In the days following the vicious <a href="http://www.dogsbite.org/blog/2009/02/whats-there-not-to-get-about-regulating.html">chimpanzee attack</a> on Charla Nash, many groups called for a federal ban on exotic pets. It was reported then that in the past 10 years, chimps had <a href="http://www.newsmax.com/us/primate_trade_us_congress/2009/02/24/185105.html">attacked 29 children</a>. Yet in the last 3 years, pit bulls <a href="http://www.dogsbite.org/newsroom-release-dog-bite-fatality-study-042209.htm">killed 24 children</a> (52 including adults). The number of people that suffered severe injury by pit bulls in this same period can be <a href="http://www.dogsbite.org/blog/2008/08/death-and-injury-by-pit-bulls-january.html">assumed as exponential</a>.<br /><blockquote>It is time for policymakers and the public to <u>stop tolerating</u> pit bull attacks. We must create laws designed to prevent these attacks.</blockquote>Just recently, a 12-foot pet python broke out of an aquarium and strangled a 2-year-old girl in her Florida home. The Humane Society of the United States reported that pet pythons have killed at least <a href="http://www.miamiherald.com/news/5min/story/1123790.html">5 children</a> since 1980. Due to the dangerous nature of these snakes many municipalities outright ban them. The question is: Why don't more policymakers regulate pit bulls, a single dog breed with a documented <a href="http://www.dogsbite.org/bite-statistics-bibliographies.htm">30-year record</a> of horrific maulings and killings?<br /><br />In light of the recent U.S. Army's adoption of a <a href="http://www.dogsbite.org/blog/2009/03/us-army-bans-pit-bulls-and-other-breeds.html">national policy</a> that prohibits pit bulls in RCI privatized housing, as well as the <a href="http://www.tylerpaper.com/apps/pbcs.dll/article?AID=/20090702/NEWS01/907020318">recent initiative in Texas</a> urging the state Legislature and U.S. Congress to ban pit bulls, DogsBite.org would like to hear your ideas on the topic of national pit bull legislation. The protest comes about two weeks after 10-year old <a href="http://www.dogsbite.org/blog/2009/06/2009-fatality-2-pit-bulls-kill-10-year.html">Justin Clinton</a> was mauled to death by two family pit bulls across from Leverett’s Chapel School. The dogs lived under an abandoned mobile home off Gore Road, about a half mile from where the victim lived. Pickens County Sheriff David Abston said the man who owned the dogs lived in a mobile home next to the one where the dogs were living. He apparently fed the dogs every day at 5:30 p.m.<br /><br />The remains of Israel Pope Jr. were discovered on Monday and sent to the Alabama Department of Forensic Sciences for examination, but <a href="http://www.montgomeryadvertiser.com/article/20090702/NEWS02/907020316/Pack+of+dogs+tied+to+Alabama+man+s+mauling+destroyed">Coroner Chad Harless</a> said authorities may never know what actually killed Pope. "I feel it's not likely we're going to be able to make a decision on (the cause of death) because of a lack of evidence." According to relatives, Pope had been missing for three days prior to Monday, which places his time of death into question as well.<br /><br /><span style="font-style: italic;">In the instance of <a href="http://www.dogsbite.org/blog/2008/01/was-placer-county-woman-mauled-by-pit.html">Cora Lee Suehead</a>, it took authorities nearly 9 months to determine the cause of death. Police said in a previous statement it is believed the collie-mix was tied up during the incident while the pit bulls were loose. In a press release issued Tuesday by the Williamson County Sheriff's Department, it stated that "Gabrial suffered at least one bite that would have made 'yelling impossible,'" whereby eliminating possible child neglect charges.<br /><br />The release also stated the attack "might have been triggered by a stuffed animal that was found in the yard," which is perhaps the most alarming distortion DogsBite.org has ever run across. "Normal" family dogs do not attack and kill children because the child may be holding a stuffed animal. Pit bulls, on the other hand, will attack and kill unpredictably and unprovoked as documented by <a href="http://www.dogsbite.org/bite-statistics-bibliographies.htm">multiple fatality studies</a> (See also: <a href="http://www.dogsbite.org/blog/2008/08/triggers-what-prompts-pit-bull-to.html">Triggers: What Prompts a Pit Bull to Attack?</a>).<br /><br />To highlight the questionable issues raised by the press release, we have included part of the article below. The tragic death of Gabrial and subsequent investigation also demonstrates two important issues often seen in serious and fatal attacks: 1) The possible protection of parents after the attack because the parents have already suffered a terrible loss. 2) And, at what point will, "Our pit bull never showed aggression before" become an inexcusable legal defense?<blockquote class="plain"><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />"The couple had three dogs, two pit bull mixes and a collie mix. Police said in a previous statement it is believed the <u>collie mix was tied up during the incident</u> while the pit bulls were loose.