Skandal PKFZ - gomen mampu tangkap ikan bilis saja.........

Bekas pengurus besar Lembaga Pelabuhan Klang (LPK), Datin Paduka OC Phang dihadapkan ke Mahkamah Sesyen Klang hari ini, atas tiga tuduhan pecah amanah berhubung skandal projek Zon Bebas Pelabuhan Klang (PKFZ).Phang tidak mengaku salah terhadap semua tuduhan tersebut.

Dia dituduh melakukan pecah amanah itu membabitkan RM254 juta. Tuduhan terhadap Phang - yang ditahan polis pagi tadi - dibaca di hadapan Hakim Yong Zaridah Sazali.Phang yang diwakili peguam Ng Aik Guan, dibenarkan ikatjamin sebanyak RM350,000 dengan seorang penjamin.Kesnya ditetap untuk mula didengar pada 12 Januari ini di mana Phang diarah menyerahkan pasportnya pada tarikh yang sama.

Dua lagi individu yang ditahan bersama Phang pagi tadi - iaitu ketua pegawai operasi Kuala Dimensi Sdn Bhd (KDSB), Steven Abok dan seorang arkitek, Benard Tan Seng Swe - turut dihadapkan di mahkamah yang sama.

KDSB merupakan kontraktor utama projek PKFZ manakala Tan pula merupakan arkitek perunding kepada KDSM bagi projek tersebut. Abok dan Tan, yang kedua-duanya memakai penutup muka semasa dibawa ke mahkamah,didakwa bersama terhadap dua pertuduhan membuat tuntutan palsu membabitkan RM5.42 juta.

Tan turut didakwa bersama-sama seorang lagi yang masih bebas terhadap 24 tuduhan membuat tuntutuan palsu berjumlah RM122.27 juta.Kedua-duanya juga tidak mengaku bersalah dan minta dibicarakan.

Steven dibenarkan ikatjamin sebanyak RM200,000 manakala Tan dibenarkan ikatjamin RM250,000. Kes mereka ditetapkan untuk didengar pada 4 Februari.

Projek PKFZ menimbulkan kontroversi apabila kosnya melambung daripada RM2 bilion kepada RM4.6 bilion. Ia dibina di satu kawasan seluas 400 hektar sebagai hab penghantaran kargo bersepadu.

Apa halnya dengan dua orang Menteri Pengakutan yang telah menandatangani surat gerenti secara haram? Bukankah mereka ini bapa jerung sebenarnya? Begitu juga dan orang kuat Kuala Demensi,MP sombong dari Sarawak itu serta beberapa ekoq penyamun UMNO yang turut terlibat dalam perancangan asal PKFZ ini? Bukankah mereka ini juga merupakan pemain-pemain utama dalam skandal PKFZ?

Political Dangers in Jailing Anwar- Kenny Gan

Recently the High Court dismissed an application by Anwar Ibrahim to strike out his sodomy charge on the basis that two medical reports have found no evidence of penetration. The High Court refused and set Jan 25 2010 for Anwar’s trial to proceed. Many Malaysians believe the charge against Anwar to be politically motivated and the conduct of the prosecution has reinforced their doubts. Few believe that Anwar will get a fair trial.

Will Anwar’s jailing help BN retain power or will it do the opposite and boost the opposition’s chances? If the prosecution can prove an ironclad case the political fallout will be limited but if Anwar’s conviction is seen as a travesty of justice BN will pay a heavy political price. To gauge the political effect of jailing Anwar it is instructive to recount the impact of the 1999 sodomy conviction and compare the different socio-political environment between the two events in the intervening ten years.

Back to 1998

In 1998 when Anwar was charged for sodomy and abuse of power, Mahathir was the Prime Minister and he ruled over a Barisan National political machine which faced no creditable challenge by the fragmented opposition. The premier’s authoritarian style earned him the label of ‘dictator’ and his liberal use of the ISA to quell dissent invoked a climate of fear.Although Mahathir achieved his aim of jailing Anwar, the effect of Anwar’s downfall a decade ago could not have been what he foreseen or desired. Despite the most heavy-handed and crude methods, he also failed to destroy Anwar politically or personally.

The twists and turns of the trial, the controversial rulings and the wholly disproportionate sentence convinced nobody. Anwar’s unfortunate beating in prison and his appearance with a black eye caused a public outcry. Despite the valiant attempts of the obedient mass media to demonize Anwar, the majority of Malaysians believed that Anwar was a victim of political conspiracy after a fallout with Mahathir. It created a political and social crisis which reverberates to this day. The U.S. State Department called the sodomy trial an abuse of human rights which was only one of a multitude of condemnations which poured in from overseas. The judiciary became the laughing stock of the international community.

Domestically, Mahathir’s reputation suffered serious harm with calls for him to resign. Demonstrations which were previously unknown in Malaysia broke out with cries of ‘Reformasi!’ and “Mahathir Resign!” They were forcibly suppressed but the anger in the hearts of the people and the disquiet created in civil society lingered to this day. The social forces unleashed led to the birth of the National Justice Party which was later to become Parti Keadilan Rakyat. The party’s symbol is an eye against a light blue background to denote Anwar’s famous black eye.

The General Election of 1999

The injustice meted out to Anwar caused the three main opposition parties – DAP, PAS and Keadilan – to come together into an electoral coalition called Barisan Alternatif to harness the wave of the public anger. However, this failed to unseat BN or deny BN two-thirds majority in the general election of 1999.

There were many reasons for this, chiefly being the non-Malays’ fear of PAS as Islamic extremists which PAS did nothing to assuage and in fact foolishly exacerbated. Mahathir also courted the Chinese, aware that his relationship with the Malays was severely strained. About 650,000 newly registered young voters were prevented from voting on the specious excuse that there was not enough time to register them. Hundreds of pages of pro-BN advertisements were published in the one-sided mass media and the playing up of inter-ethnic fear ensured that there was no fair election.

In the end, it was the non-Malays which saved Mahathir from a humiliating loss of BN’s two-thirds majority which would have forced his immediate exit. There was a significant Malay swing against BN and for the first time, Umno’s share of the Malay vote dropped below 50%. PAS turned out to be the chief beneficiary, increasing its parliamentary seats from 7 to 27 and capturing Terengganu as it rode on the groundswell of Malay anger over the Anwar injustice. After the election, a joke circulating around at that time was that the difference between a Malay and a Chinese was that the Chinese supported Umno!

Mahathir announced his resignation as Umno President and Prime Minister in 2002, acutely aware that his relationship with the Malays was broken. The baton was handed over to Abdullah Badawi in 2003 and the following general election in 2004 saw BN winning its best performance ever with 90% of parliamentary seats, not because of Badawi’s popularity but because Mahathir was gone. But the reverberations from the 1999 sodomy case did not end there. After Anwar was released from prison, he forged an electoral pact between PKR, PAS and DAP which resulted in the loss of BN’s two-thirds majority in Parliament and 5 states in the 2008 general election. From this stunning opposition gains, Pakatan Rakyat was born.

Now and 1998

Although all this is history, they are worth recounting because one can learn from the past in order not to repeat the same mistakes.In 1998 the mass media was under much tighter control and the online world was at its infancy. The words ‘blog’, ‘facebook’ or ‘twitter’ had not been invented and Internet penetration was low at less than 15%. People are now far more connected than a decade ago with the proliferation of the online world with its news, blogs, discussion groups, social networking sites, e-mail, mobile phones and SMS. The trial proceedings will be reported in detail, analyzed and dissected. Nothing can be hidden, distorted or obfuscated.

No amount of spinning in the mainstream media will convince a public otherwise if injustice has been committed. It did not work in 1998 and it will not work now especially when the online world has reached mainstream status and there is a freer flow of information.

If Anwar can be convicted in a fair trial with his guilt proven beyond reasonable doubt, little political price need to be paid by the ruling regime but the existence of two medical reports that the accuser had not been sodomized, the behavior of the police and not least the battle by the prosecution to transfer the case to the High Court and refusal to hand over evidence favourable to the defense as required by law has already tainted the prosecution’s case.

