Subject: San Marco Homeowners Group 2009 Initiatives

This e-mail will be forwarded to all appropriate Venetian Causeway associations and groups in both Miami Beach and Miami. Our goal will be to get at least 65% of all homeowners, condo owners and renters within these areas to agree to the following items.

1. Tolls. We would like to get the County to increase the toll on weekends and nights and during the season. This will help to both improve the safety, and lessen traffic, in the neighborhoods, as well as increase the budget for the County authority.

2. Speed Limit. Reduce the speed limit back to 25 miles per hour after the Causeway project is complete. Again, this is to improve the safety in the neighborhoods.

3. Dog waste. Join in the Miami Beach initiative to have signs throughout the Causeway, its parks and eyebrows, reminding dog owners that the law requires that they clean up after their dogs. If possible, have waste containers and bags affixed to the signs for easy access and use.

4. Parking. No parking on the Causeway between 11 p.m. and 7 a.m. This would be to improve the safety for walkers and residents.

We will also be contacting Mayors, Commissioners and various jogging and bicycle clubs who enjoy the islands to discuss their support of these initiatives.

Once we obtain sufficient support for these initiatives, we can present them to the County Mayor and other appropriate parties. I hope to do this by year-end.

Pursuant to the issues that have been raised regarding the Venetian Bridges Rehabilitation Project, specifically the East Bascule bridge closure, please note that the Public Works Department (PWD) must close the East Bascule bridge for 30 days for the following reasons:

1. There are approximately 4000 bolts that must be replaced. These bolts provide the connections for the structural steel members that hold up the bridge. There are numerous structural members that will also be completely removed and replaced due to their deteriorated condition. It is unsafe and impossible to do this work while anyone is on the bridge.

2. The existing bridge paint has to be removed and the bridge has to be repainted in order to remove existing rust and provide protection from future corrosion. Extensive enclosure measures are required for this painting effort and it is required to have the bridge in an “up” position while this painting work is done.

3. The bridge closure needs to occur from May 1 to May 31 since Hurricane season begins June 1 and we cannot close the bridge after that date.

As to the question of notice, it should be noted that during the past year, two publicly advertised meetings (via newspaper and mail) were held; one on June19, 2008 and the other on April 16, 2009. All the key players tied to the construction project, including the County and both Cities, were present to discuss and answer all of the resident concerns. PWD presented photos of the rusty bolts and faulty platforms supporting the bridge. Additionally, fact sheets providing project information were hand-delivered on April 13 and April 14, 2009 to mailboxes, and the tollbooth attendants handed out the fact sheet to motorists.

As to the use of a temporary bridge, it should be noted that although a temporary bridge was previously used for the East Bascule bridge, the reason that it was not used this time is that this closure is much shorter than the previous closure when it underwent major repairs approximately 10 years ago. This closure will be for 30 days while the previous closure was for over 6 months.

As to the pedestrian and bicycle concerns, PWD had analyzed the option of directing bicyclists to the Julia Tuttle Causeway and MacArthur Causeway. The former is a limited access Interstate Highway (I-195) which prohibits pedestrians and bicyclists, so it cannot be used. Furthermore, it is not recommended to use safety cones to route pedestrians or bicyclists to the MacArthur Causeway since it is a high speed six-lane divided highway with no sidewalks along the linear segment between Jungle Island on Watson Island and the Star Island Bridge. The nearest pedestrian accessible causeway connection between Miami and Miami Beach is the Kennedy Causeway from NE 79 Street in Miami to 71 Street in Miami Beach. However, since that facility is approximately four miles away, pedestrians and bicyclists who would normally walk across the length of the Venetian Causeway may use Metrobus to be transported between Miami and Miami Beach. Once the bridge closure goes into effect, Miami-Dade Transit (MDT) will be providing circulator bus routes on the east and west side of the Venetian Causeway’s bridge closure. The circulator bus will take commuters to the Omni bus station in Miami or the Lincoln Road bus station in Miami Beach. Once at either transfer point, a transfer is available to a Miami-bound bus route or to a Miami Beach-bound bus route. The Metrobus routes that will provide this service are C, M, S, K and the Night Owl.