<br /><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />Cundiff said the child was attacked about 200 feet from the home and crawled from the window, which was at the opposite side of the house as the adults' bedroom. The release went on to state that <u>Gabrial suffered at least one bite that would have made "yelling impossible."</u><br /><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />"The residence didn't have air conditioning," Cundiff said in a news release issued Tuesday. "Numerous box fans running at the same time of the incident would have made it <u>very hard for the adults in the house to hear anything</u> outside."<br /><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />Sweeney and Robinson requested all three dogs be euthanized the night of the attack, but the lead detectives called for the animals to be held at Williamson County Animal Control shelter until the investigation was complete.<br /><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />In a release Tuesday, Cundiff said the attack might have been <u>triggered by a stuffed animal</u> that was found in the yard.<br /><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />"It appears Gabrial brought the stuffed animal out with him when he left his bedroom through his open window," the release stated.<br /><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />Cundiff said the family told detectives <u>no aggression "had ever been shown to any family member from any of the three dogs</u>."<br /><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />However, Amy Fowler, a neighbor, said the <u>pit bulls were often loose and were a nuisance, threatening members of her family</u> in their yard. Fowler said she witnessed Gabrial playing with the collie several times, outside and unsupervised. She said the collie mix didn't seem to cause any problems."</blockquote><span style="font-weight: bold;">06/29/09: </span><a style="font-weight: bold;" href="http://www.southernillinoisan.com/articles/2009/06/29/breaking_news/doc4a4926529ead0482465571.txt">DCFS Opens Investigation</a><br />The Illinois Department of Children and Family Services (DCFS) has launched an investigation into Gabrial's death. Spokesperson Kendall Marlow said it isn’t the first time the state has been in contact with the boy's mother, although prior investigations were not related to animals and involved another child. Back in January, the DCFS was criticized after placing <a href="http://www.dogsbite.org/blog/2009/01/2009-fatality-4-year-old-mauled-to.html">Alex Angul</a> into a home with "known" dangerous rottweilers that subsequently killed the child.<br /><br /><span style="font-weight: bold;">06/29/09: </span><a style="font-weight: bold;" href="http://www.wsiltv.com/p/news_details.php?newsID=7744&type=top">Death Ruled "Accidental" </a><br />Johnston City, IL - Williamson County authorities say that on Saturday, June 27, 3-year old Gabrial Reese Mandrell was asleep, then woke up and "pushed out the screen" in his bedroom window. The child then "crawled out the window," and was attacked by at least one of the family's 3 dogs. The injured boy was found 200 feet away from his home and was pronounced dead shortly thereafter. In the article, Pollare repeats the many pit bull distortions voiced by pro-pit bull groups. For instance, the real problem is "individual" vicious dogs and the "criminals" who create them. Pollare neglects to mention the many "nice" family pit bulls that violently attack, most recently, the two pit bulls that killed 10-year old <a href="http://www.dogsbite.org/blog/2009/06/2009-fatality-2-pit-bulls-kill-10-year.html">Justin Clinton</a> in Texas.<br /><br />Pollare also neglects to mention the <a href="http://www.dogsbite.org/bite-statistics-bibliographies.htm">array of studies</a> that show pit bulls as the primary instigators of severe and fatal attacks. She conveniently leaves out the U.S. justice system as well. Numerous <a href="http://www.dogsbite.org/legislating-dogs-constitutionality.htm">State Supreme and Appeals Courts</a>, the <a href="http://www.dogsbite.org/blog/2009/03/district-of-columbia-court-of-appeals.html">District of Columbia Court of Appeals</a> and the <a href="http://www.dogsbite.org/blog/2008/02/united-states-supreme-court-leaves.html">U.S. Supreme Court</a> have declared Breed-Specific Laws (BSL) as constitutional. These rulings are based on the "genetic" attack traits of pit bulls and the danger they pose to the public.<blockquote>These attack traits are <u>inborn</u> due to centuries of selecting for these traits, specifically for the purposes of dogfighting.<br /></blockquote>Pollare is also the creator of the, "I'm Tired of" campaign. She recently added the "<a href="http://www.imtiredonline.com/index.php/shop/details/15/Bsl">I'm Tired of BSL</a>" bracelet to the collection. Half of the sales of this bracelet go to Best Friends Animal Society's Stop BSL program. Best Friends hardly stops at opposing BSL, however. In the wake of Michael Vick, Best Friends has launched a nationwide campaign to "<a href="http://www.dogsbite.org/blog/2009/01/best-friends-steps-into-ed-faron.html">rehabilitate</a>" pit bulls seized in dogfighting raids -- the <a href="http://www.dogsbite.org/blog/2009/01/explanation-policy-of-not-adopting-out.html">most unstable pit bulls</a> of all -- and turn them into household pets.