Furthermore, a charge of consensual sodomy is suspicious indeed when Malaysia tolerates homosexual acts between consenting adults and nobody has been dragged to court over it except Anwar and his alleged partners. We must also remember that the heady economic growth of the 1990’s engendered more tolerance for Mahathir’s autocracy while Najib has his hands full trying to keep the economy growing on the back of the world economic crisis. We can hence expect deeper political and social consequences compared to 1998.

Political Consequences

The political ramifications this time around will be huge. Unlike 1999, the opposition parties have coalesced into a workable coalition and are ready to challenge BN for the seat of power, a far cry from just trying to grab as many seats from BN as possible. Non-Malays have also lost their fear of Islamic PAS and interethnic tensions have long dissipated meaning that two powerful weapons that used to work with devastating efficiency on the non-Malays have been lost. With the non-Malays now overwhelmingly pro- Pakatan Rakyat, BN’s fortunes now depend on the Malays who are the very group likely to be incensed with any cruel and unjust treatment of Anwar.

It is worth noting that PAS’ gains in 1999 were in the rural Malay seats where it fishes in the same pond as Umno. With Umno now heavily dependent on the rural Malays to maintain its power, it seems reckless to put this voter base at risk with another clumsy and incredulous sodomy conviction. Anwar’s unjust jailing may create an anti-BN wave which the opposition can ride to victory and the non-Malays will not be saving BN this time around.

Social Consequences

Aside from the political consequences, a more insidious effect will be a crisis of public confidence in the law enforcement bodies which is already low. As these bodies need the cooperation and respect of the public to function effectively, this means their efficiency in tackling crime and corruption will be hobbled. For example, the MACC has been rendered almost functionally useless with the dive in public confidence following its one-sided investigations and Teoh Beng Hock’s death and will continue to be so until major revamps are made to instill back public confidence. Society is traumatized by crude and offensive displays of injustice. The negative sentiment will affect private domestic investment which is already in decline and foreign investors will be put off.
Unlike 1998 Anwar is now opposition leader. To jail him on a specious charge with a dubious trial will project the perception that an opposition leader has been jailed on sham charges to remove him from the political scene. This will invite condemnations from the international community and put the country in the company of banana republics such as Myanmar and Zimbabwe. The negative image projected by the country will drive away tourists and discourage others from holding functions in Malaysia.
As for Najib, his hold on Umno will weaken with the decline in public support which may impair his ability to push through further reforms. Public support has a direct effect on his ability to control his party warlords whose personal interests do not always coincide with public interests.

What Now, Najib?

There is something called the law of unintended consequences. Instead of weakening the opposition by removing Anwar, the opposition may be rejuvenated instead and the public may rally around him as a martyr of injustice and a victim of abuse of power. Mahathir harboured a deep personal animosity towards Anwar. He was willing to take any political risks to humiliate and destroy Anwar, even though general election was around the corner. The resulting social and political turmoil was acceptable collateral damage. Without the cloud of personal animosity, Najib should act in a rational manner and weigh the political risks and social consequences against the uncertain gain.

A conviction which is widely perceived as unfair and a political conspiracy will fall squarely on Najib’s shoulders. Rightly or wrongly, he will be blamed so it is not just Anwar who is on trial but also Najib’s credibility and the Malaysian justice system. It is to Najib’s interest that Anwar be given a fair trial and acquitted if there is no case. To push through a conviction on the basis of political expediency will unleash social forces which may sweep BN from power.

Unlike Najib, Anwar cannot just say the accusation is 'frivolous' and be done with it. Coz, Najib is in power, Anwar is not.The police and courts are in Najib's hands, however the rakyat are not fools.

That Saiful guy goes around boasting he was 'raped', itsnt that disgusting? A raped victim who is raped would not want to tell the whole world that he/she has been raped. Si jalang pun tak akan berbuat demikian. Its only a drama in order to kill another person political ambition. Saiful said he was raped against his will,but the court says its 'suka sama suka'. If thats the case Saiful too should be charged.

UMNO, for that matter knows, Anwar is a pain in their arse and must be rid off,whatever it takes.

Isu royalti minyak - Nazri suruh Kelantan bawah ke mahkamah......

Kerajaan PAS Kelantan dicabar membawa kes tuntutan royalti minyak ke mahkamah daripada berbuat sesuatu yang bersifat retorik dan tidak boleh membawa perubahan kepada status quo.

Menteri di Jabatan Perdana Menteri Datuk Seri Mohamed Nazri Aziz berkata, membawa isu tuntutan itu ke mahkamah merupakan langkah paling tepat berbanding usaha retorik iaitu Menteri Besar Datuk Nik Abdul Aziz Nik Mat berdoa yang bukan-bukan terhadap Perdana Menteri dan Kerajaan Pusat.

“Saya pun hairan mengapa mereka tak bawa kerajaan pusat ke mahkamah... daripada mereka buat benda-benda yang tidak boleh datangkan apa-apa perubahan kepada status quo, baik pergi ke mahkamah terus.

“Daripada berdoa yang bukan-bukan...minta diturunkan bala ke atas Perdana Menteri (Datuk Seri Najib Tun Razak) yang saya kira itu kerja bodoh. Baik terus bawa ke mahkamah kerana itu lebih dapat menyelesaikan masalah dan bukannya retorik sahaja,” kata beliau dipetik Bernama.

Beliau berkata demikian kepada pemberita ketika ditanya mengenai tindakan kerajaan negeri Kelantan yang dilihat lebih berunsurkan retorik berhubung isu tuntutan royati minyak selepas melancarkan Ensiklopedia Hansard Parlimen terbitan Yayasan Pembangunan Buku Negara dan Penerbitan Universiti Teknologi Malaysia (UTM) di lobi Parlimen hari ini.

Nik Abdul Aziz yang juga Mursyidul Am PAS sebelum ini dilaporkan mendoakan supaya pemimpin kerajaan Barisan Nasional (BN) yang bertanggungjawab tidak memberi royalti minyak supaya “pecah perut” sebagai reaksi terhadap keengganan Kerajaan Persekutuan menyerahkan bayaran royalti minyak kepada Kelantan, sebaliknya sekadar memberikan wang ihsan.

Pada Nov 4 lalu Najib mengumumkan pembayaran wang ihsan daripada kerajaan pusat kepada Kelantan yang bermula tahun depan.

Bukan tak mahu bawa ke mahkamah, tapi sama ada mahkamah itu adil atau tak adalah satu isu lain pula. Dalam isu gomen haram negeri Perak pun mahkamah kerap suka putar belit buat keputusan tak ikut perlembagaan sebenar, inikan pula isu royalti minyak.

Selain daripada itu keputusan penghakiman pula mengambil masa bertahun-tahun.

Lebih baik bawa ke mahkamah antarabangsa lagi bagus.........

Mahathir is racist,says Nazri......

Minister in the Prime Minister’s department Datuk Seri Nazri Abdul Aziz lashed out at former Prime Minister Tun Dr Mahathir Mohamad, calling him a "racist" for saying there was no need to revamp the Biro Tata Negara (BTN) or National Civics Bureau training modules.

Speaking to reporters in Parliament lobby today, Nazri said while he agreed with the former premier that BTN is for instilling the patriotic spirit, Nazri said the patriotism should not only be for the Malays.

Mahathir said last Sunday that there was no reason for the BTN modules to be revamped and felt it was better to retain the modules.

"You must remember during his time when he (Mahathir) was the PM, he was talking about (how) we must all think as Malaysians, now that he’s not PM, (and when) you read his blogs, it’s bloody racist. I don’t like that."

"He must be a Malaysian (regardless if) he’s a minister or not. He must walk his talk. Just because he wanted everyone to support him (then), you’re (a) Malaysian and the moment you’re no longer PM, you only talk about the Malays.

"I cannot accept his comments. I strongly feel the BTN courses must be inline with the 1Malaysia slogan by the PM," said Nazri .