As to the possible West Bascule bridge malfunction, it should be noted this bridge is relatively new and in good operating condition; however, in the event of a malfunction of the operating system of the bridge, it can be operated manually. The East Bascule bridge is not currently used by barges or large vessels because it does not have the needed draft or horizontal clearance. The vessels that will be diverted from the East to the West Bascule Bridge will be jet skis, pleasure craft, etc. and it is anticipated that the West Bascule bridge can handle this additional traffic.

As to access for emergency vehicles, the City of Miami and the City of Miami Beach Fire Departments have worked out an agreement, as follows:

1. The City of Miami Beach Fire Department (MBFD) will provide coverage for Belle Island during this time period.

2. The City of Miami Fire Department (MFD) will provide the primary response of Fire and Rescue services for the islands of Dilido, Rivo Alto and San Marino during this time period. MFD will handle all Fire-Rescue incidents during the construction timeframe.

3. In case there is a malfunction of the West Bascule Bridge, temporarily eliminating land based Fire Rescue response from the City of Miami Fire Department to this area, MBFD has staged a reserve engine on the Northwest corner of the intersection on the Venetian Causeway and W. Rivo Alto Drive. A MBFD reserve suburban has also been placed on the West side of the East Bascule bridge with all necessary equipment secured in place. Please see attached the city of Miami Beach Fire Department’s memorandum with respect to this issue.

4. All calls for assistance received by the City of Miami Beach 911 from the residents on any of the three islands will be handled by the City of Miami Beach Communications Operator. The City of Miami Beach Communications Operator will obtain all of the necessary information (i.e. name of caller, address, chief complaint, PAI) and handle the call in its entirety prior to transferring the information to the City of Miami Fire Alarm Office. Once the information is relayed (as a mutual aid request) from the MBFD Dispatcher/CO to the City of Miami Fire Alarm Office, the City of Miami will dispatch the appropriate resource(s) depending on the nature of the medical request from the caller.

The Venetian Bridges Rehabilitation project will be issued a Notice to Proceed on April 13, 2009. A Community Meeting will take place on Thursday, April 16, 2009 at the Miami Beach Botanical Gardens, 2000 Convention Center Drive, Miami Beach, Florida 33109, from 6:30 to 8:00 pm. The meeting is to provide project specifics including, construction schedule and the closure of the east bascule bridge, which will require a detour to the MacArthur Causeway. A meeting prior to the start of construction was not feasible due to the upcoming religious holidays. A project Fact Sheet with project details and an invitation letter to the residents regarding the April 16 meeting will be distributed this week.

Tell the Developer What You Think About His Proposal to Build a 5-Story Steel and Glass Building at 31 Venetian Way

The owner of the rental apartments at 31 Venetian Way is proposing to demolish the four existing 3-story rental apartment buildings and replace them a massive 5-story luxury rental apartment building.

The Board of Directors of the Belle Isle Residents Association voted unanimously to oppose this project as proposed because we feel strongly that it is the wrong project for our neighborhood for many reasons including:

The project is completely out of scale and not compatible with the surrounding neighborhood, which consists of humble smaller buildings and single family homes;

The proposed building is 5 stories tall with architectural features that add additional height on the roof. It is the length of two football fields and forms an imposing wall of steel and glass almost the entire length of the property along the bay, Venetian Way and abutting the single family homes on Farrey Lane;

The proposed increased size in the building area will add an additional 59 apartment units to the lot, bringing the total to 179;

The building as proposed is designed to the maximum height, maximum density and maximum number of units allowed in the neighborhood while providing minimum setback with no green space and the minimum amount of required parking;

The required "view corridor" as proposed contains a bridge of apartments, boxing in the view to the bay;

All new buildings require a baywalk that is accessible to the public. The plans for this project are unclear as to the design and access.