<br /><br />In response to Pollare's reckless campaign designed to stop municipalities from enacting Pit Bull Laws,<span class="superscript">1</span> whereby causing more <a href="http://www.dogsbite.org/blog/2008/09/video-charlotte-belvins-c.html">innocent citizens</a> and <a href="http://www.dogsbite.org/blog/2008/09/boy-scout-stabs-kills-pit-bulls.html">beloved pets</a> to be at risk of a violent pit bull attack, DogsBite.org would like to share what <u>we are tired of.</u> The pit bull problem is nearly 30 years old. In this time, countless people and pets have suffered disfiguring injury and death by these dogs. She said the pit bull had never been vicious in the past. She also said the dog belonged to her boyfriend. He was arrested on June 22 along with Walker, but on an unrelated warrant. The article refers back to an earlier story, in which Walker allegedly left several comments. The grandmother, who remains unnamed, was taken into custody yesterday morning in Bonham, Texas and was later released on bail. According to Shaylee's mother, the grandmother has been charged with Injury to a Child. Little Shaylee remains hospitalized in Dallas, and family members say she continues to make progress.<br /><br /><span style="font-weight: bold;">06/20/09: </span><a style="font-weight: bold;" href="http://www.ntxe-news.com/artman/publish/article_55106.shtml">Dog Belonged to Grandmother</a><br />Clarification about the pit bull involved in this attack has finally been made. North Texas e-News reports that the pit bull was restrained on a dog run in the grandmother's backyard. This pit bull <u>did not</u> belong to a neighbor; it belonged to the grandmother or someone who was keeping the pit bull on her property. To add to the horror of the Shaylee Bug tragedy, the pit bull reportedly had a known history of aggression including killing two dogs prior to attacking Shaylee.<blockquote class="plain"><img src="http://www.dogsbite.org/img/space.gif" height="5" width="20" />"Indications are the dog was known to be aggressive and had killed two dogs previously. Shaylee's mother told CBS 7 reporters that she does remember the June 4 attack which brings bouts of depression. Family members say that prayers are helping. As documented in the Zupf video, Shaylee now faces many rounds of plastic surgery, and medical bills that will undoubtedly stretch into half a million dollars.<br /><br /><span style="font-weight: bold;">06/11/09: </span><a style="font-weight: bold;" href="http://www.cbs7kosa.com/news/details.asp?ID=12672">3-Year Old Suffers Devastating Injury</a><br />Odessa, TX - On June 4, 3-year-old Shaylee Crosson, known as "Shaylee bug," was playing at her grandmother's house near Dallas, Texas. Moments later she was brutally attacked by a neighbor's pit bull. The little girl was rushed to the Dallas Children's Hospital where a team of doctors worked to repair extensive injuries that she suffered. It was reported that 80% percent of her scalp was ripped away in the attack and her little face suffered deep lacerations as well.<br /><br /><a href="http://www.cbs7kosa.com/news/details.asp?ID=12699">One week later</a>, West Texas friends and relatives held a prayer circle at a park about 350 miles away from Dallas. When firefighters arrived on scene, they immediately called for the dog warden as they "improvised" to corner the dog. Firefighters had to use tools to get the dog away from the front door, and, eventually, they had to spray the pit bull with a fire extinguisher to keep it from charging at emergency workers.<br /><br />As DogsBite.org has reported before, dangerous pit bulls "suspend" firefighters and emergency workers from rescuing victims at emergency scenes, as these vital workers are often not equipped to deal with the animal. Such responders may be forced to wait in their vehicles until authorities arrive to contain the dog. Meanwhile, critical moments of a victim's life tick away. One of the most poignant examples of this occurred in the death of <a href="http://www.dogsbite.org/blog/2007/10/tina-marie-canterbury-killed-by-her-two.html">Tina Marie Canterbury</a>.<br /><blockquote class="plain"><span style="font-weight: bold;">Summary</span>: After two family pit bulls owned by Canterbury severely attacked her, the dogs attacked her 21-year old son Cody Canterbury, who had tried to help her. In the 911 phone call, a second son told the dispatcher regarding the arriving ambulance: "We can't get to my mom and my brother just went out there and they attacked him too. <u>They don't need to get out of the ambulance or the dogs will try to get them, too.</u>" A family friend at the home then shot at the dogs with a 9mm handgun, but the dogs survived. When a Clay County officer arrived on the scene, the dogs attempted to attack him too before the officer shot one of the pit bulls killing it. By the time authorities reached Canterbury she was dead.