He also rubbished claims that the Cabinet decided to revamp the BTN curriculum due to Nazri’s call. A columnist (Awang Selamat) in a local weekend publication (Mingguan Malaysia) claimed the revamp of the BTN curriculum was due to Nazri’s call to be in line with the Prime Minister’s 1Malaysia slogan.

"It’s a cabinet decision. BTN’s allocation is mentioned in the PM’s department’s budget so it’s public money. Therefore, the money spent on BTN to have courses must reflect the 1Malaysia slogan by the PM.

"It should not only to raise patriotism among the Malays or Bumiputras."

"Malaysia is for all races so I disagree with any syllabus which only concentrates on patriotism just on one community."

"If they have a problem with that, I want to know what their problem is," said Nazri adding the decision for the Cabinet to revamp BTN was done when the 1Malaysia slogan was introduced by the Prime Minister.

He also said the spirit of patriotism should be instilled in all races. Nazri in not too many words also agreed that the BTN courses promoted racism.

"You want me to lie? You (will) make people laugh. I mean there are people who attended the courses who came out very angry, so I want them to tell me where I went wrong in not supporting the revamping of the BTN syllabus," added Nazri.

Mohammed Fazdil Min Bahari atau Fatine, 36, dalam laman sembang, Facebook mengakui dirinya masih berpegang kepada ajaran Islam dan berterusan melaksanakan tuntutan agama meskipun sudah berada di United Kingdom (UK) sejak awal tahun lalu.

Fatine atau atau nama panggilan mesra keluarga, Fadil, menjawab komen seorang kenalannya dengan berkata: "Sejahil-jahil saya, insya-Allah datang UK ni, saya solat, puasa tak pernah tinggal, pasal hal keseksualan saya, biarlah Allah yang tentukan."

Baru-baru ini, keluarga jurusolek terkenal kelahiran Malaysia yang kini tinggal di Derby, UK itu meluahkan rasa bimbang mereka kemungkinan Fadil bertukar kepada agama yang lain setelah berkahwin jantina sejenis dengan seorang lelaki Britain, Ian Young, 30.

Pada masa sama, keluarganya berharap Fatine yang kini terperangkap dalam masalah visa pelawat yang tidak dilanjut tempoh, tidak berasa tertekan. Di ruangan itu juga, jurusolek itu menerangkan, perkahwinannya berlangsung secara sivil dengan menandatangani satu perjanjian yang mengesahkan hubungan pasangan tersebut di UK.

"Saya buat perkongsian sivil, tiada kena mengena dengan agama, dia masih dengan agama dia dan saya masih Islam."

Sementara itu mStar melaporkan bahawa,transeksual warga Malaysia, Mohammed Fazdil Min Bahari berasa takut untuk pulang ke Malaysia ekoran reaksi negatif yang timbul daripada tanggapan salah berhubung perkahwinannya dengan seorang warga British. Katanya, dia telah menerima banyak emel dan komen orang ramai yang mengkritik dan menuduhnya menghina kerajaan Malaysia.

Mohammed Fadzil atau Fatine kesal kerana orang ramai tidak memahami tujuannya datang ke United Kingdom (UK) adalah semata-mata untuk hidup bersama lelaki yang dicintainya. Katanya, dia tidak boleh berbuat demikian di Malaysia kerana masyarakat mengkaitkan perkahwinan mereka dengan isu agama.

"Saya takut untuk pulang ke tanah air. Saya bimbang akan keselamatan saya," katanya yang mengulas tentang laporan akhbar tersebut yang didakwa memberikan gambaran kurang tepat mengenai kisah percintaan mereka sehingga mencetuskan reaksi negatif.

"Saya telah menghabiskan masa berjam-jam membuat panggilan telefon untuk memohon kemaafan. Saya amat menyayangi mereka tetapi saya tidak boleh mengubah apa yang telah berlaku," kata jurusolek artis berusia 36 tahun itu.

Fatine yang berasa kesal dengan laporan tersebut yang didakwanya telah memutarbelitkan kisah cinta mereka sedangkan mereka tidak berniat untuk menghina masyarakat Melayu.

"Mereka juga telah menyiarkan nama bapa saya, sedangan itu sebenarnya tak perlu. Ibu saya pula berasa takut untuk meninggalkan rumah sekarang," tambahnya.

Fatine kesal kerana masyarakat Melayu berasa tersinggung ekoran perkahwinan mereka, walhal mereka cuma ingin hidup bersama di UK memandangkan mereka tidak boleh berbuat demikian di Malaysia. Fatine sedar orang-orang Melayu memegang nilai-nilai tradisional dan "tidak dapat menerima orang sepertinya".

Bagaimanapun, dia berharap keadaan akan beransur reda.

Lembaga 'Teoh' di pejabat SPRM.......

Tiga individu mendakwa mereka ternampak satu lembaga yang menyerupai mendiang Teoh Beng Hock merayau-rayau di ibupejabat Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) di Plaza Masalam, Shah Alam. Menurut laporan akhbar China Press, lembaga tersebut dilihat di tingkat lima bangunan tersebut - tempat Teoh ditemui mati dan di tingkat 14, iaitu pejabat SPRM Selangor.

Laporan itu menyebut seorang pengawal keselamatan dan dua pegawai SPRM terserempak dengan lembaga itu sekitar bulan Oktober lalu - lebih dua bulan selepas Teoh ditemui mati. Pengawal keselamatan tersebut yang enggan namanya disebut berkata, dia tidak nampak muka lembaga itu, tetapi ia berpakaian sama seperti yang dipakai mendiang ketika datang ke pejabat SPRM dulu.

"Saya nampak mayatnya selepas jatuh. Saya pasti ianya Teoh walaupun saya hanya lihat bahagian belakangnya," katanya sambil menambah kejadian itu berlaku kira-kira jam 6.30 petang.

Ketika mencerita semula kejadian itu, pengawal tersebut berkata dia pergi ke bilik air di tingkat lima di mana secara dia tiba-tiba terdengar bunyi orang berjalan. Pengawal keselamatan yang lain tidak bertugas ketika itu.

"Saya rasa pelik. Biasanya pada waktu itu tiada orang lain di situ. Lalu saya berjalan ke arah tandas... kemudian saya nampak seorang lelaki di depan lif, dia memakai kot hitam dan berseluar putih," katanya.

Pada masa itu, tidak terlintas di fikiran pengawal tersebut bahawa ia adalah lembaga yang menyerupai Teoh itu.

"Saya bertanya dia hendak ke mana kerana tiada orang di atas. Dia menjawab "saya nak naik ke atas", lalu masuk ke dalam lif.

"Ketika itulah saya terfikir yang dia nampak seperti Teoh, jadi saya bergegas ke bilik keselamatan untuk melihat CCTV, tetapi tiada seorang pun dalam lif tersebut.

According to China Press, his apparition was spotted on the fifth floor of Plaza Masalam, where his remains were found, and on the 14th floor, where the MACC office is located.The report said a security guard and two MACC officers had bumped into the spectre. The sightings took place sometime in October, more than two months after the 30-year-old's death.

The security guard, who wished to remain anonymous, said he did not see Teoh's face, but the apparition was clad in the same clothes which the deceased had worn when he came to the MACC office.

"I saw his dead body after the fall. I am sure that it was Teoh even though I could only see him from the back," he said, adding that the incident happened around 6.30pm.

Recalling the spine tingling encounter, the security guard said he went to the washroom located on the fifth floor where he suddenly heard footsteps. The other officers were not on duty at the time.

"I had a strange feeling. Usually at that time, nobody would be around. So I walked out of the toilet... then I saw a man in front of the lift, he was wearing a black coat and white pants," he said.

At that point, it did not strike the security guard that this could be Teoh's spirit.

"I asked where he was going as no one was upstairs. He just answered 'I am going upstairs', the lift door opened and he went in.

"That was when I thought it could be Teoh, so I rushed to the security room to check the CCTV and saw there was nobody in the lift," he said.

Another encounter

The security guard also related the experience of a MACC officer.

"He was sitting on the sofa watching TV when he suddenly felt something biting his neck, and when he checked, he found a red mark on his neck.