At the first Design Review Board hearing, the developer was told to meet with the residents so that we can voice our concerns. Now is your chance to have your voice heard.

The developer and his attorney will present their project at BIRA's meeting on Tuesday, Feb. 24^th at 7:00pm at 20 Island Avenue on the first floor. All residents are invited to see the developer's proposal and share their views.

The problem of bay water and/or stormwater flowing out onto the street from the stormwater manhole on the east side of the Venetian Causeway at Belle Isle has been solved.

Below is a recap of the issue and the implemented solution:

When CIP initially observed the recirculation of water at the east manhole Control Structure 3 (CS-3) at high tide, it commenced a comprehensive investigation of the stormwater system, with the design Engineer of Record (EOR). The new stormwater system is comprised of a pump station, three (3) wells, numerous stormwater structures, and 24" stormwater piping throughout Belle Isle. As and interim measure, to alleviate the storm and bay water recirculation, tidal backflow prevention valves were installed by the City at each of the three (3) outfalls located at the east and west ends of Belle Isle, and at Farrey Lane.

Initially, the EOR attributed the recirculation of storm and bay water at CS-3 to the restricted flow to the bay, created by the new 24-inch pipe, that was reduced to the existing 8-inch outfall pipe at CS-3, and potential barnacle build-up inside the existing outfall pipe. At the request of the EOR, the City, a). conducted an inspection and verification of the actual clear inside diameter of the existing pipe at the east outfall, and provided the data required for calculations; b). installed pressure gauges and flow meters at each well to monitor the pressure and the flows, and to verify that the wells were receiving the intended design flows.

Readings were taken at each well, and it was determined that the wells were not receiving the required design flows. A comprehensive technical memoranda was issued buy the EOR indicated that there was insufficient head pressure at the wells. Inadequate head pressure allowed all the storm and bay water in the system to by-pass the wells to the CS-3, where it flowed onto the Causeway.

The EOR was directed by the City to provide a corrective measure, while meeting the initial stormwater design intent. A device was designed to be placed inside the CS-3. This device would reduce the 24-inch diameter pipe to a 7-inch diameter opening at the CS-3, thereby creating the necessary head pressure required to force storm and bay water into the three (3) wells, and eliminate the recirculation at CS-3. Additionally, new hydraulic calculations were submitted to the City Engineer for approval. As a result, it was agreed that the pump station would be operated with one pump, while utilizing the second pump as an alternate. The pump floats were also adjusted as part of the design modifications.

The fabrication and installation of the device, including modifications to the stormwater system were completed in December 2008. Final tests were conducted on January 15th; the results proved that there was no recirculation of storm or bay water at CS-3.

Approval of Minutes

Sandy asked for any changes to the Minutes of the March 19, 2008 and November 12, 2008 Meetings, in addition to changing the March meeting location from 20 to 3 Island There being none, Herb made a motion for their approval. Irene seconded it. The motion passed unanimously.

Ongoing Business

Traffic calming for Island Avenue North

David described the current situation, where valet parkers from the Standard maintain the 20 MPH limit, but taxis and other traffic do not. As there are children's programs in the afternoon, it is a very dangerous situation. Scott reported that he had requested a sign that shows the limit and how fast an approaching car is going and awaited word on when it would be delivered.

Update on the Park

Scott reported that the flooding has stopped, but the poorly engineered solution has not been replaced. The Parks Department will be responsible for the problems in the park as of the first of 2009. He is planning a meeting with the people responsible to discuss all of the problems mentioned at the last Board Meeting, all of which have been brought to their attention with no change so far.

Building Manager's Meeting

Continental held a meeting of Belle Island Building Managers at the Grand Venetian recently. The meeting sponsored by BIRA and organized by Scott will take place at 20 Island early in January. He will send a note to all Managers asking that they save the date, as well as post the signs about dog litter removal.

