $54.75.
But even good news like a drop in oil and some resolution to fears about Merrill couldn't prevent a sell-off abroad. Markets in Tokyo and several other Asian money centers were closed for holidays. Britain's FTSE 100 fell 3.92 percent, Germany's DAX index lost 2.74 percent, and France's CAC-40 fell 3.78 percent.
The Russell 2000 index of smaller companies fell 30.50, or 4.23 percent, to 689.76.

A Saudi scholar has issued a religious decree saying it is permissible to kill the owners of television networks broadcasting "depravation and debauchery".
"It is lawful to kill ... the apostles of depravation ... if their evil cannot be easily removed through simple sanctions," Saleh al-Luhaidan, chief justice of the supreme judicial council, was quoted by the Saudi-owned al-Arabiya news channel as saying.
"The situation is serious ... the degradation of morals is a form of perversion on Earth," al-Luhaidan said.
The 79-year-old scholar, who holds the highest judicial authority in the kingdom, made the comments during a recent radio show in which he was asked by a caller for his opinions on immoral programmes being broadcast on Arab televisions during the holy Muslim fasting month of Ramadan.
The shows depict lifestyles and values deemed offensive by many Saudi religious leaders and judges.
Many of the most popular Arab satellite networks are owned by Saudi princes and well-connected Saudi businessmen.
'Subversive shows'
Azzam Tamimi, the director of the Islamic Institute of Political Thought, told Al Jazeera: "You cannot just license the killing of people in this way.
"If I were in his place, I would criticise the people who licensed the channels in the first place and these are the rulers of his own country."
He said: "The problem is that there is a deliberate attempt to impose an imported culture on Arab societies.
"Saudi royalty owns many of these channels, they provide funding for them and I think they are responsible for this campaign."
Earlier this year, sheikh Abdul Aziz al-Sheikh, the kindgom's grand mufti, issued a fatwa (religious edict) against channels that broadcast Noor, a Turkish-produced soap opera centred on the lives of a husband and wife seeking to reconcile the conflicting pressures of traditional and modern worlds.
The grand mufti, the head of Saudi Arabia's highest religious authority, branded the popular show "subversive" and "anti-Islamic" and said anyone who broadcast it was "an enemy of God and his Prophet".
Al-Luhaidan has sparked controversy in the past by issuing a decree that Saudis can join those fighting against US troops in Iraq.