"When he was sitting in the reception area, he saw Teoh walk out from the office.

"Then the officer felt as if someone was pulling his leg. He got scared and rushed out," he said.

Following this, the security guard said the officer requested for a transfer to the MACC headquarters in Putrajaya and "never came back."

Teoh, who was the former aide to Selangor exco Ean Yong Hian Wah, was found dead after a marathon questioning session by MACC officers which dragged into the wee hours of the morning. Although the official version is that Teoh had committed suicide, his family refused to believe that the father to be, who was slated to get married the next day, would take his own life.

Following a massive public outcry, the government ordered for an inquest to be held to determine the cause of death. Teoh's remains were exhumed for a second post-mortem after renowned Thai pathologist Porntip Rojasunand made the startling revelation that there is an 80 percent probability of homicide.

Isu Ketuanan Melayu menghangatkan Dewan Rakyat sehingga mencetuskan pertikaman lidah antara beberapa Ahli Parlimen. Speaker Tan Sri Pandikar Amin Mulia terpaksa campur tangan untuk menenangkan keadaan yang mula kecoh selepas isu itu dibangkitkan oleh M Kulasegaran (DAP-Ipoh Barat).

"Tolonglah Yang Berhormat, setiap kali berhujah, mestilah berhujah seperti seorang Ahli Parlimen, bukan seorang ahli politik.

"Apabila bersikap sebagai Ahli Parlimen, Yang Berhormat akan ingat dengan peraturan mesyuarat, jangan sama sekali menzahirkan perkataan yang menggamit reaksi negatif kawan sebelah.

"Kalau mahu bercakap seperti ahli politik, buat di luar, bukan dalam waktu perbahasan, ini mesyuarat ahli Yang Berhormat, jadi jangan timbulkan lagi perkara begini," kata Pandikar Amin.

Kulasegaran membangkitkan isu Ketuanan Melayu ketika mengemukakan soalan tambahan kepada Menteri di Jabatan Perdana Menteri, Tan Sri Koh Tsu Koon berhubung perpaduan dalam kalangan rakyat di negara ini. Beliau berkata, isu perpaduan di Malaysia menghadapi halangan dan kekangan seperti isu ketuanan Melayu yang disifatkannya sebagai satu diskriminasi kepada kaum lain di negara ini.

"Dasar Ekonomi Baru (DEB) juga sangat memberi tentangan kepada keharmonian," katanya menyebabkan beberapa Ahli Parlimen daripada Barisan Nasional (BN) berdiri dan menjerit membantah.

Speaker kemudian mengarahkan semua Ahli Parlimen itu duduk sebelum meminta Koh menjawab soalan Dr Lee Boon Chye (PKR-Gopeng) dan mengetepikan soalan Kulasegaran.

Terdahulu, Koh ketika menjawab soalan Datuk Shamsul Anuar Nasarah (BN-Lenggong) berkata kedudukan Malaysia di tempat ke-26 dalam Indeks Keamanan Sedunia adalah lebih baik berbanding Sepanyol (28), Perancis (30), Britain (35), Indonesia (67), Filipina (114) dan Thailand (118). Koh berkata, Malaysia sentiasa berusaha memperbaiki kedudukannya dalam ranking dunia.

"Sekiranya kita semua mempunyai sikap yang positif dan terbuka, dan tidak hanya melihat aspek negatif saja, kita pasti akan mampu menyelesaikan sebarang masalah yang timbul," katanya.

Pada peringkat ini, Mohamed Aziz (BN-Sri Gading) bangun dan berkata, "Menteri sila jawab soalan jahat yang telah dibangkitkan Ipoh Barat. Tolong jawab bagi pihak orang Melayu, jangan beri jawapan selamat." Pandikar Amin kemudian menegur tindakan Datuk Bung Mokhtar Radin (BN-Kinabatangan) yang bangun untuk menyokong Mohamed.

"Kinabatangan sudahlah, saya sudah beritahu tadi. Jangan buat kacau tak tentu...soalan penting dan dijawab dengan baik.

"Bagaimana kita boleh beri teladan yang baik kepada rakyat jika tunjukkan satu sikap begini," katanya.

Malaysian transsexual Fatine's UK love story has sparked so much hate back home that she fears to return.

"I am so frightened to go back. I am worried for my safety," she said in response to what she claimed was a Malay tabloid's wrongful portrayal of her love and civil partnership marriage to a Briton.

She said she had been receiving many emails and comments from people condemning and accusing her of insulting the Malaysian government.Fatine, who was born Mohammed Fazdil Min Bahari said it was frustrating that people didn’t understand that she came to the UK because she wanted to be with Ian Young, the man she loved.

The 36-year old make-up artist, said she could not do that in Malaysia, adding that people only seemed to be taking a religious point of view over the matter.

Speaking up for the first time after The Sun newspaper in London broke the story, Fatine said she did not know what to do as her family had already disowned her.

"I’ve spent hours on the phone asking for forgiveness. I love them although but I can’t change what has happened," she said.

Fatine said it was a shame that the Malay tabloid had "twisted" their story, stressing that as it was never their intention to insult the Malay community.

"They also put my father’s name in it, which was unnecessary and my mother has been left frightened to leave the house," he added.

Fatine said she regretted that the community was taking it personally.

She said she appreciated that the Malays are very traditional and "people like me aren’t acceptable" and hoped that things would cool down eventually.

Fatine, who married Young in a civil partnership in May, faces deportation after her Leave to Remain visa was rejected by UK's Home Office over an "incorrect" photograph.

A second application with a passport photograph with a white background as required, instead of blue, was submitted for reconsideration but it was also thrown out in October.The couple have since submitted their third application for a Right to Family Life under the Human Rights Act in Britain.

On Monday, Immigration director-general Datuk Abdul Rahman Othman said the department might take action against Fatine when she returns home as it views problems like overstaying seriously.

Young, 30, who runs a property maintenance company, however, said Fatine’s application was still being processed by the UK Border Agency and she should not be classified as an overstayer.

He also claimed that as a result of the "misleading" article, everyone was misreading their story as an insult to Islam which it was never intended to be.

"All we want is to be married, be happy and living together. The only way we can do this is over here in the UK," he said.

He said the article made it sound like they were trying to make a mockery of Islamic laws, which was never their intention.

"As a result of the way we have been portrayed, I feel that we would be in more danger than ever if we were to try and live in Malaysia," he said.- by Choi Tuck Wo in London

Apparently, Fatin, the Malaysian transsexual fighting deportation from Britain will be punished for bringing "great shame" on the country, Malaysian authorities said according to reports today.

Immigration Department director-general Abdul Rahman Othman said that once deported to Malaysia, Fatine could be banned from travelling overseas for at least two years.

"This depends on the severity of his offence in Britain," Abdul Rahman said according to the New Straits Times newspaper.

"The penalty imposed on Fatine may be more severe than the two-year passport issuance deferment as he has brought great shame upon us," he said.

The High Court here today rejected Parti Keadilan Rakyat (PKR) national adviser Datuk Seri Anwar Ibrahim's application to strike out his sodomy charges today.

Judge Datuk Mohamad Zabidin Mohd Diah fixed Jan 25 to Feb 25, 2009 for the hearing of the sodomy case after ruling that medical reports could not serve as the basis for the court to use its inherent powers to strike out the charge.

"In my opinion, only because the medical report stated 'no conclusive clinical findings suggestive of penetration to the anus/rectum' cannot be made a basis for the court to use inherent powers to cancel the charges, at this stage, without hearing the testimonies of prosecution witnesses," said Mohamad Zabidin.

Anwar is charged with sodomising Mohd Saiful Bukhari Azlan, his former personal aide, in Desa Damansara Condominium, Jalan Setiakasih, Bukit Damansara, between 3.01pm and 4.30pm on June 26 last year.

UMNO dari kacamata Dr.Mahathir......