</blockquote><u>Minutes and moments count</u> when it comes to saving people's lives. Back in October, the Omaha Fire Department developed a <a href="http://www.dogsbite.org/blog/2008/10/omaha-firefighters-receive-dangerous.html">new training program</a> to help firefighters deal with dangerous dogs at rescue scenes. Four months later, they were called to a <a href="http://www.dogsbite.org/blog/2009/02/pit-bull-bends-metal-catch-pole-before.html">pit bull attack in progress.</a> In the end, it took three firefighters to place a catch pole loop around the dog's neck. Earlier in the month, the Senate passed the proposal 31-0. The bill is dedicated to 83-year old <a href="http://www.dogsbite.org/bite-fatalities-2008.htm#mcdaniel">Luna McDaniel</a> of Ville Platte who was killed by three loose pit bulls in 2008 and to 4-year old <a href="http://www.dogsbite.org/bite-fatalities-2009.htm#landry">Michael Blaise Landry</a> of Morganza, who was killed by three loose boxers in April.<br /><br />HB 155, which began as the <a href="http://www.villeplattetoday.com/content/luna-mcdaniel-act-be-introduced-april-session">Luna McDaniel Act</a>, says negligent homicide is the killing of a human being by a dog or other animal when the owner is criminally negligent in confining or restraining the animal. Violators would face fines of up to $5,000 and five years in prison. Tony Clayton, who was the prosecutor in the case of the attack on the 4-year old boy, said that the bill would have ensured the conviction of the dogs' owner, Candace Wells of Morganza.<br /><br />In the case of Luna McDaniel, the <a href="http://www.dogsbite.org/legislating-dogs-louisiana.htm">City of Ville Platte</a> had a pit bull ordinance in place, which increased the charges that could be brought against the owner of the dogs, Theo Doucet.<span class="superscript">1</span> These charges immediately advanced to Negligent Homicide after Luna later died from the severe injuries she suffered. HB 155 now allows prosecutors statewide to more harshly charge all dog owners who fail to properly confine their animal and the result ends in human death.<br /><div class="tanbox">It is important to note that attacks that end in death are <u>very rare</u>. Within 60 days, owners must display in a prominent place on their premises a sign using the words "Beware of Dog-Pit Bull" and a similar sign on their pen of the animal. Proof of public liability insurance in the amount of $100,000 for bodily injury or death also must be presented to the city. Owners must also provide city with photos of the dog and must microchip the animal prior to registration. She had stepped between her daughter and one of the pit bulls after her daughter tried to pet it. The dogs immediately bit into her leg and pulled her to the ground. Fayette Police Chief Danny Jenkins said her injuries were unlike anything he had ever seen. This debilitating attack was the driving force behind Fayette's new ordinance to ban pit bulls.<br /><br />The ordinance, passed 5-1, bans new pit bulls or dangerous dogs from living in the city limits and will require current owners to fulfill strict requirements, including structures to contain the dogs, liability insurance and registration for the animals before July 3. It also expands the dangerous dog rules already in place. "The ordinance we had in place was kind of toothless," Jenkins said. Jenkins also reiterated in the article a very important point:<blockquote class="plain">"After this attack we had down in Cotton Mill Village, I think that was the tipping point for something else to come along as far as ordinances go," Jenkins said. "I'd seen dog bites before, but I'd never seen a mauling. A lot of people, if they had seen [Selman's injuries], they would have been like me, and their opinion would have softened if not completely changed."</blockquote>Councilman Cedric Wilson was the lone opposition vote to the ordinance. He voiced several 25-year old themes about the pit bull debate. As Jenkins points out, however, the real issue is what victims like Christina Selman suffer in these terrible attacks. They do not suffer "dog bites," they suffer life-altering injuries. Following these injuries, they frequently must bear the weight of the medical bills as well. After the multiple assaults, Harrison chose to "rehome" the dog instead of euthanizing it. As DogsBite.org stated back then, the dog would likely be renamed and show up in a new community with its violent past record essentially hidden.<br /><br />The dog once named Patron, is now named Duke (allegedly falsified to keep bad adopters away) and is listed on Petfinder. The animal has gone from being a pit bull to an "American Bandogge Mastiff" and from being a triple mauler to a dog that "loves to sit back in your lap and get belly rubs and kisses on his head." The unlucky new owner, Kip Legaard, lost two pints of blood in the attack. He's now angry because the humane group told him that the pit bull named Mojo would make a good family dog. "The lady's like he's so sweet, so sweet, so sweet," Kip said. That is until the dog <u>suddenly</u> attacked him.<br /><blockquote>"All of a sudden BOOM the dog had my arm," he said. "It felt like someone put my arm in a <u>hydraulic press</u>."