Update on Artist Proposal for Pump Station Mural

Herb reported that he attended the Neighborhoods Committee meeting run by Commissioner Ed Tobin. He reported that Max Sklar is in charge of Art in Public Places. We must create a Proposal and then Scott will present it at a meeting of with Mr. Sklar. If it is approved, then it must be presented to the Art in Public Places Committee for approval.

Recruiting of New Members

Irene reported that she sent Notices (see attached) and went to each of the buildings not currently represented on the Board to attempt to post it on the property. Pending the receipt of new applications, she distributed the Slate for the BIRA BOARD for 2009-2010, including those members completing the second year of their term next year (see attached).

NEW BUSINESS

Plans for BIRA January 21 Annual Meeting – Guests and Agenda

Invitees: the Mayor, Commissioners, Lynne Bernstein, person representing the Park Department, Carla Dixon, Olivia Almagro-Johnson, Fernando Vasquez (responsible for the Engineering Infrastructure – flooding), Helena Blat & Martin Kreidet (representatives of The Standard Spa (who have expressed an interest in planning a park party with BIRA), Barbara Bisno (Venetian Causeway Neighborhood Association), and Todd Davis (Venetian Island Homeowners Association). The timing of the meeting is 7 p.m. unless it is in conflict with the Board meeting at 11 Island.

Herb volunteered to invite the guests and prepare a draft of the meeting announcement for review by the Board. Sandy agreed to bring a large glass bowl for on-the-spot contributions. Irene was asked to provide a sign for the bowl.

It was agreed that the first meeting of the newly elected Board of Directors would take place immediately after the Annual Meeting for the election of Officers and determination of the next Board meeting date

Set Time and Day for the Next BIRA Board Meeting

It was agreed that no meeting is necessary before the Annual Meeting.

There being no further business, David made a motion that the meeting be adjourned. Scott seconded. The motion was approved unanimously and the meeting adjourned at 7:10 p.m.

Happy Holidays from the Belle Isle Residents Association.

Here is a brief update about what's going on in our neighborhood:

Drainage and Flooding Issues

The backup of bay water that was occurring on the north side of the Grand Venetian and flowing onto Island Avenue South has been temporarily plugged. There seems to be a "deficiency" which is being addressed. The contractor has indicated that the material specified by the engineer has to be special ordered and at this time, we do not have a specific timeline as to when it will be installed. When the order has been received, the installation process should not take long. We'll keep you posted.

Park Landscaping and other items

You've probably noticed that some of the landscaping has deteriorated in the park and swale areas. We have been in contact with the parks department and they are addressing these maintenance issues. Over the last couple of days they have been busy weeding, mulching and replacing plants. They have committed to working with us to maintain these areas in the future. In addition, other items such as latches on the dog park gates, additional benches and replenishment of dog waste bags, and some additional bike racks are being addressed. Please do your part to maintain our park by cleaning up after your dogs. Also, please use designated bike racks and do not chain your bicycle to the landscaping.

Pump Station Odor

The City has completed a design for the odor control unit for the pump station and the procurement method is being established. We expect installation to begin in about four months and we are told they are working to expedite the process.

Scott called the meeting to order at 6:10 p.m.

Sandy noted that the Agenda did not include approval of the Minutes of the March 19, 2008 Meeting, so they must be approved at the next meeting.

Ongoing Business

Update on the Park

LANDSCAPING

Scott reported that they have been going back and forth about the landscaping all summer. At one point, Counselor Deede Weithorn assigned her assistant, Ann Swanson, to be the focal point of Park concerns in her office. Also, Counselor Jerry Libbin reported knowing about 25 trees that were available; Scott convinced him to have them planted in the Park and they were. However, there is still a need to replace the plantings around the 3 smaller trees.

It was suggested that we re-look at all of the dying and poor landscaping before the end of their one-year warrantee.

BIKE RACKS

Scott reported that they have been installed, but Josh noted that there is still no rack in front of 9 Island.