1. Pilihanraya Umum ke-13 hanya dua tahun lagi. Saya sedang meneliti reaksi rakyat terhadap UMNO dibawah pimpinan baru. Saya terkejut. Saya terkejut kerana seorang bekas pemimpin UMNO yang kanan telah meluahkan perasaannya dengan berkata "UMNO is rotten to the core" (UMNO busuk hingga ke ususnya).

2. Beliau telah berkata yang beliau sedang memikir untuk menyokong PAS. Beliau juga berkata beliau telah bertemu ramai pemimpin-pemimpin UMNO yang telah bersara dan mereka speendapat dengannya.

3. UMNO busuk daripada peringkat terendah hingga ke peringkat tertinggi katanya. Di cawangan, ketua cawangan hanya berjuang untuk mengekal dirinya sebagai ketua sahaja. Kenapa? Sebabnya majoriti ketua cawangan dapat jadi pengerusi Jawatakuasa Kemajuan dan Keselamatan Kampung dengan elaun tertentu dan kuasa untuk mengagih peruntukan. Berpeluang juga untuk jadi kontraktor Kelas F untuk projek kecil di luar bandar.

4. Untuk menentukan dirinya tidak dicabar ketua cawangan tidak akan benarkan sesiapa yang lebih terpelajar daripadanya masuk UMNO cawangannya. Lebih daripada itu kebanyakan peruntukan untuk jadi ahli UMNO, yang mana dia mesti melalui cawangan, tidak akan dilayan. Tujuannya ialah supaya cawangannya tidak mempunyai banyak ahli kerana mereka tetap akan menimbulkan masalah dan sukar dikawal, bahkan sukar disogok pun.

5. Sebab itu tidak ramai ahli profesional yang dapat menjadi ahli UMNO. Sebaliknya semakin ramai daripada pemimpin PAS terdiri daripada doktor, peguam, jurutera dan lain-lain profesyen.

6. Oleh kerana ketua cawangan biasanya tidak memiliki pelajaran yang tinggi dan beliau menentukan ahli lain dalam cawangannya mempunyai ilmu pengetahuan yang lebih rendah daripadanya, maka apabila ketua terpaksa berhenti kerana sebab-sebab tertentu, maka penggantinya akan terdiri daripada yang kurang berkebolehan daripadanya. Dengan itu kualiti kepimpinan akan merosot sepanjang masa.

7. Tentu ada cawangan yang tidak seperti ini tetapi pengecualian hanya mengesahkan keadaan yang sebenar.

8. UMNO, kata bekas pemimpin kanan ini sekarang dipimpin oleh perasuah. Mereka menjadi ahli Majlis Tertinggi kerana sogokan wang. Orang ramai tidak akan serah nasib mereka kepada perasuah.

9. Penempatan perasuah dalam Kerajaan dan badan-badan lain juga memburukkan lagi imej UMNO. Sudah tentu perasuah akan dipilih sebagai calon UMNO dalam Pilihanraya Umum ke-13. Jika mereka diberi kemenangan maka negara akan dapat Kerajaan perasuah. Sebab itu beliau tidak akan sokong UMNO sebaliknya akan menyertai dan menyokong parti lawan. Katanya lagi hingga kini separuh daripada orang Melayu tidak merasai nikmat kerana Kerajaan-Kerajaan pimpinan UMNO menidakkan hak mereka sedangkan mereka juga orang Melayu walaupun mereka menyokong parti lawan. Mereka yang menyokong parti lawan bertambah sejak (Tun) Abdullah kerana ramai daripada ahli UMNO sendiri sudah tidak percaya kepada UMNO.

10. Yang tinggal katanya ialah orang yang berkepentingan yang berharap mendapat sesuatu kerana menyokong UMNO. Mereka ini bukan nasionalis dan mereka tidak boleh diberi kepercayaan.

11. Banyaklah lagi hujah-hujahnya akan sebab-sebab UMNO tidak lagi akan diberi peluang untuk memerintah negara yang disayangi olehnya. Saya tidak akan hurai lebih lanjut. Hanya yang saya ingin sebutkan ialah pendapat beliau sudah menular ke semua peringkat orang Melayu, bahkan ahli UMNO juga.

12. Rakan-rakan dalam Barisan Nasional semuanya berpecah dan lemah. Mereka tidak mampu menjayakan Barisan Nasional.

13. Masa semakin singkat untuk memperbaiki keadaan ini. Saya mencatat maklumat ini untuk pengetahuan umum sahaja.

BN protest during Penang Legislative Assembly sitting......

A group of state Barisan Nasional youth leaders and supporters staged a protest outside the Penang legislative assembly this afternoon against the Pakatan Rakyat state government.

The protesters vented their frustration against what they described as an "inefficient and indecisive" state government which failed to resolve the people's problems and fulfill pre-election promises.

Led by Penang Umno Youth chief Norman Zahalan, the protest started at 12.15pm and ended about 45 minutes later. It took place while the assembly sitting was going on.

The protesters also carried banners and placards condemning the state government for failing to resolve issues such as Kampung Buah Pala, Mak Mandin Rumah Hijau and the controversial conversion of a foreshore land status.

Reports also said that some of the angry protesters had also allegedly torched and stomped on posters of Chief Minister Lim Guan Eng.

NSTP ordered to pay RM100,000 to Anwar over a defamatory article.......

The High Court today ordered New Straits Times Press (M) to pay RM100,000 in damages to Anwar Ibrahim over a defamatory article published in 2002. The court also ordered the media giant to pay RM20,000 in costs to the PKR leader.

Earlier the court ruled that NSTP had defamed Anwar in its article published in the New Straits Times on March 2, 2002.
The article, titled 'Anwar's link to US lobbyist', claimed that the opposition leader had stashed RM3 billion in foreign accounts and had foreign links to Western interests. The article was based on a report which was carried in the New Republic magazine.

In making his decision, judicial commissioner Harminder Singh Dhaliwall said that NSTP could not rely on the defence of qualified privilege as the "article was sinister and more than a reproduction of the New Republic article".

"The said article is far more sinister than the reproduction," he said.

"Hence, the court finds the article to be libellous and the defendants have to pay the damages to the plaintiff (Anwar)," he added.

Anwar had sued New Straits Times Press (M) Bhd and its former group editor-in-chief Abdullah Ahmad for RM100 million over the defamatory article.

The NSTP article was based on another article - 'The Bush Administration's dubious envoy to Taiwan' - that was published in the political weekly magazine New Republic's March 2002 issue. Anwar filed the suit on July 4, 2003.

'Baseless imputation'

Harminder said he did not quite see how ordinary, right thinking members of the community would see Anwar as an American agent.

"The purpose of dialogues, as conceded by the plaintiff, was to build strong rapport with members of the Congress and United States government," said the judge, saying that using the APPC as a vehicle does not suggest anything sinister, illegal or immoral.

"I think the community will perceive dialogues to be an excellent way to exchange ideas or even influence the thinking of the people and the countries involved. To have dialogues to build rapport and to influence change is certainly better then waging wars as recent events bear testimony.

"Looking at it in this light, I do not think members of the community will see anything wrong with the government funding the dialogues. There cannot be anything defamatory about this. Certainly, the imputation about the plaintiff being an American agent is quite baseless."

Harminder said NSTP did not try to prove the truth of its article and asserted that it was unable to show accuracy. As well, Anwar was brought in to testify that there was no truth to the article, and he was not challenged on this.

"Anwar also called the former director of investigations of the Anti-Corruption Agency, Abdul Razak Idris who told the court that he supervised investigations on the contents and allegations stated in former assistant governor of Bank Negara Abdul Murad Khalid's statutory declaration. The investigations found the allegations were baseless and sustainable."

'Qualified privilege can't be used'

Harminder further held that the writer had not interviewed Anwar, who was in prison at the time.

"Apart from resorting to the Internet, she did not take other steps to locate Paal. She also admitted she did not interview Abdul Murad.

"Her response to this was that the article contained matters which had already been commented upon by government officials and also subject to extensive coverage by the media.

"She should have verified the accuracy of the New Republic article. Her reasons for not doing so are therefore unjustifiable and unsustainable and therefore cannot be accepted."