<br /></blockquote>As Legaard's arm was bleeding, the dog attacked again. He managed to free himself and run into the bathroom. He then called 9-1-1 and waited until the dog went downstairs before he bolted from his house into the ambulance. "The dog followed me out to the ambulance ... the guys are like run, run," Leggard said. In the aftermath of the incident, Legaard still can't believe what happened, and he can't believe the Kootenai Humane Society let someone adopt that dog.<br /><br />Eric Hess is the behavioral specialist for the Kootenai Humane Society. He told reporters that he did assess Mojo prior to adoption. Hess says the behavior assessment is <u>15 pages long</u> and the pit bull passed it. Hess then <u>blamed the attack</u> on Legaard. He said that Leggard lied on his application form to adopt the dog. Legaard said he didn't have other dogs in the house when in fact he does. Those other animals, the humane group said, "could've triggered the attack."<br /><blockquote>As we have stated before, many pit bull "assessment tests" are not to be trusted -- your arm and face are on the line.</blockquote>It's certainly possible that the presence of additional dogs could have triggered a dog-on-dog attack, particularly in the case of a new pit bull in the household. But this was not a dog-on-dog attack, this was a <u>dog-on-human attack</u>. The Kootenai Humane Society had better come up with stronger reasoning than that to head off the 6-figure lawsuit that is surely coming their way. As a final note to this story, the attacking dog was never caught. So far, 8-year old Faith Guelde has endured 40 hours of surgery and more is expected. On Friday, June 12, Faith's dog escaped her property. When she found her dog, it was fighting with a pit bull in her neighbor's yard. When Faith tried to pick up her dog, the pit bull launched a violent "redirected" attack onto the young girl.<br /><blockquote>In 2007, Mary Bernal picked up her dachshund to stop a scuffle with her sister's pit bull. The pit bull attacked Mary, ripping off her entire scalp killing her. </blockquote>Faith sustained critical injuries and had to be flown by Life Force helicopter to T.C. Thompson Children's Hospital in Chattanooga. Her grandmother, Jodi Copus, says she's conscious but "very, very critical." She says right now they're just hoping to save her right arm and then plan for a long recovery. A fund has been set up to help pay Faith's costly medical bills. Donations can be made at any SunTrust Bank in the Tennessee Valley under the "Faith Guelde Benefit Fund."<br /><br />It was also reported that there is no leash law in Lookout Mountain, GA. Just across state lines and only two miles away, Lookout Mountain, TN, has a strict, <a href="http://www.wrcbtv.com/Global/story.asp?S=8961072&nav=menu1406_2_1">breed-specific ordinance</a>. Pit bull owners in this neighboring town are required to register their animals as vicious, carry a $500,000 liability insurance policy, and adhere to special confinement rules. District Attorney Micheal Jimerson will then determine whether to file charges against pit bull owners Christy and Ricky George. Lieutenant Charles Helton would not release specifics of the investigation, but it was once again noted in the article that the boy was attacked on the George's property.<br /><br /><span style="font-weight: bold;">06/17/09: </span><a style="font-weight: bold;" href="http://www.kltv.com/Global/story.asp?S=10544333&nav=menu117_2">KLTV Pities Owners; Mislabels Breed</a><br />KLTV 7 News dedicated a segment to the owners of the pit bulls that fatally attacked Justin Clinton. The segment appears to be a pit bull apology piece designed to paint the pit bull owners, Christy and Ricky George, as "victims." The story can best be described as deplorable in the wake of a young boy torn apart by the powerful jaws of these dogs. The piece also emphasizes that the dogs were <u>not loose</u>. In other words, the "victim" dog owners are <u>not liable</u> under Lillian's Law.<br /><br />The segment also confuses<span class="superscript">1</span> viewers by calling the dogs American bulldogs<span class="superscript">2</span> instead of pit bulls or pit bull-mixes. This is a common tactic taken by pro-pit bull groups to try to lower the staggering number of <a href="http://www.scribd.com/doc/11249213/Dog-Attack-Deaths-Maimings-US-Canada-September-1982-to-January-2008">serious and fatal attacks</a> that have been attributed to pit bulls over the last 30-years. Pit bull experts, such as Diane Jessup, commonly refer to pit bulls as "bulldogs" as well. There are two major lines of the breed: the Johnson type (1st left photo) and Scott type (2nd left). The Scott type was <a href="http://molossergroup.com/pg/pages/view/1180/">directly developed</a> by crossing early Johnson lines with the American pit bull terrier and has become the breed standard. Without question, the Scott type is a pit bull type dog.