Dear David,
It was so nice to hear from you. I should quickly update you on how I am doing. Currently I am working as a field supervisor for a construction company, this is the same job that I have had since I got home. I have a great boss, who is the owner, and I am basically running the show. I plan to continue working there until I finish with school.

Speaking of school, I am almost finished with my AS in Physics and I will be transferring to the University of Colorado, Colorado Springs by the Spring semester of '09. I currently have a 3.72 GPA and I am a member of Phi Theta Kappa. My family is doing well and I try everyday, through my actions, to prove to them that their faith and support in me was not misplaced. Bascially, I am trying to live my life as though everyday could be my last. In other words, I love every moment of my freedom and truly appreciate everything that I have. My daughter is one of the greatest things to ever happen to me and I would never do anything to let that little girl down.

Anyway, I hope it is nice to hear a story that has a happy ending once in awhile. I can only imagine that you don't get a lot of those in criminal law. Murder by Auto

There was a auto accident in Broward County recently. The gist of it was the man took off after hitting this family. The people he ran into went after him. The woman held our her hand to try to stop him from leaving and he ran over her and dragged her body, strewing body parts down the road.

The issue for the prosecution is identification of the accused. There's been alot of studies done that say eye witness evidence itself is unrealiable. The person who could identify him the best is dead.

So other types of evidence are needed by the prosecution. He may have made a statement to his family and they might have turned him in. The previous owner of the van identified him as the man he sold the van to. It's not proof that he was driving, but it is a connection to the van.

Gustavo Domingues Co-Defendent Found Not Guilty

Cuban National Baseball Player Found Not Guilty of Conspiracy to Smuggle Illegal Aliens

March 2007 - Key West, Florida

In the highly publicized Gustavo Dominguez, sports agent smuggling case, my client, Roberto Yosvany Hernandez, was acquitted of all charges.

Jurors acquitted, Roberto Yosvany Hernandez, of six counts of conspiracy and alien smuggling. Prosecutors allege that co-defendants Geoffrey Rodrigues and Roberto Yosvany Hernandez attempted to smuggle 22 Cuban nationals, including several baseball players, into the United States by boat July 28, 2004. Law enforcement agents intercepted the boat before it arrived, according to the charges handed down in the U.S. District Court for the Southern District of Florida. If convicted all defendants would have faced up to 10 years in prison and $500,000 in fines.

The defense strategy was to introduce reasonable doubt into the testimony of witnesses and to show that there was no tangible evidence linking Hernandez with the crime.

Cross examination of witnesses for the prosecution, including Ysbil Medina, had no credibility with the jury.
There was no tangible evidence to support the claim that Hernandez was paid $300K.
Five other baseball players could not identify Hernandez as the person driving the boat.