Harminder said there was no urgency for NSTP to print the article, as the story about APPC and Abdul Murad's statutory declaration was stale news.

"A response was necessary as there was only one side of the story available. Considering all the facts and circumstances, the article by the defendant was not a piece of responsible journalism to which the defence of qualified privilege is available," he added.

Anwar was represented by counsel Karpal Singh, Sankara Nair and Sangeet Kaur Deo, while NSTP was represented by Nad Segaram.

In an immediate response, Sankara said Anwar felt reprieved and vindicated by the judgment.

"The amount does not matter, as what is important is that he has to maintain his dignity and reputation. We will not appeal over the amount," he said.

Nad said he would get instructions from his client as to whether to appeal.

During the hearing, Abdul Razak had testified that Anwar had been cleared of having RM3 billion in foreign accounts, as stated in Abdul Murad's statutory declaration.

Despite this, various Umno leaders have continued to harp on the contents of the documents.

Mahkamah Rayuan hari ini membenarkan permohonan penangguhan sementara perintah Mahkamah Tinggi yang mengarahkan Suruhanjaya Pilihan Raya (SPR) supaya mengadakan pilihan raya kecil DUN Kota Siputeh.

Semalam, Hakim Mahkamah Tinggi Datuk Alizatul Khair Osman Khairuddin menolak permohonan SPR untuk menangguhkan perintah tersebut. Keputusan Mahkamah Rayuan itu diumumkan kira-kira jam 7.30 malam. Esok merupakan tarikh akhir bagi SPR melaksanakan perintah mahkamah tinggi supaya mengeluarkan writ pilihan raya kecil DUN Kota Siputeh.

Berikutan keputusan Mahkamah Rayuan hari ini, SPR boleh menangguhkan pengeluaran writ tersebut untuk mengumumkan tarikh penamaan calon dan hari pengundian. Keputusan hari ini dibuat sebulat suara oleh panel hakim yang diketuai oleh Datuk Sulong Matjeraie. Dua lagi hakim ialah Datuk Kang Hwee Gee dan Hakim Mahkamah Tinggi, Datuk Abd Aziz Abdul Rahim. Mengikut undang-undang, apabila SPR telah mengeluarkan writ tersebut, maka ia tidak boleh dibatalkan.

Sebelum itu, peguam kanan persekutuan, Kamaluddin Md Said berhujah bahawa wujud keadaan tertentu yang membolehkan penangguhan itu dibuat. Katanya, jika SPR sudah menetapkan tarikh penamaan calon dan pengundian, dan jika rayuan terhadap keputusan Mahkamah Tinggi kemudiannya dibenarkan, maka pilihan raya kecil itu adalah satu pembaziran dana awam. Kamaluddin juga menegaskan, jika pilihan raya kecil diadakan, ia mungkin menyebabkan ada dua wakil rakyat, jika rayuan SPR dibenarkan.

Manakala peguam kanan Sulaiman Abdullah, yang mewakili speaker DUN Kedah, Dr Abdul Isa Ismail pula berkata, jika mahkamah membenarkan penangguhan itu, ianya hanya menghalang perjalanan perlembagaan kerana kerusi tersebut telahpun diisytiharkan kosong.

"Apabila sesebuah kerusi diisytiharkan kosong, maka pilihan raya mesti diadakan dalam tempoh 60 hari dan writ pilihan raya hendaklah dikeluarkan esok," katanya.

Sulaiman berkata, juga tidak ada keperluan segera untuk memberi penangguhan kerana Mahkamah Rayuan boleh mendengar rayuan SPR sebelum tempoh 60 hari itu. Maka katanya, tidak ada keperluan segera untuk mahkamah membenarkan penangguhan.

Mahkamah Tinggi di sini hari ini menolak permohonan penangguhan oleh Suruhanjaya Pilihan Raya (SPR) terhadap keputusan mahkamah 16 November lalu yang mengisytiharkan kerusi Dewan Undangan Negeri (DUN) Kota Siputeh kosong. Oleh itu, pilihan raya kecil kawasan itu perlu diadakan dalam masa 60 hari selepas writ pilihan raya dikeluarkan selewat-lewatnya, Rabu ini.

Hakim Alizatul Khair Osman Khairuddin berkata beliau bersetuju dengan Sulaiman Abdullah, peguam utama bagi Speaker DUN Kedah, Datuk Dr Abdul Isa Ismail, bahawa SPR gagal meyakinkan mahkamah berhubung isu keadaan luar biasa bagi mewajarkan permohonan itu dibenarkan.

Katanya, alasan mengenai implikasi kewangan yang dinyatakan oleh peguam kanan persekutuan Datuk Kamaruddin Md Said, yang mewakili SPR, tidak boleh ditakrif sebagai satu keadaan luar biasa.

"Mengikut undang-undang, menguruskan pilihan raya merupakan tanggungjawab biasa SPR dan suruhanjaya ini tidak merujuk mana-mana undang-undang kes untuk menyokong hujahnya," kata Alizatul.

Namun,UMNO akan mengemukakan rayuan di Mahkamah Rayuan berhubung keputusan Mahkamah Tinggi Kuala Lumpur (Rayuan dan Kuasa-kuasa Khas)yang menolak permohonan Suruhanjaya Pilihan Raya (SPR) untuk mendapat perintah menangguhkan keputusan mengisytiharkan kerusi Dewan Undangan Negeri (DUN) Kota Siputeh sebagai kosong.

Persoalannya siapakah yang lebih berkuasa SPR atau UMNO. Sepatutnya SPR perlu akur dengan keputusan tersebut dan jangan jadi hamba UMNO.

Bukankah UMNO/BN berkata depa sudah bersiap sedia untuk menghadapi pilihanraya kecil DUN Kota Seputeh. Jika benar mereka sudah bersedia, maka kenapa perlu merayu untuk mempertahankan seorang wakil rakyat"kaki ponteng" itu?

Masalahnya di Kota Seputeh tak banyak undi pos seperti di Bagan Pinang. Ini yang merisaukan UMNO.

Seharusnya UMNO/BN sepatutnya rasa gembira kerana dapat menggantikan seorang wakil rakyat yang malas dengan yang baru................

Will Anwar be ambushed by trial? by Deborah Loh

Datuk Seri Anwar Ibrahim has failed in his bid, at the Court of Appeal, to obtain evidence from the public prosecutor about his alleged act of sodomy with a young former aide. Layperson reactions have naturally been cynical, dismissing the judgment as political in nature.

Indeed, the Court of Appeal's interpretation of Section 51A of the Criminal Procedure Code (CPC), by which it made its judgment, is worrisome from a justice perspective. The judgment nullifies the efforts of the parliamentary select committee which proposed the CPC amendments in 2006 requiring pre-trial disclosure by the prosecution to the defence. The legislature's intention was to "prevent trial by ambush" but the Court of Appeal's judgment in Anwar's sodomy case seems to overturn that principle.

But is Section 51A as clear cut as it is meant to be? And is splitting hairs over its meaning scuppering Anwar's chances for a fair trial?

Meaning of words

Section 51A was introduced to widen the scope of evidence that the defence could obtain from the prosecution. At first reading, it comes across as a clear obligation for the prosecution to make available to the defence evidence that it intends to use during trial.

Section 51A . Delivery of certain documents

1. The prosecution shall before the commencement of the trial deliver to the accused the following documents:

1. A copy of the information made under section 107 relating to the commission of the offence to which the accused is charged, if any;
2. A copy of any document which would be tendered as part of the evidence for the prosecution; and
3. A written statement of facts favourable to the defence of the accused signed under the hand of the Public Prosecutor or any person conducting the prosecution.

The meaning of the words "shall" and "any document" is clear, says member of the Bar Council's criminal law committee, Datuk Baljit Singh Sidhu, who is also the author of Criminal Litigation Process.

"The intention of 51A is to put both parties in a trial on equal footing in the interest of justice. That was parliament's intent. The word 'shall' should be taken to mean 'must'.

"If the court does not interpret 'shall' as being mandatory, then there is no point to the amendment," Baljit, who is also Gerakan Federal Territory legal adviser, tells The Nut Graph.