<br /></span></div><br /><br /><span style="font-weight: bold;">06/17/09: </span><a style="font-weight: bold;" href="http://www.kilgorenewsherald.com/news/2009/0617/front_page/001.html">Owners Recently Purchased Dogs</a><br />The Kilgore News Herald reports that both dogs had formerly been owned by someone else in Kilgore. It is unknown if prior complaints were filed against them. Authorities said the dogs, a 3-year old male and a 2-year old female, had puppies in mid-February but none remained at the home now. The Georges got both dogs, who have always been together, in February. The Georges' homeowners insurance had also reportedly lapsed because Ricky George lost his job.<br /><br /><span style="font-weight: bold;">06/16/09: </span><a style="font-weight: bold;" href="http://www.news-journal.com/news/content/news/stories/2009/06/16/06172009_Dog_attack_folo.html">Owners of Deadly Pit Bulls Named</a><br />Rusk County Sheriff investigators released the names of the owners whose pit bulls mauled a boy to death. Lieutenant Charles Helton said the owners were identified as Christi and Ricky George of Leverett's Chapel. The article also states that the attack occurred on the <u>dog owner's property</u>. Lillian's Law only applies to "loose" dogs that attack off the dog owner's property. While the investigation is still unfolding, there may be no charges that <span style="font-style: italic;">can</span> be brought.<br /><br /><span style="font-weight: bold;">06/16/09: </span><a style="font-weight: bold;" href="http://www.tylerpaper.com/apps/pbcs.dll/article?AID=/20090616/NEWS01/906169993">Full Scale Investigation Planned</a><br />News sources report that a Rusk County pit bull attack on Friday preceded the fatal pit bull mauling of Justin Clinton on Monday. Justice of the Peace Bob Richardson said a 4-year old girl was <a href="http://www.tylerpaper.com/apps/pbcs.dll/article?AID=/20090617/NEWS01/906170323">seriously attacked</a> by a leashed pit bull in Henderson. During the attack, the dog's owner was walking the pit bull on a leash when it broke free and attacked. Officials were determining what to do with that pit bull when they were notified of the attack that left Justin Clinton dead.<br /><blockquote>Currently, Rusk County does not have a leash law. Yet as one can see, a leashed pit bull can still pose a significant threat.</blockquote>TylerPaper.com, which covered the serious pit bull attack on <a href="http://www.dogsbite.org/blog/2009/04/attack-victims-husband-pit-bull.html">Kristi Langston</a> back in March, also reports that a "full scale investigation" is planned in the aftermath of Justin Clinton's death. Rusk County Sheriff Danny Pirtle said that the owners of the dogs could face felony charges under <a href="http://www.dogsbite.org/blog/2008/01/lillians-law-texas-state-dangerous-dog.html">Lillian's Law</a>. He also said the two pit bulls were put down about 30 minutes after they were confiscated from a home on County Road 133. The owners of the dogs remain unnamed.<br /><br />As noted in the comments section below, the death of Justin Clinton is a near re-enactment of the death of a 7-year old boy in Breckenridge last year. On May 18, 2008, <a href="http://www.dogsbite.org/blog/2008/05/2008-fatality-boy-killed-by-pit-bulls.html">Tanner Monk</a> was found on a road just outside his home after being killed by four pit bulls. The owners of the dogs, Crystal Watson and Jack Smith were tried and convicted under Lillian's Law and ordered to serve <a href="http://www.wfaa.com/sharedcontent/dws/wfaa/jdouglas/stories/wfaa090119_wz_dogmaulfolo.d99567f.html">7 years in jail</a>. Both cases also involved breeding pit bulls (puppies reported as present).<br /><br /><span style="font-weight: bold;">06/15/09: </span><a style="font-weight: bold;" href="http://www.news-journal.com/news/content/news/stories/2009/06/16/06162009_Boy_mauled.html">Victim: 10-Year Old Justin Clinton</a><br />Leverett's Chapel, TX - In a developing story, authorities say two pit bulls fatally mauled a 10-year old boy in East Texas. The Rusk County Sheriff's Office said witnesses reported seeing the dogs drag Justin Clinton down the side of the road in the small community of Leverett's Chapel. A Tyler television station reported that a passing motorist pulled the dogs off the boy. The fourth-grader was later pronounced dead at Good Shepherd Hospital in Longview.<blockquote>The Rev. Edwin Findley, acting on behalf of the dogs' owners, said "both families" have been hurt, even though only one family has a <u>dead son</u>.</blockquote>The newest Texas fatal pit bull mauling (Rusk county) lies on the other side of Dallas (Stephens county), where 7-old <a href="http://www.dogsbite.org/blog/2008/10/fatal-dog-mauling-trial-of-tanner-monk.html">Tanner Joshua Monk</a> was killed by his neighbors four pit bulls in May of 2008. In October of 2008, the <a href="http://www.dogsbite.org/blog/2008/10/ontario-court-of-appeals-upholds.html">Ontario Court of Appeal</a> overwhelmingly upheld the law, known as the <a href="http://www.e-laws.gov.on.ca/html/regs/english/elaws_regs_050157_e.htm">Dog Owners' Liability Act of 2005</a>, that bans the breeding, sale and ownership of pit bulls in the province of Ontario.