It's bad. It says:

* * That ISPs have to proactively police copyright on user-contributed material. This means that it will be impossible to run a service like Flickr or YouTube or Blogger, since hiring enough lawyers to ensure that the mountain of material uploaded every second isn't infringing will exceed any hope of profitability.

* * That ISPs have to cut off the Internet access of accused copyright infringers or face liability. This means that your entire family could be denied to the internet -- and hence to civic participation, health information, education, communications, and their means of earning a living -- if one member is accused of copyright infringement, without access to a trial or counsel.

* * That the whole world must adopt US-style "notice-and-takedown" rules that require ISPs to remove any material that is accused -- again, without evidence or trial -- of infringing copyright. This has proved a disaster in the US and other countries, where it provides an easy means of censoring material, just by accusing it of infringing copyright.

* * Mandatory prohibitions on breaking DRM, even if doing so for a lawful purpose (e.g., to make a work available to disabled people; for archival preservation; because you own the copyrighted work that is locked up with DRM)

More at Michael Geist, including tons o' links.

To quote Prof. Glenn Reynolds: "Doesn’t seem to be a lot of concern for Internet freedom emanating from this Administration."

Yeah. "We put ourselves on the hook in a completely inept way where we lose first. We lose entirely as the taxpayers."

Black, a former top federal banking regulator, blames Treasury Secretary Timothy Geithner for negotiating such a bad deal on behalf of the American public.

His argument goes as follows:

The government was in no way obligated to lend the struggling CIT money and, in fact, initially refused to provide it bailout funds. More importantly, being the lender of last resort, the government should have guaranteed we'd be the first to get paid if CIT eventually filed Chapter 11. By failing to do so, "it's like he [Geithner] burned billions of dollars again in government money, our money, gratuitously," says Black.

More at the links.

Second Stimulus coming, get ready.

Government-run health care, on the other hand, will be better.

"Thomas Shannon, the US State Department 'Cleaner'"

Found by way of Roger L. It didn't differentiate between saved jobs and created jobs.

Federal Education Secretary Arne Duncan said in a conference call with reporters yesterday that the country has "325,000 who would literally not be in the classroom today if not for these funds." But not in Columbus, where the district's finances looked pretty solid before the stimulus. Voters passed a levy last November that should keep the district's books largely in the black until 2012.

Of the 212.5 full-time equivalent jobs the district said were funded with part of the $64 million in stimulus it expects to receive, about 65 percent were "saved," including 36 principals and assistant principals.

So was the district on the verge of laying off 36 school administrators?

"No," Dannemiller said, explaining that the reporting choices were "created" and "saved."

"They weren't 'created,' obviously, so our only other choice was 'saved.' "

The federal Office of Management and Budget told agencies in June to define a "saved" job as "an existing position that would not have been continued to be filled were it not for Recovery Act funding."

District spokeswoman Kim Norris said the "stabilization" part of the stimulus -- designed to make up state education aid to districts that otherwise might have been cut -- makes up about 6 percent of Columbus schools' state aid. So, she said, if it hadn't been for the stimulus money, the district "would have had some decisions as what to do with that shortfall."

So although 36 principal jobs were not specifically saved, something likely got saved somewhere in the budget, she said.

All emphasis mine. My guess -- all of them.

More at the link. Go read the whole thing, especially the last paragraph:

"Deadwood on voters rolls complicates the electoral process and can cause problems like fraud and vote miscounts," Phillips said. "It always creates a perception of low voter turnout. It gets down to this: by depressing turnout, dead voters make the rest of us look bad."

I'm guessing the humor was unintentional.

"Taxpayers Unlikely to Recover $80 Billion Given to Chrysler, GM, GAO Says"

Found by way of Neal Boortz, which is where the title link takes you (scroll down). Although her talk was intended to promote the vaccine, participants said they came away convinced the vaccine should not be received.

"I came away from the talk with the perception that the risk of adverse side effects is so much greater than the risk of cervical cancer, I couldn't help but question why we need the vaccine at all," said Joan Robinson, Assistant Editor at the Population Research Institute.

Dr. Harper began her remarks by explaining that 70 percent of all HPV infections resolve themselves without treatment within a year. Within two years, the number climbs to 90 percent. Of the remaining 10 percent of HPV infections, only half will develop into cervical cancer, which leaves little need for the vaccine.