BENCHES

It was requested that 2 benches be installed in each area of the Dog Park. Scott noted that the benches have not been modified to prevent homeless from sleeping on them. It was suggested that, since no one has reported homeless use of the benches, they not be changed. The Board agreed that they still present an opportunity for the homeless in the future and must be modified.

DOG PARK

Barbara reported that the doors to the Park need latches. Although the concern about replacing the Dog Park with one for children seems to have been overcome, there are issues with full trash bins not being emptied and bag dispensers being empty.

Barbara offered to provide the contact name and number for the Dog Owners of Miami Beach. It was suggested that they, or a group of volunteers, take on the responsibility for filling the bag containers on a monthly basis

OTHER

It was reported that 4 trash cans have disappeared, including the one to be placed in front of 20 Island. Herb reported that the lights are on during all hours of the day.

Drainage Issues on Venetian Way/Island Avenue

Scott reported that a "flex valve" has been installed to eliminate the flooding at high tide, but it has not proven effective. After a one-month trial, letters will be issued to residents, but no solution seems in sight.

Update for bringing South Beach Local Bus to Belle Isle

Josh reported that this proposal has been lumped with one to bring buses to the Cultural Campus, making it much more expensive. If it happens at all, it will be a 1 year trial period starring next spring.

It was noted that the city is no longer making parking cards available, but is considering an in-car device that will allow parking and the re-use of unused minutes. They are working on how to install the device on motorcycles.

NEW BUSINESS

Artist Proposal for Pump Station Mural

Tom Kachian provided a visual presentation of the buildings at Blue Lagoon Towers (NW 8^th St.) he had covered with a mural. He then passed around a proposal to do the same for the Park Pump Station and the building next door. The cost would be between $18,000 and $22,000, with a 10 year guarantee.

The Board enthusiastically supported the concept, asked that Tom consider painting the top of the units as well, and asked Scott to determine the procedures required to authorize this work. It was suggested that, once approved, the Board might seek financial participation of Art in Public Places or other grant funding.

Review New Member Procedure and Ongoing Recruitment of New Members

Irene reported that we still need more members, particularly with the resignation of Nancy Liebman. Sandy suggested that Nancy is an important asset to the Board and should not be allowed to resign because of her inability to attend Board meetings. There was agreement and Sandy agreed to draft a response to Nancy's resignation.

Irene suggested that Bill Hahne obtain an application form from the web and send it to her and he agreed to do so.

OTHER BUSINESS

Scott reported being approached by a person with the suggestion that one week day per week, 6 vendors selling organic fruits and vegetables be allowed to do so from 7 a.m. until noon in the Park. After consideration, the Board agreed that this would present a serious parking problem and that Herb suggest she attempt this in a Park with greater parking.

David described the continued problem with car speed on Island Avenue North. Scott agreed to pursue the concept that a sign be installed showing both the 20 Mile/Hour limit and the speed of each car as they pass the sign.

Treasurer Keith reported that BIRA has a current bank balance of $330.00. $61.60 is required shortly to renew the web site. Josh offered to provide the funds and the Board agreed it should be continued. Keith will shortly learn the cost of renewing the Corporate status. It was suggested that, in addition to Board contributions, a bowl be placed at the Registration Desk at the Annual Meeting for cash contributions from attendees, a very successful method used by other associations.

Scott proposed that he invite the Building Managers from all Belle Isle buildings to a lunch he will host, during which they can share ideas about areas of cooperation.

It was reported that Andre Balazs no longer owns The Standard, although his company is managing it. Jason has left and the new Manager is Helena Blat.

Plans for Annual Meeting

After discussion, the date for the meeting was selected as January 21, 2009 at 20 Island.

Set Time and Day for the Next BIRA Board Meeting

The next Board meeting will take place at 6 p.m. on December 17, 2008.

There being no further business, Josh made a motion that the meeting be adjourned. Keith seconded. The motion was approved unanimously and the meeting adjourned at 7:50 p.m.

Scott called the meeting to order at 6:07 p.m.