<br /><br />The high court refuted that the law was <span style="font-style: italic;">vague</span> and could be used to include half-breeds and mutts. The court stated, "The total ban on pit bulls is not 'arbitrary' or 'grossly disproportionate' in light of the evidence that pit bulls have a tendency to be unpredictable and that even apparently docile pit bulls may attack without warning or provocation." Though Ontario is the only province in Canada to ban the breed, various Canadian cities have done so as well.<br /><br />In February of 2008, the <a href="http://www.dogsbite.org/blog/2008/02/united-states-supreme-court-leaves.html">U.S. Supreme Court</a> refused to hear the appeal of the Toledo v. Tellings ruling, whereby leaving the State of Ohio's pit bull law intact. The court rejected the appeal on the following grounds: Procedural due process; Substantive due process; Equal protection and Void for vagueness. Boelman, who apparently knows Altenburg, determined Altenburg's dog bit him. At the time of the bite, Boelman wasn't sure of the dog's owner.<br /><br /><span style="font-style: italic;">It's unknown if Boelman continues to receive the rabies series (3-5 shots and about $2,000).</span><br /><br /><span style="font-weight: bold;">06/13/09: </span><a style="font-weight: bold;" href="http://www.postbulletin.com/newsmanager/templates/localnews_story.asp?z=28&a=403427">Bites Victim's Face After Being Petted</a><br />Austin, MN - After a 19-year old man attempted to befriend a loose pit bull in a park, the dog bit him in the face. The pit bull had reportedly approached the victim, Kyle Anthony Boelman, in a friendly manner. Boelman said he bent down and petted the dog. When he stood up, the pit bull leapt at his face, grabbing his nose, biting him. The bite caused four open wounds to his upper and lower lips. Boelman is also currently undergoing the rabies vaccination series.<blockquote>The unpredictable <u>genetic attack trait</u> of a pit bull is extremely dangerous on its own, but a pit bull with an unknown history presents an even greater risk.</blockquote>After biting Boelman, the dog ran off. The victim said he didn't see anyone trying to catch it or willing to claim responsibility for it. The dog was described as black with white paws and wearing an orange collar with tags attached. Mineral Wells Chief of Police Mike McAllester said the June 3 incident was not the first problem with pit bulls in the area. Though he said it was "typical" of the breed. The woman, Tanya Shroeder, needed 20 stitches to reattach the lower end of her ear after the incident. "It was a full blown attack!" she said. "I knew [the pit bull] would kill one of those kids if he got the right bite. I knew it!" Due to Shroeder's heroic actions, the small child was saved from serious injury.<br /><br />It all happened on the evening of June 4, as Tanya's two kids and her friend's 4-year old daughter where playing in the backyard of her home. Tanya could hear her neighbor's dog barking and digging at the fence. "The first thing I did was yell over, can you come and get your dog I think he's going to come through the fence," said Shroeder. Nobody answered, so she approached the fence and that's when the large pit bull named Samson came bursting through.<br /><br />Shroeder's husband Tom was very upset about the incident. "My family is playing in the safety of our backyard and is attacked by a dog," he said. Beau Babka with the Cottonwood Police Department agreed. He told reporters that these types of situations are upsetting. "If you're not safe in your own backyard then where are you safe?" he said. The lawsuit says the humane group failed to capture the dog in a timely manner, forcing the officer to deal with the "vicious" animal. The lawsuit states that as officer Evan Weaver tried to place the dog into a police wagon, it bit him in the face, ''causing serious injury and scarring.''<br /><br />Weaver says on May, 3, 2008, he responded to a call about a dog bite (See: <a href="http://www.dogsbite.org/blog/2008/05/0501-0508-pit-bulls-shot-by-police.html">05/01-05/08 Pit Bulls Shot by Police</a>). He found the pit bull on a porch and placed a leash around its neck. Another officer called the Humane Society, which is contractually obligated to handle such matters, according to the lawsuit, but the officer said no one from the nonprofit organization could show up until 9 p.m. So Weaver attempted to take the animal into custody himself.<br /><blockquote>The pit bull was shot to death by police after attacking Weaver.</blockquote>Also named in Weaver's suit are residents Russell Opp and Christina Gilly, who Weaver claims are owners of the pit bull. Weaver's lawsuit, which was amended in May to include additional sufferings, is asking for more than $50,000 from each defendant. The lawsuit claims Opp and Gilly failed to control the dog properly, knowing it ''has vicious tendencies.'' On June 4, Kimani attended the magistrate court hearing to learn what the dog owner would plea to the charges. The owner sought a form of plea on the basis that the dogs had never attacked before and that they were "fun loving" dogs. Kimani spoke at the hearing, which he believes was the deciding factor in the prosecuting attorney asking for the <u>maximum fine</u>: $2,000 plus court costs.