She went on to surprise the audience by stating that the incidence of cervical cancer in the U.S. is already so low that "even if we get the vaccine and continue PAP screening, we will not lower the rate of cervical cancer in the US."

There will be no decrease in cervical cancer until at least 70 percent of the population is vaccinated, and even then, the decrease will be minimal.

....

This is not the first time Dr. Harper revealed the fact that Merck never tested Gardasil for safety in young girls. During a 2007 interview with KPC News.com, she said giving the vaccine to girls as young as 11 years-old "is a great big public health experiment."

At the time, which was at the height of Merck's controversial drive to have the vaccine mandated in schools, Dr. Harper remained steadfastly opposed to the idea and said she had been trying for months to convince major television and print media about her concerns, "but no one will print it."

"It is silly to mandate vaccination of 11 to 12 year old girls," she said at the time. "There also is not enough evidence gathered on side effects to know that safety is not an issue."

....

Since the drug's introduction in 2006, the public has been learning many of these facts the hard way. To date, 15,037 girls have officially reported adverse side effects from Gardasil to the Vaccine Adverse Event Reporting System (VAERS). These adverse reactions include Guilliane Barre, lupus, seizures, paralysis, blood clots, brain inflammation and many others. The CDC acknowledges that there have been 44 reported deaths.

Dr. Harper also participated in the research on Glaxo-Smith-Kline's version of the drug, Cervarix, currently in use in the UK but not yet approved here. Since the government began administering the vaccine to school-aged girls last year, more than 2,000 patients reported some kind of adverse reaction including nausea, dizziness, blurred vision, convulsions, seizures and hyperventilation. Several reported multiple reactions, with 4,602 suspected side-effects recorded in total. The most tragic case involved a 14 year-old girl who dropped dead in the corridor of her school an hour after receiving the vaccination.

All emphasis mine. Go read the whole thing.

Government-run health care will, of course, be better.

"CAN I LAY MY TRUST IN YOU?"

From the ol' e-mail box a few minutes ago. Grammar, spelling and syntax errors left intact as it's not nearly as funny otherwise.

CAN I LAY MY TRUST IN YOU?
Sunday, November 1, 2009 10:12 AM
From: "PROF FELIX DOLL" &lt janet.bean@att.net &gt
To: undisclosed-recipients
Dear Friend,

This letter may come to you as a surprise due to the fact that we have not yet met. After searching through your country's Chamber of Commerce and industry here in London I am contacting you to assist me, I have to say that I have no intentions of causing you any pains as you read this. I don't want you to feel sorry for me, because, I believe everyone will die someday. My name is Prof.Felix Doll, a professor of chemistry here in London, presently taking medical treatment.

I have been diagnosed with Prostate and Esophageal a cancer that was discovered very late due to my uncaring attitude for my health. It has defiled all form of medicine and right now, I have only about a few months to live according to medical experts. To be frank with you, I have not particularly lived my life so well, as I never really cared for anyone not even myself but my business and money.

Though I am very rich, I was never generous, I was always hostile to people and only focus on my business as that was the only thing I cared for. But now I regret all this as I now know that there is more to life than just wanting to have or make all the money in the world. I believe when God gives me a second chance to come to this world I would live my life a different way from how I have lived it.

Now that I know my time is almost up, I have willed and given most of my properties and assets to my immediate and extended family members and as well as a few close friends. I have decided to give alms to charity organizations, as I want this to be one of the last good deeds I do on earth.

So far, I have distributed money to some charity organizations here in UK, United Arab Emirates and Ireland. Now that my health has deteriorated so badly, I cannot do this my self any more. I once asked members of my family to close one of my accounts and donate the money which I have there to some charity organizations in Bulgaria, they refused and kept the money to themselves.

Hence, I do not trust them anymore, as they seem not to be content with what I have left for them. The last of my money is the huge cash deposit (12mGBP) that I have with a security firm abroad (Icici Bank). I will want you to help me collect this deposit and dispatched it to charity organizations and let them know that it is I, Prof.Felix Doll that is making this generous donation. I am writing this from my laptop computer in my hospital bed where I wait for my time to come.