Approval of Minutes of February 6, 2008 Board Meeting
Herb made a motion to approve the Minutes as distributed. Irene seconded. The motion was approved unanimously.

Sandy noted that all Board members had been sent the Minutes of the February 6 Annual Meeting. Anyone with suggested changes to the draft should send those changes to Sandy. These Minutes will be approved at next year’s annual meeting.

Ongoing Business

New BIRA Membership
Irene introduced Barbara Cowan whose membership on the Board was approved by e-mail. Irene suggested that all Board members suggest that potential new members apply through the web site. Irene has provided the web site update to Josh and a full list of the Board members to a public relations consultant.

Street/Landscaping/Park Renovations and Pump Station Update
Scott reported having sent Carla a punch list of items still to be done. It was noted that the sprinklers are operational in the north end and the dog fences have begun. Scott will respond to comments about the park attributed to him out of context in a recent Miami Herald article. It was again agreed that any suggested changes be made after the park is turned over to the City.

Speed limit/slow/zone 14 parking signs; Commercial Parking Only signs in front of 9 and 11 Island
Scott has sent a list of needed signage to Carla. Zone 14 signs have now been put in front of The Standard and 20 mph signs at both ends of Island Avenue.
Sandy reported that, at an open meeting on the park, she offered to obtain the Move-In/Out hours for all of the building around the Park for Manny Marquez. She has done so, with the exception of Belle Plaza, but it was noted that delivery and emergency vehicles are not restricted to those hours. Barbara Frank made a motion that BIRA support the 24 hour Commercial Parking Only signs now in place. Keith seconded. The motion passed unanimously.

Venetian Causeway Update
It was noted that the Beautification effort is being delayed to accommodate the laying of a new power cable under one of the islands.

Litigation regarding transponder fee for Venetian Island Residents
It was reported that a resident of one of the islands is suing the county for imposing tolls to her home.

It was also noted that two speed lanes are being added to the I95 without access from the Julia Tuttle and during high season this year. It was agreed that we will investigate to determine if there is a group reflecting neighborhood associations involved in this effort, so that we can express our concerns about the timing and obtain a better understand the logistics.

Chabad House signage
Scott reported that the Chabad House Rabbi agreed to no signage when it was established. Lynn Bernstein reported that there is a code violation on record since 2006. She will follow-up on it.

Letter of support for proposed parking garage in Sunset Harbour neighborhood
Scott received unanimous support from the Board and will draft a letter, keeping in mind the concerns of the Sunset Harbour Association voiced by Marilyn Freundlich, who was so helpful in our organizing the Meet the Candidates evenings last fall.

Treasurer’s Report
Keith reported that BIRA received $461.60, mostly in Board contributions. BIRA has spent $61.60 for the web site and $70 for the incorporation, leaving the current bank balance at $330.00. It was agreed that residents will not be solicited for funding until there is a cause for which it is required.

New Business

Herb made a motion that we revise the By-Laws to reflect the incorporation. Barbara Frank seconded. Motion passed unanimously. Scott agreed to draft the revision for Board review.

Barbara Cowan asked about the progress in re-routing bus 123. Scott indicated that the Parking Committee was told that any revision to its route must include the Cultural Arts Center as well, requiring additional buses, drivers, etc.

Set Time and Day for the Next BIRA Board Meeting
It was suggested that the next Board Meeting be held during the day to accommodate Josh’s schedule. Since the next meeting may be the last before the “summer recess,” it was agreed that Scott would circulate proposed dates and times to all Members.

There being no further business, Keith made a motion that the meeting be adjourned. Irene seconded. The motion was approved unanimously and the meeting adjourned at 7:12 p.m.

Belle Isle Park is getting a great dog park! It's not officially open, but they had a gate up (not the double-gated system yet), so Toby the Bichon Frisee, Jack the Rat Terrier, Bennie(?) the Beagle, and Mickey the Havanese had a great time! (Sorry about the cameraphone quality).