<br /><br /><span style="font-style: italic;">The local commissioner invited Kimani to speak at an upcoming meeting. Kimani will keep us posted with new updates.</span><br /><br /><span style="font-weight: bold;">05/13/09: Jayden Comes Home from the Hospital</span><br />Jayden's father, Kimani Allen, reports that his son is home and recovering well. He says that he is "grateful that he is with us, it could have been much worse." He also reports that the four dogs were euthanized. But for Allen, this is not enough. Allen also wants owners of such animals to be held accountable both criminally and financially after an attack. He said he started hitting the steering wheel, "my heart was pounding so fast." To make matters worse, he got stuck in traffic. He said that his emotional moment came when the ER nurse lifted the sheets. "Just the sight and picturing how those dogs handled my son, and the pain he must have been enduring was truly overwhelming."<blockquote>"I wish I was there to take the bite for him and to protect him against these vicious animals," he said.</blockquote>Jayden is scheduled to have his draining tubes removed today. As a precautionary measure, he is also undergoing <a href="http://www.dogsbite.org/blog/2008/10/rabies-prevention-after-dog-bite-always.html">rabies shots</a>. He has received the first and second series so far. Kimani said that his son will need both physical rehabilitation and counseling to heal from the attack. His father hopes to see him return to the former Jayden, who played soccer and was very athletic. Family members and doctors are encouraged by the young boy's strong will to recover.<br /><br /><span style="font-weight: bold;">05/04/09: </span><a style="font-weight: bold;" href="http://www.wsbtv.com/news/19361849/detail.html">Three Pit Bulls Attack 6-Year Old</a><br />Henry County, GA - A Henry County family said they are planning to sue the owners of some pit bulls blamed for attacking their son. The family said they are afraid the dogs may come back to the neighborhood. 6-year old Jayden Allen has injuries on both arms, on his back, hip, and neck, after three pit bulls attacked him in his neighborhood last week. A neighbor had just picked him up from school and he was in her driveway when it happened.<blockquote>"I heard him scream out and I looked back and three pit bulls were just ripping him apart,” said neighbor Suzette Newman.</blockquote>One of the dog’s owners came and got the pit bulls off the child. Jayden was rushed to the hospital with injuries so severe, his parents thought he might have to get skin grafts. "I want to see the dogs dead," said Jayden's father, Kimani Allen. "I want to maybe try to change the laws to restrict these dogs from being owned." He said, "I don’t think any parent should have to go through this. Authorities said the San Jose bound train was likely traveling at about 70 miles per hour when it struck and instantly killed both the woman and the dog. Apparently, the woman, in her early to mid-30s, was unable to let the dog go because of how she had the leash wrapped around her hand.<blockquote>The video said the woman was "petite," less than five feet tall. The dog likely weighed 3/4 of her body weight.</blockquote>Alameda County Sheriff’s Department Sgt. J.D. Nelson said two people with a dog were attempting to cross the tracks ahead of an approaching train near the Hayward Station that day. The man was able to make it through. "She tried to stop," Nelson explained. But the dog did not and "dragged itself and her into the train." Family members identified the woman as 32-year-old Vida Isabel Silver. Heather Paugh, 30, was walking to her mailbox when three pit bulls, who had jumped out of a nearby window, ambushed her. Authorities said that Paugh had a "severe chunk" taken out of her left forearm, all the way down to the bone. She also suffered multiple wounds to both legs.<br /><blockquote>Officials recently "tabled" the At-Risk Dog proposal introduced by Councillor Mike Speedy that directly targeted the alarming pit bull attack problem in Indianapolis.</blockquote>According to officials, the dogs reportedly escaped through an open window of a neighbor's home and got underneath a fence. A person inside the victim's home set loose a rottweiler in hopes that it would stop the attack. The rottweiler was subsequently mauled by the pit bulls. When police showed up, the dogs would not let responders reach the victim. Police then shot two of the pit bulls with a <a href="http://www.indystar.com/article/20090603/NEWS/90603052/Police+shot+dogs+that+attacked+woman+on+Southside">shotgun</a>. Both pit bulls initially survived the shotgun injuries; one was later put down.<br /><br />City County Councilman Mike Speedy now hopes to revive his proposed <a href="http://www.dogsbite.org/blog/2009/04/indianapolis-councillor-files-at-risk.html">At-Risk Dog</a> legislation. Speedy told reporters, "It would limit the number of pit bulls households could have to two and it would also require registration and mandatory spay and neuter of pit bulls." From her hospital bed, the victim Heather Paugh told reporters that she is recovering, but the attack has devastated her entire family.