"Any document" should also be taken to mean any type of evidence, Baljit adds. It is all the more important when it involves evidence like DNA, for which scientific expertise and time are required if defence lawyers are to analyse it.

However, the Court of Appeal in Anwar's sodomy case decided there were "limits" as to the kind of evidence the prosecution could be asked to produce before a trial. Hence, it overturned the High Court's decision ordering the prosecution to hand over evidence, which included video footage, medical reports, doctors' notes, and witness statements of alleged victim Mohd Saiful Bukhari Azlan, and others. The bench, in rejecting Anwar's cross-appeal for DNA specimens held by the prosecution, also said that the evidence requested did not fall under the category of evidence in 51A.

"The amendment [to the CPC] is as good as non-existent," SN Nair, one of Anwar's lawyers, tells The Nut Graph.

Merely procedure?

The Court of Appeal's written judgment is not out yet, so Anwar's lawyers are still unclear about the basis of the ruling although they have filed two notices of appeal at the Federal Court Registry.

But it does appear that the court reverted to the law prior to the introduction of 51A on the basis of the prosecution's arguments. "The prosecution went back to pre-amendment law arguing that they had the discretion as to what evidence to give and to decide which facts were favourable to the accused," Nair says in a phone interview.

Clause (c) of 51A(1) requires the prosecution to provide a written statement of facts that are favourable to the defence. According to Nair, evidence that is favourable to the accused can only be found in witnesses' statements.

"In witnesses' statements, there could be evidence that potentially saves the accused. Sharing of these facts means the defence gets to decide what is favourable in the interest of fair trial," Nair says.

The High Court granted access to these statements to Anwar's defence team but it was revoked by the appellate court. Some prosecutors also argue that 51A is a "procedural" amendment and not a matter of law, says criminal lawyer Richard Wee.

"While by and large the courts mostly do tell off the prosecution, there are some who buy that argument. They take the view that if a prosecutor fails to adhere to 51A, it's merely a procedural error," Wee says in a phone interview.

Such an interpretation means the prosecution's case can avoid an inconclusive end. If the court were to view 51A as a law rather than procedure, cases could end up much like how blogger Raja Petra Kamarudin was discharged but not acquitted for sedition, simply because police could not find him.

"Similarly," says Wee, "if evidence is not provided by the prosecution under 51A, the defence should be accorded the right to seek for a discharge not amounting to acquittal."

Wiggle room

The repercussions of procedural rather than legalistic interpretation of the law are alarming. Besides placing prosecution and defence on unequal footing, does it also mean law enforcement need not keep to high standards to ensure thorough and fair investigative work?

Shoddy police work is unfortunately a reality, but that's where the law could have been drafted more precisely to plug the gaps. Wee feels that 51A was not drafted specifically enough to take into account the "practical realities of what happens in court".

Some realities include: The prosecution denies before trial to having found any facts favourable to the accused. Or they may produce other evidence in mid-trial instead of evidence disclosed pre-trial. They may argue that new evidence is required in response to the defence's arguments.

Wee feels the wording about making available documents "which would be tendered as part of evidence" limits the kind of evidence that can be requested for and gives room to the prosecution to wiggle out of it.

"It would have been better to say 'any documents related' to the trial, which would be specific but in a wider sense, covers all other evidence that could be raised during trial," he says.

The obvious conclusion?

Yet, the fact is, there are judges who uphold 51A and ensure it is adhered to, notes Baljit.

"Having case management before trial for evidence to be given to the defence is normal practice and courts will set a date for mention to ensure that all this is complied with," he says.

So if other courts are upholding the law, what else are people to make of how Anwar's appeal was handled other than to think that the judiciary is not free from political interference?

High court ruled MACC cannot question witnesses overnight.........

The Malaysian Anti-Corruption Commission (MACC) can no longer question witnesses overnight. The High Court ruled today that this can be done only during office hours from 8.30am to 5pm.

Justice Mohd Ariff Md Yusof in his landmark decision held that section 30(3)(a) of the MACC Act does not give power to the MACC to conduct investigations on a witness "around-the-clock".

"The phrase 'day-to-day' in the section cannot mean 24 hours but normal working hours," Mohd Ariff said.

"Therefore, I agree that the applicant in this case had been unlawfully detained by the MACC," he said in allowing a judicial review filed by Kajang municipal councillor Tan Boon Wah.

Tan, 39, sued MACC chief commissioner Datuk Seri Ahmad Said Hamdan, MACC assistant superintendent Mohammad Hassan Zulkifli and the MACC, claiming that his detention and questioning for 16 hours overnight by the MACC was unlawful, and had resulted in him suffering losses and damage.

In his application filed on July 22, Tan asked the court to declare that the defendants, who were carrying out investigations under section 30(3)(a) of the MACC Act, could record his statements as a witness only during office hours from 8.30am to 5.30pm.

Tan was one of several people who were called up by the MACC to give statements concerning investigations on alleged misappropriation of Selangor government allocations.

The court also granted Tan damages for the unlawful detention by the MACC from 9.45pm on July 15 to 2.53am the next day and ordered the defendants to pay him costs.

In the court's decision, Mohd Ariff said the phrase "day-to-day" in the section raised ambiguity as it is not defined properly in the act.

However, he said, a proper interpretation must be given to avoid absurd results as it affected a person's fundamental liberties as guaranteed under Article 5 of the Federal Constitution.

"The phrase 'day-to-day' cannot mean 'around the clock'. Section 30 cannot be interpreted that way, to do so will offend the intention of the legislature and will curtail the ambit of personal liberty," said the judge.

He stressed that any statutory provision affecting fundamental liberties must be read properly and be given the widest room.

Inspector General of Police Tan Sri Musa Hassan appears to be unware of a statement recorded from private investigator P. Balasubramaniam by his Special Branch team in Bangkok on July 8 last year. Bala has stated in his latest revelations that the statement was recorded by the SB team led by ACP Muniandy who traced him to Bangkok through arrangements made by a Malaysian Embassy liaison officer

The private investigator had also said that Muniandy’s team was only interested in his first July 3 statutory declaration and was not bothered about his July 4 declaration retracting his allegations that the Prime Minist rrelationship with mudered Mongolian model Altantuya Shaaribuu.

Yesterday, the IGP stated that Bala who reportedly had been in and out of the country at least at eight times since his disappearance last year, was still being sought by police to record a statement over his two contradictory statutory declarations.

Musa said as Bala was not a wanted fugitive but only a witness in a case, the police had not given any instructions to the Immigration Department to stop Bala’s movement in and out of the country.

“He should know that he is wanted in assisting us in a case and take the initiative to come in personally and have his statement recorded,” Musa was quoted as telling the mainstream media questioning the IGP on Bala’s entry into the county.

“As far as the police is concerned, we are not aware of him having entered the country. You should ask the reporter who made that claim,” Musa added.

The private investigator, his wife and three children – aged between six and 11 – were reported missing the past 15 months although Bala’s latest revelations indicated he was blackmailed into withdrawing his first statutory declation.

Presiden Transparency International Malaysia(TI-M), Datuk Paul Low memuji negeri Pakatan Rakyat itu bahkan wajar dijadikan contoh. Datul Paul Low berkata sikap kepimpinan Menteri Besar Selangor, Tan Sri Khalid Ibrahim dalam memacu Selangor jelas menunjukkan kerajaan negeri ini merupakan kerajaan yang adil dan telus mencakupi semua aspek.

Katanya, peranan Khalid dalam menangani rasuah di Selangor merupakan satu perkembangan positif dalam arena politik negara.

“Saya yakin MB Selangor mempunyai kehendak politik yang kuat untuk memerangi rasuah sebagaimana yang ditunjukkannya di Selangor," kata Paul dalam satu sidang media selepas mengumumkan Indeks Persepsi Rasuah 2009,di Kelab Golf Di Raja Selangor.