As soon as I received your sincere response, I will hence give you my attorneys contact who is in the position to give you all the necessary details of how this can be done. I pray that you will support and assist me with good heart so that I can be able to achieve my goal. If you accept to help me do this, I promise you a reward of 40% of the (12mGBP).

Thank you for understanding.
Prof.Felix Doll.

Prof. Felix Doll? Seriously?

Well, I did find a picture....

Halloween Report, 2009

The thing is, you never know if you're going to get Trick-or-Treaters. Not at that time. It will only become clear much later.

It's just like finding the bottom. Where is the bottom? Have we reached it? On page 5 of that article it says homebuyers are in a "frenzy." Not here they aren't. Maybe somewhere else.

*sigh*

This Is Not a Fortuitous Development

Found by way of Instapundit.

BBC News article, no byline.

The interim leader of Honduras says he is ready to sign a pact to end its crisis which could include the return of ousted President Manuel Zelaya.

Roberto Micheletti said the agreement would create a power-sharing government and require both sides to recognise the result of November's presidential poll.

Mr Zelaya said the deal, which requires the approval of the Supreme Court and Congress, would be signed on Friday.

More at the link, go read the whole thing.

Tons o' links at Fausta's Blog, also, along with commentary.

So the Obama Administration has intimidated a democratic nation into allowing back in a president who was found guilty by his country's Supreme Court of violating that country's constitution and was subsequently removed from office by that country's Congress.

PrezBO has no respect for anyone else's constitution, either.

Feeling all Hopey-Changey yet? An emergency room visit for an allergic reaction followed up by a visit to one's doctor -- two weeks later.

I told her not to bother, that it was pointless. She asked if I wanted the slot anyway, just in case something else went wrong.

Well, no. I don't. Why would I take a slot away from someone who might actually need it? On the off chance that something else will go sideways around that time? Nah.

So I'll take my prescription for prednisone into the base clinic this morning and call it a day. Well, except for having to go into work.

I haven't heard from the woman who made the chili yesterday, as to ingredients. I really hope it was something in the chili, that I'll recognize as a problem previously. Not that she'll appreciate that -- she's a very nice lady and if she finds out she put something in the chili that made someone sick she'll be mortified.

But if I can't figure out what caused the reaction, I'll just have to wait until the next one. Assuming I survive it (a second reaction is likely to be worse) I'll have to figure out the common factor.

Tongue is still a bit swollen this morning. It feels very weird.

Update: I just got a call from my doctor's nurse, checking on me. She tried to get me in earlier but couldn't. I told her I didn't think it was necessary anyway, and she said if it happens again, just do what we did (go to the ER) and they'd follow-up to get me in right after. Hopefully that won't be necessary.

My doctor and her staff are really nice people. They can't help the system they're working in.

Update the Second: The pharmacy won't fill the prescription. There's no signature. The nice nurse in the ER handed me that paperwork and told me to go home. I figured it was all being done electronically. Apparently not.

The fellow at the pharmacy said he could call the ER, didn't see a phone number (they don't know the number for the in-town ER, especially since Shaw no longer has an emergency room? WTF?), and said it would probably be ready after lunch, assuming the ER was willing to approve the prescription. Which the doctor had entered into the hospital's database. I'm on floor this afternoon. The fellow at the pharmacy said they close at 5. So do we.

So I trotted around the corner to the clinic where my doctor works. They wanted to see the discharge paperwork, which the pharmacy had kept. I trotted back to retrieve the paperwork. Once they'd copied it they gave it to me, and I trotted back around the corner to hand it to the clinic people.

My doctor won't fill it either, without seeing me. Makes sense, actually.

The earliest I'll be able to pick up the prednisone is Monday. Three and a half days after the reaction.

Ya know what, people? I don't need it.

Oh, well.

Update the Third: I heard from the woman who made the chili. She sent me the list of ingredients. There's nothing in there that I've ever reacted to, ever, and all of it I've eaten before. In fact, it's pretty much what I put in my chili, also, except for the hot sauce, which I looked up. And read the ingredients. Nothing allergenic there, either.

So it will probably just remain a mystery.

Update the Fourth: Hubby just went to the pharmacy and picked up the prednisone. Nice man. Better than I deserve, really.

I Visit the Emergency Room Again

Just got back from the ER, Hubby had to take me in a couple hours ago as I was having a severe allergic reaction to something.