Beliau menambah, pentadbiran terbuka yang diamalkan Selangor dan perkembangan yang berlaku di negeri ini harus menjadi contoh kepada semua tanpa mengira fahaman politik supaya negara bebas dari rasuah. Katanya, pentadbiran telus yang diamalkan Selangor bukan sahaja penting bagi aspek intergriti tetapi dalam menjaga kestabilan ekonomi negara.

TI-M memaklumkan, indeks persepsi rasuah Malaysia yang dipimpin Datuk Seri Najib razak terus menjunam. Malaysia menduduki tangga ke 56 daripada 180 negara dalam Indeks Persepsi Rasuah (CPI) dunia 2009. Malaysia mencatatkan penurunan dalam indeks persepsi rasuah pada tahun ini dengan hanya memperoleh 4.5 mata berbanding 5.1 mata pada 2008. Kemerosotan berkenaan jelas menunjukkan kegagalan negara memerangi rasuah walapun pelbagai janji dibuat pihak berkuasa untuk menanganinya.

Menurut Presiden TIM,Paul Low, banyak faktor yang menyumbang kepada berlakunya kemerosotan negara memerangi rasuah. Namun, beliau menekankan pencegahan amalan rasuah haruslah bermula dari pemimpin dengan nilai intergriti yang tinggi untuk membanterasnya. “Jika anda mempunyai pemimpin yang tidak memberikan tauladan yang baik unjtuk diikuti, anda tidak boleh harap golongan muda kita mengikut apa yang baik kerana mereka hanya mengikut apa yang pemimpin buat.

"Di Malaysia, ia bukan isu mempunyai negara yang demokratik atau pilihan raya. Kita ada tetapi dalam masa yang sama kita dengan banyak tentang lompat parti dan isu berkaitan dengannya, ada yang dibayar. Jadi ia bukan soal demokrasi tetapi soal kehendak politik," katanya.

Dalam laporan berkenaan, New Zealand berada di kedudukan pertama negara yang kurang kegiatan rasuah dengan catatan tertinggi 9.4 mata, manakala Somalia berada di kedudukan terakhir kerana mencatatkan amalan rasuah tertinggi dengan catatan CPI 1.1 mata.

Perbandingan antara negara Asean menunjukkan Malaysia berada di tempat ketiga selepas Singapura dengan catatan 9.4 mata dan Brunei dengan CPI 5.5 mata, manakala Indonesia di tempat keempat. Walaubagaimanapun, Indonesia mencatatkan kenaikan,apabila mencatatkan CPI 2.8 berbanding 2.6 tahun lalu.

Lihat saja contoh SPRM beria-ia nak siasat kes tajaan haji Tuan Guru, sedangkan kes PKFZ yang hilang berbilion-bilion dan kes Khir Toyo berjoli sambil balajar menggunakan duit rakyat tak berani disentuhnya.

Kalau beginilah keadaannya dengan dasar SPRM(MACC) maka taklah kalau hairan tahun depan Malaysia akan berada bersama-sama dengan Somalia...........

Bekas Anggota Dewan Undangan Negeri kawasan Kota Siputeh Datuk Abu Hassan Sarif hari ini memfailkan rayuan terhadap keputusan Mahkamah Tinggi yang mengisytiharkan kerusi itu kosong dan beliau tidak lagi wakil rakyat kawasan itu. Abu Hassan memfailkan notis rayuan di Pejabat Pendaftar Mahkamah Tinggi di sini pada 1.35 tengah hari melalui peguam yang mewakilinya Datuk Mohd Hafarizam Harun.

Salinan notis rayuan itu akan diserahkan kepada peguam yang mewakili Speaker Kedah Datuk Dr Abdul Isa Ismail dan Pejabat Peguam Negara, kata Mohd Hafarizam semasa dihubungi di sini hari ini.

Semalam, Hakim Datuk Alizatul Khair Osman Khairuddin, semasa membenarkan semakan kehakiman oleh Abdul Isa, memutuskan kerusi itu kosong berikutan kegagalan Abu Hassan menghadiri dua sidang dewan pada tahun ini. Berikutan keputusan itu, Abu Hassan dari Barisan Nasional, dilarang menghadiri persidangan Dewan Undangan Negeri Kedah hari ini.Mahkamah juga memerintahkan pilihan raya kecil diadakan bagi kawasan Kota Siputeh yang terletak dalam kawasan Parlimen Jerlun di Kedah.

Ini sekoq Adun UMNO yang bodoh. Dah tau peraturan DUN,kalau tak hadir 2 kali berturut-turut tanpa sebab,speaker boleh isytihar kerusinya kosong. Dia berani,mungkin Adun ini rasa kerana dia orang UMNO dia boleh buat ikut suka hatinya.

Mungkin Adun UMNO ini merasakan Mahkamah Rayuan akan memihak kepadanya seperti keputusan yang dibuat di Perak. Bukankah mahkamah rakyat itu lebih bermakna?

The Selangor state assembly today nominated PKR deputy president Syed Husin Ali, 73, to the Senate as a representative from the state. Syed Husin's choice was approved by the elected representatives through block voting, in which 32 agreed, three abstained and 20 absent.

His name was proposed by Menteri Besar Abdul Khalid Ibrahim and seconded by state PAS chief and exco member Hasan Ali.

In 1990, he was asked to resign his post as Professor of Anthropology and Sociology at the University of Malaya because he contravened the law which prohibited him as a university staff member from participating in active politics.

Earlier, he was detained without trial for six years (1974 - 1980) under the ISA. He has written a number of books and articles on the peasantry, ethnic relations and development.

The Kota Siputeh state seat, held by Umno assemblyperson Abu Hasan Sarif in Kedah, is declared vacant by the High Court today.

The decision was made by the Kuala Lumpur High Court (Appellate and Special Powers) judge Alizatul Khair Osman Khairuddin following an application by Kedah Speaker Dr Abdul Isa Ismail.

Abdul Isa had filed the suit against the Election Commission after it had overruled his decision to declare the seat vacant following Abu Hasan's two consecutive absence from state assembly sitting.

Kerusi DUN Kota Siputeh diisytiharkan kosong dan satu pilihan raya kecil seharusnya dipanggil untuk mengisi kekosongan tersebut. Keputusan tersebut dibuat oleh Mahkamah Tinggi Kuala Lumpur petang ini setelah mendengar permohonan Speaker DUN Kedah, Datuk Dr Abdul Isa Ismail untuk semakan kehakiman terhadap keputusan Suruhanjaya Pilihan Raya (SPR) yang mengekalkan Datuk Abu Hassan Sarif sebagai wakil rakyat di situ.

Abdul Isa memfailkan saman pada 1 Oktober lalu, menamakan Abu Hassan daripada BN dan SPR sebagai responden. Beliau memohon diisytiharkan Abu Hassan bukan lagi ADUN bagi kerusi tersebut berikutan kegagalannya menghadiri dua persidangan DUN secara berturut-turut dan injunksi menghalang beliau daripada menjalankan tugas sebagai wakil rakyat. Beliau juga memohon mahkamah mengisytiharkan kerusi itu kosong dan memerintahkan SPR mengadakan pilihan raya kecil di samping memohon ganti rugi, kos dan faedah lain.

Pada 1 September lalu, SPR memutuskan tidak berlaku kekosongan di kerusi Kota Siputeh dan Abu Hassan masih menjadi wakil rakyatnya.

Barisan Nasional would fare better than the last general election if the 13th general election is held today, according to Merdeka Centre director Ibrahim Suffian.He said BN may also regain its two-thirds in the 222-seat lower house of Parliament, with rival block Pakatan Rakyat winning about 50 to 60 seats.Currently BN has 137 parliamentary seats compared with Pakatan's 82 seats. Three more seats are held by independent MPs.

He said the approval rating for Barisan Nasional coalition government saw a sharp upward trend among the Indians perhaps because the community had developed a feel good factor towards Najib.Approval rating for the BN among Malays, said Ibrahim had also shot up from 53 percent on polling day in March 2008 to 57 percent now. However, he said the Chinese community approval rating to BN had remained unchanged at 35 to 40 percent for the past 20 months.
